The Mayor and Council of the City of Blair, Washington
County, Nebraska met in regular session at the City Council
Chambers at 7:30 o'clock P.M. Mayor (Acting) Lutz presided at
the meeting, and City Clerk, L. W. Svendgaard recorded the pro-
ceedings of the meeting.
ROLL CALL
The Mayor directed the Clerk to call the roll, and on
roll call Councilman Allen, Jenny, Nelson, Pounds, Sick, Lutz,
and Sheets were present. Councilman Hansen was absent.
ORDER OF BUSINESS
Whereupon the Acting Mayor announced that the introductions
of ordinances was now in order.
It was moved by Councilman Lutz and seconded by Councilman
Pounds that the minutes of the proceedings of the Mayor and
Council in the matter of the passage and approval of Ordinance
No. 10.31 be preserved and kept in a separate and distinct volume
known as the Ordinance Record of .e City of Blair, Nebraska, and
that said volume be incorporated in and made a part of these
proceedings the same as though spread at large herein. Council-
man Hansen called for the question. Acting Mayor Lutz put the
question and directed the Clerk to call the roll for the vote
thereon:

Introduction of Ordinance No. 1031 of the City of Blair,
Nebraska and the matter now coming before the Mayor and Council
was the passage and approval of Ordinance No. 1031, which was
introduced by Councilman Pounds and is in words and figures as
follows:
AN ORDINANCE VACATING THAT PART OF ARTHUR STREET LOCATED IN
WEIMER'S ADDITION, IN THE CITY OF BLAIR, NEBRASKA, LYING BETWEEN
LOTS 14, 15, AND 16 ON THE SOUTH THEREOF AND LOTS 18, 19, 20,
21 AND 2R ON THE NORTH THEREOF: REPEALING ALL{0RDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING WHEN THIS
ORDINANCE SHALL BE IN FORCE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
BLAIR, NEBRASKA:
SECTION 1. That the part of Arthur Street, located in
Weimer's Addition in the City of Blair, Nebraska, lying between.
Lots 14, 15 and 16 on the South thereof and Lots 18, 19, 20, 21
and 22 on the North thereof, be vacated, and the same hereby is
vacated.
SECTION 2. That all ordinances or parts of ordinances
in conflict hbrewith are hereby repealed.

Introduction of Ordinance No. 1036 of the City of Blair,
Nebraska, and the matter now coming before the Mayor and Council
was the passage and approval of Ordinance No. 1036 of the City of
Blair, Nebraska. This Ordinance No. 1036 was introduced by

ORDINANCE NO. 1036

AN ORDINANCE OF THE CITY OF BLAIR, NEBRASKA, CODIFYING THE GENERAL
ORDINANCES OF THE MUNICIPALITY AND REPEALING PRIOR ORDINANCES IN
CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BLAIR, NEBRASKA.
SECTION 1. Codification. The general ordinances of the
Municipality of Blair, Nebraska, are hereby codified into eleven
chapters and the articles and sections thereunder, which are a-
dopted and declared to be ordinances of this Municipality.
SECTION 2. Repeal of Prior Ordinances in Conflict. All
ordinances and parts of ordinances of a general or permanent nature
passed and approved prior to the passage and approval of this
codification ordinance and in conflict with this ordinance or with
any of the provisions of this ordinance, are hereby repealed;

Provided, that in construing the provisions of this ordinance the
following ordinances shall not be considered or held to be
ordinances of a general or permanent nature, to -wit:
1. Ordinances vacating streets and alleys.
2. Ordinances authorizing or, directing public improvements
to be made.
3. Ordinances levying taxes or special assessments.
4. Ordinances granting any right, privilege, franchise, or
license to persons, firms, or corporations.
5. Ordinances providing for the issuance of bonds or
other instruments of indebtedness.
6. Ordinances establishing grades.
7. Real Estate Transactions.
8. Any other ordinance which by nature would be con-
sidered special._
SECTION 3. Exceptions. The repeal of ordinances as provided
in Section 2, Ordinance No. 1036 shall not affect any rights ac-
quired, fines, penalties, forfeitures, or liabilities incurred
thereunder, or actions involving any of the provisions of such
ordinances and parts thereof. Such ordinances above repealed are
hereby continued in force and effect after the passage, approval
and publication of this general codification ordinance for the pur-
pose of all rights, fines, penalties, forfeitures, liabilities,
and actions therefor.
SECTION 4. Defining Chapters, Articles, and Sections.
The chapters, articles, and sections as set forth herein shall be
and hereby are declared to be the chapters, articles, and sections
of this general codification ordinance. All ordinances hereafter
passed by the local Governing Body of the Municipality shall be
numbered consecutively, beginning with No. 1037.
SECTION 5. Severability. If any section, subsection,
paragraph, sentence, clause, phrase, term, or provision of this
ordinance should be declared invalid by any court of competent
jurisdiction for any reason whatsoever, such decision shall not
affect the remaining portions of this code, which will remain in
full force and effect, and the provisions of this ordinance are
hereby declared to be severable.
SECTION 6. Blanket Penalty. Any person, his agents, or
servants who shall violate any of the provisions of this Municipal
Code unless otherwise specifically provided herein, shall be
deemed (guilty of a misdemeanor and upon conviction thereof, shall
be fined in any sum not exceeding one hundred ($100.00) dollars.
Whoever aids, abets, procures, encourages, requests, advises, or
incites another to commit any act which is an offense under this
Code or under any other ordinance of the Municipality may be
prosecuted and punished as though he were the principal offender.
SECTION 7. General Difinitions:
1. Person. Whenever used in this code, the word person
shall include natural persons, artificial persons,
such as corporations, co- partnerships, associations,
and all aggregate . organizations of whatever character.
2. Gender and Number. All words used herein implying the
masculine gender may apply to, and include the feminine
or neuter gender and all words importing the plural
may be applied to, and mean a single person, firm,
or thing. All words importing the singular number
may be applied to and mean the plural number.
3. Code, Ordinance, and Chapter. Municipal Code shall

