WHEREAS, Municipal Engineers Inc., of Omaha,
Nebraska, has submitted plans and specifications together
with an estimate of costs for the construction of municipal
electric system improvements in the City of Blair consisting
of a 13.8 KV transmission line together with accompanying
apparatus, and,
WHEREAS, the Board of Public Works of the City of
Blair has reviewed and approved the plans, specifications and
estimate of costs.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF BLAIR that said plans, specifications
and estimate of costs are herewith approved and accepted.
BE IT FURTHER RESOLVED that the City Clerk is
hereby authorized and directed to publish the Notice to
Bidders in the official newspaper of the City of Blair one
time at least ten (10) days prior to bid opening which shall
be February 8, 1977 at 7.30 o'clock P.M. at the Council
Chambers.

Enforcement an riminal Justice for a grant under the Omnibus
Crime Control and Safe Streets Act of 1969 as amended by the Crime
Control Act of 1973, for hand held portable radios, and,
WHEREAS, the amount of said proposed grant would be
$3,794.58 and local funds which amount to $421..62, for a total
project cost of $4,216°.20.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF BLAIR that said application is in the best interest
of the City of Blair and the Police Department of the City of Blair

WHEREAS, a system of functionally classified streets have been
established in the Blair Urban Area, and
WHEREAS, it is the desire of the Blair City Council to revise the
existing system of functionally classified streets in order to meet the
following changing traffic conditions.
The- -City -of Blair- has cancelled its plans to construct a street from
21st Street north approximately 420', thence east to existing College View
Drive. Rather, new plans have been initiated to extend Adams Street west to
19th Street, thence south along 19th Street, and in accordance with plans
drafted by the Department of Roads of the State of Nebraska, tie into U.S.
Highway 73 at its revised intersection with Wright Street.
WHEREAS, it is the desire of the Blair City Council that the following
revisions to the 1980 National Functional Classification and the System of
Federal Aid Urban Routes be submitted concurrently to the Federal Highway
Administration for approval:
(1) That Twenty —First Street and College View Drive from U.S.
Highway 73 north 420' and thence east 1035' to the east line
of Lot 32, "66" Heights, Blair, Nebraska, be deleted from the
functional classification system and the Federal Aid Urban System.
(2) That Adams Street from the west line of 16th Street to the west
line of 19th Street in the City of Blair, Nebraska, be reclassified
a Collector street and be added to the functional classification
system and the Federal Aid Urban System.
(3) That 19th Street from its intersection with the revised plans
of the intersection of U.S. Highway 73 and Wright Street to the
south line of Adams Street in the City of Blair, Nebraska, be
reclassified a Collector street and be added to the functional
classification system and the Federal Aid Urban System.
NOW THEREFORE, in consideration of these facts the City Council takes
the following official action:
BE IT RESOLVED THAT:
The Nebraska Department of Roads is hereby requested to prepare the
necessary documents and take all necessary steps required in order to obtain
the approval of the above described revisions to the 1980 National Functional
Classification and System of Federal Aid Urban Routes in the Blair Urban Area.

WHEREAS, the members of the Omaha- Council Bluffs Metropolitan
Area Planning Agency (MAPA) have been formally designated by their
respective legislative bodies to act as the official representative in
planning matters of mutual concern; and,
WHEREAS, the Department of Housing and Urban Development has a
requirement in its regulations concerning the development of land use
and housing elements, pursuant to the Housing and Community Development
Act of 1954 (PL 93 -383) ; and,
WHEREAS, the MAPA Board of Directors has expressed concern about
the need for developing a land use plan which responds to the wants
and desires of the elected officials, citizens and interest groups in
the NAPA region; and,
WHEREAS, there are time constraints in the Department of Housing
and Urban Development regulations which do not recognize the local
involvement necessary to prepare plans responsive to the local situa-
WHEREAS, the MAPA Board of Directors has expressed their concern
to its member jurisdictions; Now therefore be it

for Street Improvement District No 129 has. prepared a schedule
of assessments for the work of improvement in said District,
which said schedule has been filed with the City Clerk, and,
WHEREAS, it is necessary to have a meeting of the Mayor
and City Council sitting as a Board of Equalization for the pur-
pose of considering the assessments in said District.
NOW THEREFORE BE IT RESOLVED by the Mayor and City
Council of the City of Blair, Nebraska, that the engineer's
acceptance referred to hereinabove and the work of improvements
in said district are hereby approved.
BE IT FURTHER RESOLVED that said Mayor and City Council
of the City of Blair, Nebraska, shall meet as a Board of Equali-
zation on September 13, 1977, between the hours of 7 :30 o'clock,
P.M., and 8:30 o'clock, P.M., of said day for the purpose of
considering the benefits derived and damages sustained to real
property included within the boundaries of said Street Improve-
ment District No. 129 of the said City by reason of the improve-

