It was moved by Councilman Conrad that the minutes of the proceedings of
the Mayor ;Ind Council in the matter of the passage and approval of Ordinance No.
71k: be preserved and kept in a separate and distinct volume known as the Ordinance
Record of the City of Blair, Nebraska, and that said volume be incorporated in
and made a part of these proceedings the same as though spread at large herein.

constructed therein, which improvements have been completed and have been accepted;

crossing of streets, avenues and alleys in said Districts was $17,792.88; that
interest which has accrued �n the warrants outstanding in addition to that shown
by the Ingineerts estimates,amounte_ more than $ None t tat the reasonable

Any or all of said bonds shall, be .redeemable at the option of the City at any time
on or after five years from the date of issuance thereof, Bonds numbers 1 to 8,
inclusie, shall bear interest at the rats of Three and One- eighth per centum
(3 1/8%) per annum from date until maturity. Bonds Numbers 9 to 12,inclusive,
shall beariinterest at the rate of Two and Five- eights per centum (2 5/8%) per
annum from date until maturity.: Bonds Numbers 13 to 18, inclusive, shall bear
interest at the rate of Two and Seven - eights per centum (2 7/8 %) per annum
from date until maturity. Said interest shall be payable semi annually -on the
fifteenth day of April and October of each year. Attached to each of said bonds
shall be interest coupons for the amount of the respective_ interest paymente-
to become due.°
SECTION III: Said bonds shall be executed on behalf of the City by
being sipled by the Mayor and attested by the City Clerk and shall have the
City Seal impressed on each bond,; ` The interest 'coupons shall be executed on
behalf of the City by being sig ed by the Mayor and Clerk either by affixing
their own proper signatures to each coupon or by causing their facsimile
signatures to be affixed thereto.
SECTION IV: The Mayor and Council shall cause to be levied and collected
annually a tax on all taxable property in said City, in addition to all other
taxes, sufficient to amount to pay the interest on said bonds as and when the
become due and to create a sinking fund to pay the principal thereof as

AN ORDINANCE RELATING TO ALCOHOLIC LIQUORS, DEFINING CERTAIN TERMS
IN RELATION. THERETO, REGULATING THE MANUFACTURE, SAVE, AND CONSUMPTION
OF SUCH LIQUORS WITHIN THE CITY, RESTRICTING THE NUMBER OF LICENSES
TO SELL ALCOHOLIC LIQUORS AND BEER WITHIN SAID CITY, REGULATING
PREMISES FROM THICH SAID LIQUORS ARE SOLD OR OFFERED FOR. SALE, PRO-
VIDING FOR THE LEVY AND COLLECTION OF OCCUPATION TAXES ": UPON VARIOUS
PHASES OF THE BUSINESS OF MANUFACTURE, DISTRIBUTION AND SELLING OF
THE SAME, TO PROVIDE PENALTIES FOR THE VIOLATION THEREOF, PROVIDING
FOR THE REPEAL OF PRIOR ORDINANC$S IN CONFLICT, AND PRESCRIBING THE
TIME WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. Definitions., Unless the context otherwise clearly
requires the definitions given in.this section shall apply in all
cases where any one of the defined terms appears hereafter in sections
,l. The word "alcohol" means the product of distillation of any
fermented liquid, whether rectified or diluted, whatever may be the
origin thereof, and includes synthetic ethyl alcohol but does not
include denatured alcohol or wood alcohol.
2. The word "spirits" means any beverage which contains alcohol
obtained by distillation, mixed with water or other substance in
solution, and included barley, rum, whiskey, gin, or other spirituous
liquors, and such liquors when rectified, bledded or otherwise mixed
with alcohol or other substances.
3. The word "wine" means any alcoholic beverage obtained by the
fermentation by the natural contents of fruits or vegetables, containing
sugar, including such beverages when fortified by the addition of "`�`°,
alcohol or spirits as above defined.
4. The word "beer" means a beverage obtained by alcoholic
fermentation of an infusion or concoction of barley or other grain,
malt and hops in water, and includes among other things, beer, ale,
stout, lager beer, near -beer, porter and the like.
5. The phrase "alcoholic liquor" includes the four varities.of
liquor above defined, "alcohol, spirits, wine and beer" and every
liquid or solid, patented or not,, containing alcohol, spirits, wine
or beer and capable of being consumed as a beverage by a human being.
The provisions of said sections shall not apply to alcohol used in the
manufacture of denatured alcohol nor to flavoring extracts, syrups
or Medicinal, mechanical, scientific, culinary or toilet prepatations,
or food products unfit for beverage purposes, not to wine intended
for use and used by any church or religious organization for sacramental
purposes.
6. The phrase "original package" means any bottle, flask, jug,
can, cask, barrel, keg, hogshead or other receptical or container
whatsoever used, corked or capped, sealed and labeled by the
manufacturer to contain and to convey any alcoholic liquor.
7. The word "Manufacturer" means every brewer, fermenter,
distiller, rectifier, wine maker, blender, processor, bottler or
person who fills or refills an original package and others engaged
in brewing, fermenting, distilling, rectifying or bottling alcoholic
liquors.
8. The word "Manufacture" means to distill, rectify, ferment,
brew, make, mix, concoct, process, blend, bottle or fill an original
package with any alcoholic liquor and includes blending but does not
include the mixing or other preparation of drinks for serving by those
persons authorized and permitted to do so by law of the State of
Nebraska.
9. The word "dthstributob" means the person importing or causing
to be imported into the state or purchasing or causing to be purchased
within the state alcoholic liquors for sale or resale to retailers.
10. The word "person" Includes any natural person, corporation,
partnership or association.
11. The word "retailer" means a person who sells, or offers for
sale, alcoholic liquors for use and consumption and not for resald
in any form.
12. "Sell at retail" and,"sale at retail" refer to and mean
sales for use or consumption and not for resale in any form.
13. The word "sale" means any transfer, exchange or barter in any
manner by any means whatsoever for a consideration and included and
means all sales made by any person whether principal, proprietor,
agent, servant or employee.
14. The words "to sell" include to solicit and receive an order
for, to keep or expose for sale and to keep with intent to sell.
SECTION 2. It shall be unlawful for any person to manufacture
for sale, keep for sale or to barter or exchage under any pretext any
alcoholic liquors within such city unless such person shall have in
force and..effect a.license therefor as provided by the _Nebraska
Liquor Control Act.
SECTION 3. It shall be unlawful to sell at retail any alcoholic
liquor within 150 feet of. any Church, school, hospital, home for
j aged or indigent persons or for veterans their wives or children
or any military or naval station. No alcoholic liquor other than beer
shall be sold for consumption on the premises within 300 feet of the
campus of any college or university.
SECTION 4. No person shall sell at retail any alcoholic liquor
on the day of any national, state, county or municipal election,
including primary elections, during the hours the polls are open in
this City. No beer shall be sold at retail on the first day of the
week, commonly cailed between the hours of 1 :00 o'clock A.M.
Sunday and 1 :00 o'clock F.M. Sunday. No alcoholic liquors, other than
beer shall be sold at retail on Sunday. No person within this City
shall sell at retail any alcoholic liquors on secular days between the
hours of 12;00 o'clock midnight and 6:00 o'clock A.M.
SECTION 5. it shall be unlawful for any person to consume any
alcoholic liquor in the public streets, alleys or public ways or upon
property owned by the state or any.goirernmental subdivision thereof,
or indide any motor 'vehicle .while upon• the .public streets, or- in theaters,
dance halls, or in any other place where.public. dancing is held or in
any other place within the City.opeh to the public after the hours _\
fixed by ordinance for - closing licensed premises:where alcoholic I.,