or the hour of the day are used in this Code, they shall be construed
to mean Central Standard Time or Central Daylight Savings Time
depending upon the season of the year.
SECTION 9. Construction of Chapters, Articles, and
Sections. For purposes of construction each chapter contained and
arranged in this Code shall be considered as a separate and distinct
ordinance grouped for convenience under the General Codification
Ordinance No. 1036, each section appearing in the several chapters
of this Code shall be considered a separate and distinct unit of
legislation germane to the chapter or article under which it is
grouped and each article appearing in the said chapters shall be
considered as a group of legislative units germane to the chapter
wherein it is placed. Any chapter, article, or section duly
enacted by the Governing Body of the Municipality and included in
this Code and any other independent ordinance, chapter, article,
section, or subsection of an ordinance duly enancted shall be
altered, amended, or revised only by the complete nufflificata.on
and repeal of such ordinance chapter, article, section, or sub-
section and by the substitution of a new ordinance, chapter, article,,
section, or subsection containing the entire ordinance, chapter,
article, section, or subsection as amended, altered, or revised.
SECTION 10. Publication and Distribution. This code was
printed in book form under the direction of the Governing Body,
and shall be distributed as they may see fit. (Ref. 17 -613, 17 -614
RS Neb.)
SECTION 11. When Operative. This ordinance shall be in
full force and shall take effect from and after its passage,
approval and publication according to law.

4. Wholesale Dealer. The words wholesale dealer or
sellers of said product at wholesale shall embrace
and include manufacturers of any product who sell
the said product to other persons for the purpose
of future resale to consumers.
5. Municipal and Municipality. The words Municipal
and Municipality whenever used in this code mean the
City of Blair, Nebraska, a Municipal Corporation.
6. Governing Body. The words Governing Body, whenever
they appear in this Code mean the Mayor and City
Council of the Municipality.
7. Mayor. The word Mayor means the Chief Administrative
official of the Municipality whenever it appears
in this Code.
8. Municipal Police. Municipal Police shall mean any
police officer of the Municipality whenever it appears
in this Code.

ROSE STREET IN THE CITY OF BLAIR TO 14TH AVENUE: AMENDING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; PROVIDING
WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. That the street recorded as Rose Street, as
described on the plat recorded the 14th day of July, 1965 with
the Washington County Clerk in the Book of Deeds, Vol. 71 and
Page 62, be and the same is hereby renamed 14th Avenue.

UNDER SECTION 1.906 OF THE MUNICIPAL CODE OF THE CITY OF BLAIR;
PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BLAIR, NEBRASKA:
SE0TION 1. That the Mayor and City Clerk be, and hereby are
authorized, empowered, and directed to enter into a contract for the
purchase of a 1972 model 4 -door sedan, police automobile, in the
amount of $2,888.85 from Sapp Brothers Ford Center.
SECTION 2. Under Section 1 -906 of the Municipal Code of the City
of Blair an appropriation in the amount of $ 2,888.85 be made from
the general funds of the City for the purchase of the abovementioned
automobile.
SECTION 3. This Ordinance shall take effect and be in force from
and after its passage, approval, and publication as required by

ORDINANCE NO. 1039
Introduction of Ordinance No. 1039 of the City of Blair,
Nebraska, and the matter now coming before the Mayor and Council
was the passage and approval of Ordinance No. 1039 of the City of
Blair, Nebraska. This Ordinance No. 1039 was introduced by
Councilman Sick and is in words and figures-:as follows:
ORDINANCE NO. 1039
AN ORDINANCE PROHIBITING THE ACCUMULATION OF JUNK ON PRIVATE
PROPERTY; DEFINING JUNK; PROVIDING FOR INVESTIGATION, NOTIFICATION
AND REMOVAL; FAILURE TO REMOVE, PENALTIES; WHEN THIS ORDINANCE SHALL
TAKE EFFECT AND BE IN FULL FORCE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BLAIR, NEBRASKA:
SECTION'S1. That Chapter 6., Article 3 of the Municipal Code
of the City of Blair, Nebraska, be amended to include the .
following sections:
SECTION 2. 6 -348 Misdemeanors; Phohibiting The Accumulation
of Junk On Private Property. It shall be unlawful for any
property owner or lessee to allow accumulation of ; dunk on
property that is located within the City limits to the ex-
tent that such accumulation is a potential hazard to health
and safety.

