GENERAL SERVICE REGULATIONS AND SPECIFICATIONS:
AVAILABILITY: To all consumers throughout the City of Blair
Se,rvice Area for singLe phase, or three phase if available,
alternating current, electric service at any of the City's
standard voltages, for all uses, when all the Consumers service
at one location is measured by one meter~ unless a Consumer takes
emergency or special service as required by the City's Service
Regulations. Not applicable to standby, breakdown, shared or
resale service.

DETERMINATION OF BILLING DEMAND: Demand for any bill ing per iod,

RESIDENTIAL SERVICE REGULATIONS AND SPECIF~CATIONS:
AVAILABILITY: To single-family dwell ings, farms, trailers, or to
each of the individual livinguni ts,apart,Jttent houses, or m,ul ti-
family dwellings, when such units are metered individually in the
City's Service Area. A "unit" shall be a trailer, apartment, or
unit of a multi-family dwelling, equipped with cooking
facilities. A building served through one meter which can be
occupied as a residence by two or more with each family unit
having separate cookingfacilit,ies shall be subject to the
General Service Schedule and is not included under the
Residen~ial Service Rates.
The single phase, alternating current, electric service will be
supplied at the City's standard voltages, for resid,ential uses,
when all electric service fur~ished under this Schedule is
measured by one meter. This Rate Schedule includes service for
air-conditioning motors ,not exceeding 7 1/2 horsepower each,
other motors not exceeding 3 horsepowe'r each; but excludes
appliances producing abnormal voltage fluctuations, including but
not limited to welders, large capacity, water heate,rs, x-ray
equipment,.etcetera. The consumer sha;Ll be required at his
expense to pave install ed a separat~e tr an s former to el i m in ate
said abnor,mal voltage fluctUations. Not applicable to standby,
breakdown, emergency, supplementary, shared or resale service.
REGULATIONS AND SPECIFICATIONS APPLICABLE TO BOTH GENERAL SERVICE
AND RESIDENTIAL SERVICE: '
GROSS MONTHLY BILL:, Each customer shall be billed and shall be
obligated to pay for electricity used ,by the customer in an
amount determined byappJ,ying the usage of., the customer àccording
to the Net Monthly Rat.e as established from timeto time by the
Board of Public Worksand'the Mayor and City Council of the City
of Blair plus 15 percent of that amount added thereto.
A production
adder may be added, at the option of the Board of

Public Works, to any monthly billing period with the amount of
the production adder to be determined fr m the previous month's
production adder as applied on the wholes Ie cost of electricity
and carried to the nearest one mill.
The summer rate shall apply to billing pe¡riOdS for usage in June
through September and winter rates shall apply to billing periods
for usage in October through May.
DISCOUNT: The customer shall be entitled to a discount of the
Gross Monthly Bill provided the customer remits full payment of
the amount due under the billing prior 0 the 11th day of the
month following receipt of the bill to th customer. If the lOth
day of the month falls ona holiday, S turday or Sunday, the
customer shall have until the end of th next business day to
remit payment and be entitled to said d scount. The discount
shall be computed as the difference bet een the Gross Monthly
Bill and the Net Monthly Rate as defined ereinabove.
RECONNECTION CHARGE: If a consumer whose service has been
disconnected has such service reconnect d at the same location
within 12 months of such disconnection, the consumer shall be
charged a reconnect ion charge equal to the monthly minimum charge
for the location multiplied by the number of months the location
was disconnected.
The Consumer's water heating and space heating equipment shall be
a type approved by the City and shall be nstalled in accordance
with the City's Service Regulations.
City shall not be required to furni h duplicate service
hereunder.

pay for said street construction.

BE IT FURTHER RESOLVED, that the City Clerk
is hereby authorized and directed to certify to the City
Treasurer for collection, a list of said special assessments
during the period of fifty days from said date of levy, and upon
the expiration of said fifty-day period,
said City Clerk is
further authorized and directed to certify said list of said
assessments showing the amounts paid thereon, and the amounts
unpaid thereon,
to the County Clerk of Washington County,
Nebraska, for entry upon the tax lists of said County as by the
Statutes in such cases provided.

