Dear Ms. Schluter & Mr. Wickwire,
It has come to the city's attention that you have constructed a carport on the above
property. The city of Blair does not require a building permit for this type of structure. However,
the city's zoning ordinance is specific regarding the definition of a carport.
A carport is defined as a permanent roofed structure with not more than two (2) enclosed
sides used or intended to be used for automobile shelter and storage. It appears you have
partially enclosed a third side. Therefore, we are asking you to remove the panels you have
installed on the north side of the carport which abuts your residential structure.
We appreciate your cooperation in this matter and request that you resolve this issue by
Friday, July 13,2007.

I have attempted to reach you by telephone recently with no success. As a result, I
am writing you a letter on behalf of the City of Blair. Currently, you have a structure on
your property that does not comply with the City's Zoning Ordinance. Specifically, you
have a structure that you purport to be a carport but it does not meet the definition. This
structure has more than two enclosed sides and as a result it is deemed to be a garage
and must meet the set back requirements.
. As a result, since your structure has more then two sides you need to remove the
third side of this structure immediately so that you are in compliance with Blair's Zoning. If
this matter is not resolved on or before August 17, 2007, I will be forced to file the
appropriate legal action against you. I am optimistic that you will resolve this matter short
of litigation.

located 695 N. 3rd Street (Be Fredericks Meadow Add, Lot 4, Blk 1) was in violation of
the City' property maintenance code specifically that a structure the Defendant purports
to be a c rport however it is not in compliance with City of Blair Zoning Ordinances and
that Oef ndant has refused or failed to correct the deficiencies identified. Further the.
property n question remains in violation as of the date of the filing of this Complaint.
Cintrary to the form of the City of Blair Ordinances in such cases made and
providedj against the peace and dignity of the City of Blair, State of Nebraska. This matter
shall be atled up before the County Court of Washi on CountY.; on February 6,2008

which by eir location, proximity to other land uses, the character of the natural environment, and
accessibil'ty to public services and facilities exhibit a high potential as living areas for the people.
The reg' ations are intended to preserve the quality and character of existing residential
neighbor oods, as well as encourage continuing maintenance and rehabilitation by insuring that
incompat'ble uses of the land will not encroach upon the residential areas.
701 RRE RURAL RESIDENTIAL ESTATE DISTRICT
701.01 TENT: This district is intended primarily for application to subdivision of land in
agricultur and scenic areas to: (a) permit the opportunity of developing estate-type lots which,
because of their size, cannot be economically accommodated within urban areas; and (b) to
encourage the provision of estate-type lots as a subdivision ofland which will assure the provisions
of at least ase minimum physical improvements necessary to protect the health, safety and general
welfare 0 people living on estate-type lots or parcels.
701.02 P RMITTED PRlNCIP AL USES AND STRUCTURES: The following shall be pennitted
as uses by right:
(1) Single family dwellings;
(2) Raisin offruit and nut trees, vegetables and horticultural specialties;
(3) Breed ng, hatching, raising and fattening birds; rabbits, chinchillas, hamsters:, or other small
animals an fowl on a domestic and noncommercial basis, not to exceed one animal unit per acre,
provided t at no structure housing poultry or small animals shall be closer than fifty (50) feet 10 any

(4) The fa sing or keeping of horses, not to exceed one (1) animal unit per acre provided that no
