Whereupon the Mayor announced that the introduction of ordinances
was now in order.
It was moved by Councilman Brown and seconded by Councilman Lutz
that the minutes of the proceedings of the Mayor and Council in the matter
of the passage and approval of Ordinance No. 830 be preserved and kept
in a separate and distinct volume known as the Ordinance Record of the
City of Blair, Nebraska, and that said volume be incorporated in and made
a part of these proceedings the same as though spread at large herein.

AN ORDINANCE AMENDING SECTION 2.215 ENTITLED "CHIEF OF POLICE; SALARY" OF
THE MUNICIPAL CODE OF THE CITY OF BLAIR, NEBRASKA, BY RAISING THE SALARY
TO BE RECEIVED BY THE CHIEF OF POLICE FROM $4410.00 ANNUALLY TO $4800.00
PER YEAR AND AMENDING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
THEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. That Section 2.215 entitled "Chief of Police;
Salary" of the Municipal Code of the City of Blair, Nebraska, be and the
same hereby is amended to read as follows:
"Section 2.215 CHIEF OF POLICE; SALARY 16 -310
The Salary of the Chief of Police is fixed to be $4800.00
per year, payable semi - monthly.
SECTION 2. All ordinances or parts of ordinances in conflict
therewith are hereby repealed.

AN ORDINANCE AMENDING SECTION 2.216 ENTITLED "CITY CLERK; EMPLOYEES;
OFFICERS; SALARIES" OF THE MUNICIPAL CODE OF THE CITY OF BLAIR, NEBRASKA,
BY CHANGING THE SALARY BASIS IN GRADE X FROM $450.00 TO A MAXIMUM OF $750.00
PER MONTH AND BY CHANGING THE HOURLY AND MONTHLY SALARY BASIS OF VARIOUS
EMPLOYEES OF THE CITY AND AMENDING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT THEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. That Section 2.216 entitled "City Clerk; Employees;
Officers; Salaries" of the Municipal Code of the City of Blair, Nebraska,
be and the same hereby is amended to read as follows:
"Section 2.216 CITY CLERK; EMPLOYEES; OFFICERS; SALARIES 16-310
The Salary of the City Clerk is fixed to be $1500.00 per
year, payable in quarterly installments.
City employees and officials whose compensation is not
otherwise fixed by ordinance or state law shall be classified
at the time of employment as (1) employees on an hourly wage
basis, or (2) as employees on a monthly salary basis. At the
time of employement of any such employee or official the Mayor
and Council shall fix the grade of such employee or official
by resolution, and the compensation of such employee or official
shall not thereafter be altered from such grade except by
ordinance changing the grade of such employee or official. The
exact compensation to be paid any such employee of official
shall from time to time be fixed within the grade by resolution
of the Mayor and Council.
Officials on a monthly salary basis shall be classified
into grades as follows: Grade I, $100.00 per month or less;
Grade II, Over $100.00 per month to $200.00 per month; Grade
III, $200.00 per month to $250.00 per month; Grade IV, $250.00
per month to $300.00 per month; Grade V, $300.00 per month to
$350.00 per month; Grade VI, $350.00 per month to $375.00 per
month; Grads VII, $375_00 per month to $400,00 per month; Grade
VIII. ' 4'DD _ DD Der m6hth to $ 1 , ).25.13D per month; Grade IX, $1-1.25.00
per month to $450.00 per month; Grade x, $450.00 per month to
$750.00 per month.
Employees on an , hourly wage basis shall be classified into
grades as follows: Grade I, $1.00 per hour or less, Grade II,
$1.00 per hour to $1.10 per hour; Grade III, $1.10 per hour to
$1.25 per hour; Grade IV, $1.25 per hour to $1.30 per hour;
Grade V, $1.30 per hour to $1.35 per hour; Grade VI, $1.35 per
hour to $1.45 per hout; Grade VII, $1.45 per hour to $1.60 per
hour; Grade VIII, $1.60 per hour to $1.71 per hour; Grade IX,
$1.71 per hour to $2.00 per hour; Grade X, $2.00 per hour to
$3.00 per hour. Casual or temporary labor hired shall be paid
at the rate provided in Grade II.
The salaries and wages of present city officials and
employees not otherwise fixed in this ordinance are fixed to be
as follows:

AN ORDINANCE AMENDING SECTION 9.305 ENTITLED "DISPOSITION OF IMPOUNDED
ANIMALS" OF THE MUNICIPAL CODE OF THE CITY OF BLAIR, NEBRASKA, BY PROVIDING
FOR A FEE TO BE PAID TO THE CITY FOR RELEASING IMPOUNDED ANIMALS.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. That Section 9.305 entitled "Disposition of Impounded
Animals: of the Code of the City of Blair, Nebraska, be and the
same hereby is amended to read as follows:
"Section 9.305 DISPOSITION OF IMPOUNDED ANIMALS
Unlicensed dogs and other animals found running at large
shall be confined in a humane manner for a period of not less
than three days. If not claimed by their owners after the expir-
ation of three days, said animals shall be disposed of by the
City Police. Any owner claiming an impounded animal shall pay
to said City a fee of $10.00 before said animal shall be released.
SECTION 2. All ordinances or parts of ordinances in conflict
therewith are hereby repealed.
SECTION 3. This ordinance shall take effect and be in force
from and after its passage, approval and publication as required by law.

There is hereby levied an occupation tax upon each and everysr
occupation and business within the corporate limits of the City
of Blair as herein after enumerated in the several different amounts
and upon the several respective occupations, professions and lines
of business as follows:
Auctioneers offering for sale goods, merchandise and live-
stock of any kind, $5.00 per day,or $25.00 per year.
Bill board advertising: Bill posting on bill boards located
on private property by persons, firms or corporations for pay
or hire, $5.00 a year per board.
Billiard Hall or pool Hall: First table per year $25.00.
Each additional table peter year, $5.00.
Bottle Club: $200.00 per year except that said occupation
tax shall not apply to non - profit corporations as exempted from
payment of federal income taxes, as provided by Section 501 (c),
(4) , (7) or (8), Internal Revenue Code of 1954, as Amended.
Bottle Club or Class TTHTT license operated by non - profit corporation
as exempted from payment of federal income taxes, $25.00 per year.
Bowling Alley First alley per year, $25.00. Each Additional
alley per year $5.00.
Buses, bus lines and taxis transporting passengers for hire
from any place within the City to other parts within or without
the City, $10.00 per year.
Circus, circus parade where tent is outside City limits,
carnivals and other rides or shows under canvas or in open air,
per day $25.00.
Coin operated amusement machines, including pinball machines,
$2.00 per year.
Concessions, concession stands, including those at carnivals,
per day $5.00, per year $50.00.
Hawkers, peddlers or sellers of goods at retail by sample
or by taking orders, from door to door, includink itinerant
magazine or book agents, for each such person, $5.00 per day or
$50.00 -a year.
Express companies in intra -state business to and from the
City of Blair, per year $5.00.
Motion Picture houses, per year $10.00.
Physicians, surgeons, opticians, optometrists, osteopaths,
chiropractors, chiropodists, or any person practicing the healing
art under advertisement or announcement that their services or
merchandise is available in said City for a limited time, per
day $5.00, per year $50.00, provided the above tax shall not
apply t� practitioners called for consultation or diagnosis or
if member of the staff of any local hospital.
Railroad companies carrying and transporting freight or
passengers for hire in or out of the City, per year $10.00.
Skating rinks, portable or otherwise, per year $50.00.
Trucks, truck lines or transportation companies transporting
freight for hire from any place within the City of Blair to other
points or places within the State of Nebraska, and from outside
of said City and within said State to or within the corporate
limits of the City of Blair, Nebraska, for each truck or truck
line, per day $1.00, per year $10.00.
Manufacturer of alcohol and spirits or either, $1,000.00
per year.
Manufacturer of beer with capacity of 100 barrels daily or
less, $100.00 per year; with capacity of 100 to 150 barrels per
day, $200 :00 per year, and with capacity in excess of 200 barrels
daily, $500.00 per year.
Manufacturer of wine, $250.00 per year.
Alcoholic a distributor, except beer, $500.00 per year.
Beer $150.00 per year.
Retailer of beer only, for consumption on the premises,
$50.00 per year.
Retailer of beer only for consumption off the premises,

