Introduction of Ordinance No. 950 of the City of Blair,Nebraska
and the matter now coming before the Mayor and Council was the
passage and approval of Ordinance No. 950, which was introduced by
Councilman Conrad and is in words and figures as follows:
ORDINANCE NO 950.
AN ORDINANCE OF THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA,
ESTABLISHING CLASSES OF NATURAL GAS SERVICE AND MAXIMUM RATES TO BE
CHARGED FOR NATURAL GAS SERVICE WITHIN THE CITY OF BLAIR, NEBRASKA
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. CLASSIFICATION: That all persons, firms or
corporations supplying natural gas service to the City of Blair,
Nebraska, and the inhabitants thereof, shall provide two classes of
service to its customers as hereinafter specified and defined:
1. Firm Gas Service
Firm gas service is defined as gas service that is supplied
on a noninterruptible basis. Firm gas service shall be made
available to all customers whos.maximum space heating re-
quirements are less than 1,000 cubic feet per hour.
2. Interruptible Gas Service
Interruptible gas service is defined as gas service that is
supplied on an interruptible basis. It shall be subject to
curtailment or interruption on demand of the gas service
company whenever::meeessary to protect the service of itsfirm
gas customers.

SECTION 2. MAXIMUM RATES: That no person, firm or corporation
supplying natural gas to the City of Blair, Nebraska, and the inhabit-
ants thereof, shall effective with meter reading periods beginning
on and after February 10, 1969 charge more for such natural gas
service than the following maximum rates:
1. Firm Gas Service Rate
Availability- This rate is available only to customers whose
maximum space heating requirements for natural gas are less than
1,000 cubic feet per hour. The gas service company shall
not be required to serve any customer at the following rate
whose space heating requirements amount to 1,000 cubic feet
or more per hour.
Rate- First 600 cu. ft. or less $1.75 per month
Next 1,400 cu. ft. at 1.44 per Mcf
Next 3,000 cu. ft. at 1.09 per Mcf
Next 5,000 cu. ft. at .96 per Mcf
Next 40,000 cu. ft. at .89 per Mcf
Next 50,000 cu. ft. at .81 per Mcf
Excess cu. ft. at .75 per Mcf
Minimum Monthly Bill $ 1.75
2. Interruptible Gas Service Rate
Availability- This rate is available only on a contract,
basis , -to cusomters whos requirements for natural gas amount
to 1,000 cubic feet or more per hour, and who install and
maintain sufficient stand -by equipment and stand -by fuel
to take care of customer's entire requirement during
periods of curtailment of the use of natural gas by the
as service company in order to protect the service of its
firm gas users.
Rate - The rate for interuptible gas service shall be such
rate as may be mutually agreed upon between the. customer
and the gas service company, but shall not be higher than
• the firm gas service rate set out ab?ve.
3. Other Contracts
The gas service company may enter into written contracts
for a term not less than one year with any customer or
class of customers making application therefor :'without dis-
crimination for special gas service for commercial and
industrial uses at such rates and on such conditions as the
contracting parties may agree.
SECTION 3. GAS COST ADJUSTMENT: As the result of an application
filed and now pending with the Federal Power Commission (Commission),
Docket No. RP69 -1, Northern Natural Gas Company (Northern), wholesale
supplier of natural gas, will be permitted to increase its wholesale
gas price to Central Telephone & Utilities Corporation (CTU), the
distributor of natural gas, on February 10, 1969. Such increased price
will be collected by Northern sibject to refund pending final deter-
mination by the Commission of the reasonableness of such increase.
Any refund, including interest thereon, if any, received by CTU from
Northern in respect of increased rates paid by CTU subject to refund
as a result of Docket No. RP69 -1 and applicable to natural gas
purchased on a firm supply basis for resale in Blair, Nebraska, shall
be refunded to CTU's firm gas customers as a credit on such customer's
bill to the extent that such increased rates paid by CTU were passed
on to such firm gas customers.
SECTION 4. That Ordinance No. 734 and all other ordinances and
parts of ordinances in conflict with the provisions of this ordinance
are hereby repealed.
SECTION 5. This ordinance shall be effective from and after
its passage and publication as mequired by law.

BLAIR, NEBRASKA, DECLARING THE NECESSITY THEREFOR, DESIGNATING THE
IMPROVEMENTS TO BE MADE IN SAID DISTRICT, LISTING THE PROPERTY IN-
CLUDED WITHIN SAID DISTRICT, PROVIDING FOR THE MANNER OF PAYMENT OF
THE IMPROVEMENTS MADE THEREIN AND PROVIDING WHEN THIS ORDINANCE SHALL
TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby declare the necessity to construct a sanitary sewer
on the following line, to -wit: Commencing at a point in the center
line of 10th Street 20 feet South of the South line of the alleys in
Blocks 83 and 86, running thence South along the center line of 10th
street to the center line of Grant Street, running thence East along
the center line of Grant Street to a point 30 feet East of the center
line of 9th Street, running thence North parallel to the center line
of 9th Street to the existing sewer main on the North side of U. S.
Highway,30, all in the City of Blair,-Nebraska. For that purpose
there is hereby created Sanitary Sewer District No. 23 of the City
of Blair, Nebraska.
SECTION 2. The improvements to be made is to eonstruet and lay
eight inch (8 ") vitrified clay sewer tile with manholes and Y's, said
improvements to be made according to plans and specifications and
estimate of cost to be prepared by the Special Engineer and said
District and to be filed with the City Clerk to be approved by the
Mayor and Council of said City.

No. 23 and subject to special to pay for the cost and ex-

AN ORDINANCE AMENDING SECTION 9.304 OF THE MUNICIPAL CODE OF THE CITY
OF BLAIR, NEBRASKA, RELATING TO VICIOUS ANIMALS AND CONTROL OF RABIES;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH;.
AND PROVIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. That Section 9.304 of the Municipal Code of the City
of Blau;, Nebraska, be and the same is hereby amended to read as
follows: The City Poundmaster of said City shall have the right to
kill any animals showing Rabies' characteristics when capture is deemed
impossible because of the danger involved. Any animal which bites a
human shall be immediately impounded in the City Pound or with a veter-
inarian and placed under observation for a period of fourteen days and
the owner shall pay all required fees for such keeping before such
animal can be released. If said animal is diagnosed as a rabid animan
during the period, it shall be destroyed and the City Poundmaster, in
such event, shall comply with State laws concerning rabid animals.
If, after confinement, the owner thereof refuses to pay the fees
provided for the keeping of said animal, then., and in that event, said
animal may be disposed of by the City Poundmaster.
SECTION 2. That all ordinances or parts of ordinances conflicting
with the provisions of this ordinance are hereby repealed insofar as
the same affect this ordinance.

