affidavit in support of Rod and Sandra Ross' appeal of the dangerous dog

2. I have previously dog -sat for Rod and Sandra Ross, watching Gabe and
Rocky whenever the Rosses went out of town and needed someone to keep an eye on
their dogs.
3. I have known Gabe and Rocky for a long time — I met Gabe three years
ago and have known Rocky since he got adopted. Gabe and Rocky have always been
very nice and have never threatened to bite me.
4. Gabe and Rocky have never even so much as growled at me. I have let
them out of the Rosses' house into the backyard by myself several times and have
never experienced any trouble with either dog. They are generally happy dogs.

2. Sandra Ross is my mother and Rod Ross is my stepfather. Gabe has
been my dog since I was 16 years old, and I am currently 21 years old. Gabe is my
best friend in dog form — he is the sweetest dog I have ever met. My family has
moved and welcomed many people into our homes and Gabe is always eager and
excited to meet any new guests.
3. Rocky quickly became another best friend of mine after moving into
our home about a year ago. Rocky is one of the most loving living things on Earth.
Rocky and Gabe are both goofy and very loving. They would never hurt anyone.
4. During the incident on June 27, 2023, Rocky and Gabe were only
trying to protect their family and their home after another party walked in
unannounced and with a strange, unfamiliar dog.
5. I have never seen either dog act aggressively or dangerously. I do not
believe Rocky or Gabe are dangerous, nor do I believe that is how they should be
labeled or "deemed." They are the sweetest, kindest and most loving dogs I have
met.

2. Rod Ross is my father and Sandra Ross is my stepmother. Their dogs,
Gabe and Rocky, are the sweetest boys I have ever met. I have never seen them act
aggressively towards anyone. They are loving and nice, often thinking they are
actually lap dogs and giving kisses to anyone they can.
3. Gabe and Rocky usually play with each other in the fenced -in backyard
and do not cause trouble. They welcome everyone to our home with wagging tails
and kisses.
4. On June 27, 2023, my family did not know Sophia had entered their
home. Without this knowledge, my family could do nothing to prevent the situation
that resulted. Gabe and Rocky were protecting their house because that is what
dogs do.
5. Gabe and Rocky are not dangerous dogs and do not deserve to be
designated as such. They were simply protecting their home from an unknown,
unannounced entry by another individual and a dog they had never met.

with wagging tails and happy faces. I have never once felt intimidated when letting
Gabe and Rocky out of their kennels at night. 1 always look forward to seeing Gabe
and Rocky.
4. I have never seen Gabe or Rocky act aggressively or in a threatening
manner. My experience with them is the exact opposite — they typically act more
passive and loving than my Goldendoodle. Gabe and Rocky are not dangerous dogs.

behavior and temperament well.
3. I have never felt that Gabe or Rocky are dangerous dogs. From my
experience, they are quite the opposite of dangerous — they are friendly, sweet and
love to get pets and attention from anyone and everyone.
4. I am aware Sophia Grantham entered my father and stepmother's
home on June 27, 2023, without their knowledge or permission. This behavior
would naturally put Rocky and Gabe on edge. Sophia's decision to enter the home
unexpectedly was made worse by bringing her dog into the home with her.
5. Prior to June 27, 2023, Rocky and Gabe had never met Sophia's dog,
Ozzie. I do not believe Rocky and Gabe are dangerous, but rather protected their
home and owners from trespassers.
6. I have never felt unsafe around Gabe or Rocky and I do not believe
they should be considered dangerous.

2. I have worked at a home for people with disabilities that is next door to
Rod and Sandra Ross' home for 18 years. I have three dogs of my own and I often
bring them to work.
3. The home for people with disabilities shares a fence line with the
Rosses' home. My dogs love to run the fence line with the Rocky and Gabe. The
Rosses' dogs have never caused any problems with me or my dogs.
4. I have never seen Rocky nor Gabe exhibit any sort of behavior that
could be considered dangerous or aggressive in the time I've lived next to the
Rosses. Whenever Rocky and Gabe interact with my dogs, they are always excited—
tails wagging, happy to see each other.