SECTION. Said Mayor and Council of the City being now

the time and place of said meeting and of the purpose thereof having
been duly given, as required by law, by publication in The Enter-
prise, a legal weekly newspaper published in said City and of gen-
eral circulation therein, proof of which publication is now on file
with the City Clerk of said City, said special meeting being held
for the purpose of fixing the valuation of the lots, parts of lots
and parcels of land in said Street Improvement District subject to
special assessments for the purpose of paying the cost of the im-
provement of the streets in said Street Improvement District, also
to fix the amount to be charged against each of such lots, parts of
lots and parcels of land., taking into account the benefits derived
or injuries sustained by reason of said improvements, said improve-
ments being the paving of a certain street in said Street Improve-
ment District, and said Mayor and Council, in said special meeting,
having considered the various purposes of said meeting and being
fully advised in the premises, finds that the amount of the special
benefits derived by each of said lots and parcels of land directly
abutting upon said street so improved in said District is hereby

said lots and parcels of land in said schedule under the column

SECTION 2. BE IT FURTHER RESOLVED, after due consider-
ation thereof, that said Mayor and Council in this meeting assem-
bled, do hereby find that none of the lots, parts of lots and
parcels of land included in said Street Improvement District No.
129 having been damaged in any sum by reason of the construction
of said street improvements and that all of said lots, parts of
lots and parcels of land directly abutting upon the streets
improved in said Street Improvement District having been specially
benefited thereby.
SECTION 3. BE IT FURTHER RESOLVED that the amounts
hereinafter fixed and charged against each of said lots, parts of
lots and parcels of land directly abutting upon the streets in
said Street Improvement District are in proportion to the special
benefits derived by each of said lots, parts of lots and parcels
of land by reason of said street improvements in said Street
Improvement District, taking into account injuries sustained by
reason of said Street Improvements, and said amounts are hereby
fixed to be the various amounts set opposite the description of
said lots and parcels of land in the schedule hereinafter set
forth under the column headed "AMOUNT OF BENEFITS ".
SECTION 4. BE IT FURTHER RESOLVED that there be, and
hereby is, charged and levied for the purpose of paying the cost
of said street improvements in said Street Improvement District,
a special assessment against each of the lots, parts of lots and
parcels of land in said Street Improvement District directly
abutting upon said improved street therein and specially benefited

SECTION 5. BE IT FURTHER RESOLVED that the above schedule
of assessments to pay for the cost of the improvements in said
Street Improvement District is hereby adopted by this Council,
after full consideration, appraisement and apportionment, and this
Council further finds that the said property so assessed is specially
benefited by said street improvements in the various amounts assessed
against each of said parcels of land and further finds that the
amount assessed against each of said parcels of land is not in excess
of the total expense and cost of said street improvements.
SECTION 6. BE IT FURTHER RESOLVED that one -tenth of the
total amount hereinbefore assessed and levied against each lot and
parcel of land, above described, shall become delinquent within fifty
days after the date of levy, being September 13, 1977, one -tenth
thereof shall become delinquent in one year thereafter, one -tenth
thereof shall become delinquent in two years thereafter, one -tenth
thereof shall become delinquent in three years thereafter, one -tenth
thereof shall become delinquent in four years thereafter, one -tenth
thereof shall become delinquent in five years thereafter, one -
tenth thereof shall become delinquent in six years thereafter,
one -tenth thereof shall become delinquent in seven years there-
after, one -tenth thereof shall become delinquent in eight years
thereafter, one -tenth thereof shall become delinquent in nine
years thereafter, each of said installments, except the first,
shall draw interest at the rate of six per cent per annum, payable
annually, from said above fixed day of levy until the same shall '
become delinquent, and after the same shall become delinquent,
interest at the rate of nine per cent per annum shall be paid
thereon; provided, however, all of said installments may be paid
at one time on any lot or parcel

WHEREAS, the eighty -third session of the Nebraska
Legislature enacted into law the Nebraska Civil Defense Act of
1973, which authorizes and directs each county, and each city
which is desirous, within the State of Nebraska to establish a
local organization for Civil Defense, and to do certain other
acts in connection therewith, and,
WHEREAS, such action is not only required by law, but
that it appears to be in the best interest of the City of Blair
and of the citizens thereof to participate in the benefits and
responsibilities of said act, and,
WHEREAS, it is the desire and intent of the City of
Blair, Nebraska, to establish a City Civil Defense Organization.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
1. That there is hereby established with said City a
City Organization for Civil Defense to be operated in conformity
with the Nebraska Civil Defense Act of 1973, as amended. This
organization will be known as the Blair Civil Defense Agency.
2. That, reposing great confidence in his integrity
and ability, Clarence Schreiner whose address is 635 South 18th
Street, Blair, Nebraska 68008, is hereby appointed director of
Civil Defense for said City organization, to service during the
pleasure of this City Council or until a successor is duly appointed.
3. That the City Treasurer will be responsible for
the receipt and disbursement of all Civil Defense Funds, where

