AN ORDINANCE AMENDING THE CITY OF BLAIR ZONING ORDINANCE SECTION
1401 GENERAL POWERS IN REFERENCE TO THE EXPIRATION DATES OF
CONDITIONAL USE PERMITS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND
EFFECT.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1 Section 1401 of the Blair Zoning Regulations of Blair, Nebraska is hereby
amended as follows, to wit:
SECTION 1401 GENERAL POWERS
ORDINANCE NO. 2131
The City Council may by conditional use permit after a Public Hearing and referral to a
recommendation from the Planning Commission, authorize and permit conditional uses that are
designated in the district use regulations if it is found that the location and characteristics of the
use will not be detrimental to the health, safety, morals, and general welfare of the area.
Allowable conditional uses may be permitted, enlarged, or altered upon application for a
conditional use permit in accordance with the rules and procedures of this Ordinance. The City
Council may grant or deny a conditional use permit in accordance with the intent and purpose of
this Ordinance. In granting a conditional use permit, the City Council will authorize limitations
and shall prescribe and impose appropriate conditions, safeguards, and a specified time limit for
the performance of the conditional use permit.
Any conditional use permit granted pursuant to the provisions for this Article 14 shall run with
the land subject only to satisfactory compliance with the conditions, safeguards and specified
time limit required under the conditional use permit, as established by the Mayor and City
Council. A conditional use permit shall not terminate merely because the conditional use permit
applicant sells, transfers, conveys or assigns, voluntarily or involuntarily, its interest in the
property subject to the conditional use permit. However, if the project granted by a Conditional
Use Permit is not started within one (1) year of issuance, the use of the property changes or a
Conditional Use Permit is granted on the basis of a conditional purchase agreement that expires,
the Conditional Use Permit shall be terminated.
SECTION 2 All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 3 This ordinance shall be in full force and effect from and after its passage,
approval and publication as provided by law.