Rod Ross, being first duly sworn upon oath, states as follows:
1. I am over the age of nineteen (19) years and am competent to testify. I
have personal knowledge of the information contained herein. I submit this
affidavit in support of my appeal of the dangerous dog declaration dated July 20,
2023, regarding my dogs Rocky and Gabe.
2. I live at 833 N. 13th Street, Blair, Nebraska, 68008, with my wife,
Sandra Ross. We have two dogs: Rocky, a 3 -year-old American bulldog mix, and
Gabe, a 7 -year-old pitbull mix. Both dogs are sweet and well-mannered. Sandra and
I have never experienced any behavioral problems with either dog.
3. Our home is accessible through the garage by a side door. The door is
very squeaky and opens into the home from the garage. On June 27, 2023, Sophia
Grantham, my daughter's friend, used this door to enter my home without the
permission or knowledge of myself or my wife.
4. As I ate dinner with my family around 6:30 p.m. on June 27, 2023, I
heard a loud squeak as the side door opened. I do not recall hearing a knock or
hearing anyone announce they were coming into my home. The squeak lasted long
enough that it sounded as though the door was opened all the way. Not expecting
company, I immediately left the dinner table to make sure Rocky and Gabe did not
run out the door.
5. I was too late. As I turned the corner, I saw Sophia in the garage with
her dog, Ozzie. Gabe stood next to Ozzie's head and Rocky stood next to her back
legs. I immediately grabbed Rocky and Sandra grabbed Gabe.
6. Chaos ensued. Sophie placed her right arm over Ozzie's body,
screaming and punching Gabe in the head with her left hand. Sandra and I tried
our beat to separate the three dogs. The dogs eventually moved from the garage to
the driveway and then the front yard.
7. Once the dogs entered the front yard, I grabbed Rocky's leash from my
pickup. Once I leashed Rocky I easily pulled him away from Ozzie and Gabe. Sophia
continued to scream and punch Gabe with her left hand, her right arm still hanging
over Ozzie. A neighbor eventually arrived and sprayed pepper spray on the dogs,
which did not help.
8. Another neighbor helped Sandra remove Gabe and leash him. Once
Sandra leashed Gabe, Sophia ran into the house with Ozzie. Sandra and I remained
in the front yard with Rocky and Gabe. Police and an ambulance showed up shortly
after. Gabe and Rocky had no injuries.
9. I spoke with Officer Keller regarding the incident and advised that
Sophia entered my home—with her dog—without my knowledge or permission. I
further advised Rocky and Gabe did not like a strange animal being brought into
their home unannounced.
10. On June 28, 2023, Animal Control Officer Brent Gunderson advised
Sandra and I as to quarantine procedure for the dogs and the general procedure for
declaring dogs as "dangerous." We diligently followed all quarantine requirements
and updated our dogs' licenses as well. On July 10, 2023, I provided Officer
Gunderson quarantine letters signed by our dogs' veterinarian.
11. On July 20, 2023, Officer Gunderson delivered the Notice of Dangerous
Dog Declaration for Gabe and Rocky. He informed me that Chief of Police Joseph
Lager made the recommendation over his objection. Officer Gunderson repeatedly
and emphatically told me to review Blair City Ordinance 6-125(4), which provides an
exception to declaring a dog dangerous or potentially dangerous.
12. After reviewing Blair City Ordinance 6-125(4) at Officer Gunderson's
suggestion, I do not believe Gabe or Rocky should be declared dangerous. Sophia
clearly committed a trespass when she entered our home, unannounced and without
permission, through a side door. Not only did Sophia trespass, she trespassed with a
dog that Gabe and Rocky had never met before. Our dogs' reactions were natural
and instinctual.
13. Other than this incident on June 27, 2023, where Gabe and Rocky
protected their home and their owners, I have never seen either dog act aggressively
or dangerously. We frequently have guests in our home. Gabe and Rocky
consistently greet visitors with wagging tails and kisses. Neither dog has a
dangerous bone in their body.