SECTION 3. 6 -349 Misdemeanors; Junk, Defined. As used
in section 6 -348 to 6 -351, unless the context c therwise'
requires, junk shall mean old scrap, copper, brass,
iron, steel, rope, rags, batteries, paper, trash, rubber
debris, waste, dismantled, unlicensed or wrecked automobiles,
or parts thereof, and other old or scrap ferrous or non-
ferrous material.
SECTIONS•.. 6 -350 Investigation, Notification and Removal.
The City Administrator or the Chief of Police, as the
case may be, shall have the power to investigate all
complaints of violations of sections 6 -348 to 6 -351, and,
if they find that such property owner or lessee has allowed
such accumulation, shall submit their findings to the
Mayor and Council. The Mayor and Council, upon receiving
such findings, may, by resolution, direct the property
owner or lessee to remove the accumulation of junk within
fifteen (15) days of receipt of the resolution delivered
by an officer of the City Police Department.
SECTION 5. 6 -351 Failure to Remove, Penalties, Any
property owner violating the provisions of sections 6 -348
to 6- 351,Aby failing to remove said accumulation within
fifteen (15) days, shall be guilty of a misdemeanor and
upon conviction thereof, be punished by a fine of not
less than twenty -five dollars (25.00) nor more than one
hundred dollars ($100.00), and the Court, as a part of
the judgment of conviction, shall order the owner to re-
move the accumulation of junk or an authorized agent of
the City, may cause said junk or motor vehicles to be
removed at the expanse of the owner or lessee from the
land whereon said junk or motor vehilces exist and the
cost of such removal shall be levied, equalized and
assessed as other special assessments.
SECTION 6. This ordinance shall take effect and be in full
force from and after its passage, approval, and publication
as required by law.

AN ORDINANCE TO CREATE A RECREATION COMMISSION, MEMBERS, APPOINT-
MENT, TERMS, DUTIES, VACANCIES; MEETINGS, ORGANIZATIONS, RULES AND
REGULATIONS; GRANTS, GIFTS AND DONATIONS FOR RECREATIONAL PLAYGROUND
PURPOSES; AND RECREATION DIRECTOR; AND WHEN TO REPEAL ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDE FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF BLAIR, NEBRASKA;
SECTION 1. THAT ARTICLE 12, ENTITLED RECREATION COMMISSION,
BE ADDED TO CHAPTER 2 OF THE MUNICIPAL CODE OF THE CITY OF
BLAIR, NEBRASKA, TO INCLUDE THE FOLLOWING SECTIONS:
SECTION 2. 2 -1281 MEMBERS, APPOINTMENT TERMS, DUTIES,
VACANCIES. The City Recreation Board shall consist of
seven members, all of whom shall be residents of the City
of Blair. Said members shall be appointed by the Mayor
by and with the consent of the City Council. Ntidther

the Mayor nor any member of the Council shall be a member
of said board. Members of said board shall serve for a
term of five years, and the term of at least one member
shall expire each year. The Recreation Board shall be
vested with the power to conduct the recreation program
for the City and to use the facilities of other political
subdivisions, with their consent, if such use does not
interfere with the primary purpose which said facilities
are intended to serve, and Veterans Field of the City,
being Lots 1 to 23, inclusive, of Block.3,,the East Half
of Lot 3 and Lots 4 to 11, inclusive, in Block 4, of
Prairie Park Addition to the City. Said Board shall
also have charge and control of the Municipal Swimming Pool.
Vacancies occurring on the Recreation Board shall be filled
by appointment of the Mayor and confirmation by the Council
for the unexpired terms.
SECTION 3. 2 -1202 MEETINGS, ORGANIZATION, RULES AND
REGULATIONS. The Recreation Board shall elect its chair-
man from its members annually and create and fill such other
offices as it may determine. The board shall hold at
least one regular meeting each month. The board shall
adopt rules for transaction of business and shall keep a
record of its resolutions, transactions, findings and
determinations, which records shall be public.
SECTION 4. 2 -1203 GRANTS, GIFTS AND DONATIONS FOR
RECREATION AND PLAYGROUND PURPOSES.- The Mayor and City
Council of the City shall have the power to accept or
reject any (a) grant or devise of real estate, (b) gift
or bequest of money or other personal property, or (c)
other donation to be applied, principal or income, for
either temporary or permanent use for playground or re-
creation purposes. Any money so received shall be de-
posiind,iith the Treasurer of the City to the - credit of
the Recreation Fund and shall be paid out in the same: manner
as other public money appropriated for recreation purposes.
SECTION 5. 2-1204 RECREATION DIRECTOR. The Recreation
Board shall have the power, with the consent of the Mayor
and Council of the City, to hire a recreation director
and such other employees it deems necessary to carry out
the recreation program in the City.
SECTION 6. This ordinance shall take effect and be in
full force from and after its passage, approval and
publication as required by law.

SECTION 3. 2 -1102 ORGANIZATION, CHAIRMAN, MEETINGS,
QUORUM, OATH. The members of the Board of Park Commiss-
ioners shall hold their first meeting following the second
Monday in January of each year, organized by electing
one of their members as Chairman of said Board. Two
members of said Board shall constitute a quorum for meetings.,
Before entering upon his duties, each member of the Board
shall take an oath, to be filed v)ith the City Clerk that
he will faithfully perform the duties of his office and
will not in any manner be actuated or influenced by
personal or political motives.
SECTION 4. 2 -1103 SALARY. Each member of the Board of
Park Commissioners shall receive a salary of ten dollars
($10.00) per annum.
SECTION 5. 2 -1104 DUTIES. The members of the Board of
Park Commissioners shall have charge of all of the
parks belonging to the City and shall have the power to
establish rules for the management, care and use of
the same. It shall be their duty to lay out, improve an
beautify all grounds and buildings now owned or here-
after acquired,for public parks and to employ such
helpers and labor as may be necessary for the proper care
and maintenance of such parks, and the improvements and
beautifying thereof, to the extent that funds may be
provided for such purposes.
SECTION 6. 2 -1105 FUNDS, DISBURSEMENTS, REPORTS. All
expenditures of the Board of Park Commissioners for
salaries and wages of the Board and employees, and all
other expenses for the maintenance and operation of the,
parks of said city shall be audited and allowed by the
Park Commissioners and paid by warrants signed by the
Chairman of the Commissioners and shall be paid by the
City Treasurer out of the park fub.ds of said City. The
Chairman of the Board of Park Commissioners shall, on
January 1 and July 1 of each year, file with the City,
Clerk an itemized statement of all the expenditures and
receipts of said Board for the preceding six months.
SECTION 7. 2 -1106 CONTRACTS. The Board of Park Commiss-
ioners or said city shall not enter into any contracts of
any nature involving any expenditure of more than one
hundred ($100.00) unless such contracts have been
approved by the majority of members if the City Council.
SECTION 8. This ordinance shall take effect and be in
full force from and after its passage, approval and pub-
lication as required by law.