S SECTION 1. That Section 9.305 of the Municipal Code of the City of Blair,
Nebraska, be and the same is hereby amended to read as follows: Unlicensed
dogs and other animals found running at large shall be confined in a humane
manner fbr a period of not less than three days. If not claimed by their
owners after the expiration of three days, said animals shall be disposed of
by the City Poundmaster. Any owner claiming an impounded animal shall pay to
said City a fee of ten dollars ($10.00) before said animal shall be released.
SECTION 2. That all ordinances or parts of ordinances conflicting with
the provisions of this ordinance are hereby repealed insofar as the same affect
this ordinance.
SECTION 3. That this ordinance shall take effect and be in force from
and after its passage, approval and publication as provided by law.

AN ORDINANCE CREATING SANITARY SEWER DISTRICT NO. 24 IN THE CITY OF
BLAIR, NEBRASKA, DECLARING THE NECESSITY THEREFOR, DESIGNATING THE IM-
PROVEMENTS TO BE MADE IN SAID DISTRICT, LISTING THE PROPERTY INCLUDED
WITHIN SAID DISTRICT, PROVIDING FOR THE MANNER OF PAYMENT OF THE IM-
PROVEMENTS MADE THEREIN AND PROVIDING WHEN THIS ORDINANCE SHALL TAKE
EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby declare the necessity to construct a sanitary sewer
on the following line, to -wit: Beginning at the existing manhole in
College Drive, said manhole being 37 feet East of the East line of Tax
Lot 99 in Section 10, Township 18 North, Range 11, running thence
Westerly along College Drive a distance of 290.4 feet to a point 10
feet West of the West of the West line of the Northeast Quarter of the
Northeast Quarter of Section 10, Township 18 North, Range 11 East of
the 6th Principal Meridian, Washington County, Nebraska. For that pur-
pose there is hereby created Sanitary Sewer District No. 24 of the City
of Blair, Nebraska.
SECTION 2. The Improvements to be made is to construct and
lay eight inch (8tt) vitrified clay sewer tile with manholes and Y's,
said improvements to be made according to plans and specifications and
estimate of cost to be prepared by the Special Engineer of said of
said District and to be filed with the City Clerk to be approved by
the Mayor and Council of said City.
SECTION 3. The property included in said Sanitary Sewer.
District No. 24 and subject to special assessments to pay for the cost
and expense of said improvement is Tax Lots 88, 89, 97 and 99 lying
in the Northeast Quarter of the Northeast Quarter of Section. 10,
Township 18 North, Range 11 East of the 6th Principal Meridian, Washing-
ton County, Nebraska.
SECTION 4. The cost of said improvements in said Sanitary
Sewer District shall be paid out of the fund created by t e levy and
assessment of the lots and parcels of lands in said Improvement Dis-
trict benefited, and to be in proportion to said benefits, all as by

AN ORDINANCE CREATING STREET IMPROVEMENT DISTRICT NO. 102 IN THE CITY
OF BLAIR, NEBRASKA, DECLARING THE NECESSITY THEREFOR, DESIGNATING THE
IMPROVEMENTS TO BE MADE IN SAID DISTRICT, LISTING THE PROPERTY INCLUDED
WITHIN SAID DISTRICT, PROVIDING FOR THE MANNER OF PAYMENT OF THE STREET
IMPROVEMENTS MADE THEREIN AND PROVIDING WHEN SAID ORDINANCE SHALL TAKE
EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby declare and deem it necessary to continue the paved
portion of College Drive by paving same so as to make a continuous paved
street, which said continuation does not exceed twelve hundred (1200)
feet, by paving College Drive beginning at the intersection of College
Drive and West line of the Northeast Quarter of the Northeast Quarter
of Section 10, Township 18 North, Range 11 East of the 6th Principal
Meridian, Washington County, Nebraska, said point being on the Westerly
city limits of the City of Blair, Running thence Easterly along College
Drive a distance of 886 feet to the existing concrete paving on College
Drive, and for said purpose there is hereby created Street Improvement
District No. 102 of the City of Blair, Nebraska.
SECTION 2. The street improvement to be maded to pave said
section of said street as aforesaid, the grade of said street to con-
form to the existing grades of said City of Blair, and said improvement
to be made according to plans and specifications and estimate of cost
to be prepared by the Special Engineer for said District and to be
filed with the City Clerk and to be approved by the Mayor and Council
of the City.
SECTION 3. The property included in said Street Improvement
District No. 102 and subject to special assessments to pay for the
cost and expenses of said street improvement is all of the privaltely
owned lots, parts of lots and tracts of land and the lots, parts of
lots and tracts of land owned by any municipal or public corporation
and abutting upon the adjacent to said street to be improved, to -wit:
Lot 1 in Anderson;s Addition to the City of Blair and Tax
Lots 46, 48, 74, 75, 76, 79, 80, 88,_89, 93, 94, 96, 97, 98, and 99,
all in the Northeast Quarter of the Northeast Quarter of Section 10,
Township 18 North, Range 11 East of the 6th Principal Meridian,
Washington County, Nebraska.
SECTION 4. The cost of said improvement in said improvement
district shall be paid out of the fund created by the levy and assess-
ments on the lots and parcels of land in said Street Improvement Dist -
rick benefited theregy in proportion to said benefits, all as by the
Statutes of the State of Nebraska in such cases made and provided.

AN ORDINANCE CREATING STREET IMPROVEMENT DISTRICT NO. 103 IN THE CITY OF
BLAIR, NEBRASKA, DECLARING THE NECESSITY THEREFORE, DESIGNATING THE IMPROVE-
MENTS TO BE MADE IN SAID DISTRICT, L1i9TINGaHE PROPERTY INCLUDED WITHIN SAID
DISTRICT, PROVIDING FOR THE MANNER OF PAYMENT OF THE STREET IMPROVEMENTS MADE
THEREIN AND PROVIDING WHEN SAID ORDINANCE SHALL TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby declare and deem it necessary to continue the paving of Colfax
Street by paving same so as to make a continuous paved street, which said
continuation does not exceed twelve hundred feet (1200') by paving Colfax
Street beginning at the existing return at the intersection of 22nd and
Colfax Streets ih the City of Blair, running thence West along Colfax Street
and terminating at the West line of Tax Lot 426 in Section 11, Township 18

distance of 295 feet, and for such purpose there is hereby created Street
Improvement District No. 103 of the City of Blair, Nebraska .
SECTION 2. The street improvement to be made is to pave
said section of'said street as aforesaid, the grade of said street to con-
form to the existing grades of said City of Blair, and said improvement to
be made according to plans and specifications and estimate of cost to be pre-
pared by the Special Engineer for said District and to be filed with the City
Clerk and to be approved by the Mayor and Council of the City.
SECTION 3. The property included in aaid Street Improvement
District No. 103 and subject to special assessments to pay for the cost and
expenses of said street improvement is all of the privately owned lots, parts
of lots and tracts of land and the lots, parts of lots and tracts of land
owned by any municipal or public corporation and abutting upon and adjacent to
said street to be improved, to -wit:
Tax Lots 304, 336, 426, 433, 434, all lying in Section 11,
Township 18 North, Range 11 East of the 6th P. M., Washington County,
Nebraska.
SECTION 4. The cost of said improvement in said improvement
district shall be paid out of the fund created by the levy and assessments on
the lots and parcels of land in said Street Improvement District benefited
thereby in proportion to said benefits, all as by the Statutes of the State
of Nebraska in such cases made and provided.

