COUNCIL MEMBER HAFER INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDINANCE AMENDING THE CITY OF BLAIR ZONING ORDINANCE AS
FOLLOWS: 1) ARTICLE 3, SECTION 303.01 TEXT OF DEFINITIONS; 2) ARTICLE 11,
SECTION 1102 FENCES, HEDGES AND RETAINING WALLS, 3) ARTICLE 11, 1111.04
SCHEDULE OF MINIMUM OFF-STREET PARKING AND LOADING REQUIREMENTS BY
ADDING AND CHANGING LANGUAGE REGARDING EGRESS WINDOW WELLS AND
THEIR SETBACKS; NET FLOOR AREA DEFINITION; SIGN DEFINITION; FENCE
HEIGHT IN THE SECOND FRONT YARD AND OFF-STREET PARKING REQUIREMENTS,
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING WHEN
THIS ORDINANCE SHALL BE IN FORCE AND EFFECT AND PROVIDING FOR THIS
ORDINANCE TO BE PUBLISHED IN PAMPHLET FORM.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. That ARTICLE 3, SECTION 303 DEFINITIONS, 303.01 TEXT OF
DEFINITIONS of the Blair Zoning Regulations of Blair, Nebraska is hereby amended as follows,
to wit:
(60.5) EGRESS WINDOW WELLS: Are permitted in the side setbacks and rear setback with a minimum
of two (2) feet distance from the property line.
(68.5) FLOOR AREA, NET: Shall mean the floor area used for commerce or work, excluding
bathrooms, breakrooms, stairwells or halls, or storerooms, etc.
(129) SIGN: Any visual image, shape, or design that is fastened, painted or projected, which
shall display or include any letter, word, model, banner, flag, pennant, insignia, device or
representation used as, or which is in the nature of, an advertisement or announcement which
directs attention to an object, product, place, activity, person, institution, organization or business
but shall not include any display of official notice or official flag.
SECTION 2. That ARTICLE 11, SECTION 1102 FENCES, HEDGES AND RETAINING
WALLS of the Blair Zoning Regulations of Blair, Nebraska is hereby amended as follows, to wit:
A 4) No fence constructed in the second -front yard (the side yard abutting the street) of a corner
lot shall exceed forty-eight inches (48") in height. However, open fences in the second front
yard may exceed forth -eight inches (48"), but no taller than seventy-two inches (72"), if the
fence is built on or inside the property -line boundary. Examples of an open fence include
decorative, picket or wrought iron where 50% of the surface is open and a person can see
through the fence. For the purposes of this section, the "second -front yard" shall be deemed
to be in the area extending from the front corner of the house to the rear lot line on the side
of the lot immediately adjacent to the City Street.
SECTION 3. That ARTICLE 11, 1111.04 SCHEDULE OF MINIMUM OFF-STREET
PARKING AND LOADING REQUIREMENTS of the Blair Zoning Regulations of Blair,
Nebraska is hereby amended as follows, to wit:

SECTION 4 All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5 This ordinance shall be in full force and effect from and following the
passage and publication hereof as required by law.
