Chambers at 7:30 o'clock, P.M. Mayor Sick presided at the

Introduction of Ordinance No. 1130.:of the City

Mayor and Council was the passage and approval of Ordinance
No. 1130 of the City. of Blair, Nebraska. This Ordinance
No. 1130 was introduced by Councilman Allen and is in words

AN ORDINANCE AMENDING SECTION 6 -115 OF THE MUNICIPAL CODE
OF THE CITY OF BLAIR TO REDUCE THE PERIOD OF IMPOUNDMENT
OF DOGS: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH: AND PROVIDING WHEN THIS ORDINANCE
SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. Section 6-115 of the Municipal Code
of the City " of Blair is hereby amended to read as follows:
"DOGS; IMPOUNDING. It shall be the duty of the Municipal
Police to capture, secure, and remove in a humane manner
to the Municipal Animal Shelter any dog violating any of the
provisions of this article. The dogs so impounded shall be
treated in a humane manner and shall be provided with a
sufficient supply of food and fresh water each day. Each

impounded dog shall be kept and maintained at the pound
for a period of not less than forty -eight (48) hours unless
reclaimed earlier by the owner. Notice of impoundment of
all animals, including any significant marks of identifica-
tions, shall be posted at the pound as public notification
of such impoundment. Any dog may be reclaimed by its owner
during the period of impoundment by payment of ten ($10.00)
dollars as a general impoundment fee. The owner shall then
be required to comply with the licensing and rabies vaccina-
tion requirements within seventy -two (72) hours after release.
If the dog is not claimed at the end of forty -eight (48)
hours, the Municipal Police may dispose of the dog in
accordance with the applicable rules and regulationsper-
taining to the same; Provided, that if, in the judgment of
the Municipal Police, a suitable home can be found for any
such dog within the Municipality, the said dog shall be
turned over to that person and the new owner shall then be
required to pay all fees and meet all licensing and vaccinat-
ing.requirements provided in this article. The Municipality
shall acquire legal title to any unlicensed dog impounded
in the Animal Shelter after forty -eight (48) hours. All
dogs shall be destroyed and buried in the summary and humane
manner as prescribed by the Board of Health.t
SECTION 2..All ordinances or parts of ordinances
in conflict. herewith are hereby repealed.
SECTION 3. This ordinance shall be in force and
take.full effect from and after its passage, approval and
publication as provided by law.

ORDINANCE NO. 1132
Introduction of :Ordinance No. 1132 of the City
of Blair, Nebraska, and the matter now coming before the
Mayor and Council was the passage and approval of Ordinance
No. 1132 of the City of Blair, Nebraska. This Ordinance
No. 1132 was introduced by Councilman Allen and is in
words and figures as follows:
ORDINANCE NO. 1132
AN ORDINANCE TO ESTABLISH MUNICIPAL REGULATIONS FOR THE
OPERATION OF SNOWMOBILES WITHIN THE MUNICIPALITY; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND
EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. That Chapter 5, Article 5, of the
Municipal Code of Blair, Nebraska, be amended to include
the following sections.
SECTION 2. SNOWMOBILES; EQUIPMENT. Every snow-
mobile operated within the Municipality shall be registered
with the State of Nebraska, as required by law. No snowmobile
shall be operated upon a public street or highway unless
it is equipped with at least one head lamp, one tail lamp,
reflector material of a minimum area of sixteen (16)

square inches mounted on each side forward of the handle
bars, and with brakes as prescribed by the Director of
Motor Vehicles.
All laws applying to the operation of other
motor vehicles shall apply to snowmobiles, except those
relating to required equipment and those which, by their
nature, have no application.
SECTION 3. SNOWMOBILES; UNLAWFUL ACTS. It shall
be deemed a misdeameanor for any person to allow a snow-
mobile, either owned or operated by him, to be operated:
1. Within the congested area of the Municipal-
ity unless weather conditions are such that it provides
the only practicable method of safe vehicular travel,
or said snowmobile is engaged in responding to an emergency,
provided however, that a snowmobile may be operated on
the street of the city provided it is driven on the far
right of the cleard roadway and provided that said use
is limited to going in a direct line to an out of town
destination or returning to the place of residence within
the city.
2. At a rate of speed greater than reasonable
or proper under the surrounding circumstances.
3. In a careless, reckless or negligent manner
so as to endanger person or property.
4. Without a lighted headlight and tail light
when such would be required by conditions.
5. In any tree nursery or planting in a
manner which damages or destroys growing stock.
6. Upon any private lands without first having
obtained permission from the owner, lessee or operator
of such lands.
7. With more than two people on a snowmobile
at one time.
8. Without having attached to said snowmobile
a safety flag which meets the following minimum standards,
to -wit: A triangular shaped 10" by 12" Day -Glo Flag
attached to a 6 foot pole or staff.
SECTION 4. SNOWMOBILES; ON PUBLIC LANDS.
Snowmobiles may be operated upon public lands owned by
the Municipality; Provided, such operation is done in a
manner which does not endanger others using the lands,
and the snow covering the land is of such depth and
consistency so as to make reasonably certain vegetation
will not be destroyed or damaged by such operation.
SECTION 5. SNOWMOBILE; ENFORCEMENT; PENALTY.
Any peace officer, including a conservation officer, may
enforce the provisions relating to snowmobiles. Any
person convicted of violating any rule or regulation
dealing with snowmobiles shall be punished by a fine of
not more than One Hundred ($100.00) dollars or imprison-
ment not to exceed ninety (90) days.
SECTION 6. That Sections 5 -505 thru 5 -509
of the Municipal Code of the City of Blair, Nebraska, are
hereby added.
SECTION 7.. This ordinance shall take effect
and be in full force from and after its passage, approval
and publication as required by law.

