ORDINANCE NO. 782 Introduct,ion of Ordinance No. 782 of the City of Blair, Nebraska, and the matter now coming before the Mayor and Council was the passage and approvel of Ordinance No. 782 of the City "of Blair, Nebraska. This Ordinance No. 782 was introduced by Councilman Megrue and is in words and figures as follows: ORDINANCE NO. 782 RECREATION ORDINANCE Blair, Nebraska May 1, 1962 AN ORDINANCE CREATING A BOARD OF RECREATION COMMISSIONERS FOR THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA; PROVIDING THE COMPOSITION OF SAID BOARD AND THE QUALIFICATIONS FOR MEMBERSHIP; OUTLINING THE MANNER OF SELECTING RECREATION BOARD MEMBERS, THEIR TERMS OF OFFICE AND DESIGNATING THE POWER AND DUTIES OF SAID BOARD; PROVIDING FOR THE REPEAL OF.ORDINANCES IN CONFLICT THEREWITH AND PRESCRIBING THE TIM I WHEN THE ORDINANCE SHALL BE IN FULL FORCE AND TAKE EFFECT- BE IT ORDAINED BY THE MAYOR AND COUNCIL OF TBE CITY OF BLAIR, NEBRASKA: Section 16 -703, Revised Statutes of Nebraska, 1943 SECTION 1. Board of Recreation Commissioners Created; Appointment, Term and Duties. There is hereby created a. board of recreation commissioners for the City of Blair, Washington County, Nebraska, such board shall be composed of seven members who shall be resident free holders of said City and who shall be appointed by the Mayor with the advice and consent of the Council thereof. Neither the Mayor nor any member of the Council shall be a member of said board. The board of recreation commissioners shall have the power to conduct the recreation program and to use the facilities of other political subdivisions, with their consent, if such use does not interfer with the primary purpose with which such facilities are intended to serve. The entire seven commissioners are to be appointed upon the passage of this ordinance, two members are to be appointed for a term of five years, two members for a term of four years, two members for a term of three years, and one member for a term of two years and every year there - after board members are to be appointed as terms expire. Each recreation commissioner so appointed shall hold office until his successor is duly appointed and qualified. In case of a vacanpy by resignation or any other cause the Mayor and City Council shall fill said vacancy for the unexpired term in the manner provided for the selection of appointive officers of this City. Five members of said board shall constitute a quorum for the transaction of business and at their first meeting after their appointment, and each year thereafter, they shall elect from their number a chairman and a secretary (which office shall not be held by the same person.) Each year the board shall hire, with the approval of the Mayor and consent of the Council a Recreation Director and to set the Directorts salary. SECTION 2. Recreation Funds, How disbursed. All moneys derived from taxation, donations, or any other source intended to be used for recreatii`ti, purposes in and 'f -the' City`of Blair, Nebraska, shall be held by the City Treasurer and kept separate and apart from all .other funds. All claims against such recreation funds shall be passed upon by the Mayor and City Council after having been approved by the Chairman and Secretary of the Board of Recreation Commissioners. SECTION 3. Tax Levy for Recreation Purposes. The Mayor and City Council shall each year make and levy a tax of not exceeding one mill upon the dollar of the assessed.value of all the taxable property within said City, except intangible property, taxable according to the laws of the State; and said levy shall be collected and put into the City Treasurer and shall constitute the Recreation Fund of the City of Blair, Nebraska. The funds so collectable shall be used for the purchase of equipment, pay- ment of salaries and wages of persons employed in the performance of such labor and for any other expenditures necessary to conduct a recreation program. SECTION 4. Repeal of Prior Ordinances in Conflict. All ordinances and parts of ordinances passed and approved prior to the passage and approval of this ordinance and in conflict therewith are hereby repealed. SECTION 5. When Operative. This ordinance shall be in full force and take effect from and after its passage, approval and publication according to law. This Ordinance No. 783 was introduced by Councilman Megrue and is in words and figures as follows: AN ORDINANCE CREATING PAVING DISTRICT NO. 60 AND PROVIDING FOR GRADING, CURBING, GUTTERING AND PAVING THEREIN. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1. That there is hereby created within said City a paving district to be known as "Paving District No. 60,T' consisting of the following described property, to -wit: Lots one (lx, two (2) , three (3) , four(L) , five(5) ,six(6) , seven (7 , eight(8) , nine (9) , ten(10) , eleven(11) and twelve(12) in Hansen Heights in the City of Blair, Washington County, Nebraska. SECTION 2. That paving in said distract should be 25 feet wide and shall extend along that portion of 25th Avenue North from College Drive to the Larsen and Jipp Addition, all of the City of Blair, Washington County, Nebraska, and that curbing and guttering shall be constructed along the portions of said blocks as required by the City Engineer in the plans and specifications and extimates to be hereinafter adopted. SECTION 3. That the cost of said grading, paving, curbing, and guttering shall be assessed against the property in said distinct specifically by the proportions to be benefitted. This Ordinance No. 784 was introduced by Councilman Stewart and is in words arid figures as follows: AN ORDINANCE CREATING PAVING DISTRICT NO. 61 AND PROVIDING FOR GRADING, CURBING, GUTTERING AND PAVING THEREIN. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1. That there is hereby created within said City a paving district to be known as "Paving District No. 61 ", consisting of the following described property, to -wit: Lots one(1), twelve (12), and alley in between in Block eighty -five (85) , Lot one (1) in Block Eighty -six (86) , Lincoln Street, in the City of Blair, and Tax Lot No. Fifty -nine (59) from the south edge of Highway. 30 South to a point even with the South line of Lot one CO in Block Eighty -six (86) all being in Washington County, Nebraska. SECTION 2. This Ordinance No. 786 was introduced by Councilman Brown and is in words and figures as follows: ORDINANCE NO. 786 AN ORDINANCE TO BE TERMED THE "ANNUAL APPROPRIATION BILL" APPROPRIATING SUCH SUMS OF MONEY NECESSARY TO DEFRAY ALL NECESSARY EXPENSES AND LIABILITIES OF THE CITY OF BLAIR, NEBRASKA, FOR THE FISCAL YEAR COMMENCING ON THE SECOND MONDAY IN AUGUST, 1962, AND SPECIFYING THE OBJECT AND PURPOSE OF EACH APPROPRIATION AND THE AMOUNT FOR EACH OBJECT AND PURPOSE. SECTION 2: That there be, and hereby is appropriated out of the rhoney derived from the levy of taxes for Public Library purposes for the present fiscal year and out of all other money and funds available therefor, the amount of all other money and purposes as follows: For salaries of employees, maintenance and operation of Public Library $ 15,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal' year shallHbe transferred to the Public Library Fund. SECTION 3: That there be, and hereby is appropriated out of the money derived from the levy of taxes for street lighting purposes for said fiscal year and out of all other money and funds available therefor, the amount for each object and purpose as follows: For street lighting purposes $ 21,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Street Lighting Fund. SECTION 4: That there be, and hereby is appropriated out of the money derived from the water works system and out of the water fund and all other money and funds available therefor, the amount for each object and purpose as follows: For improvement, extension, operation , and maintenance of water works system and salary of employees and hydrant rentals -- -$ 40,000.00 For extensions of distribution system, improvement of water department, hydrant rentals and service $100,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Water Fund. SECTION 5: That there be, and hereby is appropriated out of the money derived from taxes for parks and park purposes for said fiscal year and out of all other funds and moneys available therefor, the amounts for each object and purpose as follows: For park and park purposes, salaries of employees, maintenance, improvement and operation of Swimming Pool - - - -$ 20,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Parks and Park Purpose Fund. SECTION 6: That there be, and hereby is appropriated out of the moneys derived from the operation of the municipal electric light system and the sale of electrical current and supplies and all other funds and moneys available therefor, the amounts for each object and purpose as follows: For salaries'of light commissioner and wages of department employees, operation and maintenance of municipal power distribution system $125,000.00 For extension and improvements of munk ipal light power system generator and plant improvement and line extension -- $225,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Electric Light System Fund. SECTION 7: That there be, and hereby is appropriated out of the money derived from taxes for sewer maintenance for said fiscal year and out of all other funds and moneys available therefor, the amounts for each object and purpose as follows: For salaries of employees, operation and maintenance of sewer system and Server Treatment Plant $ 12,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Sewer Maintenance Fund. �CILV' @; 1111 ,M11611M. SECTION 8: That there be, and hereby is appropriated out of the money derived from the levy of taxes for the operation, maintenance and care of the Blair Cemetery $ 6,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Cemetery Fund. SECTION 9: That there be, and hereby is appropriated out of the money derived from the levy of taxes for the payment of refunding