This agreement is entered into on the 20 day of S5p4cm5er ,
2022, by and between Paul D. Anderson & Mary Ann Anderson, hereinafter
referred to as "OWNERS" and the City of Blair, Nebraska, hereinafter referred to as
"CITY".
LEGAL DESCRIPTION: Lots Seven and Eight (7 & 8), Block Fifty-four (54), City of
Blair, Washington County, Nebraska.
ADDRESS: 1333 Lincoln Street, Blair, Nebraska, 68008, hereinafter referred to as
"PROPERTY".
WHEREAS, OWNERS wish to demolish the primary structure at 1333 Lincoln
Street, Blair, Nebraska, 68008. IT IS THE OWNERS intent to demolish the primary
structure only, and not demolish the accessory structure. Furthermore, the
OWNERS desire to construct an office building on the property; and
WHEREAS, OWNERS wish to disconnect the water supply at the stop box and
cap the sewer main as it is located; and
WHEREAS, OWNERS have been informed that an accessory structure is not
permitted to remain on the property as it will be an empty lot after the demolition of
the primary structure; and;
WHEREAS, OWNERS have been informed that the standard operating
procedure is to disconnect the water at the corporate stop and the sewer at the
main;
THEREFORE, IT IS AGREED upon by the OWNERS and the CITY that the
water disconnect may be at the stop box; that the sewer main may be capped where
located; and, the accessory structure may remain as long as a building permit has
been issued for new construction within fourteen (14) days of this Agreement.
IT IS FURTHER AGREED UPON between the OWNERS and the CITY that
if no construction of an office building is commenced within six (6) months of this
agreement, OWNERS will cap the water at the corporate stop; cap the sewer at a
location determined by the Blair Public Works Department and remove the accessory
structure.
IT IS FURTHER AGREED UPON between the OWNERS and the CITY, if the
property is placed for sale by the OWNERS without a primary structure being erected
on the property, then OWNERS will cap the water at the corporate stop; cap the
sewer at a location determined by the Blair Public Works Department, and remove
the accessory structure.
If this Agreement is breached by the OWNERS, the City reserves the right to
hire a contractor to perform said operations, submit the bill to OWNERS for
payment, sue for a Declaratory Judgment in Washington County District Court, or
any other relief as just and equitable.