Park Street by paving same so as to make a continuous paved street, which

Street beginning at theexisting return at the intersection of 23rd and Park
Streets in the City of Blair, running thence West along Park Street and
terminating at the East right -of -way of 24th Street, being a distance of
398 feet, and for such purpose there is hereby created Street Improvement
District No. 104 of the City of Blair, Nebraska.
SECTION 2. The Street Improvement to be made is to pave said
section of said street as aforesaid, the grade of said street to conform'
to the existing grades of said City of Blair, and said improvement to be
made according to plans and specifications and estimate of cost to be pre-
pared by the Special Engineer for said District and to be filed with the
City Clerk and to be approved by the Mayor and Council of the City.
SECTION 3. The property included in said Street Improvement
District No. 104 and subject to special assessments to pay for the cost
and expenses of said street improvement is all of the privately owned
lots, parts of lots and tracts of land and the lots, parts of lots and
tract of land owned by any municipal or public corporation and abutting
upon and adjacent to said street to be improved, to -wit:
Lots 6, 7, 8 and 9, Block 17, Dexter's Addition, and Lots 1, 10,
11 and 12, Block 8, Dexter's Addition, City of Blair, Washington County,
Nebraska.
SECTION 4. The cost of said improvement in said improvement
district shall be paid out of the fund created by the levy and assessments
on the lots and parcels of land in said Street Improvement District.bene-
fited.thereby in proportion to said benefits, all as by the Statutes of
the State of Nebraska in: such cases made and provided.
SECTION S. This ordinance shall take effect and be in force

SECTION 2. That any owner, agent or occupant, upon conviction of
violating the provisions of this ordinance, shall be fined in any sum not
more than $100.00 for each such offense and shall stand committed until
such fine and costs of prosecution are paid or otherwise discharged accord-
ing to law. The imposition of any penalty hereunder shall not be construed
to be a waiver of the right of the City to collect for the cost of work done
by the City in connection with removing any such weeds.

herewith are hereby repealed.

of the money derived from the water works system and out of the
water fund and all other money and funds available therefor, the

For improvement, extension, operation and maintenance of

SECTION 5. That there be, and hereby is appropriated out

of the money derived from the operation of the municipal light

SECTION 9. That there be and hereby is appropriated out of
the money derived from the levy of taxes for the payment of refunding
bonds and interest thereon and the sinking fund for said fiscal year
and out of the money derived from taxes levied for payment of inter-
sections and for district paving bonds, and interest and out of any
and all other funds and money available therefor, the amounts for
each object and purpose as follows:
For payment of principal and interest of bonds indebtedness
due or to become due and for sinking bonds funds $145,000.00
Any balance of said funds remaining over and unexpended at
the end of the fiscal year shall be transferred to the Sinking Fund
for the payment of refunding bonds.
SECTION 10. That there be, and hereby is appropriated
out of the money derived from the levy of taxes for the maintenance
and operation of the Fire Department for the, present fiscal year and
out of all other money and funds available therfor, belonging to
said City, the amounts for each object nad purpose as follows:
For the maintenance and operation of the City Fire Department -- $10,000.00
Any balance of said fund remaining over and unexpended at
the end of the fiscal year shall be transferred to the fund for mainten-
ance and operation of the City Fire Department.
SECTION 11. That there be, and hereby is appropriated out
of the money derived from the levy of taxes for the purpose of Purchase
of Fire Department Apparatus for the present fiscal year and out of
all other money and funds available therefor, belonging to said
City, the amounts for each object and purpose as follows:
For the purchase of Fire Department Apparatus

the end of the fiscal year shall be transferred to the Fire Department

SECTION 2. The street improvement to be made is to pave said
section of said street as aforesaid, the grade of said street to
conform to the existing grades of said City of Blair, and said improve-
ment to be made according to plans and specifications and estimate
of cost to be prepared by the Special Enginner for said District and
to be filed with the City Clerk and to be approved by the Mayor and
Council of the City.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby declare and deem it necessary to continue the paved
portion of 14th street and Fairview Drive by paving same so as to
make a continuous paved street, which said continuation does not ex-
ceed twelve hundred (1200) feet by paving 14th Street and Fairview
Drive as follows: Beginning at the intersection of the South edge
of the existing paving on Adams Street and the center line of 14th
Street, running thence South along 14th Street a distance of 599.7
feet to the South line of Lot two, Block 118, llth Addition to the
City of Blair, Nebraska, and beginning at the intersection of the
West edge of the existing paving on 13th Street and the center line
of Fairview Drive, running thence West along Fairview Drive a distance
of 306 feet to the East edge of the proposed paving on 14th Street
as described above, and for said purpose there is hereby created
Street Improvement District No. 108 of the City of Blair, Nebraska..
SECTION 2. The Street Improvement to be made is to pave
said section of said street as aforesaid, the grade of said street
and said improvement to be made according to plans and specifications
and estimate of cost to be prepared by the Special Engineer for said
District and to be filed with the City Clerk and to be approved by
the Mayor and Council of the City.
SECTION 3. The property included in said Street Improve-
ment District No. 108 and subject to special assessments to pay for
the cost and expenses of said street improvement is all of 'the
privately owned lots, parts of lots and tracts of land and the lots,
parts of lots and tracts of land owned by any municipal or public
corporation and abutting upon and adjacent to said street to be
improved, to -wit:
Bounded on the West by Lot 2, Block 118, llth Addition to
the City of Blair, Nebraska, bounded on the North by Lots 8, 9 and
10 of Northview Addition and on the South by Lots 11, 12 and 13 of
Northview Addition, Washington County, Nebraska.
SECTION 4. The cost of said improvement in said improvemet
district shall be paid out of the fund created by the levy and
assessments on the lots and parcels of land in said Street Improve-
ment District benefited thereby in proportion to said benefits, all
as by the Statutes of the State of Nebraska in such cases made and
provided.
SECTION 5. This ordinance shall take effect and-be in
force from and after its passage, approval and publication as pro-
vided by law.