OF THE CITY OF BLAIR TO INCREASE THE LICENSE FEES FOR DOGS;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN
FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. Section 6 -101 of the Municipal. Code
of the City of Blair, Nebraska, is hereby amended,to read
as follows: DOGS; LICENSE. Any person who shall own,
keep, or harbor a dog over the age of three (3) months
within the Municipality shall within thirty (30) days after

acquisition of the said dog acquire a license for each
such dog annually by or before the first (1st) day of
January of each year. The said tax shall be delinquent
from and after January thirty -first (3lst).; Provided, the
possessor of any dog brought into or harbored within the
corporate limits shall be liable for the payment of the dog
tax levied herein. Licenses shall be issued by the
Municipal Clerk upon the payment of a license fee of Four
($4.00) Dollars for each male dog and spayed female dog and
Seven ($7.00) Dollars for each unspayed female dog. Said
license shall not be transferable and no refund will be
allowed in case of death, sale, or other disposition
of the licensed dog. The owner shall state at the time
the application is made and upon printed form's provided
for such purpose, his name and address and the name, breed,
color, and sex of each dog owned and kept by him. A.cer-
tificate that the dog has had a rabies shot, effective
for the ensuing year of the license, shall be presented
when the license is applied for and no license or tag
shall be issued until the certificate is shown.
SECTION 2. All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3. This ordinance shall be in force and
take full effect from and after its passage, approval and
publication as provided by law. .-

AN ORDINANCE DECLARING THE NECESSITY OF OBTAINING AN INTEREST
IN,CERTAIN LANDS IN THE CITY OF BLAIR FOR ROADWAY PURPOSES;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN
FORCE AND EFFECT.
WHEREAS, in order to complete the construction of
Grant Street in the City of Blair, it is necessary to
construct a roadway together with a tube at the intersection
of Grant Street and South Creek in said City, and,
WHEREAS, the City of Blair does not presently own
the right -of -way sufficient to complete said street system,
and,

WHEREAS, the Greater Blair Corporation, a Nebraska
Corporation, owns lands upon which it will be necessary
to construct said roadway together with appurtenant structures.
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF BLAIR:
SECTION 1. That the City of Blair hereby deter -
mines the necessity of acquiring certain interest in land
for constructing a drop inlet and for roadway purposes
consisting of a perpetual easement through, over, across
and along the following described property, to -wit:
A tract of land lying in the Northwest Quarter
of the Southwest Quarter (NWµSW4) of Section Seven (7) ,
Township Eighteen (18) North, Range Twelve (12) East of
the Sixth Principal Meridian in Washington County, Nebraska.
More particularly described as follows: Commencing at the
4µ corner North of the Southwest corner of said Section;
thence Northerly along the West line of said Section a
distance of 94.55 feet to a point on the Northerly R.O.W.
of Grant Street, being the point of beginning; thence

Introduction of Ordinance No. 1135 of the City of
Blair, Nebraska, and the matter now coming before the Mayor
and. Council was the passage and approval of Ordinance No. 1135
of the City of Blair, Nebraska. This Ordinance No. 1135 was
introduced by Councilman Allen and is in words and figures as
follows:
ORDINANCE NO. 1135
AN ORDINANCE ESTABLISHING STREET IMPROVEMENT DISTRICT NO. 125
IN THE CITY OF BLAIR, NEBRASKA, DESIGNATING THE PURPOSES OF
SAID DISTRICT, DEFINING THE LIMITS AND BOUNDARIES OF SAID
DISTRICT, PROVIDING FOR THE MANNER OF PAYMENT OF THE STREET
IMPROVEMENTS THEREIN, AND PROVIDING WHEN SAID ORDINANCE SHALL
TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. A petition signed by the owners of more
than three- fourths of the lots of land abutting upon the streets
to be improved as hereinafter set forth, petitioning for the
improvement of the following described streets in the City of

Blair, Nebraska: On Sixteenth Street from the South City
Limits of Blair, Nebraska, North to the existing pavement, all
in the City of Blair, Washington County, Nebraska, by paving
the same, said petition therefor having been presented and
filed with the City Clerk, there is hereby created Street
Improvement District No. 125 of the City of Blair, Washington
County, Nebraska.
SECTION 2. The street improvements to be made on
said streets in said district shall be to pave the same, the
grade of said streets to conform to the grades as established
by the. City of Blair and said improvements to be made according
to plans and specifications and estimate of cost to be prepared
by the. Special Engineer for said district and to be filed with
the City Clerk and to be approved by the Mayor and City Council
of said City.
SECTION 3. The property included in said Street
Improvement District No. 125 and subject to special assessments
to pay for the cost and expenses of said street improvement is
all of the privately owned lots, parts of lots and tracts of
land and the lots, parts of lots and tracts of land owned by
any municipal or public corporation and abutting upon and
adjacent to said streets to be improved, to -wit: Lots Seven-
teen (17) through Twenty -Two (22) inclusive, in Larsen's Third
Addition to the City of Blair, Washington County, Nebraska.
SECTION 4. The cost of said improvements in said
Improvement District shall be paid out of the fund created
by the levy and assessments on the lots and parcels of land
in said Street Improvement District benefited thereby in pro-
portion to said benefits, all as by the Statutes of the State
of Nebraska in such cases made and provided.
SECTION 5. This ordinance shall take effect and be
in force from and after its passage, approval and publication
as provided by law.

