COUNCIL MEMBER SCHANK INTRODUCED THE FOLLOWING RESOLUTION:
WHEREAS the City of Blair, Nebraska was presented with a Developer's Agreement
between the City of Blair, Nebraska, City of Blair, Nebraska, and Justin Von Loh, owner of Von
Loh Investments, LLC. to include extension districts for paving and storm sewer, water, and
sanitary sewer services for the final plat for the subdivision legally described as: Elk Ridge
Subdivision, an Addition to the City of Blair, Washington County, Nebraska.
WHEREAS, Resolution No. 2023-1 was passed and adopted approving this Developer's
Agreement,
WHEREAS, Elk Ridge Subdivision has been replated and a new legal description for
paving and storm water, water and sanitary sewer services created in the replat of the subdivision,
the Developer's Agreement adopted by Resolution No. 2023-1 shall be repealed to allow for the
adoption of a new Developer's Agreement on April 11, 2023 adopted by Resolution No. 2023-12.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF BLAIR, NEBRASKA, that the Developer's Agreement adopted by Resolution
2023-1 is repealed and a new agreement adopted by Resolution No. 2023-12 on April 11, 2023.
COUNCIL MEMBER SCHANK MOVED THAT THE RESOLUTION BE ADOPTED AS
READ, WHICH SAID MOTION WAS SECONDED BY COUNCIL MEMBER HAFER. UPON
ROLL CALL, COUNCIL MEMBERS FERRARI, HAFER, HIGHFILL, PAULSEN,
SANDVOLD, SCHANK, WOLFF, AND WILLIS VOTING "AYE", AND COUNCIL
MEMBERS NONE VOTING "NAY", THE MAYOR DECLARED THE FOREGOING
RESOLUTION PASSED AND APPROVED THIS 11TH DAY OF APRIL 2023.