funds of the city in order to compensate those part - time
officers who are employed as Humane Officers for the City
of Blair, Nebraska, upon approval of the salary by the

the general fund until August 1, 1972, at which time the

AN ORDINANCE TO PROVIDE FOR THE INCREASE OF COMPENSATION TO CERTAIN
MUNICIPAL OFFICIALS AND TO SPECIFY THOSE OFFICIALS COVERED BY THIS
SECTION OF THE MUNICIPAL CODE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BLAIR, NEBRASKA:
SECTION 1. That Chapter 1, Article 10 of the Municipal Code of
Blair, Nebraska be amended to include the following section.
SECTION 2. Compensation; Municipal Officials. The compensation of
any any elective official of the Municipality shall not be
increased or diminished during the term for which he shall
have been elected, except when there has been a merger of
offices; provided, the compensation of the members of
the Governing Body, a board, or commission may be increased
or diminished at the beginning of the full term of any
member whether or not their terms of one or more members
commence and end at different times. No elected official
may be rehired if he resigns and desires to be rehired during
the unexpired term of office if the salary of the same
shall have increased . He may be rehired after the term
of office during which he resigned at a greater salary.
All salaries shall be set by ordinance of the Governing
Body and will be available for public inspection at the
office of the Municipal Clerk.
SECTION 3. That Sectinn 1 -1002 of the Municipal Code of Blair,
Nebraska, is hereby amended.
SECTION 4. This ordinance shall take effect and be in full force
from and after its passage, approval and publication as
required by law.

Section 1. The City of Blair does hereby repeal and vacate

Nebraska; Mid -East Nebraska Regional Planning Commission.
Section 2. The City of Blair does hereby withdraw from
the Mid -East Nebraska Regional Planning Commission and does
hereby terminate its participation therein.

Provide certain minimum standards, additions, and require-
ments for safe and stable design, methods of construction,
and uses of materials and buildings hereafter erected,
constructed, enlarged, altered, repaired, relocated, and
converted, the National Building Code, the most recent
addition in force, recommended by the National Board of
Fire Underwriters, and printed in book or pamphlet form
as hereby incorporated by reference in additon to all
amended additions as though printed in full herein. All
prior ordinances of the municipality and conflict herewith

PERMIT; ADDING THIS ORDINANCE TO THE MUNICIPAL CODE OF THE CITY OF
BLAIR, NEBRASKA; WHEN THIS ORDINANCE SHALL BE IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BLAIR, NEBRASKA:
Section 1. That Chapter 9, Article 1 of the Municipal Code
of Blair, Nebraska be amended to include the following
sections.
Section 2. 9 -104 Building Permits, It shall be unlawful
to commence or to proceed with the erection, construction,
re- construction, conversion, alteration, enlargement or
extension of the exterior of any building or any part
thereof or to move or raze any building or structure with-
out first having applied in writing to the City Clerk and
being issued a building permit to do so.
Section 3. 9 -105 Application and Permit Forms.
A. Application for a building permit shall be in writing
and shall be delivered to the City Clerk who shal], refer
such application to the City Administrator for rejection or
authorization for issuance of a permit. Such application
shall be accompanied by specifications showing the size of
the proposed building or structure and its location on the
lot, in the case of new construction, and in all cases the
proposed construction materials and details and type of
construction to be used.
B. Blank forms shall be provided said City Clerk for the
use of those applying for permits as provided for in this
article. Any permits authorized by the City Administrator
shall be issued by the City Clerk and shall be on standard
forms for such purposes and furnished by the City.
C. A complete record of all such applications, plans and
permits shall be kept in the ii fice of the City Clerk.
Section 4. 9 -106 Building Permit Fees. The fees to be
charged for building permits from and after the passage
of this ordinance shall be as follows:
(1) For work costing less than $50.00 $ No fee
(2) For work costing from $50.00 to $400.00 3.00
(3) For work costing from $400.00 to $5,000.00 6.00
(4) For work costing over $5,000.00 6.Q0
plus $1.00 for each additional $1,000.00 of cost, pro-
vided that the maximum fee charged hereunder shall be
$100.00
Section 5. 9 -107 Expiration. Any Wilding permit under
which no construction work has been commenced within six
months after the date of issue of said permit or under
which the proposed construction has not been completed
within two years of the date of issue shall expire by
limitation and no work or operation shall take place under
such permit after such expiration. Upon payment of ten
cents per month on each one thousand dollars of the con-
struction cost on which the original permit was issued,
but not less than one dollar per month in any case, a build-
ing permit may be extended for a period not exceeding six
months by the City Clerk.
Section 6. That Section 9 -104 thru 9 -107 of the Municipal
Code of Blair, Nebraska are hereby added.
Section 7. This .ordinance shall take effect and be in full
force from and after its passage, approval and publication
as required by law.