AN ORDINANCE CREATING A BOARD TO BE KNOWN AS THE BLAIR
;CEMETERY BOARD, PROVIDING FOR THE QUALIFICATIONS AND APPOINT -
. MENT OF MEMBERS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL
BE IN.FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. There is hereby created an official
board of the City of Blair to be known as the Blair Cemetery
Board.
SECTION 2. The Blair Cemetery Board shall consist
of six (6) members chosen from among the citizens at large

of the City of Blair who shall serve without pay and shall
have entire control and management of any cemetery now owned
or hereafter acquired by the City of Blair.
SECTION 3. Neither the mayor nor any member of
the City Council may be members of the Blair Cemetery Board.
At the time of the establishment of the Blair Cemetery Board,
two (2) members shall be appointed for a term of one (1)
year, two (2) for a term of two (2) years, and two (2)
for a term of three (3) years, and thereafter two (2)
members shall be appointed each year for a term of three (3)
years. All appointments to the Blair Cemetery Board shall
be made by the Mayor and shall be approved by a majority
vote of the City Council. Vacancies in the membership of
the Board shall be filled in like manner as regular members
of the Board are appointed.
SECTION 4. The City Clerk of the City of Blair
shall be an ex- officio member of the Blair Cemetery Board
and shall have charge of all records and proceedings of said
Board and shall keep a record of all transactions affecting
the cemeteries owned by the City of Blair.
SECTION 5. All cemetery records and records of
the proceedings of the Blair Cemetery Board shall be kept
at the City Hall under the control and supervision of the
City Clerk and shall be open for public inspection.
SECTION 6. The Blair Cemetery Board shall have
the power to make general rules and regulations to provide
for the orderly maintenance, alteration, repairing, building
or rebuilding to preserve and maintain the usefulness and
effectiveness of any cemetery owned by the City of Blair.
The Blair Cemetery Board shall hold regular meetings which
shall be open to the public and shall be held quarterly in
the months of January, April, July and October and the City
Clerk shall have the power to call additional meetings as
they are needed.. The City Clerk shall notify board members
of the time and place of said meetings and shall also cause
notice to be published in the official newspaper of the City
as required by law.
SECTION 7. All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 8. This ordinance shall be in force and .
take full effect from and after its passage, approval and
publication as provided by law.

AN ORDINANCE APPROVING AND ACCEPTING THE FINAL PLATTING ON A
PORTION OF LARSEN HEIGHT'S ADDITION TO THE CITY OF BLAIR
UNDER CERTAIN TERMS AND CONDITIONS SPECIFIED HEREIN; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT.
WHEREAS, the Mayor and City Council of the City of
Blair have been presented with a proposed final platting of
a portion of Larsen Height's Addition to the City of Blair, and,
WHEREAS, the Planning Commission of the City of
Blair has approved the preliminary plat of all of Larsen
Height's Addition and the final platting of a portion of Larsen
Height's Addition described hereinbelow, subjeet to certain
terms and conditions.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. The final platting of that portion of
Larsen Height's Addition described as follows, to -wit:
Lot 1 in Block 1; Lots 1 through 4, inclusive, in
Block 2; Lots 1 through 5, inclusive, in Block 3;
Lots 1 through 16, inclusive, in Block 4; Lots 1
through 10, inclusive, in Block 5; Lot 1 in B1ock,6;
and Lots 1 and .2 in Block 7, all in Larsen Height's
Addition to the City of Blair, Washington County,
Nebraska,
is hereby approved and accepted subject to the terms and
conditions, contained hereinbelow.
(a) That no building permits shall be issued for
the construction of any dwelling or any building upon said
premises until a sewage treatment system is installed and
approved by the Department of Environmental Control of the
State of Nebraska.
(b) That no building permits shall be issued as
stated hereinabove until the developers have furnished to the
City a written agreement between them and the Board of Public
Works of the City of Blair, providing for the maintenance of
said sewage system, providing who is to pay for said main-
tenance, and further providing that upon the completion of
the outfall sewer and sewage treatment plant now under con-
struction in the City of Blair that the developers shall abandon
the temporary sewage treatment facilities referred to here -
inabove and shall connect the development to said outfall
sewer.
(c) That no building permits shall be issued for
those lots described as park areas for a period of two (2)
years from the date hereof during which period the City of
Blair shall have the option to purchase said lot or lots for
a price as computed pursuant to the subdevelopment ordinances
of the City of Blair. If at the end of said two (2) -year
period the City has failed to exercise said option then and
in that event said lots shall revert to R -72 zoning and
building permits may be obtained for construction upon said
lot or lots.
(d) That the plans and specifications for Street
Improvement Districts to be created within said final platting
shall include proper consideration for storm sewage facilities
and said plans and specifications shall not be approved by
the Mayor and City Council until said requirement has been
met.
SECTION 2. All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3. This ordinance shall be in force and
take full effect from and after its passage, approval and
pnhlication as provided by law.
SECTION 4. That the Mayor and City Council are
hereby authorized and directed on behalf of said City to
sign the acceptance of said final platting and that the
City Clerk is further authorized and directed to cause said