25th Street and Washington Street, described as follows: Beginning at

Nebraska, running thence North along the West side of 25th Street to
the intersection of said 25th Street and Washington Street, thence
running Easterly along the North side of Washington Street to its inter-
section with Fontanelle Boulevard and terminating at this point, and
for said purpose there is hereby created Sidewalk Improvement District
No. 3, of the City of Blair, Nebraska.
SECTION 2. The sidewalk improvement [to be made is to lay a side -
walk along said streets as aforesaid, the grade of said sidewalk and
said improvement to be made according to plans and specifications and
estimate of cost to be prepared by the Special Engineer for saidDistrict
and to be filed with the City Clerk and to be approved by the Mayor and
Council of the City.
SECTION 3. The property included in Sidewalk Improvement District
No. 3 and subject to special assessments to pay for the cost and

CHAPTER 10. SUBDIVISION REGULATIONS
ARTICLE 1. TITLE. PURPOSE. AND DEFINITIONS
SECTION 10.101 NAME AND CITATION OF TITLES. These regulations
shall be known, referred to and cited as "The Land Subdivision Regulations"
of the City of Blair, Nebraska.
SECTION 10.102 PURPOSE. The purpose of these regulations is to
provide for the orderly development of the City of Blair and its environs

by insuring, through the prescribed rules and standards, functional arrange-
ments of street layouts, open spaces, adequate community facilities and
utilities, and to generally provide conditions favorable for the health,
safety and convenience of the community.
SECTION 10.103 DEFINITIONS. For the purpose of these regulations,
which shall be known and cited as "The Land Subdivision Regulations" of the
City of Blair, Nebraska, certain words used herein are defined as follows:
Alley. An alley is a public or private thoroughfare which
affords only secondary access to property abutting thereon.
City. City of Blair, Nebraska.
City Administrator. Administrator of the City of Blair, Nebraska.
City Clerk. City Clerk of the City of Blair, Nebraska.
City Council. City Council of the City of Blair, Nebraska.
City Engineer. The engineer ordinarily retained by the City
of Blair, Nebraska for the recommendation, advice and prosecution of
engineering work as requested by the City.
Comprehensive Plan. The master plan for the improvement and
development of the City of Blair,Nebraska as adopted by the City's
Planning Commission and City Council in accordance with the laws of the
State of Nebraska and the ordinances of the City of Blair.
Cul -de -sac. A. short public way with one end open to traffic
and the other end terminated by a vehicular turn - around.
Dead End Street. A public way which has only one outlet for
vehicular traffic and does not terminate in a~ vehicular turn - around.
Dedication. The intentional appropriation of land by the
owner to some public use.
Easement. A grant by the property owner of the use of a strip
of land by the public, or a public agency or utility for a specific
purpose or purposes.
Improvements. Street grading, street surfacing and paving,
curbs and gutters, street lights, street signs, sidewalk; crosswalks,
water mains and lines, water meters, fire hydrants, sanitary sewers,
storm drainage facilities, culverts, bridges, public utilities, or other
such installations as designated by the City Council or its specific
approving authority.
Lot. A measured portion of a subdivision or other parcel of
land intended as a unit for transfer of ownership or for development.
Lot, Depth of. The mean horizontal distance between the front
and rear lot lines.
Lot, Double Frontage. A lot having a frontage or two non -
intersecting streets.
Lot, Reverse Frontage. A lot which extends continuously be-
tween two parallel or approximately parallel streets bounding a block
and is abutted along one street frontage by an easement for screen
planting. A block containing reverse frontage lots is composed of one
tier of lots rather than the standard two tiers.
Lot. Width of. The average distance between side lot lines.
Master Plan. See Comprehensive Plan.
Monument. An identification marker established by certified
land survey and set by a registered land surveyor or registered
engineer at each section corner, angle point, block corner, street
centerline, or other point.
Planning Commission. The Planning Commission of the City of
Blair, Nebraska.
Plat. A map which delineates the subdivision of a quantity of
land. A plat commonly shows lots, blocks, streets and other features
relevant to the development and improvement of the property.
Plat, Final. The final plan of the plat, subdivision or
dedication prepared for filing or recording in conformance with these
regulations.
Plat, Preliminary. The preliminary plan of the plat, sub-
division or dedication prepared in accordance with the requirements
of these regulations.
Sidewalk or Walkway. That portion of a dedicated right -of-
way or easement intended for pedestrian use only.
Street. The term includes streets, highways, avenues,
boulevards, parkways, roads, lanes, walks, alleys, viaducts, subways,
tunnels, bridges, public easements and rights -of -way and other ways.
Street,, Collector. A street or highway which is intended to
carry traffic from minor streets to mayor streets. Collector streets are

usually the principal entrance streets to residentail developments
and the streets for circulation within the developments.
Streets, Ma-ior. A street or highway used primarily for
fast or high volume traffic, including expressways, freeways, boule-
vards, and arterial streets.
Street, Minor. A street intended primarily to provide
pedestrian and vehicular access to the abutting properties.
Subdivider. Any person, group, corporation, partnership, or
other entity, or any agency thereof, dividing or proposing to divide
land so as to constitue a subdivision.
Subdivision. The division of a lot, tract onparcel of land
into two (2) or more sites or other divisions of land for the purpose,
whether immediate or future of ownership or building development
excaptthat the division of land shall not be considered to be a sub -
divisin when the smallest parcel of land created is more than five
(5) acres in area.
ARTICLE 2. PROCEDURE.
SECTION 10.201. PROCEDURE FOR APPROVAL OF PRELIMINARY PLAT.
A. All plats, preliminary and final, shall be prepared in
conformance with the provisions of these regulations a&d.in conformance
With the Blair Comprehensive Plan. The subdivider shall be responsible
for such conformance.
B. Eight (8) copies of the Preliminary Plat and required
supplementary material as specified in Article 3 of these regulations
shall be submitted to the Planning Commission at least ten (10) days
prior to the meeting at which it is to be considered. The Secretary
of the Planning Commission shall distribute one (1) copy of the
Preliminary Plat!, with the request for moments within seven (7) days
to each of the following: City Council, City Administrator, City Clerk,
and School Board and wherever else deemed necessary by the Planning
Commission.
C. Following review of the Preliminary Plat and supplementary
material, the Planning Commission shall, within thirty (30) days, act
thereon. If the Preliminary Plat is approved, the Planning Commission
shall express its approval and state the conditions of such approval,
if any. If the Preliminary Plat is disapproved, the Planning Commission
shall express its disapproval and its reasons therefor.
D. The action of the Planning Commission shall be noted on or
attached to two (2) copies of the Preliminary Plat. One (1) copy shall
be returned to the subdivider and the other retained by the Planning
Commission.
E. Approval of a Preliminary Plat shall not constitute
approval of the Final Subdivision Plat. Rather, the Preliminary Plat
shall be deemed an expression of approval of the general design con-
cept and serves as an acceptable guide for the preparation of the
Final Plat. Approval of the Preliminary Plat shall become void after
twelve (12) months from the date of such approval.
SECTION 10.202. PROCEDURE FOR APPROVAL OF FINAL PLAT .
A. The Final Plat shall conform substantially to the Prelim-
inary Plat as approved and may be comprised of only that portion of
the approved Preliminary Plat which the subdivider proposes to record
and develop at the time.
B. The Final Plat shall be submitted to the Planning CoJLutlission
for approval at least ten (10) days prior to the meeting at which it
is to be considered.
C. The original, one (1) reproducible copy and two (2) copies
of the original shall be prepared as specified in Article 3 of these
regulations.
D. Upon approval of the Final Plat, a certification of approval
by the City Council shall be endorsed thereon by the City Clerk, and
the original shall be filed with the Washington County Register of
- Deeds, the reproducible copy with the City Clerk, and the two (2)
copies of the oriiginal with the City Administrator and Planning
Commission .
SECTION 10.203. PIATS OUTSIDE CORPORATE LIMITS. Procedure for
approval of Preliminary and Final Plats of land within two (2) miles
of the corporate limits shall be the same as set forth in Article 2,