BE IT FURTHER RESOLVED,

Council after full consideration, appraisement and apportionment,
and this Council further finds that the property so assessed is

respective rates as indicated.
The grossmon thly bill due each
customer shall be computed on the following proposed rates to
which shall be added an amount of 15% of the customer's bill:

Blair
electric
system has increased; and
Whereas
the administrative and actual costs of removing

replacing

Whereas the current expense charges to the customers
of

after
they
have been removed as a result of nonpayment of the

WHEREAS, local municipal government has a prime responsibility in the continuance and enhancement of
"Nebraska... the Good Life" in the communities of our state; and
WHEREAS, community needs and problems can best be detennined and solved through a cooperative
effort between elected officials and those citizens they represent; and

WHEREAS, the ALL-NEBRASKA COMMUNITY Program, administered statewide by the Department of
Economic Development as part of the Nebraska Community Improvement Program (NCIP), has been
reviewed and found to be a means to improve our community; and
WHEREAS, the Mayor and Council (Board) of the City (Village) of B I air
do herewith pledge their full support, endorsement, and cooperation in carrying out the requirements
of the ALL-NEBRASKA COMMUNITY Program.
NOW THEREFORE BE IT RESOLVED, that the City (Village) of B I air
urges its citizens to join this effort and hereby declares this City (Village) to be an official entrant in the
ALL-NEBRASKA COMMUNITY Program for the year 1982.

INTRODUCED THE FOLLOWING RESOLUTION:
RESOLUTION NO.

WHEREAS, a bill which is known as LB 574 relating to
cities of the metropolitan class limiting the merger, consolida-
tion, and annexation powers of said cities has been introduced
before the Nebraska Unicameral, and,
WHEREAS, the Mayor and City Council of the City of
Blair, Nebraska, are in agreement with the philosophy that a
resident or homeowner has a right to select a municipality within
which he cares to reside, and,
WHEREAS, the Mayor and City Council agree with the
concept that a metropolitan class city should not be given the
unilateral authority to determine in which municipality a resi-
dent or homeowner shall live.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF BLAIR, NEBRASKA, that said municipality
endorses the concepts inherent in LB 574 and encourages the
adoption thereof.

has requested an increase in the number of authorized reserve
officers, and,
WHEREAS, the Municipal Cod,e of the City of. Blair,
Nebraska, provides for the establishment of a police reserve
force and composition thereof, and,
WHEREAS, it is hereby deemed necessary by the Mayor and
City Council that there be an increase in the number of authorized
reserves in the Blair Police reserve force.

of Blair, provides that the gove~ning body may by resolution
prohibit or regulate parking on designated streets or parts of
streets,
NOW THEREFORE~ B~ IT RESOLVED by the Mayor and City
Council of the C¡ty of Blair, Nebraska, 'that any vehicle parking
in excess of thirty (30) minutes be prohibited on the west side
of 16th Street between Front Street and the railroad right-of-way
of the Chicago Northwestern Railroad and on the north side of
Front Street west from its intersection with 16th Street for a
distance of

WHEREAS, the City of Blair, has installed a sanitary
sewer main, the specifications and particular location of which
is shown on specification sheet number one~ which was appended and
attached to the specifications of Sanitary Sewer District No. 45
and which said sheet number one is attached hereto marked Exhibit
"A", and by this reference made a part hereof, and;
WHEREAS, said sewer has been constructed according to
the specifications thereof in the proposed location as shown on
said sheet number one and;
WHEREAS, the City of Blair intends t~ assume a major
portion of the construction cost thereof but further hereby deems
it equitable that said adjacent land owners to the constructed
sewer should be liable for and should pay a hookup fee at the
time they request hookup to said sewer; and that said hookup fee
should be in an approximate amount comparable to that paid by the
land owners in Sanitary Sewer Extension District No. 45;
NOW THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Blair, Nebraska, that any person, entity,
firm or corporation requesting and desiring to connect and hook a
sanitary sewer to said constructed sanitary sewer as shown on
sheet number one attached hereto marked Exhibit "A" shall pay and
remit in full at the time said connection is requested to the
City of Blair a hookup f~e in an amount equal to $5.1672332 per
fron~ foot of the parcel or parcels
requested by said land
owner, firm, entity, person or corporation to be connected to

finance its share of the cost of the construction of this project identified as M-6464 (1)