AN ORDINANCE PROVIDING FOR THE SALE OF IMPOUNDED VEHICLES, PROVIDING FOR
NOTICE BY REGISTERED MAIL AND PUBLICATION PRIOR TO SAID SALE, PROVIDING
FOR THE DISTRIBUTION OF THE PROCEEDS OF THE SALE, PROVIDING THAT THIS ORDINANCE
SHALL ALSO BE KNOWN AS SECTION 3.912 OF THE PUBLISHED ORDINANCES OF SAID CITY,
PROVIDING WHEN THIS ORDINANCE SHALL B IN.FORCE AND EFFECT AND REPEALING ALL
ORDINANCES IN CONFLICT THEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. All vehicles impounded and not claimed by the owner or
owners within 90 days may be sold to pay the storage charges, towing charges,
and the $2.00 fee provided for in Section 3.910 of these ordinances.

notify the registered owner or owners of the vehicle of the time and place
of the sale. Said notice shall be given by mailing a registered letter
addressed to the owner or owners at his, her or its address shown upon the
registration certificate, if any, of the impounded vehicle, and stating the
time and place of sale, which notice shall be mailed at least 30 days before
the date of sale.
SECTION 3. In addition to the notice by registered letter there
shall be a notice of sale given by publication for two successive weeks in
a legal newspaper of general circulation in the City of Blair, Said published
notice shall show the name of the owner:or owners of said vehicle, the make,
model, serial number and motor number of the vehicle, and the time and place
of sale. The sale shall be held not less than 15 :days :after the first
publication of said notice.
SECTION 4. After the sale the City Shall:
(1) Deduct from the proceeds the charges due the City as in this
article provided to be made for the impounding of such vehicle, plus the
cost of notifying the owner and the cost, if any, of publishing the notice
of sale;
(2) Hold the surplus, if any, of such proceeds subject to the
order of the owners of the vehicle.
(3) Immediately after the sale mail to the owner or owners of the
vehicle a notice stating that such sale has been held and the amount of
surplus, if any, to such owner or owners.
CO At any time within 12 months thereafter upon demand of the
owner or owners, pay such surplus to such owner or owners.
SECTION 5. This ordinance shall be designated as Section 3.912
of Ordinance 800 of the City of Blair.
SECTION 6. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 7. This ordinance shall take effect and be in force
from and after its passage, approval and publication according to law.

SECTION 1. That Section 1.208 entitled "ADDITIONS" of the Municipal
Code of the City of Blair, Nebraska, be and the same is amended to read as
follows:

The propietor or proprietors of any land within the corporate
limits of the City, or contiguous to the same, may lay out said land
into lots, blocks, streets, avenues, alleys and other grounds, under the
name of TT Addition to the City of Blair, Nebraska,"
and shall cause an accurate map or plat thereof to be made out, design-
ating explicitly the land so laid out, and particularly describing the
lots, blocks, streets, avenues, alleys and other grounds belonging to
such addition. The lots shall be designated by numbers and all streets,
avenues, boulevards, drives, roads and other grounds shall be designated
as provided in Chapter 8, Article 1 of this ordinance. Such plat shall
be acknowledged by some officer authorized to take the acknowledgments
of deeds and shall contain a dedication of all streets, alleys, thorough-
fares and public grounds therein to the use and benefit of the public
and shall have appended ac survey, made by some competent surveyor, with
a certificate attached certifying that he has accurately surveyed such
addition and that the lots, blocks, streets, avenues, alleys, parks,