affidavit in support of Rod and Sandra Ross' appeal of the dangerous dog
declaration dated July 20, 2023, regarding their dogs Rocky and Gabe.
2. I am the founder and representative of Helping Hand, a non-profit
animal rescue organization that originated in Washington County. Gabe is a rescue
Helping Hand temporarily housed prior to his adoption by the Rosses.
3. Over the twenty -plus years of working as an animal rescue, it is part of
Helping Hands protocol to assess all animals in regard to temperament to the best
of our ability. Assessments include all different types of aggression dogs may
display, including toy aggression, food aggression, aggression with other animals
and aggression based on various human gestures. We assess dogs by putting a hand
on their head, pulling their tail, touching their face, etc. to observe their reaction.
4. Gabe came to Helping Hand through an owner surrender. As a young,
energetic dog, Gabe lived in an apartment with children and was exposed to
domestic violence. From the get -go Gabe welcomed every dog that entered his play
yard at Helping Hand. He was amorous and accepting, and he absolutely loved to
play with other dogs. He showed no aggression around other dogs.
5. Initially, Gabe was leery of men because of his exposure to domestic
violence. However, he quickly learned to trust again and accepted everyone, human
and animals alike. Even during his time of lack of confidence he never once showed
aggression towards any handler, volunteer or animal.
6. It is my understanding Rocky is also a rescue from a local shelter that
performs assessments similar to Helping Hand.
7. The incident on June 27, 2023, could have been avoided, had several
human indiscretions not occurred. Consider the 4th of July timeframe things
blowing up around the neighborhood and putting the dogs on alert that something
was not quite right with the atmosphere.
Additionally, for an individual to walk into a home with no warning
and a triinge new dog unfamiliar to Gabe and Rocky, Gabe and Rocky's reactions
were not at all out of the norm. They simply acted as pack animals in defending
their home and family.
9 How the situation between the dogs was broken up again falls on the
humans and not the animals. As rescuers, we are taught how to break up a fight.
Stickil,g a hand into the middle of dogs fighting is always a bad idea and is
essentially volunteering to get bitten. While I do not fault the other owner for
punching the dogs in the heat of the moment, her behavior likely caused the
situation to escalate.
10. Through decades of doing rescue and shelter work, I have learned 95%
of all dog bite incidents and dog fight incidents fall on the responsibility of the
humans. Humans punish the dogs and react too quickly by either putting the dogs
down or deeming them as dangerous, when animal training or behavioral sessions
with a qualified trainer are a more viable, safe option.
11. I truly do not believe Gabe and Rocky are dangerous or aggressive. The
fault here lies with a string of human errors in reaction to very normal dog
behavior.

2023, regarding my dogs Rocky and Gabe.
2. I live at 833 N. 13tb Street, Blair, Nebraska, 68008, with my husband,
Rod Ross. We have two dogs: Rocky, a three-year-old American bulldog mix, and
Gabe, a seven-year-old pitbull mix.
3. We have owned Rocky for a little over one year and Gabe for five years.
Both dogs are very loving, sweet and well-behaved. They are not dangerous or
aggressive.
4. On June 27, 2023, around 6:00 p.m., Sophia Grantham, my step-
daughter's friend; sent me a message on Snapchat letting me know she was out
walking her dog, Ozzie. Sophia asked if she could stop by my house to get water for
her and Ozzie. I said sure and told Sophia she could even take a taco with her, as I
was making dinner when she messaged me.
5. I expected Sophia to message me when she was close to my house, but
I never received another message from her after 6:00 p.m. I assumed Sophia would
come through the front door as she typically does when visiting my stepdaughter. I
also assumed she would not bring her dog into my home.
6. Instead, around 6:30 p.m., Sophia walked through the garage of my
house and opened a side door into my home without my knowledge or permission.
She did not knock or announce her presence. She also had Ozzie with her, whom my
dogs had never met before.
7. The side door from the garage to the house is very squeaky. I heard a
loud squeak as Sophia opened it and exclaimed, "Look! There's doggies!" I assume
Sophia made this comment to Ozzie. I immediately jumped up from the kitchen
table to make sure my dogs were not near the door, but I was already too late.
8. By the time I made it to the door, Sophia, Ozzie, Rocky and Gabe were
already in the garage. Gabe stood next to Ozzie's head and Rocky stood next to her
rear end. Sophia was screaming, punching Gabe in the head with her left hand and
draping her right arm over Ozzie's body.
9. The next few minutes were a blur of chaos. I tried to remove Gabe and
Rod tried to remove Rocky. The dogs all moved from the garage to the driveway and
eventually our front yard as we tried to separate them. Sophia continued to scream
and punch the dogs with her left hand while keeping her right arm on Ozzie.
10. Rod managed to retrieve Rocky's leash from his pickup and pull Rocky
away. Shortly after, a neighbor arrived and sprayed pepper spray on the Ozzie and
Gabe, which seemed to escalate the situation. Another neighbor eventually helped
pull Gabe away, which allowed me to put a leash on him.
11. Sophia ran into our house with Ozzie as Rod and I sat in the front yard
with Gabe and Rocky. Police and an ambulance showed up shortly after. Sophia
declined medical treatment. Fortunately Gabe and Rocky had no injuries.
12. The day of the incident, law enforcement did not speak to me. They
spoke to Rod, who advised them Sophia entered our home without our permission
and with her dog.
13. On June 28, 2023, Animal Control Officer Brent Gunderson advised
Rod and I as to the quarantine procedure and whether our dogs would be declared
"dangerous." We diligently followed all quarantine requirements and updated our
dogs' licenses.
14. On July 20, 2023, Officer Gunderson delivered the Notice of Dangerous
Dog Declaration for Gabe and Rocky. He informed Rod that Chief of Police Joseph
Lager made the recommendation over his objection and repeatedly encouraged Rod
to review Blair City Ordinance 6-125(4).
15. After reviewing Blair City Ordinance 6-125(4) at Officer Gunderson's
suggestion, I do not believe Gabe or Rocky should be declared dangerous. Not only
did Sophia commit a trespass in entering our home unannounced, without
permission and through a side door, she brought an unfamiliar dog into our home.
Our dogs reacted as any dog would and protected their home.
16. Other than this isolated incident, I have never seen Gabe or Rocky act
aggressively at any time. Gabe and Rocky love having guests in our home. They
enjoy the extra attention, greeting everyone with happy faces and wagging tails.
Our dogs are sweet, loving and affectionate --not dangerous.

