19733035 OPENING The Mayor and Council of the City of Blair, Washington County, Nebraska, met in regular session in the Council Chambers at 7:30 o'clock P.M. Mayor Sick presided at the meeting and City Clerk, k L. W. .Svendgaard, recorded the proceedings of the meeting. ROLL CALL ORDER OF BUSINESS Whereupon the Mayor announced that the introduction - of ordinances was now in order. It was moved by Councilman Pounds and seconded by Councilman Jenny that the minutes of the proceedings of the Mayor and Council in the matter of the passage and approval of Ordinance No. 1073 be preserved and kept in a separate and distinct volume known as the Ordinance Record of the City of Blair, Nebraska, and that said volume be incorporated in and made a part of these proceedings the sane as though spread at large therein. ORDINANCE NO. 1073 Introduction of Ordinance No. 1073 of the City of Blair, Nebraska and the matter now coming before the Mayor and Council was the passage and approval of Ordinance No. 1073 of the City of Blair, Nebraska. This Ordinance No. 1073 was introduced by Council- man Allen and is in words and figures as follows: ORDINANCE NO. 1073 AN ORDINANCE PROHIBITING THE OWNERS OR OPERATORS OF FILLING STATIONS AND THE OWNERS OR OPERATORS OF BUSINESS ESTABLISHMENTS PROVIDING PROVATELY OWNED PARKING TO BE USED BY THE PUBLIC WITHIN THE LIMITS OF THE CITY OF BLAIR, NEBRASKA FROM PUSHING SNOW ONTO THE PAVED PORTIONS OF THE STREETS OR ALLEYS OF SAID CITY; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA: SECTION 1. It shall be unlawful for the owner or operator of any filling station and for the owner or operator of any business providing privately owned parking for the general public within the limits of the City of Blair, Nebraska to remove or cause to be re- moved snow from said areas which isfpushed onto the paved portion of the streets or alleys of said City. SECTION 2. Any person, firm, or corporation who shall violate this ordinance shall be deemed guilty of a misdemeanor and shall be fined in any sum not in excess of $100.00. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. This Ordinance No. 1074 was introduced by Council- man Jensen and is in words and figures as follows: AN ORDINANCE ESTABLISHING CLOSING HOURS FOR THE BLAIR CITY PARK; DECLARING IT UNLAWFUL TO LOITER IN SAID PARKS DURING CLOSING HOURS; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA: SECTION 1. OF THE MUNICIPAL CODE OF THE CITY OF BLAIR, NEBRASKA, AND REPEALING ORDINANCE NO. 1050. IN THE CITY OF BLAIR, NEBRASKA; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA, WASHINGTON COUNTY. SECTION 1. That Section 1 -502 of the Municipal Code of the City of Blair, Nebraska, be and the same hereby is amended to read as follows: "Ordinances, resolutions, or order for the appropriation of money shall require for their passage the concurrence of the majority of the members elected to the Governing Body. This Ordinance No. 1092 was introduced by Councilman Nelson and is in words and figures as follows: AN ORDINANCE CREATING DOWNTOWN IMPROVEMENT AND PARKING DISTRICT NO. 1 IN THE CITY OF BLAIR, NEBRASKA; DESIGNATING THE IMPROVE- MENTS TO BE MADE IN SAID DISTRICT; PROVIDING FOR THE INITIAL RATE OF TAX IN SAID DISTRICT; LISTING THE PROPERTY INCLUDED IN SAID. DISTRICT; PROVIDING FOR THE MANNER OF PAYMENT OF THE IMPROVEMENTS MADE THEREIN; AND'PROVIDING WHEN SAID ORDINANCE SHALL TAKE EFFECT. WHEREAS, on the 10th day of July, 1973, a resolution was adopted by the Mayor and City Council of the City of Blair, Nebraska, declaring the intention of said body to create a Downtown Improvement and Parking District pursuant to the laws of the State of Nebraska embodied in the Downtown Improvement and Parking District Act of 1969, and, WHEREAS, said resolution provided that a public hearing be held to consider the establishment of such a district on the 31st day of July, 1973, at the hour of 7:30 o'clock, P.M., and, 3135 WHEREAS, proper notice for said hearing was given by publication and mailing all as provided by law, and, WHEREAS, said hearing has been held and the City Council has heard all protests and evidence for and against the creation of said district and has duly considered the same, NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1. There is hereby created Downtown Improve- ment and Parking District No. 1 of the City of Blair, Nebraska. SECTION 2. The boundaries of Downtown Improvement and Parking District No. 1 are hereby fixed and described as follows: Beginning at the intersection of the center line of the right -of -way of.l9th Street with the center line of the right -of -way of Lincoln Street; thence North along the center line of the East -West right -of -way of Front Street; thence East along said center line of Front Street to its intersection with the center line of the North -South right-of-way of 15th Street; thence South along the center line of 15th Street to its intersection with the center line of the East -West right- of-way of Lincoln Street; thence West along said center line of Lincoln Street to the point of beginning, all in the City of Blair, Washington County, Nebraska. SECTION 3. The businesses and professions within the area established by this ordinance shall be subject to the provisions of the additional tax provided by Sections 19 -3401 to 19 -3420 RRS Nebraska 1943, as amended, and the area upon which said occupation and license tax would be imposed are those lots or parts of lots which are presently used for business purposes located in Blocks Forty -four (44), Forty -five (45), Forty -six (46) , Forty -seven (47) , Thirty -six . (36) , Thirty - seven (37) , Thirty -eight (38) and Thirty -nine (39) in the City of Blair, Washington County, Nebraska. SECTION 4. No general license and occupation tax shall be imposed or established at this time so that there is no initial rate of tax to be imposed, but at such time as said tax is established, it shall be fair and equitable and uniform as to class and shall be based primarily on the square footage of the owner's and user's place of business or professional office space. SECTION 5. An occupation and license tax and the rate of said tax may be established and imposed only after the adop- tion of a resolution of intention which shall set forth a date of public hearing on said tax and shall be published according to law, and no tax shall be imposed until the Mayor and City Council have been presented with a petition signed by 51% of the users of the square foot taxable space in said district approving the overall plan of improvement, estimate of cost and the proposed initial rate of tax in said district, all of which shall have been previously approved by the Mayor and City Council as provided by law. It is further provided that when circulated and when presented to the Mayor and City Council said petition shall have attached to it a copy certified by the City Clerk of said plans, estimate of costs and proposed initial rate of tax as approved by the Mayor and Council. SECTION 6. The uses to which the.additional revenue to be raised by said general license and occupation tax shall be for the planning, construction and maintenance of improve- ments to the benefit of the general public in said Downtown ATTEST: L. It was moved by Councilman Jenny and seconded by Councilman Nelson that the minutes of the proceedings of the Mayor and Council in the matter of the passage and approval of Ordinance No. 1105 be preserved and kept in a separate and distinct volume known as the Ordinance Record of the City of Blair, Nebraska, and that said volume be incorporated in and made a. part of these proceedings the same as though spread at large therein. ORDINANCE NO. 1105 Introduction of Ordinance No. 1105 of the City of Blair, Nebraska, and the matter now coming before the Mayor and Council was the passage and approval of Ordinance No. 1105 of the City of .Blair, Nebraska. This Ordinance No. 1105 was introduced by Councilman Nelson and is in words and figures as follows: ORDINANCE NO. 1105 AN ORDINANCE PROHIBITING THE CARRYING, POSSESSING OR TRANS- PORTING OF FIREARMS UNLESS SAID FIREARMS ARE UNLOADED AND BROKEN DOWN OR UNLOADED AND CONTAINED IN AN'ENCLOSED GUN CASE AND PROVIDING FOR CONFISCATION OF SAID FIREARMS SUB- SEQUENT TO CONVICTION HEREUNDER, - ENUMERATING SECTION NUMBERS OF SAID - PROVISIONS; REPEALING ALL ORDINANCES. OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT. •• BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1. There