liquors are sold at- retai to consume; any alcoholic liquor, -except
beer, in any restaurant, cafe, coffee shop-or +other public eating •
place.
SECTION 6. It shall be the policy of the City That the number
of licenses to sell alcoholic liquors, except beer, in the original
package at retail within this City -shall be not more than one for each
1500 persons residing within said City; and subh licensees-may also
sell beer for consumption off the premises. The number of licenses to
sell.beer only for consumption :on the premises shall be not more than
one for each .1,000 persons residing in said city.
SECTION 7. Every police officer of the City is hereby authorized
to enter at-7 ny time upon: the premises of any licensee under the laws
of the .State of Nebraska, who sells any alcoholic liquor, to examine
the premises and to determine whether any provisions of the ordinances
of the City or of the laws of the state of Nebraska have been or are
being violated.
SECTION 8. For the purpose of raising revenue- :there is hereby
levied an occupation tax upon each and every occupation and business
respecting alcoholic liquors.which is carried on within the corporate
limits :as follows: (a).Manufacturer of alcohol and spirits or either,
$1,000.00; (b) Manufacturer of beer with capacity of 100 barrels daily
or less, $100.00, with capacity thf 1O0 =into, >35'02bar. els:::per da rr $200.00,

urer of wine $250.00; (d) alcoholic liquor distributor, except beer,

consumption off . the premises, sales in original package only, $25.'00;
(h).retailer of alcoholic liquors .for consumption on the premises and
off the premises, $250.00; (i) retailer of alcoholic for con-
sumption off the premises, sales in original package only, $150.00;
(j) Non-beverage users of liquors Class 1, $5,00, Class 2, $25.00,
Class 3, $50.00, Class 4, $100.00., Class 5, $250.00, The occupation
tax year shall commence on the first day of'May and end on the 30th