This is a 21 -year-old female who presents to the emergency department today for dog
bites. The patient indicates that she was bitten by 2 pit bulls around 7:00 PM. The
patient states that the 2 dogs belong to her best friend's parents. Evidently the owners
have confirmed that the dogs are both up-to-date on their vaccinations, and they did
Provide vaccination records to the patient's family. The patient indicates that she
had her dog, a yellow lab, with her at the time. Evidently the 2 pit bulls attacked her and
her dog. She indicates that she was bitten on the right forearm and hand, and also on
the left hand. The patient indicates that she was pulled to the ground onto her knees,
and was sort of drug on the ground a little bit. She denies any injury to her head, chest,
or abdomen. She reports minor abrasions to her knees, but no pain in her legs. She
indicates that she has been able to ambulate. Her main concern is bites to the right
forearm. She has several punctures about the right elbow and proximal forearm area,
as well as punctures on both hands. She indicates that her last tetanus immunization
was about 9 years ago. She has been otherwise physically well lately. No other
complaints or concerns. Nothing tried for relief prior to coming in. She was offered pain
medication upon my initial evaluation, but declines.

The patient presents to the emergency department for dog bites to her left hand, right
forearm, and right hand. Does have several puncture wounds noted. She has puncture
wounds on both hands, and several puncture wounds on the right proximal forearm
area. X-rays were obtained and do not show any obvious evidence of bony trauma
or retained foreign body. She does not have any evidence of compartment syndrome.
There is no pallor. Distal sensation is intact. Right radial and ulnar pulses are 2+. She
does not have pain out of proportion to exam. She does have good extension of the
right wrist demonstrating intact radial nerve. However, she is having a hard time
with abduction of the fingers and thumb opposition. This could be due at least in part to
some swelling and pain. The patient seems apprehensive about doing these
movements. However, I am concerned about the possibility of a nerve injury given
the multiple puncture wounds to her proximal forearm area. I spoke on the phone
with Jessica, who is on-call for orthopedics with MD West One. She indicates that the
patient should call the office and get an appointment scheduled to see one of the hand

specialists on an outpatient basis. I recommended that the patient call the office
tomorrow to get an appointment scheduled to be seen for follow-up in the next couple of
days. We are going to prescribe Augmentin to hopefully reduce the risk of infection
from the dog bites. She will be given her first dose of Augmentin here in the emergency
department. The wounds were thoroughly cleansed here in the emergency
department. The patient tolerated this well. She was instructed to return to the
emergency department at any time if she develops any new or worsening symptoms.
She will otherwise just plan on following up with orthopedics. She voices understanding
and is in agreement with the plan of care.
The patient has been evaluated here in the emergency department and has been given
a medical screening examination. At this time, the patient does not have evidence of an
emergency medical condition. The patient will be discharged from the department.

At approximately 7:15pm today Ozzie was on a walk when she was attacked by 2 large, loose dogs
(not feral) for approximately 10 minutes. P did not appear to lose consciousness during the attack.
Afterwards P was able to walk, but was bleeding significantly from multiple injuries in various parts of
her body. P was asymptomatic before the traumatic event.
Ozzie is UTD on vx (as are the dogs who attacked P), not currently on any medications, and has a
medical history of a seizure (March 2023) and anxiety. P is currently on Prozac 30mg q 1-2 times a