Council further finds that the property so assessed is specially

excess of the amount of special benefits derived by said various

SECTION 6. BE IT FURTHER RESOLVED, that one -fifth of
the total amount hereinbefore assessed and levied against each
lot and parcel of land above described, shall become delinquent
in fifty days after the date of this levy, said date of levy being
December 13, 1977; one -fifth shall become delinquent in one year
thereafter; one -fifth shall become delinquent in two years there-
after; one -fifth shall become delinquent in three years there-
after; one -fifth shall become delinquent in four years there-
after. Each of said installments except the first shall draw
interest at the rate of six per cent per annum payable annually

SECTION 5. BE IT FURTHER RESOLVED, that the above
schedule of assessments to pay for the cost of-the improvements.
in said Water Extension District is hereby adopted by this
Council after full consideration, appraisement and apportionment,
and this Council further finds that the property so assessed is
specially benefited by said water line construction in the
various amounts assessed against each parcel of land, and further
finds that the amount assessed against each of said parcels of
land is not in excess of the amount of special benefits derived
by said various parcels of land from said water line construction,
and further finds that the total amount of said assessment is not
in excess of the total expense and cost of said water line
construction.
SECTION 6. BE IT FURTHER RESOLVED, that one -fifth of
the total amount hereinbefore assessed and levied against each
lot and parcel of land above described, shall become delinquent
in fifty days after the date of this levy, said date of levy
being December 13, 1977; one -fifth shall become delinquent in
one year thereafter; one -fifth shall become delinquent in two
years thereafter; one -fifth shall become delinquent in three
years thereafter; one -fifth shall become delinquent in four
years thereafter. Each of said installments except the first
shall draw interest at the rate of six per cent per annum payable
annually from said above fixed date of levy until the same shall
become delinquent, and after the same shall become delinquent,
interest at the rate of nine per cent per annum shall be paid
thereon providing, however, all installments may be paid at one
time on any lot or parcel of land within fifty days from said
date of levy without interest, whereby such lot or parcels of

thereof, having been duly given as required by law by publication
in The Enterprise, a legal weekly newspaper published in the City
of Blair, and of general circulation therein, proof of which publi-
cation is now on file with the City Clerk of said City, said
meeting being held for the purpose of fixing the amount to be
charged against each of the lots, parts of lots and parcels of
land in said Sanitary Sewer Extension District, subject to special
assessments, for the purpose of paying the cost of the construction
of a sewer in said Sanitary Sewer Extension District, taking into
account the benefits derived or injuries sustained by reason of
said improvements, and said Mayor and Council in said meeting
having considered the various purposes of said meeting, and being
fully advised in the premises, the amount of the special benefits
in said District derived by each of said lots and parts of lots
and parcels of land therein by reason of the construction of the
sewer in said District, is hereby fixed to be the amounts set
opposite the description of each of said lots and parcels of land
in the schedule hereinafter set forth under the column headed
"AMOUNT OF BENEFITS ".
SECTION 2. BE IT FURTHER RESOLVED, after due consi-
deration thereof, that said Mayor and Council in this meeting
assembled, do hereby find that none of the lots, parts of lots
and parcels of land included in said Sanitary.Sewer Extension .
District No. 41 have been damaged in any sum by reason of the
construction of said sewer, and that all of said lots, parts of
lots and parcels of land directly abutting upon said sewer
construction have been especially benefited thereby.
SECTION 3. BE IT FURTHER RESOLVED, that the amounts
hereinafter fixed and charged against each of said lots, parts of
lots and parcels -of -- land -directly abutting upon the sewer constru-
ction in said Sanitary Sewer Extension District, are in proportion
to the special benefits derived by each of said lots, parts of lots
and parcels of land by reason of the construction of a sewer in
said Sanitary Sewer Extension District, taking into account injuries
sustained by reason of said sewer construction, and said amounts
are hereby fixed as the various sums set opposite the description
of said lots, parts of lots and parcels of land in the schedule
hereinafter set forth under the column headed "AMOUNT OF ASSESS-
MENTS".
SECTION 4. BE IT FURTHER RESOLVED, that there be and

