I am writing you this letter on behalf of the City of Blair regarding a deck building permit
#12116. It is my understanding that you first obtained this building permit back in 2005. You did
receive a final extension of this building permit up to and including August 3, 2007. Recently, our
inspector reviewed this matter and found that there remains a life safety issue on this deck at your
home.
With this letter you are on notice that this matter must be rectified on or before September 30,
2007 or I will be forced to prosecute to the full extent of the law. Please note you will receive no
more extensions on the building permit past September 30, 2007. If you do not comply with this
deadline, you could be brought before the Blair Planning Commission and the structure could be
removed.

county aforesaid, made in the name of the State of Nebraska, before the undersigned
County Judge, within and for said county this 28 day of January 2008, who being duly
sworn on oath says that he has just and reasonable grounds to believe, and does believe;

specifica'ly the unfinished railing on a deck and that Defendant failed to correct the
deficienc es identified by the September 30, 2007 deadline. Further the property in
question remains in violation as of the date of the filing of this Complaint.
Contrary to the form of the City of Blair Ordinances in such cases made and
provided, against the peace and dignity of the City of Blair, State of Nebraska. This matter

304.18 Built ing security. Doors, windows or hatchways for
dwelling units, room units or housekeeping units shall be pro-
vided with devices designed to provide security for the occu-
pants and property within,
304.18.1 (Doors. Doors providing access to a dwelling unit,
rooming unit or housekeeping unit that is rented, leased or
y Iet shall b equipped with a deadbolt lock designed to be
readily op enable from the side from which egress is to be
made with out the need for keys, special knowledge or effort
and shall F ave a lock throw of not less than 1 inch (25 mm).
Such dead colt locks shall be installed according to the man-
ufacturer's specifications and maintained in good working
order. For hepurpose of this section, a sliding bolt shall nut
be considered an acceptable deadbolt lock.
304-18.2 %Vindows. Operable windows located in whole or
in part wi!hits 6 feet (1828 mm) above ground level or a
walking surface below that provide access to a dwelling
unit, rooming unit or housekeeping unit that is rented,
leased or let shall be equipped with a window sash locking
device.

SECTION 305
INTERIOR STRUCTURE
305,1 General. The interior of a structure and equipment
therein shall be maintained in good repair, structurally sound
and in a sank.. try condition. Occupants shall keep that part of
the. structure c,'hich they occupy or control in a clean and sad-
tary
condition. Every owner of a structure containing a room-
ing house, housekeeping units, a hotel, a dormitory, two or
more dwelling units or two or more nonresidential occupan-
cies, shall maintain, in a clean and sanitary condition, the
shared or pubic areas of the structure and exterior property.
305.2 Structt ral members. All structural members shall be
maintained structurally sound, and be capable of supporting
the imposed brads.
305.3 Interio • surfaces. All interior surfaces, including win-
dows and doot,s, shall be maintained in good, clean and sanitary
condition. Peeling, chipping, flaking or abraded paint shall be
repaired, removed or covered. Cracked or loose plaster,
decayed woor and other defective surface conditions shall be
corrected.
305.4 Stai zd walking surfaces. Every stair, ramp, landing,
balcony, porch, deck or other walking surface shall be main-
tained in sound condition and good repair.
305.5 flandre ils and guards. Every handrail and guard shall
be timely faste led and capable of supporting normally imposed
loads and shall be maintained in good condition.
305,6 Interior' doors. Every interior door shall fit reasonably
well within its frame and shall be capable of tieing opened and
closed by bein? properly and securely attached to jambs.head-
ers or tracks as intended by the manufacturer of the attachment
hardware.

GENERAL REQUIREMENTS
SECTION 306
HANDRAILS AND GUARDRAILS
306.1 General. Every exterior and interior flight of stairs hav-
ing more than four risers shall have a handrail on one side of the
stair and every open portion of a stair, landing, balcony. porch,
deck, ramp or other walking surface which is more than 30
inches (762 mm) above the floor or grade below shall have
guards. Handrails shall not be less than 30 inches (762 mm)
high or more than 42 inches (1067 mm) high measured verti-
cally above the nosing of the tread or above the finished floor of
the landing or walking surfaces. Guards shall not be less than
30 inches (762 mm) high above the floor of the landing, bal-
cony, porch, deck, or ramp or other walking surface.
Exception: Guards shall not be required where exempted
by the adopted building code.
SECTION 307
RUBBISH AND GARBAGE
307.1 Accumulation of rubbish or garbage. All exterior
property and premises, and the interior of every structure, shall
be free from any accumulation of rubbish or garbage.
307.2 Disposal of rubbish. Every occupant of a structure shall
dispose of ail rubbish in a clean and sanitary manner by placing
such rubbish in approved containers.
307.2.1 Rubbish storage facilities. The owner of every
occupied premises shall supply approved covered contain-
ers for rubbish, and the owner of the premises shall be
responsible for the removal of rubbish.
307.2.2 Refrigerators. Refrigerators and similar equip-
ment not in operation shall not be discarded, abandoned or
stored on premises without first removing the doors.
307.3 Disposal of garbage. Every occupant of a structure shall
dispose of garbage in a clean and sanitary manner by placing
such garbage in an approved garbage disposal facility or
approved garbage containers.
307.3.1 Garbage facilities. The owner of every dwelling
shall supply one of the following: art approved mechanical
food waste grinder in each dwelling unit; an approved incin-
erator unit in the structure available to the occupants in each
dwelling unit; or an approved leakproof, covered, outside
garbage container.
307.3.2 Containers. The operator of every establishment
producing garbage shall provide, and at all times cause to be
utilized, approved leakproof containers provided with
close -fitting covers for the storage of such materials until
removed from the premises for disposal.
SECTION 308
EXTER MINATION
308.1 Infestation. All structures shall be kept free from insect
and rodent infestation. All structures in which insects or
rodents are found shall be promptly exterminated by approved
processes that will not be injurious to human health. After
extermination, proper precautions shall be taken to prevent
reinfestation.

Sec. 9 -201. BUILDING CODE; ADOPTED BY REFERENCE. To provide certain minimum
standards, provisions and requirements for safe and stable design, methods of construction, and uses
of materials in buildings hereafter erected, constructed, enlarged, altered, repaired, relocated, and
converted the International Building Code, 2000 edition, including all appendices, as recommended
and published by the International Code Council, Inc. in book or pamphlet form, is hereby
incorporat by reference, and the adoption of such Code by reference shall be construed to
incorporat. any amendments or revised editions to such International Building Code as though
printed in Fell herein, insofar as said International Building Code and any amendments or revised
editions di: not conflict with the statutes of the State of Nebraska and so long as one copy of such
International Building Code shall at all times be kept current in' the office' of the Blair City Clerk.
Such International Building Code shall also include all amendments, deletions or additions which the
City Counuil and Mayor may make from time to time. Copies of the International Building Code, as
amended, are on file at the office of the Municipal Clerk pursuant to state statutes and are available
for public inspection during the regular hours the Municipal offices are open. The provisions of the
International Building Code shall be controlling throughout the Municipality and throughout its
zoning jurisdiction.

Sec. 9 -202 BUILDING CODE/THE ABATEMENT OF DANGEROUS BUILDINGS;

There are no safety issues at this time, even though there is no deck, the door going out has
been blocked on the inside.