Repair:
Two puncture on lower right abdomen - confirmed no involvement with abdominal cavity. Connected
the two punctures using metzenbaums. Closed subcutaneous pocket with 3-0 Securodox in simple
continuous patterns, Closed skin margins with 2-0 Nylon.
One puncture on lower left abdomen - confirmed no involvement with abdominal cavity. Debrided
area around puncture and extended puncture 2-3 cm to allow closure of subcutaneous pocket with
3-0 Securodox in simple interrupted pattern. Apposed skin margins with 2-0 Nylon.
Puncture on cranial chest with an associated pocket that dived dorsal/deep, but no obvious muscle
trauma. Placed penrose drain exiting ventral to pocket and sutured into place subcutaneously dorsal
to wound. Used 3-0 Securodox to close subcutaneous tissue over drain, and apposed skin margins
with 2-0 Nylon.
Puncture present right lateral to anus, on ventral aspect of tail base and dorsal aspect of tail all
debrided and closed with 3-0 Securodox.
Right dorsal neck puncture present with 3-4 inch pocket. Placed a penrose drain that exited ventral
to the puncture,
A few smaller punctures on top of head closed with staples.
Right ear pinna distal 5 cm degloved on outer layer. Additional 3-4 cm laceration on dorsal outside of
pinna near ear base. Debrided margins. Cropped ear to remove degloved area. Used 4-0 Securocryl
absorbable sutures that do not need to be removed to repair all ear margins.
Puncture on left ventral to the left ear base extended several inches ventrally, and placed penrose
drain. Several other smaller punctures with less pocketing closed with surgical staples.
Left ear pinna contained at least 4 lacerations ranging from 1-2 cros that were all debrided and
repaired with 4-0 Securocryl in a simple interrupted pattern with absorbable suture that does not
need to be removed.
Puncture on caudal aspect of right thigh and just ventral to cranial right knee debrided and closed
with 2-0 Nylon in a simple interrupted pattern.
The deepest of the wounds, and wounds most concerning for potential complications were on the
dorsal caudal abdomen just cranial to the tail base. Six deep punctures were present that all
connected subcutaneously. Three punctures close in proximity on the caudal aspect were connected
using metzenbaums and explored subcutaneously. The dorsal muscles around the tail base were
completely transversely lacerated down to the vertebra. The muscle was repaired with 3-0 PDS in a
simple continuous pattern. A penrose drain was placed that was sutured into place subcutaneously
on the left lateral aspect of the region of punctures and made to exit ventral to the puncture on the
right dorsal caudal thigh. Margins of punctures debrided. Subcutaneous tissue closed over drain
using 3-0 PDS as needed. All punctures in this region closed with surgical staples.

DIAGNOSIS:
Dog bite wounds - Severe
MEDICATIONS:
1. Clavamox (375 mg) tablets: Give 1 tablet by mouth every 12 hours until gone for infection. Side
effects include vomiting and diarrhea. Call if side effects occur. Give with food.
NEXT DOSE DUE: When you get home.
2. Rimadyl (100 mg) tablets: Give 1/2 tablet by mouth every 12 hours to control pain. Side effects of
this medication can include vomiting, diarrhea, lethargy, stomach ulcers, a poor appetite and blood
in the stool (black tarry stool). If you notice any side effects discontinue the medication and call us
for further advice. Give with food.
NEXT DOSE DUE: Thursday morning.
3. Codeine (60 mg) tablets: Give 1/2-1 tablet by mouth every 6-12 hours as needed for pain. Side
effects of this medication include sedation.
NEXT DOSE DUE: Wednesday 10 am.
4. Gabapentin (300 mg) capsules: Give 1 capsule by mouth every 8-12 hours as needed for pain.
Side effects of this medication include sedation.
NEXT DOSE DUE: When you get home.
DIET:
Normal. You may also feed a bland diet for the next 5 days to encourage Ozzie to eat.
o A bland diet consists of feeding 1 part boiled, skinless, boneless chicken or turkey breast, lean
hamburger or cottage cheese and 2 parts white rice. You may also purchase a commercially
prepared bland diet such as Royal Canin GI low fat, Give 1 cup of this mixture per 10 pounds.
o Gradually make the transition back to Ozzie's regular diet over 2-3 days as long as there are no
further problems.
EXERCISE RESTRICTION FOR THE NEXT 10-14 DAYS:
Ozzie has had general anesthesia/sedation and may be a little groggy for the next 4-8 hours. Please
do not allow Ozzie to run, jump, use stairs or walk around unattended during this time.
Keep Ozzie quiet and avoid heavy activity while she heals.
Do not allow Ozzie to do any running, jumping, or rough play.
Short trips outside to urinate and defecate only. Keep Ozzie on a leash at all times when outside to
use the restroom.

