COUNCILMEMBER RYAN INTRODUCED THE FOLLOWING RESOLUTION:
WHEREAS, in the last 30 days, it was brought to the attention of the Administrator for the
City of Blair, Nebraska, that Rory G. Haner, the owner of the South 90' of Lot 11 and the South 90'
of Lot 12, Block 91, Fifth Addition to the City of Blair, Washington County, Nebraska, intended to
divide said real estate; and,
WHEREAS, the division of said lots would create a nonconforming lot of record in violation
of Section 205 and Section 1202 of the Zoning Regulations of the City of Blair, Nebraska.
NOW, THEREFORE, BE IT RESOLVED that, pursuant to Neb. Rev. Stat. 76-2,110, the
City of Blair hereby objects to any conveyance or transfer which divides the South 90' of Lot 11 and
the South 90' of Lot 12 in Block 91, Fifth Addition to the City of Blair.
BE IT RESOLVED, FURTHER, that the City Clerk is hereby authorized to record this
Resolution in the office of the County Clerk of Washington County, Nebraska against the above-
described real estate.
COUNCILMEMBER REEH MOVED THAT THE RESOLUTION BE ADOPTED AS READ,
WHICH SAID MOTION WAS SECONDED BY COUNCILMEMBER ABBOTT. UPON ROLL
CALL, COUNCILMEMBERS RYAN, ABBOTT, REEH, SHOTWELL, BOEKA, MCMANIGAL,
FANOELE AND REALPH VOTING "AYE" AND COUNCILMEMBERS NONE VOTING
"NAY", THE MAYOR DECLARED THE FOREGOING RESOLUTION PASSED AND
APPROVED THIS 14TH DAY OF SEPTEMBER, 1999.

The undersigned is the attorney for the City of Blair, Nebraska. It recently came to my
attention that you have or intend to separate the southern 90 feet of Lot 11 from the southern 90 feet
of Lot 12, and it is my further understanding that there is asingle-family residence already located
on Lot 1 1. Please he advised that division of these two lots would create a nonconforming lot of
record in violation of Section 205 and Section 1202 of the Zoning Regulations of the City of Blair,
Nebraska. For your information, I am enclosing copies of both of those regulations.
I believe you have already been advised that the minimum lot size required in the Multi-
Family Residential Low Density District is 6,000 square feet.
You are hereby notified that the division of this contiguous parcel (southern 90 feet of Lot
11 and southern 90 feet of Lot 12) is in a violation of the Zoning Regulations, and that it is the
intention of the City of Blair to file notice of such violation in the real estate records of the
Washington County Clerk. The City will address this issue at its September 14,1999, City Council
meeting.