Sections 10.201 and 10.202 above, except that one (1) copy of the
Preliminary Plat shall be referred to the Washington County Surveyor
and one (1) copy to the Washington County Board with a request for
their recommendations to be submitted to the Planning Commission.
The Planning Commissions shall not take action on the Plat prior to
receiving the recommendations of the Washington County Surveyor and
Board. If no recommendation is received by the Planning Commission within
twenty (20) days, the Plat shall be deemed approved by the Washington
County Surveyor and Board.
SECTION 10.204. VACATION or A FLAT OF RECORD.
A. Conditions: A subdivider may make application to the
Planning Commission to vacate any plat of record under the following
conditions.
(1) The plat to be vacated is a legal plat of record.
(2) Vacation of the subdivision will not interfere with
development of, nor deny access via public thoroughfare
to, adjoining properties or utility services or other
improvement.
(3) Vacation of the subdivision will not be contrary to the
Blair Comprehensive Plan.
B. Procedure: The land owner or owners shall present a
proposal to the.;Ylanning Commission, containing the legal description
of the subdivision and calling for vacation thereof. The Planning
Coinuission shall study the proposal and shall send recommendations to
the City Council. The City Council shall approve or deny the proposal.
If the proposal is approved, it shall then be recorded in the office
of the Washington CountyR *ster of Deeds. All fees for the recording
of such vacation shall be paid by the subdivider.
SECTION 10.205. PROFESSIONAL ASSISTANCE. The City Council
or the Planning Commissions may request such professional assistance
as it deems necessary to properly evaluate the plats submitted.
ARTICLE 3. PLATS AND DATA
SECTION 10.301 PRELIMINARY PLAT AND SUPPLEMENTAL,DATA..
A. Requirements, General: A Preliminary Plat shall be based
on a survey of the property prepared by a registered land surveyor.
A Preliminary Plat shall at a minimum meet the design standards set
forth in these regulations. Sheets sizes for plats shall be adequate
to provide for a scale making it possible to clearly read all necessary
information shown thereon.
B.Requirements, Specific: Preliminary Plats shall include
the following information:
(1) Identification and description
(a) Title and description.
(b) Names and addresses of the subdivider (s) and the
engineer or surveyor.
(c) North point.
(d) A graphic scale.
(e) Date of survey.
(f) Legal description of the subdivision.
(g) Boundary lines of the subdivision.
(2) Site Details
(a) Total acreage of the subdivision
(b) Contours with intervals of two (2) feet based on
datum approved by the City of Blair, If the sub-
division exceeds five (5) acres in area or contains
unusual topographical features, closer contour lines
may be required by the Planning Commission.
(c) Delineation of public grounds other than streets
or alleys.
(d) Location of proposed streets and alleys.
(e) Names, location, widths and other dimensions of
proposed streets and alleys.
(f) Layout, numbers and approximate dimensions of
proposed lots, blocks.
(g) Drainage channels, wooded areas, rock outcrop and
other significant natural features.
(h) Existing sewers, water mains, culverts or other
underground structures within the tract and immed-
iately adjacent thereto. If water mains and sewers

.rd not on or adjacent to the tract, direction and
distance to the nearest one shall be shown including
invert elevations of sewers.
41)Location, widths and names of all existing or platted
streets or other public ways within and immediat.ily
adjacent to the tract, existing permanent buildings,
railroad rights -of -way, section lines, and other
such important features.
(j)Proposed public improvements; highways or other
major improvements planned by public authorities for
future construction on orcnear the tract.
(3) Other information:
(a)Vicinity Map. A map shall be presented accompanying
or included on the Preliminary Plat showing the
geographic relationship of the proposed subdivision
to the surrounding area. Features to be noted on
the vicinity map include major streets, railroads,
public areas. Vicinity maps shall be prepared at
a scale of no smaller than 1" equals 2,000'.
(b)A description of proposed curbs, gutters, sidewalks,
street surfacing and, street substructure.
(c)When required by the Planning Commission, there shall
be furnished profiles showing existing ground sur-
face and proposed street grades, including extensions
for a reasonable distance beyond the limits of the
proposed subdivision; typical cross sections of the
proposed grading, roadway and sidewalk.
SECTION 10. 302 FINAL PLAT AND REQUIRED SUPPLEMENTAL DATA
A. The Final Plat shall be drawn in ink on a good quality
reproducible material at a scale that is adequate to clearly show all
pertinent information. The Final Plat shall show the following:
(l)Accurate boundary lines, with dimensions and angles,
which provide a survey of the tract, closing with
an error of not more than one (1) foot in ten
thousand (10,000) feet.
(2)Accurate references to known or permanent monuments.
(3)Accurate locations of all existing and recorded
streets intersecting the boundaries of the tract.
(4)Accurate legal description of the boundary.
(5)Street names.
(6)Complete curve notes for all curves included in the
plan.
(7) Street lice; with accurate dimensions in feet and
hundredths of feet with angles to street, alley and
lot lines.

the enforcement of these regulations.
The subdivider shall prepare las proposed plat in conformance
with the following provisions;
Land which the Planning Commission has found to be unsuitable
for subdivision, due to flooding, bad drainage, steep slopes, rock
formation, or other features likely, to be harmful to the safety, wel-
fare or health of the future residents, shall not be subdivided unless
adequate methods for sub - division are formulated by the developer and
approved by the City Engineer and the Planning Commission.
A. The arrangements, classification, extent, width, grade and
location of all streets shall conform to the Comprehensive Plan and
shall be designed in relation to existing and planned streets, topo-
graphic conditions, public convenience and safety, and the proposed
uses of the land to be served by such streets.
B. Where such is not shown in the Comprehensive Plan, the
arrangement of streets in a subdivision shall either:

(1) Provide for the continuation or appropriate pro-
jection of existing principal streets in surrounding
areas; or,
(2) Conform to a.plan for the neighborhood approved or
adopted by the Planning Commission to meet a parti-
cular situation where topographical or other conditions
make continuance or conformance to existing streets
impracticable.
C. Minor streets shall be so laid out that their use by through
traffic will be discouraged.
D. Where a subdivision abuts or contains an existing or proposed
major street or highway, the Planning Commission may require reverse
frontage lots with screen planting in a reservation strip along the
rear property line, deep lots with rear service alleys abutting the
major street or highway, or such other treatment as may be necessary
for adequate protection of residential properties and for separation
of through and local traffic.
E. Where a subdivision borders on or contains a railroad right -
of -way, the Planning Commission may require a street approximately
parallel to and on each side of such right -of -way, at a distance suitable
for the appropriate use of the intervening land. Such land would be
appropriately used for park purposes in residental districts, or for
commercial or industrial purposes in non - residential districts. Such
distances shall be determined with due regard for the requirements of
approach grades or future grade separations.
F. Reserve strips in private ownership controlling; access to
streets shall be prohibited.
G. Street jobs with centerline offsets of less than one hundred
and fifty (150) feet shall be avoided.
H. A tangent at least one hundred (100) feet long shall be
introduced between reverse curves on major and collector streets.
I. When connecting street lines deflect from each other at any
one point by more than ten (10) degrees, they shall be connected by a
curve with a radius adequate to insure a sight distance of not less
than four hundred (400) feet for collector streets, and of such greater
radii as the Planning Commission shall determine for special cases.
J. Streets shall be laid out so as to intersect as nearly as
possible at right angles and no street shall intersect any other
street at less than eighty (80) degrees.
K. Curb radii on all block corners shall be ten (10) feet: and a
five (5) foot radius shall be used at intersections of streets and alleys,
L. Street rights -of -way shall be as shown in the Comprehensive
Plan and, where not shown therein, shall be not less than the following:
(1) Major streets - 66 feet.
(2) Collector streets 60 feet.
(3) Minor streets - 50 feet.
(4) Cul -de -sacs - 100 feet in diameter for turn - around.
(5) Alleys, residential district - 20 feet.
(6) Alleys, commercial or industrial district - 20 feet.
M. Pavement widths of roadways shall be as sh+wn in the Compre-
hensive Plan but shall not be less than the following:
(1) Mayor streets - 36 feet.
(2) Collector streets -.30 feet.
(3) Minor streets - 25 feet.
(4) Cul -de -sacs - 80 feet in diameter for turn - around.
(5) Alleys - 16 feet.
(6) Sidewalks - 4 feet.
N. Half streets shall be prohibited, except where essential to
the reasonable development of the subdivision in conformity with the
other requirements of these regulations; and where the Planning Commission
finds it will be practicable to require the dedication of the other half
when the adjoining property is subdivided. Wherever an existing half
street is adjacent to a tract to be subdivided, the other half of the
street shall be platted within such tract.
0. Cul -de -sacs shall not be longer than two hundred (200) feet.
P. No street names shall be used which will duplicate or be
confused with the names of existing streets. Street names shall be sub-
ject to the approval of the Planning Commission.
Q. Street grades, wherever feasible, shall not exceed the
following, with due allowance for reasonable vertical curves:
(1) Major streets g 8 percent.
(2) Collector streets - 10 percent.
(3) Minor streets - 12 percent.

R. No street grade shall be less than one -half (1/2) of one

(100) feet from an intersection, but in no case shall grades exceed

U. General considerations:
(1) Intersections of more than two (2) streets at a
point shall not be permitted.
(2) Alleys shall be discouraged in residential districts
but shall be provided in commercial and industrial
districts.
V. Other rights -of -way or easements.
(1) Easements for utility rights -of -way shall be not
less than ten (10) feet in width and wherever
possible shall be provided along rear property
lines. If provided along side property lines, their
rights -of -way shall be in addition to the minimum
lot width requirements.
(2) Pedestrian walks shall be at grades no greater than
ten (10) percent unless provided with steps whose
design meet with the approval of the City Engineer.
(3) Where a subdivision is traversed by a water 'course,
coulee, drainage way, channel, or stream, there
shall be provided a storm water easement or drain-
age right -of -way conforming substantially with the
lines of such water course, and such further width
or construction or both that will be adequate for
such purpose. Paralley streets, parkways, walkways,
culverts or bridges may be required in connection
with such drainage easement.
SECTION 10.403 BLOCKS

(1)
A. Block length shall not exeed six hundred sixty (660) feet
nor be less than three hundred sixty (360) feet, where lot sizes
average less than two (2) acres. The length of blocks shall be con-
sidered to be the distance from street centerline to opposite street
centerline and shall be measured through adjacent back lot lines or
through the center of the block. In cases of irregular shaped blocks,
the requirements shown herein may be waived by the Planning Conunission.

B. Pedestrial crosswalks not less than tam (10) feet wide
may be required in blocks longer than five hundred (500) feet where
such crosswalks are deemed by the Planning Commission to be essential
to provide circulation, or access to schools, playgrounds, shopping
centers, transportation, or other community facilities.
C. The width of blocks shall generally be sufficient to allow
twc (2) tiers of lots and be at least two hundred (200) feet in width.
In cases of irregular shaped blocks the minimum width may be waived by
the Planning Commission.
D. Block's intended for business and industrial use should be
specifically designated for such purposes with adequate space set aside
for off street parking and delivery facilities. The Planning Commission
may require service drives or frontage roads along major streets for
business or industry.
E. Where frontage is on a major or collector street, the long
dimensions of the block should front thereon.
SECTION 10.404 LOTS

A. Lot dimensions and area for lots shall conform to the re-
quirements of the Zoning Regulations of the City of Blair, Nebraska.
B. Platting of lots for commercial purposes should be avoided
in favor of the comprehensive design of a balanced shopping center
providing for off street parking and loading space.
C. Satisfactory access from a public street shall be provided
for all lots.
D. Double frontage and reverse frontage lots shall be avoided,
where possible.
E. Corner lots shall be of extra width sufficient to maintain
building lines on both streets.
F. Side lot lines shall be approximately at right angles or
radial to street lines.
G. Excessive depth in relation to width of over 3 to 1 shall
be avoided.
SECTION 10.405 PUBLIC SITES" AND OPEN SPACES
A. Where a park, playground, school or other site for public
use shown on the Comprehensive Plan is located in whom or in part in
the applicant's subdivision, the Planning Commission may require the
dedication or reservation of'such area within the subdivision.
B. Where deemed essential by the Planning Commission upon
consideration of the type of development proposed in the subdivision,
and especially in large -scale developments not anticipated in the
Comprehensive Plan, the Planning Commission may request the dedication
or reservation of such other areas or sites of a character, extent or
location suitable to the needs created by such development for school,
parks and other neighborhood facitlities.
C. All subdividers shall be assessed an equitable amount in
dollars and /or :land to implement the public sites and open space seg-
ment of the Comprehensive Plan. The form and amount of assessment
shall be fixed by the Planning Commission at the meeting when the
Preliminary Plat is considered.
ARTICLE B. IMPROVEMENTS
SECTION 10.501 PLANS AND SPECIFICATIONS
The subdivider shall construct and install the improvements
described in Section 10.502 below in accordance with a construction
plan and specifications recommended by the City Engineer and Planning
Commission and approved by the City Council.
Schedules of improvements shall be prepared by the City
Engineer. The schedules shall contain standards, and class of construc-
tion which are consistent within zone districts. The subdivider shall
be furnished copies of pertinent shcedules and shall include the speci-
fied improvements on his Final Plat.
SECTION 10.502 REQUIRED IMPROVEMENTS
A. Monuments. Monuments shall be placed at all block corners,
.angle points, points of curves in streets, lot corners and:at other
intermediate points.
B. Water Mains. Water mains shall be provided and extend to
the boundaries of the subdivision, exept where, in the opinion of the
City Water Commissioner, connection to a public water supply is im-
practical. A rural water supply shall comply with the requirements
of the Washington County Health Department.
C. Sanitary Sewers. Sanitary sewers shall be provided and
extend to the boundaries of the subdivision, exeept where, in the
opinion of the City Engineer, the provision of sanitary sewers is
impractical, in which case individual lots will comply with the size
requirements of both these regulations and the Zoning Regulations and
provide gpptic tanks and disposal fields approved by the Washington
County Health Department prior to or at the time of construction of
any buildings on such lots.
D. Storm Drains. The subdivision shall be provided with
adequate drains, ditches, culverts, complete bridges, storm sewers,
intakes and manholes to provide for the collection and the removal
of all surface waters, and these improvements shall extend to the
boundaries of the subdivision so as to provide for extension by adjoin-
ing properties.
E. Sidewalks. A concrete sidewalk with a minimum width of
four (4) feet shall be provided adjacent to each lot grontage.
F. Grading. All streets andalleys within the platted area
which are dedicated to public use shall be brought to approved grade.
G. Curb and Gutter. Curb and gutter shall be installed on
all roadways within the platted area which are dedicated for public
use and shall be constructed of concrete in accordance with designs,
specifications and approved grades.
H. Sufacinm. All roadways being dedicated for public use
shall be surfaced from curb to curb. Suffacing shall be concrete
and shall be constructed in accordance with approved designs, speci-
fications and grades.
I. Other Improvements. The installation of other improvements
may be .'' when deemed necessary in the best public interests of
the community or in conformance with the Comprehensive Plan.
J. Land Restoration. Following excavation of land for
development purposes, restoration may be required by means of re- seeding,
sodding or other practices outlined by the Planning Commission.
ARTICLE 6. VARIANCES
SECTION 10.601 HARDSHIP