Kuhr, which said easement provides for a temporary construction
easement to facilitate the bridge construction on Tenth Street at
South Creek in the City of Blair,
Nebraska,

EASEMENT AGREEMENT

hereinafter referred to as "The School, "and the City of Blair,
Nebraska, hereinafter referred .to as "Blair," WITNESSETH:
WHEREAS, Blair desires to obtain an easement for the
purposes of constructing and maintaining enclosed and open storm
sewer drainage over the property described in Exhibit A, and
WHEREAS, the School is agreeable to granting said
easement,
NOW, THEREFORE, .in consideration of One Dollar ($1.00),
mutual covenants herein and the benefits that'each may derive from
said easement and other good and valuable consideration, the School
does hereby grant Blair a perpetual easement' over and across the
real estate described on Exhibit A for the purposes of maintaining
and constructing open and closed storm sewer drainage systems.
It is hereby understood and agreed by and between the
parties that the storm sewer system from 16th Street west to the
abandoned railroad right-of-way of the Chicago Northwestern Rail-
road shall be an enclosed storm sewer system and that the inter-
section thereof with said abandoned railroad right-of-way the City

of Blair may maintain an open drainage system.

Blair shall be responsible for and shall maintain and grade said
drainage ditches, storm sewer and culvarts þy keeping them clear

drainage way in conjunction with and as part of the Jackson
Street sewer project, a copy of said easem~nt being attached
hereto, marked Exhibit "A" and by this referençe made a part

with the terms and conditions thereof and find said proposed
easement acceptable;

summary of the proposed budget statement of the City of Blair for
the fiscal year beginning August 1, 1982, and ending July 31,
1983, was published in The Enterprise, the official newspaper of
the City of Blair, on July 22, 1982, and,
WHEREAS, said budget statement as prepared on Budget
Form APprovided by the State of Nebrask~ an~ consists of ten
pages including the notice referred to hereinabove and was filed

that the following water rates for the
customers of the municipal water works of the City of Blair, are
hereby adopted and established for the City of Blair and shall be
appended to the Municipal Code of the Ci ty of Blair as provided
by the provisions therein.
The gross monthly bill due each cus~omer shall be
computed on the following rates as applied to the respective
usages to which shall be added an amount of 15% of the customer's
bill:

BE IT RESOLVED by the Mayor and City Council of the City of
Blair, Nebraska, that the following sewer rates for the customers of
the municipal water works of the City of Blair, are hereby adopted
and established for the City of Blair and shall be appended to the

The monthly bill due each customer shall be computed at the
rate of 45% of a residential customer's average water bill for
the months of December, January and February of each year and 45% of
a commercial or industrial user's current month's water.
The rates as specified ~ereinabove shall be effective as
to commercial or industrial users with the bills which shall be sent
to the customers on or about October 1, 1982, or as soon as said
rates may be incorporated into the automatic billing procedures,
whichever is later. The rates as specified herein shall be effective
as to residential users with the bi 11 s which shall be sent on
or about May
1, 1983.
When two or more of said customers, including separate
units of apartment houses or multiple family dwellings are served
by a common water meter, the sewer use fee shall be the greater of the
minimum monthly sewer charge applied to each of the individual units
or the actual sewer use fee as calculated by the precentage applied
to the water bill.

This lease entered into this 27th day of July, 1982, between
Washington County, Nebraska (County) and the City of Blair, Nebraska (City).
1.
Premises.
The County hereby leases to the City, the f~llowing
premises located in the Washington County Law Enforcement Building located
on Block 75, City of Blair, Nebraska, to wit:

The portion of the basement currently used as an exercise area shall
be in the exclusive control of the City, and the City agrees to hold the
County harmless for any injury to any person occuring in this ares, and
further, the City agrees to relinquish such area on ten (10) days notice.
2.
Term.
-
The term of this lease shall be year to year after the
expiration of the initial term on July 31, 1983, and may be terminated
either by mutual agreement or by one year written notice delivered prior
to the beginning of the last term.
3.
Consideration.
In consideration of the foregöing, the City agrees
to pay the County 25% of the insurance, snow removal, Maintenance Reserve
Fund, utilities and supplies expense incurred on account of the operation
of the building, payable October 31, January 31, April 30 and July 31, the
first three payments being estimated at ~ of the previous year's actual
expenses,
the final payment being in an amount necessary t~ pay the actual
expenses for the cu!rent year.
The maintenance reserve fund shall be
computed at $4,000.00 per year unless either party notifies the other prior
to July 1, of their desire to renegotiate the amount to be contributed to
this fund.
In addition, the City agrees to pay 50% of the net of the
dispatcherls salary, janitorial salary, and uniform allowance, less the
$1,600.00 due from other communities.
The County agrees to pay 50% of the
teletype expense.
In addition, the
City agrees to pay 50% of the expense
of tqe radio system.
It is agreed that phe City will pay the County $13,818.38

**Radio System was a one-time expenditure, therefore, it has not been included in
the computation of the next year quarterly payment.
Therefore, the quarterly payment for the current year is based on $22,060.75 ~ 4 =$5,515.19
The balance on the 81-82 year was paid to the County Treasurer on August 12,1982, in
the amount of $13,818.38. That was the figure for the quarterly payment, based on
the City paying 25% of Janitor Salary. An adjustment has been made on that percentage,
setting it at 12i%, thus an over-payment in the amount of $1,84J.75 was made ,on the
final payment. Therefore, credit in the amount of $1,843.75 shQuld þe taken on the
first quarterly installment on the 82-83 year, thus the City will pay one payment in
the amount of $3,671.44 for first quarter of 82 and three remaining payments in the
amount of $5,515.19.

WHEREAS, the City of Blair, by and through action of the
Mayor and City Council, on November 19, 1963, adopted an
ordinance which authorized and approved the issuance of
industrial Development Revenue Bonds of the City of Blair,
Nebraska, for the purpose of acquiring certain lands, plant, and
related machinery and which entered into an agreement with Blair
Manufacturing Company, and Nebraska Corporation, concerning the
lease and reconveyance of those lands,
plant,
and related
machinery, and
WHEREAS, Blair Manufacturing Company has complied in
all respects wi th the terms of said agreement wi th the Ci ty of
Blair and the First National Bank & Trust Company of Lincoln, as
Trustee, and
WHEREAS, a call of redemption of all of the Industrial
Development Revenue Bonds has been duly made by said Trustee,
and,
WHEREAS,
as a term and condition of the option of the
Blair Manufacturing Company to repurchase the land, plant, and
related machinery conveyed to the City of Blair as a term and
condition of said Bonds is required to pay to the City of Blair
the sum of $3000.00, and,
WHEREAS,
the Mayor and City Council of the City of
Blair feel that the payment of said sum would be an unjustified
windfall to the City of Blair, and
WHEREAS,
the City of Blair has received benefits from
the isssuance of said Bonds and the operation of the Blair
Manufacturing Company in the City of Blair which greatly exceeds
the monetary sum of $3000.00.
NOW THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Blair, Nebraska,
that the payment of
$3000.00 by Blair Manufacturing Company pursuant to said
agreement is hereby waived.

RESOLUTION NO. 1982-

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF BLAIR, NEBRASKA:
SECTION to
The Mayor and City Council hereby approve
the request of, Charles Wentz for ~he issuance by the City of
Industrial 'Develppment Revenue Bonds 'in an'a:mount of not to
exceed $1,600,000.00 to providø financing for the purchase of
land and equipment for a pyrolizer plant to be leased by the City
to Charles Wentz.
SECTION 2.
That said bonds in an amount not to exceed
$1,600,000.00 shall be issued whe,n the documents relating thereto
have been submitted to and approved by the City Attorney and the
Mayor and City Council of the City of Blair, Nebrasks.
SECTION 3.
Issuance of the bonds shall be pursuant to
Section 18-1614 to 18-1623 R.~.S. Nebraska 1943 as amended, and
neither the passage of this Resolution nor the issuance of said
bonds shall obligate the ,City for any pecuniary liability or
constitute a charge agains't the general creditor taxing powers
of the City of Blair, Nebraka, and said bonds, when issued shall
be payable solely from monies paid by or on beha~~ of Charles
Wentz.