If any of these are observed, please call us or your primary care veterinarian as Ozzie may be
showing signs of serious internal injury that was not present or able to be detected initially. These
injuries can sometimes be life-threatening if not managed as they appear.
Drain care:
Ozzie has a drain placed as part of Ozzie's wound treatment plan. Expect to see a clear to red
tinted fluid from the drain site. This is normal, and beneficial. If the drain is not flowing and the area
appears fluid filled, please contact a veterinarian.
Keep the drain site free of crust and debris so that it will continue to flow. Fluid flows around the
drain, not through the middle of the tube. Warm packing may be prescribed to assist with drainage.
Keep Ozzie in a clean environment because bacteria can travel up the drain and cause an
infection/abscess. You may also keep the area covered with a T-shirt or clean sock , etc, to help
prevent infection. This covering must be changed once or twice daily.
The drain should be rechecked and removed in 3 days by a veterinarian.
Cool pack:
Please cool pack the affected area twice a day for 2-3 days as needed for 10-15 minutes. Ice should
not be placed directly on the skin, but instead wrapped in a wash cloth,
Monitoring at home:
Monitor Ozzie closely for any of the following signs:
o Loss of appetite
o Vomiting and/or Diarrhea
o Severe depression, weakness, or collapse
o Severe pain/discomfort
o Increased respiratory effort or respiratory distress
If Ozzie is getting worse, if Ozzie's signs are not resolving, or if you are concerned for any reason
please call or have Ozzie seen by a veterinarian.
FOLLOW UP RECOMMENDATIONS:
1. The wounds should be examined by your primary veterinarian in 3-5 days to ensure they are
healing appropriately and to have the drains removed.
2. Please have the sutures and staples removed by your primary veterinarian in 10-14 days. Note
that the sutures used on Ozzie's ear flaps will not need to be removed and should dissolve within 2
weeks.
3. There is a very real possibility that Ozzie will need a follow up surgery if the skin on his hind end
does not have good blood supply. If the wounds are turning black please see your family vet. The
wound on the abdomen mammary area should be monitored closely as wounds in this area tend to
swell more and have an increased risk of infection.
4. There was muscle damage to the base of Ozzie's tail. It is unknown if her tail has nerve damage.
If the tail has nerve damage it may not be able to wag when the area has healed.

Ozzie presented for a recheck.
Ozzie was seen by UPC on 6/28/23 for severe dog bite wounds. On 6/30/23 Ozzie had 4 drains
removed. Last night, O noticed swelling around the neck where one of the drains had originally been
placed. The swelling has progressively grown overnight. O has been cleaning the wounds and doing
warm compresses. Eating and drinking okay, No vomiting or diarrhea. Ozzie is currently on gabapentin,
codeine, clavamox, and rimadyl. No other medications or prior medical history.
OBJECTIVE SECTION
Discussed cellulitis/seroma based on FNA of the swelling on the ventral neck. Told O can still do
medical management or can place a drain. O wished to have a drain placed. Once Ozzie was down,
able to evaluate her other wounds better. Areas of necrosis along the incisions over the right hip and
dorsum. Opened these incisions and found purulent fluid and infected tissue. Debrided the area and
placed a drain. Told O will need to extend meds and add on another antibiotic. Told her that we will
keep the drain in for 5 days this time. Told her that Ozzie had a lot of wounds that her body has to try
healing so complications may continue to arise.

dorsum had necrotic tissue along them and in the surrounding area. Purulent discharge coming from the
previous drain hole on the right hip.

Ozzie was diagnosed with an ear infection. There are many potential causes for ear infections
ranging from allergies, food sensitivities, metabolic disorders, genetic variations in the anatomy of
the ear, and excessive moisture. If Ozzie has recurrent ear infections we recommend working with
you family veterinarian to determine if there are any underlying causes that need to be identified and
treated, although in some cases a cause is not found.
Signs of an ear infection vary but often include, head shaking, scratching at the ears, a foul odor,
redness, increased debris in the ear, and pain. Seek veterinary attention as soon as possible if
Ozzie's signs worsen or do not show steady improvement.
Since there is some mild swelling on the ventral neck we are giving Ozzie another course of
anti-inflammatory and antimicrobials, No drain was determined to need to be placed today.

Sophia Grantham is my patient and has been under my care since July 13, 2023. Sophia sought out
outpatient mental health therapy to learn to control emotions and restore daily functioning after she was
attacked by two dogs on June 27, 2023. She is currently being seen on a weekly basis.
At this time I highly discourage Sophia sharing intimate details of the incident due to the fact it will be
triggering and make the trauma worse. Exposure therapy needs to be done in a systematic way, in a
shaping, stepped approach. Sophia is in the "preparation stage" of treatment and is in no way ready to
describe the traumatic event she experienced. It would be in many ways abusive to ask her to do this.

