SVENDGAARD WHEREAS, a system of functionally classified streets have been established in the Blair Urban Area, and WHEREAS, it is the desire of the Blair City Council to revise the existing system of functionally classified streets in order to meet the following changing traffic conditions. The- -City -of Blair- has cancelled its plans to construct a street from 21st Street north approximately 420', thence east to existing College View Drive. Rather, new plans have been initiated to extend Adams Street west to 19th Street, thence south along 19th Street, and in accordance with plans drafted by the Department of Roads of the State of Nebraska, tie into U.S. Highway 73 at its revised intersection with Wright Street. WHEREAS, it is the desire of the Blair City Council that the following revisions to the 1980 National Functional Classification and the System of Federal Aid Urban Routes be submitted concurrently to the Federal Highway Administration for approval: (1) That Twenty —First Street and College View Drive from U.S. Highway 73 north 420' and thence east 1035' to the east line of Lot 32, "66" Heights, Blair, Nebraska, be deleted from the functional classification system and the Federal Aid Urban System. (2) That Adams Street from the west line of 16th Street to the west line of 19th Street in the City of Blair, Nebraska, be reclassified a Collector street and be added to the functional classification system and the Federal Aid Urban System. (3) That 19th Street from its intersection with the revised plans of the intersection of U.S. Highway 73 and Wright Street to the south line of Adams Street in the City of Blair, Nebraska, be reclassified a Collector street and be added to the functional classification system and the Federal Aid Urban System. SICK, Mayor R E S O L U T I O N WHEREAS, the eighty -third session of the Nebraska Legislature enacted into law the Nebraska Civil Defense Act of 1973, which authorizes and directs each county, and each city which is desirous, within the State of Nebraska to establish a local organization for Civil Defense, and to do certain other acts in connection therewith, and, WHEREAS, such action is not only required by law, but that it appears to be in the best interest of the City of Blair and of the citizens thereof to participate in the benefits and responsibilities of said act, and, WHEREAS, it is the desire and intent of the City of Blair, Nebraska, to establish a City Civil Defense Organization. BE IT FURTHER RESOLVED, that one -fifth of the total amount hereinbefore assessed and levied against each lot and parcel of land above described, shall become delinquent in fifty days after the date of this levy, said date of levy being December 13, 1977; one -fifth shall become delinquent in one year thereafter; one -fifth shall become delinquent in two years there- after; one -fifth shall become delinquent in three years there- after; one -fifth shall become delinquent in four years there- after. Each of said installments except the first shall draw interest at the rate of six per cent per annum payable annually from said above fixed date of levy until the same shall become delinquent and after the same shall become delinquent, interest at the rate of nine per, cent per annum shall be paid thereon providing, however, all installments may be paid at one time on any lot or parcel of land within fifty days from said date of levy without interest, whereby such lot or parcela of land shall be exempted from any further lien or charge therefor. BE IT FURTHER RESOLVED, that the above schedule of assessments to pay for the cost of the improvements in said Sanitary Sewer Extension District is hereby adopted by this Council after full consideration, appraisement and apportion- ment, and this Council further finds that the property so assessed OFFICER OF O'HANLON & O'HANLON LAWYERS BI.AIR, NEBRASKA is specially benefited by said sewer construction in the various amounts assessed against each parcel of land, and further finds • that the amount assessed against each of said parcels of land is not in excess of the amount of special benefits derived by said various parcels of land from said sewer construction, and further finds that the total amount of said assessment is not in excess of the total expense and cost of said sewer construction. SECTION 6. BE IT FURTHER RESOLVED, that one -fifth of the total amount hereinbefore assessed and levied against -each lot and parcel of land above described, shall become delinquent in fifty days after the date of this levy, said date of levy being December 13, 1977; one -fifth shall become delinquent in one year thereafter; one -fifth shall become delinquent in two years there- after; one -fifth shall become delinquent in three years there- after; one -fifth shall become delinquent in four years thereafter. BE IT FURTHER RESOLVED that the above schedule of assessments to pay for the cost of the improvements in said Street Improvement District is hereby adopted by this Council, after full consideration, appraisement and apportionment, and this Council further finds that the said property so assessed is specially benefited by said street improvements in the various amounts assessed - against each -of said parcels of - land and further finds that the amount assessed against each of said parcels of land is not in excess of the total expense and cost of said street improvements. SECTION 6. BE IT FURTHER RESOLVED that onetenth of the total amount hereinbefore assessed and levied against each lot and parcel of land, above described, shall become delinquent within fifty days after the date of levy, being December 13, 1977, one -tenth thereof shall become delinquent in one year thereafter, one -tenth thereof shall become delinquent in two years thereafter, one -tenth thereof shall become delinquent in three years thereafter, one -tenth thereof shall become delinquent in four years thereafter, one -tenth thereof shall become de- linquent in five years thereafter, one -tenth thereof shall become delinquent in six years thereafter, one -tenth thereof shall become delinquent in seven years thereafter, one -tenth thereof shall become delinquent in eight years thereafter, one -tenth thereof shall become delinquent in nine years thereafter, each of said installments, except the first, shall draw interest at the rate of six per - cent - per - annum, -- payable annually, from said above fixed day of levy until the same shall become delinquent, and after the same shall become delinquent, interest at the rate of OFFICES OP O'HANLON & O'HANLON LAWYERS BLAIR, NEBRASKA nine per cent per annum shall be paid thereon; provided, however, all of said installments may be paid at one time on any lot or parcel of land within fifty days from said above date of levy, without interest, whereby such lot or parcel of land shall be exempted from any further lien or charge therefor. SECTION 7. BE IT FURTHER RESOLVED that all the proceeds from the payment of the assessments hereinbefore levied, together with the interest thereon, shall constitute a sinking fund to be used solely and exclusively for the payment of the cost of the street improvements in said Street Improvement District or for the payment of bonds, and interest thereon, which may be used for payment of said street improvements. SECTION 8. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to certify to the City Treasurer for collection, a list of said special assessments, during the period of fifty days from said date of levy and upon the expiration of said fifty -day period, said City Clerk is further authorized and directed to certify to the County Clerk of Washington County, Nebraska, said list of assessments, showing the amounts paid thereon and the amount unpaid thereof, for entry upon the tax lists of said County, as by the Statutes in such cases provided. 4 SECTION 9. This resolution shall be in force and effect from and after its passage and approval and a copy thereof shall be published in The Enterprise, the official newspaper of said City, one time.