A. Upon application by the subdivider therefor, and where it
can be shown in the case of a particular proposed subdivision, that
strict compliance with the requirements of these regulations would
result in extraordinary hardship to the subdivider because of unusual
topograpy, or other such conditions, thus retarding the achiemvent of

the objective of these regulations, then the City Council upon recomm-
endation from the Planning Commission may vary, modify or waive require-
ments so that substantial justice may be done and the public interest
secured; provided that such variance, modification or waiver will not
have the effect of nullifying the intent and purpose of these regulations,
or of the Comprehensive Plan.
B. In no case shall any variance, modification or waiver be
more than a minimum easing of the requirements; in no case shall it
have the effect of reducing the traffic capacity of any major or second-
ary streets; and in no case shall it be in conflict with existing
Zoning Regulations.
SECTION 10.602 PLANNED UNIT DEVELOPMENT
If a planned unit development of over five (5) acres in a
single ownership is proposed, detailed site plans showing the location
of access, streets, buildings, parking facilities, recreational
facilities and landscaping areas shall be submitted to the Planning
Commission for review, together with detailed information as to pro-
posed use and occupancy.
After a public hearing thereon, if the Planning Commisson
finds that the interests of the community in good design, environmental
amenity and efficiency of public services would be enhanced thereby,
the Commission may waive one or more of the subdivision regulations
(excepting the requirements for the installation of dmprovements) or
may establish additional conditions to be met by the development plan.
In approving such a development plan the Planning Commission
shall be assured that it provides and dedicates adequate open spaces
and improvements for circulation, parking, recreation, education and
service needs of the tract when fully developed and that such covenants,
financial and legal guarantees are provided that will assure that the
plan will be followed and achieved.
ARTICLE 7. FEES
In order to cover the costs of advertising, holding public
hearings, and other expenses incidental to the approval of a sub-
division, the subdivider shall pay a fee at the time of application
for tentative approval of a Preliminary Plat. Such fee will be based
upon the estimated number of lots created. At the time of application
for final approval of the subdivision, the required fee will be re-
calculated on the bases of the actual number of lots created, and an
adjustment of the fee will be made, the subdivider to pay an additional
amount or to receive a refund due to changes in the number of lots.
If, because of failure of the subdivider to submit a Final Plat within
twelve (12) Months after receiving tentative approval of a Preliminary
Plat, it is necessary to re- submit a Preliminary Plat for tentative
approval, the subdivider shall be required to pay the fee currently
in effect at the time of re- submission.
The fees for approval of a subdivision shall be charged and
collected at the following rates:

credited to the General Fund of the City of Blair.
ARTICLE 8. ENFORCEMENT
SECTION 10.801 VALIDITY
No plat or subdivision of the City of Blair or within two (2)
miles thereof shall be recorded or filed with the County Register of
Deeds, nor shall any plat or subdivision have any validity until it
complies with the provisions of these regulations and has been approved
by the City Council as prescribed herein.

SECTION 10.802 BUILDING PERMITS
Not more than two (2) building permits shall be issued for
each separate tract existing at the effective date of these regulations
unless the tract shall have been platted in accordance with the provisions
of these regulations.
SECTION 10.803 CITY FUNDS EXPENDED
No public improvements over which the City Council has control
shall be made with City funds, nor shall any City funds be expended
forsstreet maintenance, street improvements, or other services in any
area that has been subdivided after the date of the adoption of these
regulations unless such subdivision and streets have been approved in
accordance with the provisions of these regulations and the street
accepted by the City Council as a public street.
ARTICLE 9. AMENDMENTS
The City Council may amend these regulations from time to
time, provided, however, that such amendments shall not become effect-
ive until a recommendation from the Planning Commission is received
and other conditions satisfied as may be required by law.
ARTICLE 10. SEVERABILITY
If any article, section, sub - section, sentence, clause or
phrase of these regulations be declared unconstitutional or void,
such decision shall not affect the validity of these regulations as
a whole or any part thereof, other than the part so declared invalid.
Any person, firm co- partnership, association, or corporation
violating any of the provisions of this chapter shall be guilty of a
misdeameanor and shall upon conviction thereof be punished as speci-
ied by Section 1.109 of the Municipal Code of the City of Blair,
Nebraska. The sale of each and every lot sold in violation of this
chapter shall be considered a separate violation. Each day of a con-
tinuing violation of these regulations shall constitute a separate and
distinct offense and shall be punishable as such.
ARTICLE 12 . CONFLICTING REGULATIONS REPEALED
All regulations or part of regulations in conflict herewith
are hereby repealed, except any regulations that impose more restrict-
ive regulations than are imposed herein.
These regulations shall be in effect from and after their
adoption and Publication as required by law.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
1. That the West half of Lot eight (8) in Block thirtyi -two
(32), City of Blair, be sold to Washington County, Nebraska by Special
Warranty Deed, without abstract, for the sum of $300.00 and that the
Mayor and City Clerk execute and deliver to purchase' such deed upon
receipt of said purchase price.
2. That notice of said sale and the terms thereof shall be
published for threee consecutive weeks in the Enterprise, the legal
newspaper of the City of Blair, immediately after the passage and
publication of this ordinance.
3. That if a remonstrance against such sale signed by legal
electors of said City equal in number to thirty percent, of the electors
thereof voting at the last regular municipal election held therein,
be filed with the City Clerk within thirty days after the passage and
publication of this ordinance, thensaid property shall not then, nor
within one year thereafter, be sold.
4. That this ordinance shall take effect from and after its
passage, approval and publication as provided by law.