AN ORDINANCE TO AMEND SECTION 1 -314 (CHIEF OF POLICE; POLICEMEN;
POWERS; DUTIES.,) BY DELETING THE REFERENCE TO THE POLICE
COURT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL
BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. That Chapter 1, Article 3, Section 1 -314
of the Municipal Code of Blair, Nebraska, be amended to read
as follows:
Appointed Officials; Chief of Police. The Chief of
Police shall have the immediate superintendence of the police.
He and the policemen shall have the power, and it shall be
their duty, to arrest all offenders against the laws of Nebraska
or of the City; by day or by night, in the same manner as a

Sheriff or Constable, and keep them in the City prison or
other place to prevent their escape, until a trial or examina-
tion may be had before the proper officer; and they shall

. law and all process issued by the County Court in connection
with a violation of a Municipal law. They shall arrest and
detain any person found violating any law of Nebraska or any
law of the City, until a legal warrant can be obtained. Each
member of the Police Department of the City shall have the
duties of becoming well informed as to the ordinances of the
City, of enforcing such ordinances, of wearing at all times
the badge, uniform and insignia furnished by the City for the
Police and of properly caring for same, and such further
duties as shall be assigned to them by the Mayor and Council
and as are otherwise provided byelaw. The Chief of Police
shall have custody of all Municipal property used by the City
Police; shall execute the orders of the Mayor; shall be a
member of the Board of Health and Secretary and quarantine
officer thereof; shall have charge of traffic control on the
City streets; shall make and file or cause to be made and
filed complaints for violations ofthe ordinances of the City;
shall have charge of the City jail and the prisoners therein;
and shall perform such other duties as are assigned to or
required of him by the Mayor and Council or otherwise provided
by law.

and Council was the passage and approval of Ordinance No. 1145

AN ORDINANCE CREATING WATER DISTRICT NO. 12 IN THE CITY OF
BLAIR, NEBRASKA, DECLARING THE NECESSITY THEREFORE, DESIGNATING
THE IMPROVEMENTS TO BE MADE IN SAID DISTRICT, LISTING THE
PROPERTY INCLUDED WITHIN SAID DISTRICT, PROVIDING FOR THE MANNER
OF PAYMENT OF THE IMPROVEMENTS MADE THEREIN AND PROVIDING WHEN
SAID ORDINANCE SHALL TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA.
SECTION 1. The Mayor and City Council of the City
of Blair, Nebraska, hereby declare the necessity to construct
a water district on the following line, to-wit: On Twenty -Sixth
Avenue from the existing water main on College Drive Northerly
to the North line of Section Eleven (11):, Township Eighteen (18)
North, Range Eleven (11), East of the Sixth Principal Meridian
in Washington County, Nebraska. For that purpose there is
hereby created a Water District No. 12 of the City of Blair,
Nebraska.
SECTION 2. The improvements to be made are to construct
and lay a six -inch cast iron water main with valves and hydrants,
said improvements to be made according to plans and specifi-
cations and estimate of cost to be prepared by the Special
Engineer of said District and to be filed with the City Clerk
to be approved by the Mayor and Council of. said City.
SECTION 3. The property included in said Water
District No. 12 and subject to special assessments to pay for
the costs and expenses of said improvement are Lots One (1)
through Eight (8), inclusive, in Terra West Addition to the
City of Blair, Washington County, Nebraska.
SECTION 4. The costs of said improvement in said
Water District shall be paid out of the fund created by levy
and assessment of the lots and parcels of land in said
improvement district, benefited, and to be in proportion to
said benefits, all as by the Statutes of the State of
Nebraska as made and provided.
SECTION 5. This ordinance shall take effect and be
in full force from and after its passage, approval and pub-
lication as provided by law.

priated out of the money now on hand for the Special Gasoline
Road Fund and from the money derived from special gasoline
tax and motor registration fee, and the amounts for each object and
purpose as follows:
For salaries of employees, for purchase of and the
repair of Equipment and for construction of street
improvements $365,000.00
Any balance in said fund remaining over and unex-
pended at the end of the fiscal year shall be transferred
to the Special Gasoline Tax Fund.
SECTION 13. That there'be, and hereby is appro-
priated out of the money derived from the levy of taxes for
the purpose of paying'the City's share of the employees
and officers federal Social Security Tax for the present
fiscal year and out of all other money and funds amilable
therefore, belonging to the said City the amount for each
object and purpose as follows:
For City's share of employees and officers' Federal
Social Security Tax $ 35,000.00
Any balance in said fund 'remaining over and unexpended
at the end of the fiscal year shall be transferred to the
Social Security Tax Fund.

