COUNCIL MEMBER FANOELE INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDNANCE CREATING PAVING DISTRICT NO. 190 IN THE CITY OF BLAIR,
WASHINGTON COUNTY, NEBRASKA, DESCRIBING SAID STREET IMPROVEMENT
DISTRICT AND IMPROVEMENTS TO BE CONSTRUCTED THEREIN, AND PROVIDING
THAT SPECIAL ASSESSMENTS MAY BE LEVIED IN PROPORTION TO BENEFITS TO
THE PROPERTY IN SAID DISTRICT.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
Section 1. Pursuant to Sections 16 -617, 16- 617.01, 16 -618, 16 -619 and 16 -620, R.R.S.
Neb. 1997, Paving District No. 190 be and the same is hereby created within the City of Blair,
Nebraska, the outer boundaries of which District shall encompass the following- described
properties together with the street described below upon which said properties abut:
A TRACT OF LAND BEING DESCRIBED AS LOTS 1 -4 AND LOT 6 OF
GIBBS SUBDIVISION, LOCATED IN THE NORTHWEST ONE -
QUARTER OF SECTION 23, TOWNSHIP 18 NORTH, RANGE 11 EAST OF
THE 6th. P.M., WASHINGTON COUNTY, NEBRASKA. BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE
NORTHWEST CORNER OF SAID GIBBS SUBDIVISION, THENCE NORTH
87 °55'39" EAST (ASSUMED BEARING) ALONG THE NORTH LINE OF
SAID GIBBS SUBDIVISION A DISTANCE OF 472.40 FEET TO THE POINT
OF BEGINNING; THENCE CONTINUING ALONG SAID LINE NORTH
87 °55' -39" EAST A DISTANCE OF 849.83 FEET; THENCE THE
FOLLOWING SIX (6) COURSES ALONG THE WESTERLY LINE OF US
HIGHWAY 30 RIGHT -OF -WAY: (1)SOUTH 02 °13'26" EAST FOR 40.41 FEET
(2)SOUTH 24 °57'01" WEST FOR 151.48 FEET (3)SOUTH 40 °10'42" WEST
FOR 101.91 FEET (4)SOUTH 35 °37'24" WEST FOR 37.02 FEET (5)SOUTH
35 °34'31" WEST FOR 211.42 FEET (6)SOUTH 26 °00'37" WEST FOR 240.60
FEET; THENCE SOUTH 87 °55'52" WEST FOR 567.97 FEET ALONG
THE SOUTH LINE OF SAID GIBBS SUBDIVISION; THENCE NORTH
02 °04'08" WEST A DISTANCE OF 234.29 FEET; THENCE NORTH 27 °57'22"
EAST A DISTANCE OF 240.58 FEET; THENCE NORTH 02 °04'21" WEST A
DISTANCE OF 217.14 FEET TO THE POINT OF BEGINNING.
ABOVE DESCRIBED TRACT CONTAINS 10.88 ACRES, MORE OR LESS.
Within said District, the street to be improved and improvements to be included are:
23 south/southwest from Pittack Street approximately 691 lineal feet ending in
an extended temporary cul -de -sac. Also included is the intersection of 23 Avenue and
Gibbs Drive to the limits of the 23 Avenue right -of -way.
Section 2. The improvements to be constructed in Paving District No. 190 shall include
grading, paving, curbing, guttering, storm sewer and other necessary or incidental appurtenances
to the improvements. Paving will consist of 37 feet wide by 7 inches thick Portland Cement
Concrete.
Section 3. All of said improvements shall be constructed to the established grades as fixed
by ordinance of said City and shall be constructed in accordance with plans and specifications to
be approved by the City Council. Said improvements in Paving District No. 190 shall be made at
public cost, and the cost of such improvements, excepting street intersections, shall be assessed
against the property within said District specially benefited thereby, in proportion to such
benefits.
Section 4. That this ordinance shall be known as Ordinance No. 2132 and shall be in
effect from and after its passage, approval and publication according to law.
