power must be exercised either di-

consisting of three commissioners,
authorised by Section 19A of the

the election of 1906. .The constitu-tlonsl smendnsnt provided that "The

Bill of 1891 was Nebraskrs oon-

rates.Naturally,the legislature,being
limited in time. cannot (ive due con-slderstlon to such s complex sub-
i°¢t as making rates, especially ss
conditions change from month to
month and from year to year,soth...what might be a perfectly
equitable sud reasonable rote today
could well be conflsatory a yearhence, and therefore invalid. The
lend contests over the Newberry hill
had much to do 1\rlt.h developing the
principles o f r s te making now lnforce.Under the proofs submitted
at the first trlsl, it wss shown that
the rstes were than confiscstory and
the luv was suspended; but tn moreprosperous times, it might have been

over public utility rstes has been in
alelegsting a limited power to s com-
mission whlch is in session all thesesr round and not, like the teglsla-
tune, ln session three months out of
twenty-four.In sdual practice, the
cornrnisslon does not make rates-although it could--but examines andapprove! or rejects comrnns carrier
rates which odginute either with the
compsnies or the consumers.