,Blair Apartments and all other money and funds available

Blair Apartment Fund.

out of the money derived from the levy of taxes for Supervised
Recreation purposes for the fiscal year and out of all moneys
and funds available therefore, the amount for each object and
purpose as follows:
For salaries of employees, purchase of equipment,
maintenance of playgrounds, and recreation centers,
including the construction of necessary buildings $ 35;000.00
Any balance of said fund remaining over and unexpended
at the end of the fiscal year shall be transferred to the
Supervised Recreation Fund.
SECTION 16. That there be and hereby is appropriated
out of the money derived from the Federal Government for revenue
sharing, and out of all moneys available therefore, the amount
for each object and purpose as follows:
For .salaries of employees, maintenance, purchase of
equipment, and other expenditures that are authorized
by the Federal Revenue Sharing Act $140,000.00

AN ORDINANCE CREATING STREET IMPROVEMENT DISTRICT NO. 129 IN
THE CITY OF BLAIR, NEBRASKA, DECLARING THE NECESSITY THEREFOR,
DESIGNATING THE IMPROVEMENTS TO BE MADE IN SAID DISTRICT,
LISTING THE PROPERTY INCLUDED WITHIN SAID DISTRICT, PROVIDING

SECTION 1. The Mayor and City Council of the City,
of Blair, Nebraska, hereby declare and deem it necessary to
pave an unpaved gap in the street system of said City, the,
description of which is on Thirteenth Street from Jackson
Street to Park Street, and for said purpose there is hereby
created Street Improvement District No. 129 of the City of
Blair, Nebraska.

SECTION 2. The street improvement to be made is
to pave said street as aforesaid, the grade of said street
to conform to the existing grades, of said City of Blair, and
said improvement to be made according to plans and specifica-
tions.and estimate of cost to be prepared by the Special

and to be approved by the Mayor and Council of the City.
SECTION 3. The property included in said Street
Improvement District No. 129 and subject to special assess-
ments to pay for the cost and expenses of said street improve-
ment is all of the privately owned lots, parts of lots and
tracts of land and the lots, parts of lots and tracts of land
owned by any municipal or public corporation and abutting
upon and adjacent to said street to be improved, to -wit:

necessary for the transaction have been prepared and said

Section 2. That the City shall lease a parcel of
ground consisting of Lots 9, 10, 11, 12, 13, 14 and 15 in
Block 57 in the Original Townsite of the City of Blair,
Washington County,, Nebraska to the City of Blair Library
Building Corporation for a. term commencing October 1, 1975,
and ending October 1, 2000, and that the form of Lease
between the City, as Lessor, and said Corporation, as
Lessee, presented to this meeting be and hereby is approved.
Section 3. That the City should enter into a
Lease - Purchase Agreement with City of Blair Library Building
Corporation whereby said Corporation will construct on the
premises covered by the Lease described in Section 2 above
a library building and lease said premises and building to
the City of Blair, and that the Lease- Purchase Agreement
in the form presented to this meeting is approved.
Section 4. That the Mayor and City Clerk of the
City of Blair be and they hereby are authorized and
directed to execute and deliver on behalf of the City of
Blair said Lease and the Lease - Purchase Agreement, includ-
ing necessary counterparts, in substantially the form and
content as presented to this meeting, but with such changes
or modifications therein as to them seem necessary,
desirable or appropriate for and on behalf of the City of
Blair and affix the seal of the City thereto, and said
Mayor and City Clerk are further authorized and directed
to execute and deliver any other documents or certificates
and do all other things necessary or appropriate to carry
oit said agreements.
Section 5. The Mayor and Council of the City
of Blair do hereby approve the formation of City of Blair
Library Building Corporation, including the Articles of
Incorporation and Bylaws thereof, and the five Directors
thereof; and further approve the execution and delivery
of the Mortgage and Trust Indenture from said Corporation
to First National Banl.of Omaha, Nebraska, as Trustee,
under which $200,000 of Building Bonds, dated October 1,
1975, are to be issued; and the Mayor and Council of the
City do hereby approve the issuance of said Building Bonds
by. said Corporation.
Section 6. The Mayor and Council hereby state
that it is the intention of the Mayor and Council that the
interest on the $200,000 of Building Bonds issued by the
Corporation dated October 1, 1975, shall be excludable
from gross income under the Federal Income Tax by virtue
of Section 103 (a) (1) of the Internal Revenue Code of
1954, as amended, and Revenue Ruling 63. -20 issued there-
under, and the Mayor and City Clerk are authorized to take
all actions necessary or appropriate to carry out said
intention and obtain such interest exclusion.
Section 7. This ordinance shall be in full force
and effect from and after its passage'as provided by law.

PROVIDING FOR THE APPOINTMENT OF AN ELECTRICAL INSPECTOR;

HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE
AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF

SECTION 1. Section 9 -501 of the municipal code of
the City of Blair is hereby repealed.
SECTION 2. There is hereby added to the municipal
code of the City of Blair the following section, to -wit:
9 -501 ELECTRICAL CODE;' ADOPTED BY REFERENCE. To provide
certain minimum standards, provisions, and requirements for
safe and fire proof installation, methods of connection,
and uses of materials in the installation of electrical

wiring and appliances shall be as found in The National
Electrical Code, 1975 edition, as recommended by the National
Board of Fire Underwriters, printed in book or pamphlet
form, in addition to all amended editions as though printed
in Dull• herein. Three (3) copies of the Electrical Code
shall be on file at the office of the Municipal Clerk and
shall be available for public inspection at any reasonable
time.
SECTION 3. There is hereby added to the municipal
code of the City of Blair the following section, to -wit:
9 -502 ELECTRICAL INSPECTOR. The electrical inspector shall
be the municipal official who shall have the duty of
enforcing the National Electrical Code as adopted by the
City of Blair. He shall have all powers granted to the
building inspector in performance of his duties. The
electrical inspector shall have a thorough knowledge of the
National Electrical Code as adopted by'the City of Blair.
He shall have had wiring experience and shall otherwise be
competent to fulfill the duties of electrical inspector.
The building inspector and electrical inspector may be one
and the same person if the Mayor and Council determine
that the building inspector is qualified and competent to
fulfill the duties of electrical inspector.
SECTION 4. All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 5. This ordinance shall be in force and
take full effect from and after its passage, 'approval and
publication as provided by law.