off and marked. Such plat or map shall also have appended to it a

such map or plat is so 'made out, acknowledged and certified and has
been approved by the City Planning Commission and by the Mayor and
Council, the same shall be filed and recorded in the office 6f
Register of Deeds of Washington County, Nebraska. Thereupon such plat
shall be equivalent to a deed in fee simple to the City from the
proprietor or proprietors of all streets, avenues, alleys, public
squares, parks and commons, and of such portion of the land as in
therein set apart for public and City use or is dedicated to charitable,
religious or educational purposes. All additions thus laid out shall
remain a part of the City and all additions laid out adjoining or
contiguous to the corporate limits shall be included within the same
and become a part of the City for all purposes. The inhabitants of
such addition shall, be entitled to all the rights and privileges and
subject to the larva, ordinances, rules and regulations of the City.
No addition shall have any validity, right or privileges as an addition
unless the terms and conditions of this ordinance are complied with,
the plat thereof submitted to and approved by the City Planning
Commission and the Mayor and Council and their approval endorsed
thereon.

Introduction of Ordinance No. 839 of the City of Blair, Nebraska,
and the matter now coming before the:Maylr and Council was'the passage and
approval of Ordinance No. 839 of the City of Blair, Nebraska. This Ordinance
No. 839 was introduced by Councilman Brown and is in words and figures as
follows:
ORDINANCE NO. 839
AN ORDINANCE CREATING STREET IMPROVEMENT DISTRICT NO. 75 IN THE CITY OF
BLAIR, NEBRASKA, DECLARING THE NECESSITY THEREFOR, DESIGNATING THE IMPROVE-
MENTS TO BE MADE IN SAID DISTRICT, LISTING THE PROPERTY INCLUDED WITHIN SAID
DISTRICT, PROVIDING FOR THE NAMMER OF PAYMENT OF THE STREET IMPROVEMENTS
MADE THEREIN AND PROVIDING WHEN SAID ORDINANCE SHALL TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. The Mayor and City Council of Blair, Nebraska, hereby
declare and deem it necessary to improve Park Street from its intersection
with 16th Street west to and including its intersection with 17th Street
in said City by paving the same, and for said purpose there is hereby
created Street Improvement District No. 75 of the City of Blair, Nebraska.
SECTION 2. The street improvement to be made on the street in
said district shall be to pave the same, the grade of said street to conform
to the existing grades of said City of Blair, and said improvements to be
made according to plans and specifications and estimate of cost to be prepared
by the Special Engineer for said district and to be filed with the City
Clerk and to be approved by the Mayor and Council of said City.
SECTION 3. The property included in said Street Improvement District
No. 75 and subject to special assessment to pay for the cost and expenses
of said street improvement is all of the privately owned lots, parts of
lots and tracts of land and the lors, parts or tracts of land owned by any
municipal or public corporation and 'abutting upon and adjacent to said street
to be improved, to-wit: Tax Lots 109,-166, 154 and 140, all in Section 11,
Township 18 North, Range 11, East of the Sixth Principal Meridian, Lots 2,
3, 4, 5 and the west 48 feet of Lot 1, in Block 10, in the Second Addition,
and the right of way of the Chicago, St. Paul, Minneapolis and Omaha
Railroad described as commencing at a point 48 feet east of the Northwest
corner of Lot 1 in Block 10 in the Second Addition, thence Easterly on a
line parallel with the south line of Park Street to the west line of 16th
Street, thence Northerly to the south line. of Park Street and commencing
at the Southwest corner of Tax LOt 140 in Section 11, thence westerly on a
line parallel with the North line of Park Street to the Southeast corner of
Tax Lot 154 in said Section 11, and all in the City of Blair, Washington
County, Nebraska.
SECTION 4. The cost of said improvement in said Improvement
District shall be paid out of the fund created by the levy and assessments
on the lots and parcels of land in said Street Improvement District
benefited thereby in proportion to said benefits, all as by the Statutes
of the State of Nebraska in such cases made and proiided.
SECTION 5. This ordinance shall take effect and be in force
from and after its passage, approval and publication in accordance with
law.