This letter serves as a notice of appeal for a Dangerous Dog Designation
dated July 20, 2023, regarding Rodney and Sandra Ross' dogs, Gabe and Rocky.
This Declaration is based on Blair Police Department Incident Report #BLPD2300.
It is my understanding the alleged incident took place on June 27, 2023.
The Rosses have hired me to represent them in this matter, and it is a duty
take very seriously. To that end, I request that you provide me with any and all
copies of officer reports, reports of any animal control officers, body -worn camera
video, cruliser camera video, complaining witness statements, witness statements,
statements made by the Rosses, veterinarian records, and all other documents
relating to this designation.
Because the Blair Police Department has declared the dogs as "dangerous," it
must be proven that any alleged injuries required medical treatment. "Medical
treatment" is defined under Blair Municipal Ordinance 6.125(5) as "treatment
administered by a physician or other licensed health care professional that results
in sutures or surgery or treatment for one or more broken bones." Accordingly, I
request any and all medical records of any complaining witness' alleged injuries
from the incident. My clients and I are willing to follow a protective order regarding
the use of these records for administrative and litigation purposes.
Failure to provide the requested records will result in a violation of the
Rosses' constitutional right to due process. The Fourteenth Amendment of the
United States Constitution protects individuals such as the Rosses from arbitrary
government action by requiring notice and an opportunity to be heard. "The purpose
of notice under the Due Process Clause is to apprise the affected individual of, and

Water Div. v. Craft, 436 U.S. 1, 15 (1978). In administrative procedures such as
these, the government must follow fair procedures before depriving citizens of life,
liberty or property. Mathews v. Eldridge, 424 U.S. 319 (1976). The procedures must
be tailored to ensure my clients have a meaningful opportunity to present their
case. Id. Failure to provide the requested records will prevent the Rosses from
preparing an adequate defense to the designation.

This Declaration is based on the attached synopsis of facts.
Based on this Declaration, you are required to comply with the following sections of the City of
Blair Municipal Code and submit the following to City Staff:
1) Written proof from Veterinarian that your dog has been spayed, neutered and
implanted with a microchip, along with the identification number (within 30 days
from declaration).
2) Written proof of public liability insurance of not less than $100,000 (within 30 days
from declaration).
3) Written proof from the Nebraska Humane Society of your attendance and completion
of the required "Potentially Dangerous Dog" class (within 90 days from declaration).
IMMEDIATELY: Sec -6-103 LICENSES. Any person who shall own, keep or harbor a dog or
cat over the age of 6 months within the City shall, within 10 days after acquisition of said dog or

RESTRAINED. It shall be unlawful for any person owning, harboring, or having the care of a
dangerous or potentially dangerous dog to permit such dog to go beyond the property of such
person unless the dog is under the control of a person 19 years of age or older, restrained securely
by a harness and leash no longer than 6 feet, and properly muzzled to prevent the dog from biting.

DOGS; SPAYING OR NEUTERING; MICROCHIP IDENTIFICATION AND LICENSE
REQUIRED. D. Any dog declared dangerous or potentially dangerous shall be spayed or neutered,
implanted with microchip identification by a licensed veterinarian at the owner's expense and
written proof of spaying or neutering and the microchip identification number being
provided to the City within 30 days after such declaration is entered.

NOTE: A copy of the verification letter must be provided to the City.
You have a right to appeal this declaration to the City Council Police Committee. An appeal
of this declaration must be made within ten (10) days of the date of mailing or date of personal
service of this notice, and must be made in writing to the City of Blair, along with payment of the
appeal fee of two hundred dollars ($200.00), payable to the City of Blair. A hearing will be held
by the City Council Police Committee within ten (10) days of the date of filing your written appeal,

Assignment: On 06/27/2023 I, Ofc. I<eller was assigned to work uniformed patrol from 1700 hrs. to 0500 hrs. in
marked unit 116,
Report:_ At approximately 1910 hours, myself and Sgt. Wittrock #1239 received information from Washington County
Dispatch of multiple 911 calls reference a dog attack between three dogs and possibly two parties at 833 N 13th Street,
Blair, NE 68008.
1 arrived at approximately 1911 hours and noticed a female party, identified as Sandra L. Ross (DOB: 12/18/1966),
holding onto a leash attached to a medium sized grey Pit Bull mix named Gabe. Next to Sandra was a male party,
identified as Rodney E, Ross (DOB: 03/29/1965), sitting on the ground also holding a leash to a white and brawn Pit
Bull and Bull Dog mix named Rocky, R. Ross explained the two dogs, Gabe and Rocky, attacked their stepdaughter's