bonds and interest thereon and the sinking fund for said fiscal year and out of the money derived from taxes levied for payment of intersection and for district paving bonds and interest and out of any and all other funds and money available therefor, the amounts for each object and purpose as follows: For payment of principal and interest on bond indebtedness due or to become due and for Sinking Bond Funds $115,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Sinking Fund for the payment of refunding bonds. SECTION 10: That there be, and hereby is appropriated out of the Veterans Memorial Field Fund and out of all other funds and moneys available therefor, the amounts for each object and purpose as follows: FOrs: salaries of employees, operation and maintenance, of Veterans Memorial Field $ 10,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Veterans Memorial Field Fund. SECTION 11: That there be, and . hereby is appropriated out of the money derived from the levy of taxes for the maintenance and operatidn of the Fire .Department for the present fiscal year and out of all other money available therefor, belonging to said City, the amounts for each object and purpose as follows: For maintenance and operation of the City Fire Department - -$ 6,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the fund for the maintenance and operation of the City Fire Department. SECTION 12: That there be, and hereby is appropriated out of the money derived from the levy of taxes for the purpose of purchase of Fire Department Apparatus for the present fiscal year and out of all other money and funds available therefor, belonging to said City, the amounts for each object and purpose as follows: For purchase of Fire Department Apparatus $ 15,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Fire Department Apparatus Fund. This Ordinance Councilman Murdoch and is in words and figures ORDINANCE NO. 8 AN ORDINANCE TO ESTABLISH :AND DECLARE A POLICY LIMITING THE AREA WITHIN THE CITY OF BLAIR WITHIN WHICH AREA SAID CITY WILL EXTEND NEW MAINS AND LINES TO FURNISH TO PRIVATE PROPERTY WATER FROM ITS MUNICIPAL WATER PLANT AND SYSTEM, AND PROVIDES FURTHER THAT ANY EXTENSIONS HEREAFTER OF SUCH WATER SYSTEM. TO SERVICE PROPERTY WITHIN'THE.CITY OF BLAIR OUTSIDE OF SAID AREA SHALL BE AT THE EXPENSE OF THE PROPERTY OWNER DESIRING SAID SERVICE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1: That it is necessary for the public good, convenience and welfare that .a policy be hereby now declared and established as to the construction and extension of water mains to furnish water from the municipal'water plant of this City to private property and persons in areas which have become a part of and annexed to said City subsequent to December 31, 1952, or which may hereafter be annexed to and become a part of said City. SECTION 2: That it be hereby ordained andr.declared to be the policy of the City of Blair, Nebraska, that no further extensions of water mains or water service from said municipal water plant shall be made and paid for out of funds of any kind of the said city hereafter to service any property in said City which was not within the City limits and a part of the area of said city on or before December 31, 1952, it being the intent and policy hereby created that any and all of such extensions of water mains and water service to any property now in the City of Blair or hereafter annexed thereto which was not a part of and within the limits of said City on December 31, 1952, shall be paid for by the owner of said property or the persons desiring such water service either in cash or by the formation of water districts and levy of assessments against all of the property in such districts to..pay the eost thereof. SECTION 3: Be it further ordained that no such extensions of water service 'shall be constructed by the City of Blair or any of its officers or employees to any such area unless and ,until satisfactory arrangements approved by the Board of Public Works of said City have been made for payment of the entire cost of such installation, provided however, that the installation of fire hydrants attached to such extensions shall be done at the expense of said City or its water department. That there is hereby created within said City a Street Improvement District, to be known as "Street Improvement District No. 65 ", consisting of the following deecribed property, to -wit: Lots 7 through 12 inclusive in Block 15 and Lots 1 through 6 inclusive in Block 10 in Dexters Addition to the City of Blair, Washington County, Nebraska. SECTION 2. That the paving in said District is to be 21 feet wide and shall extend along said portions of Park Street from its inter- section with 21st Street to. its - intersection with 22nd Street, and that guttering and curbing all ready there is to be used as far as practical and that other grading, curbing, guttering, and paving shall be in accordance with plans, specifications and estimates to be hereinafter adopted.