warrants and legal and miscellaneous costs and that after applying
all moneys collected on special assessments and other funds available
for such purpose, there still remains due and payable from the City
on the District cost not lest than $160,000.00; that special assess -
ments have been levied according to law on the.real estate in said
Districts specially benefited by said improvements and said special
assessments are valid liens on the lots and tracts of land upon
which they are assessed; and that all conditions, acts and things
required by law to exist or to be done precedent to the issuance
of Street Improvement Bonds of said Districts in the amount of
$160,000.00 pursuant to Section 16 -623, R. R. S. Nebraska, 1943,
as amended, do exist and have been done as required by law.
Section 2. The Mayor and Council of the City of Blair
further find and determine: That pursuant to ordinances heretofore
duly enacted Sanitary Sewer Districts Nos. 23, 24, 26, 27 and 28
were created, and sanitary sewer improvements were constructed
therein, which improvements have been completed and accepted by
the City; that the total cost of said improvements as heretofore
found by the City engineer and Mayor and Council is $101,716.16
and that additional expenses for warrant interest and legal and
miscellaneous costs have been .incurred; that special assessments
have been levied according to law on the real estate in said
Districts specially benefited by said sewer improvements, and
said special assessments are valid liens on the lots and tracts
of land upon which they are assessed; that after applying all moneys
collected on the special assessments and other funds available for
such purpose, there still remains due and payable from the City
not less than $95,000.00 for said sanitary sewer improvements; that
all conditions, acts and things required by law to exist or to be
done precedent to the issuance of District Sewer Bonds of said
Districts in the amount of $95,000.00 under Section 16- 670,.R. R.
S. Nebraska, 1943, as amended, do exist and been done as
required by law.
Section 3. The Mayor and Council of the City of Blair
further find and determine: That pursuant to ordinances heretofore
duly enacted Water Districts Nos. 1, 2, 3, 4 and 5 were created
and water improvements were constructed therein, which improvements
have been completed and accepted by the City; that the costs of said
improvements as heretofore found by the City engineer and Mayor and
Council are,$104,778.44, and that additional expenses for warrant
interest and legal and miscellaneous costs have been incurred; that
special assessments have been levied according to law on the real
. estate in said Districts specially benefited by said water itprove-
ments, and said special assessments are valid liens on the lots and

Section 4. The Mayor and Council of the City of Blair
further find and determine: That all conditions, acts and things
required to exist or to be done precedent to the issuance of
Various Purpose Bonds of the City of Blair, Nebraska, in the princial
amount of $355,000.00 under Sections 18 -1801 and 18 -1802, R. R. S.
Nebraska, 1943, as amended, to pay the cost of the improvements
mentioned in Sections'1,. and 3 hereof do exist and have been done
as required by law.
Section 5. To pay the costs of improvements specified
in Sections 1, 2 and 3 hereof there shall be and there are hereby
ordered issued Various Purpose Bonds of the City of Blair, Nebraska,
in the principal amount of Three Hundred Fifty -five Thousand Dollars
($355,000) consisting of 71 bonds numbered from 1 to 71 inclusive

Bonds maturing on May 15, 1978, and thereafter are redeemable
at the option of' the City at any time on or after May 15, 1977,
at par plus accrued interest to date fixed for redemption.
Said bonds shall bear interest as follows:

the City by being signed by the Mayor and City Clerk and shall

Section 8. The special assessments levied upon the
'real estate as described. in Sections 1, 2 and 3 of this ordinance
and the interest on said assessments shall constitute a sinking
fund for the payment of the principal of and interest on said
bonds. The City agrees it will collect said special assessments
and in case the moneys collected therefrom are nbt sufficient to
fully and promptly pay the interest and principal of said Various
Purpose Bonds as and when such interest and principal become due,
then the City will cause to be levied and collected annually .a tax
by valuation on all the taxable property in the City, in addition
to all other taxes, sufficient in amount to fully pay the principal
and interest of said bonds when and as such interest and principal

Section 9. After being executed by the Mayor and Clerk
said bonds shall be delivered to the City Treasurer who shall be
responsible therefor under his official bond. ''The City Treasurer
shall cause said bonds be in the office of the County
Clerk of Washington County and with the Auditor of Public Accounts
of the State of Nebraska. The City Clerk is directed to make and
certify in duplicate transcripts of the proceedings of the City
precedent to the issuance of said bonds, one of which transcripts
shall be filed with the Auditor of Public Accounts of the State of
Nebraska, and the other shall be delivered to the purchaser of
said bonds.
Section 10. Said bonds having been sold, the City
Treasurer is authorized to deliver said bonds to the purchaser on
receipt of full payment of the purchase price, which shall be not
less than par and accrued interest to date of payment.

YARD, SIDE YARD, AND REAR YARD SET BACK REQUIREMENTS IN RESIDENTIAL
AND AGRICULTURAL DISTRICTS; PROVIDING WHEN THIS ORDINANCE SHALL BE
IN FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BLAIR, NEBRASKA:
Section. In A -1 Residence District, A -2 Residence
Districts and A -3 Residence - Agriculture Districts there
shall be a setback line for all buildings of not less
than 25 feet from the front lot line, provided that where
40% or more of the lots in the same block contain
buildings, which have an average setback line with a
variance of not more than 6 feet, no building hereafter
erected or structurally altered shall project beyong the
average set back line so established and, provided further,
that this regulation shall not be so interpreted as to
require a setback of more than 50 feet. On corner lots
the front line of the building shall comply with the set-
back regulations for the street upon which the front

of the building faces and to not less than one -half of the
set back requirements on the side street when there are
buildings located on said side streets. Accessory build-
ings on corner lots, regardless of which way said buildings
face, shall be set back to conform to the full front
setback required on both streets, except that where
there are no buildings fronting on the side street,the
side yard requirements only shall apply on that side.
Section 2. In A -1 Residence,Distriets, A -2 Residence
Districts and A -3 Residence - Agricultural Districts
there shall be a side yard on each side of each principal
building of not less than 7 feet measured from the
outermost projection of said building, inclduing its
sills, cornices, ornamental features or ._eaves to said

EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BLAIR, NEBRASKA:
Section 1. 1 -324 City Clerk and Acting Administrator;
Duties: There is herewith created the position of City
Clerk and Acting Administrator of the City of Blair,
Nebraska who shall have charge of the operation, maintenance,
repair, general supervision, and management of all other
property of the City, except its Public Utilities and
except as otherwise provided by Ordinance or Law; shall
receive all applications for permission to cut or trim

trees and may grant or refuse such applications on behalf
of the City, but shall promptly report all such applications
and the disposition thereof made by him to the Mayor and
City Council; shall receive and investigate any complaints
with respect to City property and services other than
matters concerning the operation of the City -owned
Utilities, and promptly and properly report on the same
to the Mayor; shall perform all duties of building and
construction inspection; shall plan and correlate the use
of general City employees so that efficient use of suchs
employees shall be obtained by the City; shall inspect the
operations of City Boards, Departments and employees other
than the City Public Utilities, and make recommendations
to the Mayor for their improvement and perform such other
duties as may be required of him from time to time by the
Mayor and City Council; he shall attend the meetings of
the governing body, and keep a, correct journal of the
proceedings of that body; he shall keep a record of all
outstanding bonds against the municipality and when any
bonds are sold, purchased, paid, or cancelled, said record
shall show the fact. He shall make, at the end of the
fiscal year, a report of thebusiness of the Municipality
transacted through his office for the year in which he
shall describe particularly the bonds issued, and sold
during the year, and the terms of the sale with each, and
every item, and expense thereof. He shall file all
official bonds after the same shall have been properly
executed, and approved. He shall make the proper certificate
of passage which shall be attached to original copies of
all bond ordinances hereafter enacted by the Governing
Body. He shall issue, and sign all licenses, permits, and
occupation tax receipts authorized by law, and required by
the Municipal ordinances. He shall collect all occupation
taxes, and license money except where some other Municipal
officer is specifically charged with that duty. He shall
keep a register of all licenses granted in the Municipality,
and the purpose for which they have been issued.
He shall permit no records, public papers, or other doc-
uments of the Municipality kept, and preserved in his
office to be taken therefrom, except by such officers of the
Municipality as may be entitled to the use of the same, but
only upon their leaving, a receipt therefor. He shall keep
all the records of his office, including a record of all
licenses issued by him in a blank book with a proper index.
He shall include as part of his records all petitions under
which the Governing Body shall order public work to be done
at the expense of the property fronting thereon, together
with references to all resolutions, and ordinances relating
to same. He shall endorse the date, and hour of filing
upon every paper, or document:; so filed in his office. All
such filings made by him shall be properly docketed. In-
cluded in his records shall be all standard codes, amend-
ments thereto, and other documents incorporated by reference,
and arranged in triplicate in a manner convenient for re-
ference. He shall keep, and preserve the proceedings of the
Governing Body in two (2) separate, and distinct record
books: The Minute Records, wherein shall be recorded the
miscellaneous, and informal doings of the Governing Body.
The Minute Record shall not include the passage, and approval
of ordinances except such resolutions incorporating by ref -
erence- the Ordinance Record into the Minute Record. The
Ordinance Record wherein shall be recorded the formal pro -
ceeings of the Governing Body in the matter of passing, .
approving, publishing, posting, and certifying of ordinances.
After the formalities for the legal enanetment of an ordinance,

as required by law, have been completed, the City Clerk
shall record, and spread at large in the Ordinance Record
his ordinance minutes on printed forms. In all cases
hereafter where single ordinances are introduced for the
consideration of the Governing Body, the City Clerk shall
cause to be introduced an appropriate resolution incor-
porating by reference the Ordinance Record into the Minute
Record. He shall keep an accurate, and complete account
of the appropriation of the several funds, draw., sign, and
attest all warrants ordered for the payment of money on the
particular fund from which the same is payable. At the end
of each month, he shall then make a report of the amounts
appropriated to the various funds, and the amount of the
warrants drawn thereon. Nothing herein shall be construed
to prevent any citizen, official, or other person from
examining any public records of all reasonable times.
He shall deliver all warrants, ordinances, and resolutions
under his charge to the Mayor for his signature. He shall
also deliver to officers, employees, and committees all
resolutions, and communications which are directed at said
officers, employees, . or committees. With the seal of the
Municipality, he shall duly attest the Mayor's signature
to all ordinances, deeds, and papers required to be attested
to when ordered to do so by the Governing Body. Within
thirty (30) days after my meeting of the Governing Body,
unless otherwise directed, he shall.preparei and publish
the substance of the proceedings in a legal newspaper of
general circulation in the Municipality, and whip i was
duly designated as such by the Governing Body; Provided,
the charge for such publication shall not exceed the rates
provided by the statutes of the State of Nebraska. Said
publication shall be charged against the General Fund.
He shall then keep a blank book with a proper index, copies
of all notices required to be published. or posted by him'
by order of the Governing Body, or under the ordinances of
the Municipality, to which notices shall be attached the
printer's affidavit of publication, if the said notices
are required to be published, or the City Clerk's certificate
under seal where the same are required to be posted only.
He shall receive all objections to creation of paving
districts, and other street improvements. He shall receive
the claims of any person against. the Municipality, and in
the event that the said claim is disallowed in part, or
in whole„the City. Clerk shall notify such claimant, his
agent, or attorney by letter within five (5) days after
such disallowance, and he shall then prepare transcripts
and .appeals of any disallowance of a claim in all proper
cases.
He may charge a reasonable fee for certified copies of any .
record in his office as set by resolution of the Governing
Body. He shall destroy, Municipal Records under the direction
of the State Records Board pursuant to sections.84 -1201
thru 84 -1220; Provided, the Governing Body shall not have
the authority to destroy the Minutes of the City Clerk,
the permanent ordinances, and resolution books, or any
other records classified as permanent by the State Records
Board. He shall perform all other duties of the City
Administrator and City Clerk and provided by the Municipal
Code of the City of Blair, Nebraska (Reference 16 -308, 16 -317,
19 -1102, 19 -1104, 84 -1201 through 84 -1220, 84 -172 RS NEB.)
Section 2. 1 -325 Deputy City Clerk; Duties. Deputy City
Clerk shall perform all duties and functions as are delegated
to him by the City Clerk and acting Administrator. In the