SECTION 5. BE IT FURTHER RESOLVED, that the above
schedule of assessments to pay for the cost of the improvements
in said Sanitary Sewer Extension District is hereby adopted by
this Council after full consideration, appraisement and apportion-
ment, and this Council further finds that the property so assessed

is specially benefited by said sewer construction in the various
amounts assessed against each parcel of land, and further finds

that the amount assessed against each of said parcels of land is
not in excess of the amount of special benefits derived by said
various parcels of land from said sewer construction, and further
finds that the total amount of said assessment is not in excess
of the total expense and cost of said sewer construction.
SECTION 6. BE IT FURTHER RESOLVED, that one -fifth of
the total amount hereinbefore assessed and levied against -each lot
and parcel of land above described, shall become delinquent in
fifty days after the date of this levy, said date of levy being
December 13, 1977; one -fifth shall become delinquent in one year
thereafter; one -fifth shall become delinquent in two years there-
after; one -fifth shall become delinquent in three years there-
after; one -fifth shall become delinquent in four years thereafter.
Each of said installments except the first shall draw interest at
the rate of six per cent per annum, payable annually, from said
above fixed date of levy until the same shall become delinquent,
and after the same shall become delinquent, interest at the rate of
nine per - -cent per annum shall be paid thereon providing, however,
all installments may be paid at one time on any lot or parcel of
land within fifty days from said date of levy without interest,
whereby such lot or parcels of land shall be exempted from any
further lien or charge therefor.
SECTION 7. BE IT FURTHER RESOLVED, that all proceeds
from the payment of the assessments hereinbefore levied, together
with the interest thereon, shall constitute a sinking fund to be
used solely and exclusively for the payment of the cost of the
sewer construction in.said Sanitary Sewer Extension District, or
for the payment of bonds and interest thereon which may be issued
to pay for said sewer construction.

SECTION 8. BE IT FURTHER RESOLVED, that the City
Clerk is hereby authorized and directed to certify to the. City
Treasurer for collection, a list of said special assessments
during the period of fifty days from said date of levy, and upon
the expiration of said fifty -day period, said City Clerk is
further authorized and directed to certify said list of said
assessments showing the amounts paid thereon, and the amounts
unpaid thereon', to the County Clerk of Washington County, Nebraska,
for entry upon the tax.lists of said County as by the Statutes
in such cases provided.

benefits derived by each of said lots and parcels of land directly
abutting upon said street so improved in said District is hereby
fixed to be the amounts set opposite the description of each of

SECTION 5. BE IT FURTHER RESOLVED that the above
schedule of assessments to pay for the cost of the improvements
in said Street Improvement District is hereby adopted by this
Council, after full consideration, appraisement and apportionment,
and this Council further finds that the said property so assessed
is specially benefited by said street improvements in the various
amounts assessed - against each -of said parcels of - land and further
finds that the amount assessed against each of said parcels of
land is not in excess of the total expense and cost of said
street improvements.
SECTION 6. BE IT FURTHER RESOLVED that onetenth of the
total amount hereinbefore assessed and levied against each lot
and parcel of land, above described, shall become delinquent
within fifty days after the date of levy, being December 13,
1977, one -tenth thereof shall become delinquent in one year
thereafter, one -tenth thereof shall become delinquent in two
years thereafter, one -tenth thereof shall become delinquent in
three years thereafter, one -tenth thereof shall become delinquent
in four years thereafter, one -tenth thereof shall become de-
linquent in five years thereafter, one -tenth thereof shall become
delinquent in six years thereafter, one -tenth thereof shall
become delinquent in seven years thereafter, one -tenth thereof
shall become delinquent in eight years thereafter, one -tenth
thereof shall become delinquent in nine years thereafter, each of
said installments, except the first, shall draw interest at the
rate of six per - cent - per - annum, -- payable annually, from said above
fixed day of levy until the same shall become delinquent, and
after the same shall become delinquent, interest at the rate of

nine per cent per annum shall be paid thereon; provided, however,
all of said installments may be paid at one time on any lot or
parcel of land within fifty days from said above date of levy,
without interest, whereby such lot or parcel of land shall be
exempted from any further lien or charge therefor.
SECTION 7. BE IT FURTHER RESOLVED that all the proceeds
from the payment of the assessments hereinbefore levied, together
with the interest thereon, shall constitute a sinking fund to be
used solely and exclusively for the payment of the cost of the
street improvements in said Street Improvement District or for
the payment of bonds, and interest thereon, which may be used for
payment of said street improvements.
SECTION 8. BE IT FURTHER RESOLVED that the City Clerk
is hereby authorized and directed to certify to the City Treasurer
for collection, a list of said special assessments, during the
period of fifty days from said date of levy and upon the expiration
of said fifty -day period, said City Clerk is further authorized
and directed to certify to the County Clerk of Washington County,
Nebraska, said list of assessments, showing the amounts paid
thereon and the amount unpaid thereof, for entry upon the tax
lists of said County, as by the Statutes in such cases provided.

SECTION 9. This resolution shall be in force and
effect from and after its passage and approval and a copy thereof
shall be published in The Enterprise, the official newspaper of
said City, one time.