AND PROVIDING WHEN THIS ORDINANCE SHALL TAKE FULL FORCE AND

SECTION 1. That Article I of Chapter 5 of the
Municipal Code of the City - of Blair, Nebraska, is hereby
amended to read as follows:
Article 1. Definitions
5 -101 Alley. The term "alleys' shall mean the
entire width between the property lines of every way or
place of whatever hature, when any part thereof, is open
to the use of the public as a matter of right for vehicular
traffic, when the entire width between property lines of
said way or place does not exceed twenty (20) feet.

5 -102 Alley Entrance. The term "alley entrance"
shall mean the extension of the.alley from the lot line to
the street curb line.
5 -103 Area. The term "area" shall mean the geo-
graphical boundaries within which an operating motorcycle or
operating motor - driven cycles can be heard.
5 -104 Authorized Emergency Vehicle. The term
"authorized emergency vehicle" shall mean vehicles of the
Fire Department and of the Police Department of the Munici-
pality and ambulances.
5 -105 Crosswalk. The term "crosswalk" shall mean
that portion of a roadway included within the prolongation
or connection of the lateral lines of sidewalks at inter-
sections.
5 -106 Curb. The term "curb" shall mean the
lateral boundaries of that portion of a street designated
for the use of vehicles whether marked by curb stones or
not so marked.
5 -107 Driver. The term "driver" shall mean
every person who drives or is in the actual: physical control
of a vehicle.
5 -108 Intersection or Street Intersection. The
terms "intersection's or "street intersection" shall mean
the space occupied by two (2) streets at the point where
they cross each other, bounded by the lot lines extended
and shall include the sidewalk space as well as the roadway.
5 -109 Motorcycle. The term
mean every motor vehicle having a seat
of the rider and.designed to travel on
wheels in contact with the ground, but
"motorcycle" shall
or saddle for the use
not more than three (3)
excluding a tractor.
5 -110 Motor -Drive Cycle. The term "motor -
driven cycle" shall mean every motorcycle including every
motor - scooter propelled by a motor, and every bicycle with
motor attached.
5-111 Motor Vehicle. The term "motor vehicle"
shall mean every vehicle which is self- propelled.
5 -112 Non- resident. The term "non - resident"
shall include every person who is not a resident of the
State of Nebraska.
5 -113 Non - resident's Operating Privilege. The
term "non - resident's operating privilege" shall mean the
privilege conferred upon a non - resident by the laws of the
State • of Nebraska pertaining to the operation by such person
of a motor vehicle, or the use of a vehicle owned by such
person, in the State of Nebraska.
5 -114 Official Traffic Signs. The term "official
traffic signs" shall mean all signs, markings, and devices,
other than signals, not inconsistent with this chapter,
placed or erected by authority of the Governing Body for
the purpose of directing, warning, or regulating traffic.
5 -115. Operator. The term "operator" shall
include every person who shall operate or be in actual
physical control of a vehicle as the owner thereof, or as
the agent, employee, or licensee of the owner thereof.

5 -116 Person. The term "person" shall mean
every natural person, firm or corporation, co- partnership
or. association.
5 -117 Private Driveway. The term "private
driveway" shall mean :every road, or driveway not open to
the use of the public for purposes of vehicular travel,
including driveways into gasoline filling stations and
public garages.
5 -118 Racing of Motor. The term "racing of
motor" shall mean sudden acceleration or deceleration of
the motor of a motor vehicle.
5 -119 Right -of -way. The term "right-of-way"
shall mean the privilege of the immediate use of the roadway.
5 -120 Sidewalk Space. The term "sidewalk space"
shall mean that portion of a street between the curb lines
and the adjacent property lines.
5 -121 Stop. The term TTstopTT shall mean to cause
complete cessation of movement of a vehicle which is occupied
by at least one (1) person.
5 -122 Stop Signs. The term "stop sign" shall
mean any object placed in any street at or near a street
intersection with the word "stop" written, or inscribed
thereon.
5 -123 Street or Highway. The term "street" or
"highway" shall mean the entire width between property
lines of every way or place of whatever nature, when any
part thereof is open to use of the public as arrmatter of
,right for purposes of vehicular traffic.
5 -124 Stunting. The term "stunting" shall mean
operating a vehicle in a manner causing it to weave or
suddenly change course, or the loss of body contact with the
seat by a driver or passenger, and not for the purpose of
safe operation of such vehicle.
5 -125 Touring. The term "touring" shall mean
any repetitious driving in the same area which causes a
disturbance.
5 -126 Traffic. The term "traffic" shall mean
pedestrians, ridden or herded animals, vehicles and other
conveyances, either singly or together, while using any
street, alley, or public way for purposes of travel.