is hereby added to the Municipal Code of the City of Blair the following section to be enumerated as Section 6 -349 of said Code: 1 t6 -34.9 FIREARMS- POSSESSION- TRANSPORTATION- WHEN ALLOWED. It shall be unlawful for any person, except an authorized law enforcement officer, purposely, or knowingly to ATTEST: 3204 transport in any conveyance or in any other manner whatsoever, or to possess,off of his own premises, any rifle, shotgun, air gun, air rifle, or hand gun, provided that "b-b" guns shall not be included in the designation air gun or air rifle, unless it is unloaded and contained in an enclosed gun case, or unloaded and broken down. The removal of the bolt from any such firearms, or carrying any such firearm in a holster - type gun case without 'further breaking down such firearm, shall not be deemed. to be a compliance with the requirements of this Section. The provisions of this Section shall not be construed to apply to the Armed Forces of the United States, including R.O.T.C. units and the National Guard in the performance of their official duties. Nor shall the provisions of this Section be construed to prevent carrying unloaded and uncased rifles in parades or using rifles in ceremonials, or to prevent possession of rifles or shotguns at shows, or exhibits, or for other lawful use, ,purpose or activity, including but not limited to skeet and trap shooting, target shooting at rifle ranges, hunter safety instruction conducted by qualified instructors, when such do .. not endanger public safety or are detrimental to public welfare, provided the prior approval of the Public Safety Director of the City of Blair shall have been obtained for such use, purpose or activity.?? SECTION 2. There is hereby added to the Municipal Code of the City of Blair the following section to be enumerated as Section 6 -550 of said Code: TT6 -550 CONFISCATION OF FIREARMS. In addition to imposing any of the penalties provided for in Section 6 -401 of the Blair Municipal Code, the Court may order confiscation of any firearm enumerated in Section 6 -349 of this Chapter as a part of the judgment of conviction of any person convicted of violating the provisions of this Chapter." This Ordinance No. 1106 was introduced by Councilman Pounds and is in words and figures as follows: ORDINANCE NO. 1106 AN ORDINANCE AMENDING SECTION 1 -805 OF THE MUNICIPAL CODE OF THE CITY OF BLAIR, BY PROVIDING FOR THE METHOD BY tHICH CANDIDATES FOR MUNICIPAL OFFICES MAY FILE FOR ELECTION; AMENDING SECTION 1 -806 OF THE MUNICIPAL CODE OF THE CITY OF BLAIR, BY PROVIDING THAT PETITIONS MUST BE FILED AT LEAST SIXTY (60) DAYS PRIOR TO THE STATEWIDE PRIMARY ELECTION; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1. Section 1 -805 of the Municipal Code of the City of Blair is hereby amended to read as follows: "1 -805 ELECTIONS; DIRECT FILING. Candidates for municipal offices are authorized to file for election directly with the City Clerk. Said filing must take place at least sixty (60) days prior to the date of the statewide primary election and must be in such form and manner as provided in 32 -535 RRS Nebr. 1943 as amended." SECTION 2. Section 1 -806 of the Municipal Code of the City of Blair is hereby amended to read as follows: "1 -806 ELECTIONS; PETITION CANDIDATES. Candidates for any municipal office in the City may be nominated by petition. Such petitions shall be signed by registered voters equal in number to 5% of the votes cast in the City or Ward at the most recent municipal election. The form of such petition shall be prescribed by the Secretary of State of the State of Nebraska, shall be filed with the City Clerk, and the deadline for filing such petitions shall be sixty (60) days prior to the statewide primary election. Within twenty -four (24) hours after the receipt for filing of a petition for nomination, the City Clerk shall notify by either registered or certified mail, the candidate so nominated, who shall, within five (5) days from the filing of such petition for nomination, file with said officer his acceptance of the petition for nomination, or his name shall not be printed on the election ballot unless otherwise provided by law."