SECTION 4. That there be, and hereby is appropriated out of the

system and salary of employees and hydrant rentals $ 60,000.00
For extensions of distribution system, Improvement of water

SECTION 5. That there be, and hereby is appropriated out of the
money derived from taxes for parks and park purposes for said fiscal year

For park and park purposes, salaries of employees, maintenance,
improvement and operation of Swimming Pool $ 20,000.00
Any balance of said fund remaining over and unexpended at the end of the

SECTION 6. That there be, and hereby is appropriated out of the
money derived from the operation of the municipal light system and the sale
of electrical current and supplies and all other funds and moneys dvailable

share of the employees and officers federal Social Security Tax for the

THE TAXABLE PROPERTY IN THE CITY OF BLAIR, NEBRASKA, FOR ALL PURPOSES
NECESSARY TO MAINTAIN THE CITY GOVERNMENT FOR THE CITY OF BLAIR, NEBRASKA,

BE IT ORDAINED BY THE MAYOR AND CITY COUN(L OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby declare it necessary to construct a sanitary sewer on 25th
Street in said City from a point opposite the South line of Lot Eight (8)
in Peaceful Valley Addition to the City northerly to a point opposite the
North line of Lot One (1) in said Peaceful Valley Addition to the City of
Blair. For said purpose there if hereby created Sanitary Sewer District
No. 13 of the City of Blair, Nebraska.
SECTION 2. The improvement to be made is to construct and lay
an 8 inch vitrified clay sewer tile with manholes, Y's and cleanouts, and
said improvement to be made according to plans and specifications and estimates
of cost to be prepared by the Special Engineer of said District and to be
filed with the City Clerk and to be approved by the Mayor and Council of
said City.
SECTION 3. The property included in said Sanitary Sewer District
No. 13 and subject to special assessment to pay for the cost and expense
of said improvement is Lots 1, 2, 3, 4, 5, 6, 7 and 8 in Peaceful Valley
Addition to the City of Blair, and the West 150 feet of. the South 355.6
feet of Lot 4 In Block 115 in the Tenth Addition to the City of Blair, and
the West 150 feet of Lot 4 in Block 114 in the Tenth Addition to the City
of Blair, Washington County, Nebraska.
SECTION 4. The cost of said improvements in said sanitary sewer
district shall'be paid out of the fund created by the levy and assessment
on the lots and parcels of land in said improvement district benefited and
to be in proportion to said benefits, all as by the statutes of the State
of Nebraska in such eases made and provided.
SECTION 5. This ordinance shall take effect and be in force
from and after its passage, approval and publication in accordance with law.

is hereby created Street Improvement District No. 76 of the City of Blair,
Nebraska.
SECTION 2. The street improvement to be made on the street in
said district shall be to pave the same, the grade of said street to conform
to the existing grades of said City of Blair and said improvement to be made
according to plans and specifications and estimate of cost to be prepared by
the Special Engineer for said district and to be filed with the City Clerk
and to be approved by the Mayor and Council of said City.
SECTION 3. The property included in said Street Improvement District
No. 76 and subject to special assessment to pay for the cost and expenses of
said street improvement is all of the privately owned lots, parts of lots
and tracts of land and the lots, parts or tracts of land owned by any
municipal or public corporation and abutting upon and adjacent to said street
to be improved, to -wit:
Lots 8 and 9 in Block 1 and Lots 1 and 16 in Block 2, all in
Carter's Addition, sometimes known as T. M. Carter's Addition to
the City of Blair, all in Washington County, Nebraska.
SECTION 4. The cost of said improvement in said Improvement District
shall be paid out of the fund created by the levy and assessments on the
lots and parcels of land in said Street Improvement District benefited
thereby in proportion to said benefits, all as by the Statutes of the State

SECTION 1. It shall be the duty of the owners and adult occupants
of any lot or tract of ground in the City to keep same free from weeds or
other rank, growth of vegetation
SECTION 2. It shall be the duty of the city administrator to
notify any such owner or occupants to remove such weeds or vegetation within
a reasonable time specified by him, such notice to be given in the same
manner as provided in Section 8.502 of the Municipal Code of the City of
Blair.
SECTION 3. In the event said landowner or occupant shall fail to
remove said weeds or vegetation within the time specified in said notice,
the City may have such work done and may levy and assess the cost and expenses
therefor upon the property benefited in the same manner as other special
taxes for improvements are levied and assessed.