year all occupation taxes shall become-due and payable for the full
amount regardless of the time during the taxing period when the
license shall be in force. The amount of the occupation tax shall be
deposited with the City Clerk within 24 hours after the application
has been filed with the Nebraska Liquor Control Commission. The
City Clerk shall hold such deposit in trust until the application is .
granted and if the applicationiis denied shall promptly return the
deposited tax to. the applicant., The.City Clerk shall pay all occup-
ation taxes collected to, the City Treasurer as soon as the license
is issued and the Treasurer shall credit the same to the general fund
of the City. In the event any applicant shall fail to pay the
occupation taxes herein levied, the Mayor and Council shall pass a
resolution requesting the Nebraska Liquor Control Commission to deny
said application.
SECTION 9. No minor may sell or dispense or have in his
possession or physical control any alcoholic liquor in any tavern
or any public place, indluding public streets, alleys, and ways, or
upon property owned by the State of Nebraska, or any subdivision
thereof, or inside vehicles.while upon public streets, alleys or
gays. It shall be unlawful to sell, give away, exchange or deliver
or permit to sale, gift, or procuring of any alcoholic liquors to
or for any minor, any person who is mentally incompetent or any
person who is physically or mentally incapacitated by the consumption
of such liquors. No minor shall obtain or attempt to obtain alcoholic
liquor by misrepresentation of age or by any other method in any
place where alcoholic liquor is sold and no partat or guardian
shall knowingly suffer or permit any minor of which he or she may be
a parent or guardian to violate these provision.
SECTION 10. Any person, firm or corporation which shall violate
any of the terms of this ordinance shall be guilty of a violation
of this ordinance and upon conviction thereof for each offense shall
be fined not to exceed $100.00 or sentences to the City jail for a
term not to exceed 30 days, or both.
SECTION 11. All ordinances and parts of ordinances passed and
approved prior to the passage and approval of this ordinance and in
conflict therewith or any of the provisions thereof are hereby repealed.
SECTION 12. This ordinance shall be in full force and effect
from and after its passage, approval and publication according "to law..

THE PROPERTY OF THE CITY OF BLAIR, PROVIDING WHEN THIS ORDINANCE

SECTION 1. The Mayor and the City Council find that 15th Street
between Nebraska Street and State Street in the City of Blair is not now
being used for street purposes, that no damage to any property holder
of said city or to the public will be� occasioned by the vacation thereof
and that it is expedient and to_the best interests of said City and to
the business generally to vacate such street.
SECTION 2. That said portion of said street is hereby vacated and
shall no longer be or constitute such street and that the land so
vacated shall revert to the City of Blair, as provided by law.

might be read by title upon its first and second readings and at large
on its third reading with "Yeas" and TTNaysTT each time called,
recorded, approved and passed at the same meeting.
SECOND READING
Ordinance No. 780 now comes on for the second reading. The Mayor
instructed the Clerk to read said Ordinance No. 780 by title upon its
second reading.
Whereupon it was moved by Councilman Conrad and seconded by Council-
man Larsen that Ordinance No. 780 be approved on its second reading and
its title agreed to.
Councilman Lutz called for the question. The Mayor put the
question and instructed the Clerk to call the roll for the vote thereon:

The Mayor and Council of the City of Blair, Washington County,
Nebraska, met in regular session in the Council Chambers at 7:30 o'clock
P.M. Mayor Donald Schettler presided and City Clerk, L. W. Svendgaard,
recorded the proceedings of the meeting.
The Mayor directed the Clerk to call the roll and on roll call '
Councilmen: Conrad, Larsen, Lutz, Megrue, Murdoch, and Stewart being
present, Councilmen Andreasen and Brown being absent.
ORDER OF BUSINESS
November 21, 1961
Whereupon the Mayor announced that the introduction of Ordinances
was now in order.
It was moved by Councilman Megrue that the minutes of the proceedings
of the Mayor and Council in the matter of the passage and approval of
Ordinance No. 781 be preserved and kept in a separate and distinct volume
known as the Ordinance Record of the City of Blair, Nebraska, and that
said volume be incorporated in and made a part of these proceedings the
same as though spread at large herein.
Councilman Stewart seconded the motion. Councilman Larsen called
for the question. The Mayor put the question and directed the Clerk to
call the roll for the vote thereon:

Introduction of Ordinance No. 781 of the City of Blair, Nebraska,
and the matter now coming before the Mayor and Council was the passage
and approval of Ordinance No. 781 of the City of Blair, Nebraska. This
Ordinance No. 781 was introduced by Councilman Lutz and is in words and
figures as follows:
AN ORDINANCE AUTHORIZING AND DIRECTING THE CONVEYANCE BY THE CITY OF BLAIR
OF VACATED FIFTEENTH STREET FROM THE SOUTH LINE OF NEBRASKA STREET TO A
POINT OPPOSITE THE NORTH LINE OF THE ALLEY RUNNIGN EAST AND WEST IN
BLOCK SEVENTEEN IN THE CITY OF BLAIR, TO. TYSON'S, INC., A CORPORATION,
FOR THE CONSIDERATION OF $1,000.00
BE IT ORDAINED by the Mayor and City Council of the City of Blair,
Nebraska:
SECTION I. That the bid of $1,000.00 male by Tyson's Inc., for the
purchase of vacated Fifteenth Street from the South line of Nebraska
Street to a point opposite the North line of the alley running East and
West in Block Seventeen in the City of Blair, Washington County,
Nebraska, now owned by said City, having been acquired by street vacation,
be accepted.
SECTION 2. That upon compliance with the laws concerning the sale
of real estate by municipalities that the Mayor and City Clerk be, and
they hereby are, authorized to execute and deliver a deed on behalf of
said City to said purchasers, the purchase price of said real estate
having been deposited with said City.
SECTION 3. This ordinance shall take effect and be in force from
and after its passage, approval and publication, as provided by law.
