COUNCIL MEMBER WOLFF INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDINANCE TO AMEND THE BLAIR CITY MUNICIPAL CODE, CHAPTER 5,
ARTICLE 2, SECTION 5-203 TRUCK ROUTES, REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH, PROVIDING WHEN THIS
ORDINANCE SHALL BE IN FULL FORCE AND EFFECT AND PUBLISHING IN
PAMPHLET FORM.
WHEREAS, Nebraska Revised Statute § 16-201 authorizes the City of Blair to have the
care, supervision and control of all public streets, alleys, public squares, and commons within the
city; and
WHEREAS, the City of Blair determined that it is in the public interest that upon request
before the City Council, there may exist a need to designate truck routes unlawful for any person
to operate any truck on the following city streets the Municipality: Lincoln Street from Highway
75 to 25th Street, Grant Street from Highway 75 to 25th Street, Colfax Street from 10th Street to
23rd Street, South Street from 10th Street to 23rd Street, Butler Street from Highway 75 to Highway
30, and Wilbur Street from 10th Street to 16th Street, 16th Street from Highway 30 to Wilbur Street,
unless to pick up or deliver goods, wares, or merchandise to businesses or residences on those
streets; and
WHEREAS, In addition, the Governing Body may, by resolution, designate certain streets
in the Municipality that trucks shall travel upon, and it shall be unlawful for persons operating
such trucks to travel on other streets than those designated for trucks, unless to pick up or deliver
goods, wares, or merchandise, and in that event, the operator of such truck shall return to such
truck routes as soon as possible in traveling through or about the Municipality. The Governing
Body shall cause notices to be posted or shall erect signs indicating the streets so designated as
truck routes; and
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR OF THE CITY
COUNCIL OF THE CITY OF BLAIR, NEBRASKA AS FOLLOWS:
Article 2. Municipal Traffic Regulations
Sec. 5-203 TRUCK ROUTES. For purposes of this section, a "Truck" is considered a
"Commercial Truck" and subject to this Section if it is a motor vehicle weighing over 10,000
pounds, that is designated, used, or maintained primarily for the transportation of property or
persons for hire, compensation, or profit, and is designated as a truck by the manufacturer. It is
unlawful for any person to operate any truck on the following city streets in the Municipality:
Lincoln Street from Highway 75 to 2511 Street, Grant Street from Highway 75 to 25th Street, Colfax
Street from l Otis Street to 23rd Street, South Street from l Otis Street to 23rd Street, Butler Street from
Highway 75 to Highway 30, and Wilbur Street from 10th Street to 161h Street, 161h Street from
Highway 30 to Wilbur Street, unless to pick up or deliver goods, wares, or merchandise to
businesses or residences on those streets. In addition, the Governing Body may, by resolution,
designate certain streets in the Municipality that trucks shall travel upon, and it shall be unlawful
for persons operating such trucks to travel on other streets than those designated for trucks, unless
to pick up or deliver goods, wares, or merchandise, and in that event, the operator of such truck
shall return to such truck routes as soon as possible in traveling through or about the Municipality.
The Governing Body shall cause notices to be posted or shall erect signs indicating the streets so
designated as truck routes.
In addition to the restrictions provided for hereinabove, the Chief of Police or Director of
Public Works shall have the authority to prohibit any truck from traveling upon any street other
than those designated for trucks regardless of its pickup or delivery of goods, wares, merchandise,
or other cargo to prevent injuries to the streets of the Municipality from vehicles which weight
would be injurious to such streets. (Neb. Rev. Stat. §16-209)
(NOTE: See Resolution No. 2011-8 for definition of "Commercial Truck" and additional
guidelines for truck routes.)
Any person who violates this section shall be punished as outlined in Article 7, Section 5-701
and 5-702.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
This ordinance shall be in full force and effect from and after its passage, approval, and
publication as provided by law.