1REAT ANY DISEASED OR INSECT INFESTED TREE UPON RECEIPT OF PROPER NOTICE,

SECTION 1. It shall be unlawful for any person, partnership,
association or corporation to fail, refuse or neglect to remove, destroy,
spray, trim or treat any diseased or insect infested tree or any tree having
overhanging, damaged or broken limbs constituting a hazard to public safety,
health or welfare after notice to so do given by the city administrator,
as provided in Section 8.502 of Ordinance No. 800 of the City of Blair.
SECTION 2. That any person, partnership, association or corporation
upon convictinn of violating the provisions of this ordinance, shall be fined
in any sum not more than $100.00 for each offense and shall stand committed
until such fine and costs of prosecution are paid or otherwise discharged
according to law. The imposition of any penalty hereunder shall not be
construed to be a waiver of the right of the City to collect for the cost
of work done by the City in connection with any such tree.
SECTION 3. That all ordinances and parts of ordinances in conflict
herewith are hereby repealed.

AN ORDINANCE CREATING SANITARY SEWER DISTRICT NO. 14 IN THE CITY OF BLAIR,
NEBRASKA, DECLARING THE NECESSITY THEREFOR, DESIGNATING THE IMPROVEMENTS
TO BE MADE IN SAID DISTRICT, LISTING.THE PROPERTY INCLUDED WITHIN SAID
DISTRICT, PROVIDING FOR THE MANNER OF PAYMENT OF THE IMPROVEMENTS MADE THEREIN
AND PROVIDING WHEN SAID ORDINANCE SHALL TAKE EFFECT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. The Mayor and City Council of the City of Blair,
Nebraska, hereby declare it necessary to construct a sanitary sewer on the
following line, to -wit: Beginning at the existing 8 -inch sewer in the
center line of 23rd Street, running thence westerly along the south line of
Tax Lot 345 and said south line of Tax Lot 345 projected through Tax Lot
247 to the easterly right of `way of Fontanelle Boulevard, thence southwesterly
across Fontanelle Boulevard to its westerly right of way, thence south.

Tax LOt 415, thence southwesterly to the center line of 25th Street and a
line described as beginning at .a point on the westerly right of way of
Fontanelle Boulevard, which point is 10 feet south of the southeast corner

Township 18 North, Range 11, in the City of Blair, Washington County,
Nebraska. For said purpose there is hereby created Sanitary Sewer District

SECTION 2. The improvement to be made is to construct and lay
an 8 -inch vitrified clay sewer tile with manholes, Y's and cleanouts, said
improvement to be made according to plans and specifications and estimates
of cost to be prepared by the Special Engineer of said District and to be
files with the City Clerk and to be approved by the Mayor and Council of
said City.
SECTION 3. The property included in said Sanitary Sewer District
No. 14 and subject to special assessment to pay for the cost and expense of
said improvement is Tax Lots 197, 318, 345, 247, 303, 413, 414 and 415, all
in Section 11, Township 18 North, Range 11, East of the 6th Principal
Meridian in the City of Blair, Washington County, Nebraska.
SECTION 4. The Cost of said improvements in said sanitary sewer
district shall be paid out of the fund created by the levy and assessment on
the lots and parcels of land in said improvement district benefited and to
be in proportion to said benefits, all as by the statutes of the State of
Nebraska in such cases made and provided.
SECTION 5. This ordinance shall take effect and be in force
from and after its passage, approval and publication in accordance with
law.
