2003-03RESOLUTION NO. 200 3 - ;3 BE IT RESOLVED BY THE CHAIRMAN AND BOARD MEMBERS OF THE AIRPORT AUTHORITY FOR THE CITY OF BLAIR, NEBRASKA, AS FOLLOWS: RESOLVED THAT on or about October 29, 2002, a public hearing was held by the Airport Authority for the City of Blair, Nebraska ("hereinafter referred to as "Airport Authority") regarding the nature of and necessity for the proposed expansion project for the Airport Authority located on Highway 133 south of Blair, Nebraska, and that at such hearing, no objections were heard to the proposed project. RESOLVED THAT the Airport Authority has submitted plans and specifications of the proposed expansion project to the Federal Aviation Administration ("FAA") and the State of Nebraska Department of Aeronautics ("State of Nebraska") for review and input and has also been approved for State and Federal funding for a large portion of said proposed expansion project. RESOLVED THAT at the regular monthly meeting of the Airport Authority held on November 19, 2002, the Airport Authority affirmed and approved the provisions and specifications for such expansion project and authorized the staff, representatives, employees and agents of the Airport Authority to proceed with implementing the expansion project and authorizing entering into negotiations involving the acquisition of rights or interests in real estate required for such expansion project. WHEREAS, under Nebraska law, the Airport Authority is authorized to close any roads, streets, parkways, avenues, or highways as may be necessary or convenient to facilitate the construction or operation of a project and that in furtherance of the plans and specifications of the Airport Authority expansion project, it will be necessary for the Airport Authority to close a portion of County Road P38; and furthermore that the Airport Authority after extensive investigation and study finds that the closure of the portion of said county road, in association with the proposed acquisition of real estate adjacent thereto, will not create an undue hardship to the general public or any specific individuals and that it would be in the public good and safety to close a portion of said county road, as described in the plans and specifications. RESOLVED THAT the staff, representatives, employees and agents of the Airport Authority are hereby authorized and empowered to proceed with all reasonable steps necessary to begin the process required to close that portion of said County Road, described in the plans and specification of the expansion project, it being understood that as part of said closure process, that the County Board of Washington County, Nebraska shall be advised at least ninety (90) days prior to the date of said closure. BE IT FURTHER RESOLVED THAT the staff, employees, agents and representatives of the Airport Authority be and hereby are authorized to contact the Washington County Board of Supervisors to explain the terms and specifications of the expansion project, including but not limited to the proposed closure of a portion of said county road and to work with the County Board of Supervisors to implement the closure process in a reasonable and prudent manner. BOARD MEMBER HAVEKOST MOVED THAT THE RESOLUTION BE ADOPTED AS READ, WHICH SAID MOTION WAS SECONDED BY BOARD MEMBER COMBS UPON ROLL CALL, BOARD MEMBERS COMBS, HAVEKOST, JOHNSON, MEYER VOTING "AYE", AND BOARD MEMBERS NONE VOTING "NAY", THE CHAIRMAN DECLARED THE FOREGOING RESOLUTION PASSED AND ADOPTED THIS 21st DAY OF JANUARY, 2003.
