2001-1BLAIR AIRPORT AUTHORITY RESOLUTION NO. 2001 - 1 BOARD MEMBER HAVEKOST INTRODUCED THE FOLLOWING RESOLUTION: WHEREAS, pursuant to Resolution No. 1993-22 of the City of Blair, Nebraska, the Blair Airport Authority has the full and exclusive jurisdiction and control over all facilities owned or thereafter acquired by such City for the purpose of aviation operation, air navigation, air safety operation, including, but not limited to, the following described real estate, to -wit: Tax Lot 86 and Tax Lot 88 in Section 27, Township 19 north, Range 11 East of the 6" P.M., Washington County, Nebraska; Tax Lot 60 in Section 27, Township 19 North, Range 11 East of the 61" P.M., Washington County, Nebraska; Tax Lot 63 in Section 34, Township 19 North, Range 11 East of the 6`' P.M., Washington County, Nebraska; and, Part of Tax Lot 74 lying in the E 1 /2 S W 1 /4 of Section 27, Township 19 North, Range 11 East of the 61" P.M., Washington Colony, Nebraska, and more particularly described as follows: From the S1/4 Corner of said Section 27, T 19 N, R 11 E; thence N 00°00'00" E (assumed bearing) along the North -South 1/4 Section line a distance of 1590.55 feet to the centerline of North Creek as said Creek is now located, said Point being the Point of Beginning; thence along said Creek centerline as follows N 64°40'03" W a distance of 11.95 feet; S 71 °45'50" W a distance of 43.96 feet; S 00°36'44" E a distance of 85.08 feet; thence S 66°43'00" W a distance of 62.84 feet; S 87 ° 3 8' 16" W a distance of 43.24 feet; thence along the old creek centerline as said North Creek was previously located as follows: N 52°38'00" W a distance of 119.95 feet; S 49°28'00" W a distance of 169.35 feet; N 84°08'00" W a distance of 90.50 feet; N 33 ° 16'00" W a distance of 148.30 feet; S 31'47,00" W a distance of 194.20 feet; S 11 °41'00" W a distance of 206.30 feet; S 24°32'00" E a distance of 167.95 feet; S 32°26'00" W a distance of 82.38 feet to a point on the easterly right-of-way line of U.S. Highway No. 75; thence northerly along said easterly R.O.W. line along a 11,534.16 foot radius curve to the left an arc distance of 1063,72 feet (said curve having a chord bearing N 18°22'12" W and a chord distance of 1063.35 feet) to a point 33.00 feet south of the centerline of County Road No. P-313 as said road is now traveled; thence N 89°50'33" E parallel to and 33.00 feet south of said traveled county road centerline a distance of 1001.61 feet to a point on the North -South 1/4 line of said Section; thence S 00°00'00" W along said N-S 1/4 Section Line a distance of 398.14 feet to the Point of Beginning; and Airport Authority's interest, if any, in Tax Lot 77 in Section 27, Township 19 North, Range 11 East of the 61" P.M., Washington County, Nebraska, the same being abandoned railroad right-of-way, (all of the above collectively referred to as "Subject Property"). WHEREAS, the Blair Airport Authority retained the services of Nelsen Appraisal Services, Inc. of Blair, Nebraska, to appraise the Subject Property, and that the appraised fair market value is in the sum of Two Hundred Thirty Six Thousand Dollars ($236,000.00). WHEREAS, the Blair Airport Authority and the City of Blair, Nebraska have received an offer to purchase such real estate from 3 Diamonds, LLC in the amount of Two Hundred Thirty Six Thousand Dollars ($236,000.00). NOW, THEREFORE, BE IT RESOLVED by the Board Members of the Blair Airport Authority that the Blair Airport Authority agrees to surrender the use and occupancy of the Subject Property to the City of Blair, Nebraska, subject to and contingent upon the following terms: A. That the City of Blair agrees to enter into an interlocal agreement with the Blair Airport Authority whereby the City of Blair agrees to pay over to the Blair Airport Authority the entire sale proceeds from the sale of the Subject Property; and B. That cash or certified funds are tendered in the amount of $236,000.00 by 3 Diamonds, LLC at time of closing of the real estate transaction; and, C. That the purchaser of the Subject Property agrees to execute and deliver a Covenant of Restrictions in form satisfactory to the City of Blair specifying that the Subject Property will be utilized as a golf course for a period of years to be determined by the City of Blair, Nebraska. BOARD MEMBER MEYER MOVED THAT THE RESOLUTION BE ADOPTED AS READ, WHICH SAID MOTION WAS SECONDED BY BOARD MEMBER JOHNSON. UPON ROLL CALL, BOARD MEMBERS Havekost, Van Slyke, Meyer, Johnson VOTING"AYE", AND BOARD MEMBERS None VOTING "NAY", THE CHAIRMAN DECLARED THE FOREGOING RESOLUTION PASSED AND ADOPTED THIS 7TH DAY OF FEBRUARY, 2001.