INTRODUCED THE FOLLOWING RESOLUTION:
RESOLUTION NO. 1982 - 31
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF BLAIR, NEBRASKA,
that Section B (2) of the electrical service
regulations of the City of Blair, Nebraska, should be amended to
read as follows:
The City has the right at any time, to prevent
loss due to nonpayment of bills, to require the consumer to
maintain a deposit with the City equal to not more than triple
the maximum estimated monthly bill due from the consumer.
In no
event, however, shall said deposit be less than $25.00.
BE IT FURTHER RESOLVED that said amendment should be
made pursuant to the Municipal Code of the City of Blair,
Nebr aska, and shown pur suan t to the Munic ipal Code of the City of
Blair, in an appendix attached to the Municipal Code of the City
of Blair, Nebraska, entitled Permit, License, and Application
Fees.

WHEREAS, Section 5-404 of the Municipal Code of the City
of Blair, provides that the governing body may by resolutiDn
prohibit or regulate parking on designated streets or parts of
streets.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF BLAIR, NEBRASKA, that parking of any
vehicle be prohibited except for loading and unloading of
passengers on the East side of 21st Street from the intersection
of Jackson Street and 21st Street in the City of Blair to a point
South thereof a distance of fifty feet from said intersection in
the City of Blair, Nebraska, and that the Street Department of
the City of Blair and the Police Department are hereby authorized
and directed to place Loading Zone Only signs reflecting the no
parking restrictions as established hereby at necessary intervals
along said restricted
parking area as established hereby and
that following the passage and publication of this Resolution it
shall be unlawful for any person to fail, neglect or refuse to
comply with said prohibition.

WHEREAS,
the
City
of
Blair desires
to
establish
a
dedicated
street,
the
West side of Tax Lot
14,
in
Weimer's
Addition to the City of Blair, Washington County, Nebraska, and
WHEREAS, the owners thereof Junior A. Porter and Delores
Porter
are agreeable to the establishment of said street and are
the record title owners of:
The West 34' of Lot 14, in Weimer's Addition to
the City of Blair, Washington County, Nebraska;
and
WHEREAS,
the City of Blair and the Porters are desirous
of
negotiating a price for the real estate to avoid the
expense
and other disadvantages of a condemnation of the real estate; and
WHEREAS,
the
said Porters have offered and
agreed
to
sell
the
above-described premises to the City of Blair for
the
sum of One Thousand Eight Hundred Dollars ($1,800.00), and
WHEREAS,
said
sum is agreeable and acceptable
to
the
City of Blair;
NOW,
THEREFORE,
BE
IT
RESOLVED
that
the
Agreement
attached hereto,
marked Exhibit "A" and by this reference made a
part hereof, said Agreement constituting an offer for sale of the
premises is agreeable to said City, and that said Agreement is
premised upon completion of all necessary public notices and
hearings for the acquisition of said real estate.
BE IT FURTHER RESOLVED THAT THE MAYOR AND CITY CLERK OF
THE CITY OF BLAIR,

execute an acceptance of said offer pursuant and according to

WHEREAS, there has been signed by the City of Blair on the
27th day of May , 19..8.Q., and by the State on the lOtij. day of-
TlInp . , 19.Jl.O, an agreement providing for the construction of a Federal
Aid Secondary project ~~ whi~h is removing and replacing
a bridge at 10th Street and South Creek in Blair, Nehra~ka.
WHEREAS, in the above agreement, the City has pledged sufficient funds to
finance its share otthe cost of the construction of this project identified as BRO- 7089 (5)
, and
WHEREAS, the above mentioned agreement provided that the City would pay
all non-federal costs
, and
WHEREAS, the S1ate and the City received bids for the construction of
this project on December ~, 1982 , at which time six
bids were received for the construction of the proposed work, and
WHEREAS, the following contractor has been selected as the low bidder to whom
a contract shou Id be awarded:

contractor to whom a contract should be awarded.
2. The Council does not desire to perform any of the work with its own forces in
lieu of performing thework by the contract method.
3. The Council hereby authorizes the Mayor and the City Clerk of
Blair to sign the construction contract on behalf of said City.