and Acting Administrator.
Section 3. 1 -308 and 1 -321 are hereby repealed and the
abovementioned Sections are hereby added to the Municipal
Code td the City of Blair, Nebraska.
Section 4. This ordinance shall take effect and be in
full force from and after its passage, approval and pub-
lication as required by law.

INCLUDED WITHIN SAID DISTRICT, PROVIDING FOR THE MANNER OF PAYMENT

through Forty -five (45) in Baronage Valley, an addition
to the City of Blair, Washington County, Nebraska.
SECTION 4. The costs of said improvement and said Water
District shall be paid out of the fund created by levy
and assessment of the lots and parcels of land in said
improvement district, benefited, and to be in proportion
to said benefits, all as by the statutes of the State
of Nebraska as madeand provided.

SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska hereby declare the necessity to construct a sanitary
sewer on the following line, to -wit: Beginning at a point in
the centerline of 16th Street from the existing sewer main
approximately 80' South of the middle of the intersection of
16th Street and Adams Street; thence North along 16th Street,
as shown on the Baronage Valley plat, and proceeding to the
intersection of 16th Street and Baronage Drive; thence Easterly
and Northerly along Baronage Drive to the end of Baronage Drive

as platted, providing for separate extensions from the point of
intersection of Baronage Drive and Lords Court; thence South-
easterly to the center of Lords Court, also beginning at the
intersection of 16th Street and Baronage Drive; thence Northerly

of the west line of Baronage Valley, also beginning at the
intersection of Baronage Drive and Baronage Circle; thence
along said Circle Northerly, Easterly, Southerly and Westerly

created a Sanitary Sewer District No. 31 if the City of Blair,

SECTION 2. The improvement to be made is to construct and lay
an eight (8) inch vitrified clay sewer tile with manholes and
wyes, said improvement to be made according to plans and spec-
ifications and estimate of costs to be prepared by the Special.
Engineer of said District and filed with the City Clerk and
approved by the Mayor and City Council of said City.
SECTION 3. The property included in said Sanitary Sewer
District No. 31 and subject to special assessments to pay for
the costs and expense of said improvement are Lots One (1)
through Forty -five (45) in Baronage Valley, an addition to
the City of Blair, Washington County, Nebraska.
SECTION 4. The costs of said improvement and said Sanitary
Sewer District shall be paid out of the fund created by levy
and assessment of the lots and parcels of land in said improve-
ment district, benefited, and to be in proportion to said
benefits, all as by the statutes of the State of Nebraska as
made and provided .

Light System Fund,
SECTION 7. That there be, and hereby is appropriated out
of the money derived from taxes for sewer maintenance for
said fiscal year and out of all other funds and moneys
available therefor, the amounts.for each object and purpose
as follows:
For salaries of employees, operation and maintenance
of sewer system and sewer treatment plant $ 75,000.00
For extension, improvements of sewer system $1,134,000.00
Any balance of said fund remaining over and unexpended at the
end of the fiscal yearshall be transferred to the Sewer
Maintenance Fund.
SECTION 8. That there be, and hereby is appropriated out
of the money derived from the levy of taxes for the operation,
maintenance and care of;the Blair Cemetery $ 12,000.00
Any balance of said fund remaining over and unexpended at
the end of the fiscal year shall be transferred t� the
Cemetery Fund.
SECTION That there be, and hereby is appropriated out
of the money derived from the levy of taxes for the payment
of refunding bonds and interest thereon and the sinking
fund for said fiscal year and out of the money derived
from taxes levied for payment of intersections and for
district paving bonds, and interest and out of any and all
other funds and money available .. therefor,: the amounts for
each object and purpose as. follows:
For payment of principal and interest of bond indebtedness
due or to become due and for sinking bonds fund = - -- $162,000.00
Any balance of said funds remaining over and unexpended at
the end of the fiscal year shall be transferred to the. Sinking
Fund for the payment of refunding bonds.
SECTION 10. That there be, and hereby is appropriated out
of the money derived from the levy of taxes for the maintenance
and operation of the Fire Deparment for the present fiscal
year and out ()fell other money and funds available therefor,