5 -127 Truck. The term "truck" shall mean a
motor vehicle equipped or used to transport anything other
than persons. (Ref. 39- 602(109) RS Neb.)
5 -128 Vehicle. The term "vehicle" shall mean
every device in, upon, or by which any person or property
is or may be transported or drawn upon a street, and shall
be deemed to include wagons, trucks, horses whether led,
driven, or ridden, automobiles, motorcycles, bicycles,
tricycles, sleighs, steam, or gasoline tractors, buses,
scooters, snowmobiles, and all other conveyances for persons
or property, except railway trains running upon their own
rails or tracks.

SECTION 2. Be it further ordained by the Mayor
and Council of the City of Blair, Nebraska, that, the follow-
ing section is hereby added to the Municipal Code of the
City of Blair, to-wit:
5-508 Operation of Motorcycles or Motor-Driven
Cycles Upon a Public Street. It shall be unlawful for any
person, corporation, partnership or other legal entity to
operate or cause to be operated a motorcycle or motor-
driven cycle upon any street within the corporate limits
of the City of Blair except in compliance with the following:
1. The operator of such vehicle shall have upon
his or her possession a valid driver's license issued by
the State of Nebraska (or if such operator is a non-resident,
such operator shall have upon his or her possession evidence
of a non-resident's operating privilege) and which has not
been suspended, limited, or cancelled.
2. Such vehicle shall at such time of operation
be capable of performing in accordance with the standards
then fixed by the Motor Vehicle Laws of the State of Nebraska
and by the Ordinances of the City of Blair.
3. The operator shall operate said vehicle in
accordance with the Motor Vehicle Laws of the State of
Nebraska and Ordinances of the City of Blair.
4. Such vehicle shall be equipped with an exhaust
system, including muffler, in good working order, sufficient
to prevent excessive or unusual noises.
5. Before operating a motorcycle or motor-
driven cycle upon a public street the operator thereof shall
have first become sufficiently proficient in the operation
thereof to control said vehicle without unreasonable danger
to others; and if said vehicle is rented, leased, or borrowed
from another, said operator shall first have demonstrated
to the lessor, renter, or lender of such equipment that he
or she is sufficiently proficient to operate such vehicle
upon a public street without unreasonable danger to others.
6. No person under 18 years of age shall purchase,
rent, lease, or borrow a motorcycle or motor-driven cycle
unless he or she has first obtained written consent from
either of his or her parents, or his or her legal guardian;
and no such person under 18 years of age shall take pos-
session of and operate any motorcycle or motor-driven
cycle unless on the occasion of such purchasing, or on
the first occasion of such renting, leasing, or borrowing of
such motorcycle or motor-driven cycle such person under
18 years of age obtains and files with such seller, renter,
lessor, or lender an acknowledgment in writing, signed by
either parent of such minor or such minor's legal guardian,
in the presence of and witnessed by such lessor, renter,
or lender, or his duly authorized agent, to the effect that
permission is granted for such child to purchaseauvehicle,
or the rent, lease, or borrow a motorcycle or motor-driven
cycle from such renter, lessor, or lender, and that such
parent or guardian consents to such sale, and/or consents
to the renting, leasing; or lending of a motorcycle or
motor-driven cycle to such child and assumes full legal
responsibility for acts or actions of such child in the
operation of any such motorcycle or motor-driven cycle
then or thereafter sold, rented, leased or lent to such
child; and such responsibility and committment of such
parent or guardian shall continue until it is revoked in
writing by either parent or by said guardian by written
instrument delivered to such seller, lessor, renter, or
lender.

7. No motorcycle or motor - driven cycle shall be
operated in such a manner that it carries more than one
passenger in addition to the operator.
8. Not more than two motorcycles or motor -
driven cycles shall be operated side by side'ubbn any
street..
9. No motorcycle or motor - driven cycle shall be
driven on any sidewalk in. Blair, Nebraska.
10. No motorcycle or motor - driven cycle shall be
operated in any manner so as to cause a disturbance in any
area of the city. Touring, stunting, or racing of motors
are prohibited in any hospital or nursing home area, and
in residential areas.
11. No operator of a motorcycle or motor - driven
cycle shall engage in maneuvers, stunting' or other opera-
tions dangerous to himself or his passenger `or to the
persons or property others; and except, when done for
the better control of a vehicle, in emergencies or to
maneuver {rough passages of a street, an operator must at
all times keep body contact with the saddle or seat of such
vehicle.
12. No person shall operate a motorcycle or
motor - driven cycle having handle -grips more than 18 inches
ab the mounting point, but in no case to exceed shoulder
i eight .
SECTION 3. In the event any provision or portion
of this ordinance should be held invalid, theri .. remaining
provisions shall remain in full force and effect.
SECTION 4. This ordinance shall take effect and
be in force from and after its passage, approval, and pub-
lication as required by law.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. A petition . signed by the owners of more
than three - fourths of the lots of land abutting upon the
streets to be improved as hereinafter set forth, petitioning
for the improvement of the following described streets in the
City of Blair, Nebraska: On Front Street in the City of Blair,
Nebraska, from Tenth Street, East to the East end of said
Front Street adjacent to Lot Ten (10) in K -Span Industrial
Park Subdivision in the City of Blair, by Paving the same,
having been presented and filed with the City Clerk, there is
hereby created Street Improvement District No. 129 of the
City of Blair, Washington County, Nebraska.
SECTION 2. The street improvements to be made on
said streets in said district shall be to pave the same, the
grade of said streets to conform to the grades as established
by the City of Blair and said improvements to be made accord-
ing to plans and specifications and estimate of cost to be
prepared by the Special Engineer for said district and to be
filed with the City Clerk and to be approved by the Mayor
and City Council of said "City.
SECTION 3. The property included in said Street
Improvement District No. 129 and subject to special assess-
ments to pay for the cost and expenses of said street improve-
ment is all of the privately owned lots, parts of lots and
tracts of land and the lots, parts of lots and tracts of land
owned by any municipal or public corporation and abutting
upon and adjacent to said streets to be improved, to -wit:
Lots One (1) through Ten (10), inclusive, in K -Span Industrial
Park Subdivision in the City of Blair, and Tax Lot One Hundred
Eighty -Four (184) in Section Twelve (12), Township Eighteen
(18) North, Range Eleven (11), East of the Sixth Principal
Meridian, all in Washington County, Nebraska.
SECTION 4. The cost of said improvements in said
Improvement District shall be paid out of the fund created
by the levy and assessments on the lots and parcels of land
in said Street Improvement District benefited thereby in
proportion to said benefits, all as by the Statutes of the
State of Nebraska in such cases made and provided.?
SECTION 5. This ordinance shall take effect and
be in force from and after its passage, approval and publica-
tion as provided by law.