friend, identified as Sophia 1. Grantham (DOB: 08/14/2001), and her Golden Lab mix named Ozzie.
R, Ross explained he did not know Grantham was coming over with her dog and advised Rocky and Gabe did not like
it. R. Ross explained Rocky and Gabe attacked Ozzie in the garage. R. Ross stated he, S. Ross, and Grantham tried to
split the dogs apart. During the process, Grantham was bit several times on the right bicep and forearm. Grantham had
four bite puncture wounds total. Photographs were not taken of the injuries due to Blair EMTs wrapping the wounds
beforehand because Grantham denied medical treatment to take Ozzie to an emergency vet hospital in Omaha, NE,
Ozzie had severe bite wound injuries to both ears and possibly her back two legs, Photographic evidence was taken of
Ozzie's injuries, Photographic evidence was also taken in the kitchen of the residence due to the attack.
R, Ross and S, Ross did not suffer from any injuries caused by the three dogs,
Two Animal Quarantine Order Letters were issued to R, Ross for Rocky and Gabe, Due to the severity of injuries given
to Grantham and Ozzie, I believe Rocky and Gabe meet the definition of City of Blair Municipal Code Sec, 6-125
Dangerous and Potentially Dangerous Dogs: Definition.
Disposition: I am requesting this case to be ACTIVE and FORWARD to City of Blair Administration to declare Rocky and
Gabe to be dangerous or potentially dangerous dogs due to the severity of the dog attack and have a written notice of
such declaration be sent to Rodney E. Ross (DOB: 03/29/1965) and Sandra L. Ross (DOB: 12/18/1966) of 833 N 131h
Street, Blair, NE 68008. 1 also request this case to be FORWARD to Animal Control for follow-up on Rocky and Gabe

Narrative
Report: On June 28,2023 1 spoke with Rodney and Sandra Ross at their residence here in Blair. I received copies that
both dogs were up to date on their vaccinations. I also explained that I needed the dogs seen by a vet at the end of the
quarantine period. Sandra asked me if their dogs would be declared "Dangerous". I told her that I would have to
obtain all of the information on what took place before that determination could be made. Sandra then asked what
would happen if the dogs were declared "Dangerous". I then explained what the procedure was at the department. I
left after that.
On that same day I contacted Sophia Grantham at her residence here in Blair. I spoke to her about the incident. I told
her I hade to issue a quarantine letter for her dog because it was involved. Sophia asked me what would happen next. I
then explained if the dogs were declared "Dangerous" and what the steps were. I then left after that.
Later that same day Sophia stopped at the station and asked for a witness statement form. I provided one for Sophia. I
asked Sophia to take it with her and fill it out when she had time. I asked Sophia to drop it back off when it was filled
out.
On July 10, 2023 1 received a call from Tammy, Sophia's mother. Tammy asked me what the status of the case was. I
told Tammy that I had just come' back into the office and had not read her daughter's statement yet. Tammy asked if
the dogs would be declared "Dangerous". I told Tammy that determination had not been made yet. Tammy asked
what would happen if the dogs were declared "Dangerous". I then explained the steps to Tammy.
Tammy then told me she had some photos of the Injuries and would drop them by at the station, I said that would be
fine. Tammy stopped by ten minutes later and dropped them off,
I then made a call to Rodney Ross and left a voice mail, I asked if the dogs had been to the vet. I asked that the letters
be dropped back off at the office if they had been seen by a vet.
Ross called back shortly after that and told me they were just at the vet. The dogs were fine. Ross then dropped of the
signed quarantine letters,
After reading Sophia's witness statement form, I am not declaring the dogs "Dangerous or Potentially Dangerous" per
Blair City Ordinance 6-125,4.

(4) No dog may be declared dangerous or potentially dangerous if it inflicts injury or damage on a person committing a
willful trespass or other tort upon premises occupied by the owner or lessee of the dog or committing or attempting to
commit a crime. No dog may be declared dangerous or potentially dangerous for taking action to defend or protect a
human being within the immediate vicinity of the dog from an unjustified attack or assault. No dog used in lawful
activities of any law enforcement officer shall be declared a dangerous or potentially dangerous dog.

On 6/27/2023 our office received a report of two dogs attacking and Injuring a person, and a dog in the 1,300
BLK of N 13�h Street in Blair (BPD Incident Report #BLPD2300). Through our investigation we learned that the
attack was unprovoked. It is our determination that the animals, "Gabe and Rocky", the property of Rodney
Ross of Blair Ne are Dangerous Dogs as defined by Blair Municipal Ordinance 6-125(2)(b).
2, "Dangerous dog" shall be defined as one who meets one or more of the
following conditions:
a. Has killed a human being;
b, Has inflicted an injury on a human being that requires medical treatment;
c. Has killed a domestic animal without provocation; or,
d. Has been previously determined to be a potentially dangerous dog by an
animal control authority, the owner has received notice from an animal
control authority or animal control officer of such determination, and the
dog inflicts an Injury on a human being that does not require medical
treatment, injures a domestic animal, or threatens the safety of humans
or domestic animals,
The Blair Police Department respectfully requests that these dogs be designated as a Dangerous Dogs and that
the owner be served proper notice of such designation.