belonging to said City, the amounts for each object and
purpose as follows:
For the maintenance and operation of the City Fire Dept.$16,000.00
Any balance of said fund remaining over and unexpended at the
end of the fiscal year shall be transferred to the fund for
maintenance and operation of the City Fire Department.
SECTION 11. That there be,and hereby is appropriated out .
of the money derived from the levy of taxes, for the purpose
of Purchase of Fire Department Apparatus for the present,
fiscal year and out of all other money and funds available
therefor, belonging to said City, the amounts for each
object and purpose as follows:
For the purchase of Fire Department Apparatus $ 9,000.00
Any balance of said fund remaining over and unexpended at
the end of the fiscal year shall be trasnferred to the Fire
Department Apparatus Fund.
SECTION 12. That there be, and hereby is appropriated out
of the money now on hand for the Special Gasoline Road
Fund and from the money derived from special gasoline tax
and motor registration fee, and the amounts for each object
and purpose as follows:
For construction of street improvments $240,000.00
Any balance, of said fund remaining over and unexpended at
the.end of the fiscal year shall be transferred to the
Special Gasoline Tax Fund.
SECTION 13. That there be, and hereby is appropriated out
of the money derived from the levy of taxes for the purpose
of paying the City's share of the employees and officers.
Federal Social Security Tax for present fiscal year and
out of all other money and funds available therefore,
belonging to the said City the amount for each object and
purpose as.(f ollows :
For City's share of employees and Officers' Federal
Social Security Tax $22,000.00
Any balance in said fund remaining over and unexpended at
the end of the fiscal year shall be transferred to the Social,
Security Tax Fund.
SECTION 14. That there be, and hereby is appropriated out
of the money derived from the operation of the Blair Apartments
and all other money and funds available therefore, the amount
for each object and purpose as follows:
For salaries of employees, operation and maintenance
of Blair Apartments $48,000.00
Any balance of said fund remaining over and unexpended at the
end of the fiscal year shall be transferred to the Blair — 1
Apartment Fund.
SECTION 15. That there be, and hereby is appropriated out of
the money derived from the levy of taxes for Supervised
Recreation purposes for the fiscal year and out of all moneys
and funds available therefore, the amount for each object and
purpose as follows:

THEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN FORCE AND

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION1. That a zoning code is hereby adopted for the
City of Blair, Nebraska, which shall be cited as the 1972
revised zoning ordinance of the City of Blair, Nebraska.
SECTION 2. Under the provisions of Section 18 -132, RS
Nebraska 1943, reissue of 1970, because said zoning code
is a standard code which contains rules and regulations
printed as said code in book or pamphlet form, and be-
cause not less than three (3) copies of such standard

zoning code have been filed for use and examination by the
public in the office of the clerk of the City of Blair,
Nebraska, prior to the adoption thereof, no publication
of said complete zoning code is required by law.
SECTION 3. That said zoning code, being adopted in book
or pamphlet form pursuant to the above statute, is by
reference incorporated herein. Not less than three (3)
copies of such zoning code shall be at all times kept
current in the office of the clerk of the City of Blair,
Nebraska.

SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby declare and deem it necessary to improve
Adams Street from its intersection with llth Street easterly
to its intersection with the existing paved County Road in
said City, by paving the same, and for said purpose there
is hereby created Street Improvement District No. 115 of
the City of Blair, Nebraska.

SECTION 2. The street improvement to be made is to pave
said section of said street as aforesaid, the grade of
said street to conform to the existing grades of said
City of Blair, and said improvement to be made according
to plans and specifications and estimate of cost to be
prepared by the Special Engineer for said District and to
be filed with the City Clerk and to be approved by the
Mayor and Council of said City.
SECTION 3. The property included in said Street Improve-
ment District No. 115 and subject to special assessments
to pay for the cost and expenses of said street improvement
is all of the privately owned lots, parts of lots and
tracts of land and the lots, parts of lots and tracts of
land owned by any municipal or public corporation and
abutting upon and adjacent to said street to be improved, to-
wit:
Tax Lot Fifty -nine (59) in Section One (1) , Township
Eighteen (18) North, Range Eleven (11) , East of the Sixth
Principal Meridian in Washington County, Nebraska; Lot
Twenty -eight (28) in Block Three (3) in the Second
Replat of Fairview Heights Addition to the City of Blair,
Nebraska; and Lots One (1) , Six (6) and Seven (7) in
Block Two (2) in Beck's Addition to the City of Blair,
Nebraska.
SECTION 4. The cost of said improvement in said Improvement
District shall be paid out of the fund created by the levy
and assessments on the lots and parcels of land in said
Street Improvement District benefited thereby in proportion
to said benefits, all as by the Statutes of the State of
Nebraska in such cases made and provided.
SECTION 5. This ordinance shall take effect and be in

FIRST READING
The Mayor directed the Clerk to read by title Ordinance
No. 1072 of the City of. Blair, Nebraska. The Clerk thereupon
read the aforesaid Ordinance No. 1072 by title upon its first
reading.
Whereupon Councilman. Jensen moved that Ordinance No. 1072
be approved on its first' reading and its title agreed to.
Councilman Pounds seconded the motion and Councilman Jenny called
for the question. The Mayor put the question and directed the
Clerk to call the roll for the vote thereon:
Yeas: Allen, Ellis, George,Jenny, Jensen, Lutz, Nelson, Pounds.
Nays: None.
Absent: None.
Motion: Carried.
SUSPENSION OF RULES
Whereupon it was moved by Councilman Jensen that the
Statutury Rules requiring reading on three different days be
suspended for consideration of this Ordinance No. 1072. It was
seconded by Councilman Pounds and Councilman Jenny called for the
question. The Mayor put the question and directed the Clerk to
call the roll for the vote thereon:
Yeas: Allen, Ellis, George, Jenny, Jensen, Lutz, Nelson, Pounds.
Nays: None.
Absent: None.
Motion: Carried.
Whereupon the Mayor declared the Statutory Rules in regard
to the passage and approval of Ordinances suspended so said
Ordinance No. 1072 might be read by title upon its first and
final reading with the "yeas't and "nays" each,time called, recorded
and approved and passed at the same meeting.