AN ORDINANCE PROVIDING FOR THE CONSTRUCTION DEDICATION AND
ACCEPTANCE OF FRONTAGE STREETS IN THE CITY OF BLAIR; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR NEBRASKA
SECTION 1. That there is hereby added to Section
12 -102 of the municipal code of the City of Blair to be inserted
in proper alphabetical order the following definition, to -wit:
Street, Frontage. A street which is intended to provide ingress .
and egress to abutting properties where access cannot be
obtained directly to each individual property from a street or
federal highway. This term shall be used interchangeably with
the term "parallel accesses."
SECTION 2. There is hereby added to Section 12 -403
of the municipal code of the City of Blair the following sub -
section, to -wit: "W. Frontage Roads. Pavement widths of
frontage roads shall be not less than 20 feet. Frontage roads
shall be considered on an individual basis by the Planning
Coyiunission and the Mayor and City Council Where said bodies
deem it necessary, said bodies may require additional dedication
of 5, feet of right -of -way for snow removal or other purposes,
and in addition said bodies may require curbs to be constructed
as a part of the surfacing on one or both sides of said frontage
roads. In considering the acceptance of the dedication of all
frontage roads, said bodies shall specifically take into account
traffic patterns in the area and any additional traffic hazards
that may result from the acceptance of the dedication of a
frontage road."
SECTION 3. All ordinances or parts of ordinances

836.26 FEET OF TAX LOT ONE HUNDRED SIXTY -TWO (162) IN SECTION

the North 836.26 feet of Tax Lot One Hundred Sixty -Two (162) in
Section Thirteen (13), Township Eighteen (18) North, Range
Eleven (11), East of the Sixth Principal Meridian in Washington
County, Nebraska, have indicated to the Mayor and City Council
of the City of Blair their desire that said territory which is
contiguous to the City of Blair be annexed to, said City, which
said request was accompanied by a plat of said territory to
be annexed certified by a competent surveyor.
SECTION 2. That the Mayor and City Council of the
City. of Blair find that the land described hereinabove is
urban or suburban in characted and not agricultural in character.
SECTION 3. That a majority of the City Council of
the City of Blair voted in favor of said annexation.
SECTION fit-. That the tract of land described herein
be and the same hereby is annexed to the City of Blair, Nebraska.
SECTION 5. The limits of the City of Blair, Nebraska,
are hereby extended to include this said territory.
SECTION 6. All ordinances or parts of ordinances

NANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE
SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. Section 11 -1001 of the. Municipal Code of
the City of Blair is hereby amended to read as follows:
11 -1001 BOARD OF ADJUSTMENT; CREATION. A Board of Adjustment
is hereby created consisting of five (5) regular members, plus
one additional member designated as an alternate who shall
attend and serve only when one of the regular members is unable
to attend for any reason, each to be appointed for a term of
three (3) years and removable for cause by the appointing

authority upon written charges and after public hearings.
Vacancies shall be filled for the unexpired term of any member
whose term becomes vacant. One (1) member only of the Board
of Adjustment shall be appointed from the membership of the
Planning Commission, and the loss of membership on the Planning
Commission by such member shall also result in his immediate
loss of membership on the Board of Adjustment and the appoint -
meht of another Planning Commission member to the Board of
Adjustment. The Board of Adjustment shall adopt rules in
accordance with the provisions of this Chapter. Meetings of
the Board shall be held at the call of the Chairman and at
such other times as the Board may determine. Such Chairman,
or in his absence the acting Chairman, may administer oaths
and compel the attendance of witnesses. All meetings of the
Board shall be open to the public. The Board shall keep
minutes of its proceedings, showing the vote of each member
upon each question, or, if absent or failing to vote, indicat-
ing such fact, and shall keep records of its examinations and
other official actions, all of which shall be immediately
fled in the office of the Municipal Clerk and shall be a
public record.
