2023-50RESOLUTION NO. 2023-50 COUNCIL MEMBER SANDVOLD INTRODUCED THE FOLLOWING RESOLUTION: WHEREAS, the City of Blair is a municipal corporation duly organized under the laws of Nebraska; WHEREAS, KJK Investments, is a Nebraska LLC Partnership; WHEREAS, the City of Blair and KJK Investments entered into a Developer's Agreement dated March 8, 2022, for the "Lots 1 - 6 Grant Street Industrial Park," which was approved by the Blair City Council on March 8, 2022, Resolution 2022-10; WHEREAS, the Developer's Agreement includes extension districts for paving and storm sewer, water, and sanitary sewer services for the final plat for the subdivision legally described as Tax Loty 27t of the SE 1/4 and a portion of the SW 1/a of Section 7 Township 18 North Range 12 East of the 6th P.M., East, Washington County, Nebraska, commonly known as: Lots 1-6 Grant Street Industrial Park; WHEREAS, the Engineer certified with a Certificate of Completion dated October 19, 2023, attached hereto as Exhibit A, that the Grant Street Industrial Park, Sanitary, Storm Water and Paving Districts are completed in conformance with all Ordinances, Plans, Specifications and Minimum Standards, as approved and as established by the City of Blair and the Nebraska Department of Health and Human Services (Water); WHEREAS, the Engineering Certificate was presented to the Mayor and City Council, and the City Council hereby formally accepts the Engineering Certificate dated October 19, 2023 from Randall L. Pierce, P.E., Registered Professional Engineer from the E & A Consulting Group, Inc.; WHEREAS, in accordance with the Developer's Agreement, the Developer shall convey by proper legal instrument all of its rights, easements, title, and interest in such sanitary sewer and 1 easements to the City of Blair. The City Council hereby authorizes the Mayor to sign any such agreements transferring ownership as recommended by the City Administrator and City Attorney, without the same being presented at a formal public meeting; WHEREAS, the Mayor and City Council have been presented with this Resolution and the Certificate of Completion dated October 19, 2023, which are acceptable to the City of Blair; and NOW, THEREFORE, BE IT FURTHER RESOLVED that said Resolution is hereby adopted and approved by the municipality and the Mayor and City Clerk of the City of Blair are hereby authorized and directed to execute the same on behalf of the municipality and the Mayor is authorized to sign any such agreements transferring ownership as recommended by the City Administrator and City Attorney, without the same being presented at a formal public meeting. COUNCIL MEMBER SANDVOLD MOVED THAT THE RESOLUTION BE ADOPTED AS READ, WHICH SAID MOTION WAS SECONDED BY COUNCIL MEMBER PAULSEN. UPON ROLL CALL, COUNCIL MEMBERS HIGHFILL, FERRARI, SANDVOLD, WILLIS, WOLFF, PAULSEN AND HAFER VOTING "AYE" AND COUNCIL MEMBERS NONE VOTING `NAY", THE MAYOR DECLARED THE FOREGOING RESOLUTION PASSED AND APPROVED THIS 24TH DAY OF OCTOBER, 2023.