NORTH OF THE NORTH LINE OF GRANT STREET AND SOUTH OF THE RIGHT OF
WAY OF THE CHICAGO AND NORTHWESTERN RAILROAD COMPANY; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING
WHEN THIS ORDINANCE SHALL BE IN FORCE.

SECTION 1. That that part of Twelfth Street in the

AN ORDINANCE AMENDING SECTION 3.404 OF THE MUNICIPAL CODE OF THE CITY
OF BLAIR, NEBRASKA, RELATING TO DRUNKEN DRIVING AND THE PENALTIES
THEREFOR: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
THEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. That Section 3.404 of the Municipal Code of the
City of. Blair, Nebraska, be and the same hereby is amended to read as
follows:
"It shall be unlawful for any person tooperate or be
in actual physical control of any motor vehicle within the City while
under the influence of alcoholic liquor or of any drug. Any person
who shall operate or be in the actual control of any motor vehicle in
the City while under the influence of alcoholic liquor or of any drug,
shall be deemed guilty of a misdemeanor and upon conviction thereof shall
be punished as follows: Such person shall be fined the sum of $100.00
or ordered confined for not more than three months in the city prison
or to hard labor in the City on the streets or elsewhere for the benefit
of the City, or both, and shall be ordered by the Police Magistrate, as
part of the judgment of conviction, not to drive any motor vehicle for
any purpose for a period of six months from the date of payment or satis-
faction of such fine and shall order that the operator's license of such
person be revoked for a like period."
SECTION 2. That all ordinances or parts of ordinances
conflicting with the provisions of this ordinance are hereby repealed
insofar as the same affect this ordinance.

provided, at the rate of six dollars per day for each day the d€fendant
shall actually work."

WASHINGTON COUNTY, NEBRASKA, AND PROVIDING WHEN THIS ORDINANCE SHALL
TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby extend the corporate limits of said City to include
urban and suburban land now contiguous to said City Described as
Tax Lot 55 in Section 23, Township 18 North, Range 11 East of the
6th P. M., Washington County, Nebraska.
SECTION 2. This ordinance shall take effect from and
after its passage, approval and publication as provided by

The Mayor and Council of the 'City of Blair, Washington
County Nebraska met in regular session at the City Council Chambers
at 7:30 o'clock P. M. Mayor H. V. Simpson presided at the meeting,
and City Clerk, L. W. Svendgaard recorded the proceedings of the
meeting.
ROLL CALL
The Mayor directed the Clerk to call the roll and on roll
call Councilman Hansen, Kuhr, Pounds, Sheets, Stokes, Taylor and
Whitaker were present. Councilman Lutz was absent.
ORDER OF BUSINESS
Whereupon the Mayor announced that the introductions of
ordinances was-now-in order.
It was moved by Councilman Stokes and seconded by Council-
man Kuhr that the minutes of the proceedings of the Mayor and Council
in the mattero of the passage and approval of Ordinance No. 987 be
preserved and kept in a separate and distinct volume known as the
Ordinance Record of the City of Blair, Nebraska; and that said
volume be incorporated in and made a part of these proceedings the
same as though spread at large herein. Councilman Hansen called for
the question. The Mayor put the question and directed the Clerk to
call the roll for the vote thereon:
Yeas: Hansen, Kuhr, Pounds, Sheets, Stokes, Taylor and Whitler..
Nays: None.
Absent: Lutz.

Introduction of Ordinance No. 987 of the City of Blair,
Nebraska and the matter now coming before the Mayor and Council
was the passage and approval of Ordinance No. 987, which was
introduced by Councilman Hansen and is in words and figures as
follows:
AN ORDINANCE VACATING THE PLAT OF LOTS 30, 31, 32 and 33, BLOCK 2,
FAIRVIEW HEIGHTS ADDITION, CITY OF BLAIR, WASHINGTON COUNTY,
NEBRASKA: APPROVING THE REPLAT'THEREOF AS LOTS 25 30, 31, 32 and
33, BLOCK 2, FAIRVIEW HEIGHTS ADDITION, CITY OF BLAIR, WASHINGTON
COUNTY, NEBRASKA: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL BE IN
FORCE:
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR,
NEBRASKA:
SECTION 1. Whereas Donald E. Schettler and Jacqueline
Schettler and Marius Hansen and Carrie F. Hansen, being all of the
owners of Lots 30, 31, 32 and 33 in 2, Fairview Heights
Addition to the City of Blair, Washington County, Nebraska, have
filed a petition asking that the plat of said Addition as to said
above numbered lots be vacated and it appearling that it would be
to the best interests of said owners and of the City to vacate said
partial plat, and
SECTION 2. Whereas the owners thereof have filed with
their petition a Replat of said lots into Lots 25, 30, 31, 32 and
33, in Block 2, Fairview Heights Addition to the City of Blair,
Washington County, Nebraska, now therefore
SECTION 3. The plat astto Lots 30, 31, 32 and 33 in Block
2, Fairview Hiekh s Addition to the City of Blair, Washington County,
Nebraska, is hereby wholly and entirely vacated and the replat thereof
as Lots 25, 30, 31, 32 and. 33 in Block 2, Fairview Heights Addition
to the City of Blair, Washington County, Nebraska, is hereby accepted
and approved and, execution. and acknowledgement by the owners
thereof shall be recorded in the office of the County Clerk of
Washington County, Nebraska.
SECTION 4. All ordinances and parts of ordinances in
conflict therewith shall be and the same hereby are repealed.
SECTION 5. This ordinance shall be in full force and
effect from and after its passage, approval and publication as
required by law.

SUSPENSION OF RULES
FIRST READING
The Mayor directed the Clerk to read by title Ordinance
No. 987 of the City of Blair, Nebraska. The Clerk thereupon read
the aforesaid Ordinance No. 987 by title on its first reading.
Whereupon Councilman Stokes moved that Ordinance No.
987 be approved on its first readingand its title agreed to.
Councilman Kuhr seconded the motion, and Councilman
Hansen called for the question. The Mayor put the question and
directed the City Clerk to call the roll for the vote thereon:
Yeas: Hansen, Kuhr,, Poun ces '. Sheets .' 'Tay ,or, Whitaker.
Nays: None.
Absent: Lutz.
Motion: Carried.
Whereupon it was moved by Councilman Stokes and seconded
by Councilman Kuhr that the statutory rules in regard, to the
passage and adoption of Ordinances be suspended so that Ordinance
No. 987 might be introduced, read, approved and. passed at the same
meeting.
Councilman Hansen called for the question. The Mayor put
the question and directed the Clerk to call the roll for the vote
thereon:
