The Mayor and Council of the City of Blair, Washington
County, Nebraska, met in regular session in the Council Chambers
at 7:30 o'clock P.M. Mayor Sick presided at the meeting and City

Introduction of Ordinance No. 1073 of the City of Blair,
Nebraska and the matter now coming before the Mayor and Council
was the passage and approval of Ordinance No. 1073 of the City of
Blair, Nebraska. This Ordinance No. 1073 was introduced by Council-
man Allen and is in words and figures as follows:
ORDINANCE NO. 1073
AN ORDINANCE PROHIBITING THE OWNERS OR OPERATORS OF FILLING STATIONS
AND THE OWNERS OR OPERATORS OF BUSINESS ESTABLISHMENTS PROVIDING
PROVATELY OWNED PARKING TO BE USED BY THE PUBLIC WITHIN THE LIMITS OF
THE CITY OF BLAIR, NEBRASKA FROM PUSHING SNOW ONTO THE PAVED PORTIONS
OF THE STREETS OR ALLEYS OF SAID CITY; PROVIDING PENALTIES FOR THE
VIOLATION THEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN
FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
WASHINGTON COUNTY, NEBRASKA:
SECTION 1. It shall be unlawful for the owner or operator of
any filling station and for the owner or operator of any business
providing privately owned parking for the general public within the
limits of the City of Blair, Nebraska to remove or cause to be re-
moved snow from said areas which isfpushed onto the paved portion
of the streets or alleys of said City.
SECTION 2. Any person, firm, or corporation who shall
violate this ordinance shall be deemed guilty of a misdemeanor
and shall be fined in any sum not in excess of $100.00.
SECTION 3. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4. This . ordinance shall be in force and take full effect
from and after its passage, approval and publication as provided by
law.

AN ORDINANCE ESTABLISHING CLOSING HOURS FOR THE BLAIR CITY PARK;
DECLARING IT UNLAWFUL TO LOITER IN SAID PARKS DURING CLOSING HOURS;
PROVIDING PENALTIES FOR THE VIOLATION THEREOF; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING

Blair, Nebraska, are hereby established and said Parks shall

any City Park during closing hours.

SECTION 1. Section 1 -208 to 1 -213 inclusive, of the
Municipal Code of the City of Blair, Nebm ska, establishing
a police magistrate court and police magistrate for the
City of Blair, Nebraka, are hereby declardd obsolete and
inapplicable to municipalities in the State of Nebraska,
because the statutes of the State of Nebraska have abolished
said courts and the position of police magistrate.
SECTION 2. Section 1 -208 to 1 -213 inclusive, of the
Municipal Code of the City of Blair, Nebraska, are hereby
repealed.

CODE OF THE CITY OF BLAIR, NEBRASKA, AND REPEALING ORDINANCE NO.
1050. IN THE CITY OF BLAIR, NEBRASKA; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN
THIS ORDINANCE SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA, WASHINGTON COUNTY.
SECTION 1. That Section 1 -502 of the Municipal Code of the
City of Blair, Nebraska, be and the same hereby is amended to
read as follows: "Ordinances, resolutions, or order for the
appropriation of money shall require for their passage the
concurrence of the majority of the members elected to the
Governing Body. Ordinances of a general or permanent nature
shall be read by title onrthree (3) different days, except
as 'provided in Section 1- 503." (Ref. 16 -404. RS Nebraska) .

SECTION 2. That Section 1 -503 of the Municipal Code of the
City of Blair, Nebraska, be and the same hereby is amended
to read as follows: "Ordinances shall be passed and approved
in, the manner specified in Section 1 -502, provided however,
that this requirement may be suspended by three - fourths
majority vote of the Council and in such case said Ordinances
may then be read by title and number one time and then moved for
final passage. A Three - fourths vote of the Council may require
an Ordinance to Joe read in full before final passage under
either process."
SECTION 3. Ordinance No. 1050 of the City of Blair, Nebraska,
which was passed and approved April 25, 1972, is hereby
repealed.
SECTION 4. All Ordinances or parts, of Ordinances in conflict
herewith are hereby repealed.
SECTION 5. This Ordinance shall be in force and take full
effect from and after its passage, approval and publication
as provided by law.

SECTION,l. There is hereby created a Black Elk - Neihardt
Park Board the purpose of which shall be to oversee and
maintain on behalf of the City of Blair, Nebraska, the
proposed Black Elk - Neihardt Monument and Park, which said
Board shall consist of seven (7) members to be known as
Directors.

SECTION 2. The said Directors shall have been residents
of the City of Blair for a period of not less than one (1)
year and. said Board shall act without compensation. The
term of office of each Director shall be three (3) years.
Within ten (10) days after their appointment, the Directors
shall meet and organize said Board by the election from
among their number of a President, Vice President and a
Treasurer of the Board, and shall elect a Secretary who
teed not be a member of the Board. Any two of the offices
except the President and Vice President may be had by
one Director. The Board shall from time to time adopt
'rules and regulations to effectuate the purposes of said
Board. A majority of such Board shall constitute a quorum.
SECTION 3. The Black Elk - Neihardt Park Board shall keep
a record of its transactions, orders, notices and actions,
which record shall be filed with the City Clerk and shall
be part of the City Records and shall be available to the
public.
SECTION 4. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION 5. This ordinance shall be in force and take full

PROVIDING FOR THE MANNER OF PAYMENT OF THE STREET IMPROVEMENTS

DISTRICT, DEFINING THE LIMITS AND BOUNDARIES OF SAID DISTRICT, PRO-
VIDING FOR THE MANNER OF PAYMENT OF THE STREET IMPROVEMENTS THEREIN,
AND PROVIDING WHEN SAID ORDINANCE SHALL TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. A. petition signed by the owners of more than
three- fourths of the lots of land abutting upon the streets
to be improved as hereinafter set forth, petitioning for
the improvement of the following described streets in the
City of Blair, Nebraska; 21st Street from South Street to
Davis Street and Davis Street from its intersection with
21st Street West to the end of said street, all in the
City of Blair, Washington County, Nebraska, by paving the
same, said petition therefor having been presented and
filed with the City Clerk, there is hereby created Street

Improvement District No. 117 of the City of Blair,
Washington County, Nebraska.
SECTION 2. The street improvements to be made on said
streets in said' district shall be to pave the same, the
grade of said streets to conform to the grades as est-
ablished by the City of Blair and said improvements' to
be made according to plans and specifications and estimate
of cost to be prepared by the Special Engineer for said
district and to be filed with_the City Clerk and to be
approved by the Mayor and City. Council of said City.
SECTION 3. The property included in said Street Improve-
ment District No. 117 and subject to special assessments
to pay for the cost and expenses of said street improvement
is all of the privately owned lots, parts of lots and
tracts of land and the lots, parts of lots and tracts of
land owned by any municipal or public corporation and
abutting upon and adjacent to said streets to be im-
proved, to -with: Lots 11 through. 20, Block 2, in
McMenemy's Second Addition; Lot .,:Block 2, in McMenemy's
Second Addition; Lots 1 through 5, Block 2, in Smith's
' Addition; Lots 4 and 5 in Block 1 in Smith's Addition;
and Lots 9 and 10, Block 1, in McMenemy's Second Addition,
all in. the City of Blair,.Washington County, Nebraska.
SECTION 4.. The cost of said . improvements in said
Improvement District shall be paid out of the fund created
by the levy and assessments on the lots and parcels of
land in said Street Improvement District benefited
thereby in proportion to said benefits, all as by the
Statutes of the State of Nebraska in such cases made
and provided.
SECTION 5. This ordinance shall take effect and be in
force from and after its passage, approval and publication
as provided by law.

SECTION 1. The offices of the City Clerk • and City Treasurer

SECTION 2. On August 1, 1973, the City Clerk shall take

Treasurer.

Heights Addition to the centerline of a County Road

City of Blair, Nebraska.
SECTION.2. The improvement to be made is to construct and
lay an..eight (8).. inch vitrified clay sewer tile with man-
holes and wyes, said improvement to be made according to
plans and specifications and estimate of costs to be 7 pro-
pared by the Special Engineer of said District and filed
with the City Clerk and approved by the Mayor and City
Council of said City.
SECTION 3. The property included in said Sanitary Sewer
District .No. 33 and subject to special assessments to pay
for the costs and expense'of saidvimprovement.are Lots One
(1) through Twenty -nine (29) , inclusive, in College Heights
Addition, and Lots Four (4) through Twenty -six (26)

SECTION 2. The improvements to be made are to construct
and lay a six -inch cast iron water main with valves and
hydrants, said improvements to be made according to plans
and specifications and estimate of cost to be prepared by
the Special Engineer of said District and to be filed with
the City Clerk to be approved by the Mayor and Council of
said City.
SECTION 3. The property included in said Water District
No. 8 and subject to special assessments to pay for the
costs and expenses of said improvement are Tax Lots One
Hundred Twenty -six (126) , One Hundred Twenty --five • (125)
One Hundred Twenty -seven (127) , Twenty - eight (28) and
Thirty -six (36) in Section Seven (7) , Township Eighteen
(18) North, Range Twelve (12) East of the Sixth Principal
Meridian in Washington County, Nebraska.
SECTION 4. The costs of said improvement and said Water
District shall be paid out of the fund created by levy
and assessment of the lots and parcels of land in said
improvement district, benefited, and to be in proportion
to said benefits, all as by the statutes of the State of
Nebraska as made and provided.
SECTION 5. This ordinance shall take effectand be in
full 'force -from and after its passage, approval and
publication_ as provided by law.

out, of the money derived from the operation of the municipal
light system and the sale of electrical current and supplies and
all other funds and money available therefore the amounts for

For extension and improvements of municipal light power
system generator and plant improvement and

out of the money derived from taxes for sewer maintenance for

sewer system and sewer Treatment Plant - - - -$ 40,000.00
For extension, improvements of sewer system $1,051,000.00

Maintenance Fund.
SECTION 8. That there be, and hereby is appropriated
out of the money derived from the levy of taxes for the operation,
maintenance and care of the Blair Cemetery $ 12,000.00

at the end of the fiscal year shall be transferred to the Cemetery
Fund.
SECTION 9. That there be, and hereby is appropriated
out of the money derived from the levy of taxes for the payment
of refunding bonds and interest thereon and the sinking fund for
said fiscal year and out of the money derived from taxes levied
for payment of intersections and for district paying bonds, and
interest and out of any and all other funds and money available
therefore, the amounts for each object and purpose as follows:
For payment of principal and interest of bonds indebtedness
due or to become due and for sinking bonds

Any balance of said funds remaining over and unexpended
at the end of the fiscal year shall be transferred to the Sinking
Fund for the payment of refunding bonds.
SECTION 10. That there be, and hereby is appropriated
out of the money derived from the levy of taxes for the maintenance
and operation of the Fire Department for the present fiscal year
and out of all other money and funds available therefor, belonging
to said City, the amounts for each object and purpose as follows:

of Purchase of Fire Department Apparatus for the present fiscal

belonging to said City, the amounts for each object and purpose

at the. end of the fiscal year shall be transferred to the Fire
Department Apparatus Fund.
SECTION 12. That there be, and hereby is appropriated
out of the money now on hand for the Special Gasoline Road Fund
and from the money derived from special gasoline tax and motor
registration fee, and the amounts for each object and purpose
as follows:
For salaries of employees, for purchase of and the repair
of Equipment and for construction of street

Any balance in said fund remaining over and unexpended
at the end of the fiscal year shall be transferred to the Special
Gasoline Tax Fund.
SECTION 13. That there be, and hereby is appropriated
out ofthe money derived from the levy of taxes for the purpose
of paying the City's share of the employees and officers federal
Social Security Tax for the present fiscal year and out of all
other money and funds available therefor, belonging to the said
City the amount for each object and purpose as follows:
For City's share of employees and officers' Federal Social
Security Tax $ 24,000.00
Any balance in said fund remaining over and unexpended
at the end of the fiscal year shall be transferred to the Social
Security Tax Fund.
SECTION 14. That there be, and hereby is appropriated
out of the money derived from the operation of the Blair
Apartments and all other money and funds available therefor, the
amount for each object and purpose as follows:
For salaries of employees, operation and maintenance of
Blair Apartments $ 62,000.00
Any balance of said fund remaining over and unexpended
at the end of the fiscal year shall be transferred to the Blair
Apartment Fund.
SECTION 15. That there be, and hereby is appropriated
out of the money derived from the levy of taxes for Supervised
Recreation purposes for the fiscal year and out of all moneys
and funds available therefor, the amount for each objeet'and
purpose as follows;
For salaries of employees, purchase of equipment, main-
tenance of playgrounds, and recreation centers,
including the construction of necessary buildings -- $ 30,000.00
Any balance of said fund remaining over and unexpended
at-the end of the fiscal year shall be transferred to the
Supervised Recreation Fund.
SECTION 16. That there be and hereby is appropriated
out of the money derived from the Federal Government for revenue
sharing, and out of all moneys available therefor, the amount

and other expenditures that are authorized by the

SAID. DISTRICT; PROVIDING FOR THE MANNER OF PAYMENT OF THE
IMPROVEMENTS MADE THEREIN; AND'PROVIDING WHEN SAID ORDINANCE
SHALL TAKE EFFECT.
WHEREAS, on the 10th day of July, 1973, a resolution
was adopted by the Mayor and City Council of the City of Blair,
Nebraska, declaring the intention of said body to create a
Downtown Improvement and Parking District pursuant to the laws
of the State of Nebraska embodied in the Downtown Improvement
and Parking District Act of 1969, and,
WHEREAS, said resolution provided that a public hearing
be held to consider the establishment of such a district on
the 31st day of July, 1973, at the hour of 7:30 o'clock, P.M.,
and,

WHEREAS, proper notice for said hearing was given by
publication and mailing all as provided by law, and,
WHEREAS, said hearing has been held and the City
Council has heard all protests and evidence for and against
the creation of said district and has duly considered the same,
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. There is hereby created Downtown Improve-
ment and Parking District No. 1 of the City of Blair, Nebraska.
SECTION 2. The boundaries of Downtown Improvement and
Parking District No. 1 are hereby fixed and described as
follows: Beginning at the intersection of the center line of
the right -of -way of.l9th Street with the center line of the
right -of -way of Lincoln Street; thence North along the center
line of the East -West right -of -way of Front Street; thence
East along said center line of Front Street to its intersection
with the center line of the North -South right-of-way of 15th
Street; thence South along the center line of 15th Street to
its intersection with the center line of the East -West right-
of-way of Lincoln Street; thence West along said center line
of Lincoln Street to the point of beginning, all in the City
of Blair, Washington County, Nebraska.
SECTION 3. The businesses and professions within
the area established by this ordinance shall be subject to the
provisions of the additional tax provided by Sections 19 -3401
to 19 -3420 RRS Nebraska 1943, as amended, and the area upon
which said occupation and license tax would be imposed are
those lots or parts of lots which are presently used for business
purposes located in Blocks Forty -four (44), Forty -five (45),
Forty -six (46) , Forty -seven (47) , Thirty -six . (36) , Thirty -
seven (37) , Thirty -eight (38) and Thirty -nine (39) in the City
of Blair, Washington County, Nebraska.
SECTION 4. No general license and occupation tax
shall be imposed or established at this time so that there is
no initial rate of tax to be imposed, but at such time as said
tax is established, it shall be fair and equitable and uniform
as to class and shall be based primarily on the square footage
of the owner's and user's place of business or professional
office space.
SECTION 5. An occupation and license tax and the rate
of said tax may be established and imposed only after the adop-
tion of a resolution of intention which shall set forth a date
of public hearing on said tax and shall be published according
to law, and no tax shall be imposed until the Mayor and City
Council have been presented with a petition signed by 51% of
the users of the square foot taxable space in said district
approving the overall plan of improvement, estimate of cost and
the proposed initial rate of tax in said district, all of which
shall have been previously approved by the Mayor and City
Council as provided by law. It is further provided that when
circulated and when presented to the Mayor and City Council
said petition shall have attached to it a copy certified by
the City Clerk of said plans, estimate of costs and proposed
initial rate of tax as approved by the Mayor and Council.
SECTION 6. The uses to which the.additional revenue
to be raised by said general license and occupation tax shall
be for the planning, construction and maintenance of improve-
ments to the benefit of the general public in said Downtown

within an adjacent crosswalk and to other traffic lawfully using

DISTRICT, PROVIDING FOR THE MANNER OF PAYMENT OF THE STREET

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. A petition signed by the owners of
more than three - fourths of the lots of land abutting upon
the streets to be improved as hereinafter set forth,
petitioning for the improvement of the following described
streets in the City of Blair,: Nebraska: Beginning at the
intersection "of" Tenth "Avenue and Jackson Street in the
City of Blair, Nebraska; thence North on Tenth Avenue to
the existing concrete pavement in Beck's Addition to the
City of Blair, Washington County, Nebraska, and terminating
at that point, by paving the same, said petition hereto-
fore having been presented and filed with the City Clerk,
there is hereby created Street Improvement District No.
122 of the City of Blair, Washington County, Nebraska.
SECTION 2. The street improvements to be made
,on said street in said district shall be to pave the same,
the grade of said street to conform to the grades as
established by the City of Blair and said improvements to
be made according to plans and specifications and estimate
of cost to be prepared by the Special Engineer for said
.district and to be filed with the City Clerk and to be
approved by the Mayor and City Council of said City.
SECTION 3. The property included in said Street
Improvement District No. 122 and subject to special assess-
ments to pay for the cost and expenses of said street
Improvement is all of the privately owned lots, parts of
lots and tracts of land and the lots, parts of lots and
tracts of land owned by any municipal or public corporation
and abutting upon and adjacent to said streets to be
improved, to -wit: Lots One (1) through Sixteen (16)
inclusive, in Greenbriar Addition to the City of Blair,
and the South 30.0 feet of Block One (1) of Beck's Addition
and the South 30.0 feet of Lot Five (5) in Block Three (3)
in Beck's Addition, all in the City of Blair, Washington
County, Nebraska.

SECTION 4-. The cost of said improvements in said
Improvement District shall be paid out of the fund created
by the levy and assessments on the lots and parcels of land
in said Street. Improvement District benefited thereby in
proportion to said benefits, all as by the Statutes of the

this subsection,, the term "nudity" shall mean the showing
of the human male or female genitals, pubic area or buttocks
or the human female breast including the nipple or any
portion below the nipple with less than a full opaque
covering."

ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS
ORDINANCE SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. Section 1 -314 of the Municipal Code of
the City of Blair is hereby amended to read as follows:
"CHIEF OF POLICE.; POLICEMEN; POWERS; DUTIES. The Chief of
Police shall have the immediate superintendence of the police.
He and the policemen shall have the power, and it shall be
their duty, to arrest all offenders against the laws of
Nebraska or of the City, by day or by night, in the same
manner as a Sheriff or Constable, and keep them in the City
prison or other place to prevent their escape, until a trial
or examination may be had before the proper officer; and
they shall have the same power, as Sheriff andConstable in
relation to all criminal matters and process. They shall
arrest and detain any person found violating any law of
Nebraska or any legal ordinance of the City, until a. legal
warrant can be obtained. Each member of the Police Depart-
ment of the City shall have the duties of becoming well
informed as to the ordinances of the City, or enforcing such
ordinances, of wearing at all times the badge, uniform and
insignia furnished by the City for the Police and of properly
caring for same and such further duties as shall be assigned
to them by the Mayor and Council and as are otherwise
provided by law. The Chief of Police shall have custody of
all municipal property used by the City Police, shall
execute the orders of the Mayor, shall be a member of the
Board. of Health and the Secretary and quarantine officer
thereof, shall have charge of traffic control on the City
sheets, shall execute and serve or cause to be served all
process of the Police Court of the City, shall make and
file or cause to be made and filed complaints for violations
of the ordinances of the City, shall have charge of the City
jail and the prisoners therein and shall perform such other
duties as are assigned to or required of him by the Mayor
and Council or otherwise provided by law."

WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. Section 1 -318 of the Municipal Code
of the City of Blair is hereby amended to read as follows:
. "OFFICERS; VACANCIES. Whenever a vacancy in any elective
office shall occur, such vacancy shall be filled by appoint-
ment by the Mayor, with the consent of the Council to hold
for the remainder of said unexpired term. Whenever the
Council shall fail to consent to any appointment made
hereunder by the Mayor by the close of the second (2nd)
regular Council meeting following the announcement of the
appointment, the vacancy shall be filled by a special
election to be held as provided by law in the ward in which
such vacancy exists, or in the City, as the case may be.
Any City officer may be removed from office for misconduct,
including habitual or willful neglect, of duty, extortion,
corruption, fraud, malfeasance in office and conviction of
a felony while in office.
The following appointive officers may be removed
at pleasure by vote of a majority of all members of the
Council with the approval of the Mayor, City Administrator,
City Engineer, City Attorney, City Street Commissioner,
Chief of the Fire Department, City Physician and City
Utility Commissioner."
SECTION 2. All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3. This ordinance shall be in force and
take full effect from and after its passage, approval and
publication as provided by law.

of Blair, Nebraska. This Ordinance No. 1104 was introduced by
Councilman Pounds and is in words and figures as follows:

AN ORDINANCE AMENDING SECTION 1 -802 OF THE MUNICIPAL CODE OF THE

the City of Blair is hereby amended to read as follows:
"ELECTIONS; PROCLAMATION. At least ninety (90) days prior to
any general City Election, the Mayor shall issue a proclamation
designating all of the offices to be filled by vote of the
elector's of the City, or the special issues or propositions
to be submitted for approval or rejection by such electors,
and transmit the same forthwith to the City Clerk for filing.
In the case of a special election, such proclamation shall be
issued ten (10) days prior thereto."
SECTION 2. Section 1 -803 of the Municipal Code of
the City of Blair is hereby amended to read as follows:
TTELECTIONS; GENERAL ELECTION NOTICE. Not less than twenty
(20) days nor more, than thirty (30) days prior to any general
City election, the City Clerk shall prepare a notice to be
published in a newspaper that is published in or of general
circulation in the City, which shall be substantially as follows:
Notice is hereby given that on Tuesday, the

the City of Blair, Nebraska, a general election will
be held for selecting the following city officials.

AN ORDINANCE PROHIBITING THE CARRYING, POSSESSING OR TRANS-
PORTING OF FIREARMS UNLESS SAID FIREARMS ARE UNLOADED AND
BROKEN DOWN OR UNLOADED AND CONTAINED IN AN'ENCLOSED GUN
CASE AND PROVIDING FOR CONFISCATION OF SAID FIREARMS SUB-
SEQUENT TO CONVICTION HEREUNDER, - ENUMERATING SECTION NUMBERS
OF SAID - PROVISIONS; REPEALING ALL ORDINANCES. OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING WHEN THIS
ORDINANCE SHALL BE IN FORCE AND EFFECT. ••
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. There is hereby added to the Municipal
Code of the City of Blair the following section to be enumerated
as Section 6 -349 of said Code: 1 t6 -34.9 FIREARMS- POSSESSION- TRANSPORTATION-
WHEN ALLOWED. It shall be unlawful for any person, except an
authorized law enforcement officer, purposely, or knowingly to

transport in any conveyance or in any other manner whatsoever,
or to possess,off of his own premises, any rifle, shotgun, air
gun, air rifle, or hand gun, provided that "b-b" guns shall
not be included in the designation air gun or air rifle,
unless it is unloaded and contained in an enclosed gun case,
or unloaded and broken down. The removal of the bolt from
any such firearms, or carrying any such firearm in a holster -
type gun case without 'further breaking down such firearm, shall
not be deemed. to be a compliance with the requirements of
this Section.
The provisions of this Section shall not be construed
to apply to the Armed Forces of the United States, including
R.O.T.C. units and the National Guard in the performance of
their official duties.
Nor shall the provisions of this Section be construed
to prevent carrying unloaded and uncased rifles in parades or
using rifles in ceremonials, or to prevent possession of rifles
or shotguns at shows, or exhibits, or for other lawful use,
,purpose or activity, including but not limited to skeet and
trap shooting, target shooting at rifle ranges, hunter safety
instruction conducted by qualified instructors, when such do
.. not endanger public safety or are detrimental to public welfare,
provided the prior approval of the Public Safety Director of
the City of Blair shall have been obtained for such use,
purpose or activity.??
SECTION 2. There is hereby added to the Municipal
Code of the City of Blair the following section to be enumerated
as Section 6 -550 of said Code: TT6 -550 CONFISCATION OF FIREARMS.
In addition to imposing any of the penalties provided for in
Section 6 -401 of the Blair Municipal Code, the Court may order
confiscation of any firearm enumerated in Section 6 -349 of
this Chapter as a part of the judgment of conviction of any
person convicted of violating the provisions of this Chapter."
SECTION 3. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION 4. This ordinance shall be in force and take
full effect from and after its passage, approval and publica-
tion as provided by law.

PRIMARY ELECTION; REPEALING ALL ORDINANCES OR PARTS OF

offices are authorized to file for election directly with
the City Clerk. Said filing must take place at least sixty
(60) days prior to the date of the statewide primary
election and must be in such form and manner as provided
in 32 -535 RRS Nebr. 1943 as amended."
SECTION 2. Section 1 -806 of the Municipal Code
of the City of Blair is hereby amended to read as follows:
"1 -806 ELECTIONS; PETITION CANDIDATES. Candidates for
any municipal office in the City may be nominated by
petition. Such petitions shall be signed by registered
voters equal in number to 5% of the votes cast in the City
or Ward at the most recent municipal election. The form
of such petition shall be prescribed by the Secretary of
State of the State of Nebraska, shall be filed with the
City Clerk, and the deadline for filing such petitions
shall be sixty (60) days prior to the statewide primary
election. Within twenty -four (24) hours after the receipt
for filing of a petition for nomination, the City Clerk
shall notify by either registered or certified mail, the
candidate so nominated, who shall, within five (5) days
from the filing of such petition for nomination, file
with said officer his acceptance of the petition for
nomination, or his name shall not be printed on the election
ballot unless otherwise provided by law."
SECTION 3. All ordinances or parts of ordinances
