COUNCIL MEMBER SCHANK INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDINANCE TO AMEND THE BLAIR CITY MUNICIPAL CODE TO ADOPT THE 2018
INTERNATIONAL BUILDING CODE, AMENDING THE APPLICABLE CITY MUNICIPAL
CODE SECTIONS, GENERALLY, REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH, PROVIDING WHEN THIS ORDINANCE
SHALL BE IN FULL FORCE AND EFFECT AND PUBLISHING IN PAMPHLET FORM.
WHEREAS, the City of Blair determined that it is in the public interest that the City of
Blair adopt the 2018 International Building Code and to amend applicable City Code Sections to
update the existing Blair Municipal Code from the 2009 International Building Code to the 2018
International Building Code;
SECTION 1. Chapter 3, Article 1, Section 3-109— Water Service, shall be amended as
follows:
Sec. 3-109 MUNICIPAL WATER: REMOTE READOUTS. All new dwelling units applying
for City water service shall be required to obtain, from the City, and install remote readout
devices. The installation of the remote readout device will be made by means of Electrical Metallic
Tubing (EMT), Flex or Schedule 40 conduit as close as practicable to the water meter and extend
outside of the siding at the nearest exterior wall. Access panels are required at any 90-degree
connection.
1. This standard will also apply to existing dwelling units that undergo a basement
remodel or finished basement. (Amended by Ordinance 2478 3/8/2022)
SECTION 2. Chapter 4, Article 5, Sections 4-507 NUISANCES: SWIMMING POOLS
and 4-507.01BARRIER, SWIMMING POOL; SPECIFICALLY DEFINED shall be repealed.

SECTION 3. Chapter 8, Article 5, Section 8-505.1 shall be added as follows:
Sec. 8-505.01 SIDEWALK EVALUATION: Sidewalks shall be considered out of compliance,
and the property owner shall be responsible for repairs, if any of the following issues are found:
1. Any slab having cracks which create a differential in height of at least one-half inch (1/2");
2. Any slab having a hole or crack two inches (2") or more in diameter and at least one-half
inch (1/2") deep;
3. Any slab that is badly cracked or structurally unsound; or,
4. Any slab that is up -heaved or recessed, thereby causing a change of grade in the sidewalk
of twenty percent (20%) or more (one inch in height for every ten inches horizontal).

SECTION 4. Chapter 9, Article 1, Sections 9-101 and 9-109 Sub -Section 1. Definitions
shall be amended as follows:
Sec. 9-101 BUILDING INSPECTOR: POWER AND AUTHORITY. The Building Inspector
shall be the Municipal official who shall have the duty of enforcing all building and housing
regulations as herein prescribed. He or she shall inspect all buildings repaired, altered, built, or
moved in the Municipality as often as necessary to ensure compliance with all Municipal
ordinances. He or she shall have the power and authority to order all work stopped on any
construction, alteration, or relocation which violates any provisions prescribed herein. He or she
shall issue permission to continue any construction, alteration, or relocation when he or she is
satisfied that no provision will be violated. If the stop order is an oral one, it shall be followed by
a written stop order within one (1) hour. Such written order may be served by any Municipal
Policeman.
Sec. 9-109 FACTORY BUILT HOUSING AND PRE -FABRICATED COMPONENTS.
SUB -SECTION 1. DEFINITIONS
CITY: shall mean the corporate and jurisdictional limits of the City of Blair, Nebraska.
FACTORY BUILT HOUSING: shall mean single or multi -family dwelling units which are
either wholly or partially fabricated at an off -site location to be wholly or partially assembled on
site, but not to include mobile homes or cabin trailers.
FABRICATION: shall mean to construct, build, or assemble any component prior to
incorporating it into one (1) completed structure as a factory -built house.
FABRICATOR: shall mean an individual, firm, or corporation fabricating factory -built houses.
INSTALLATION: shall mean the assembly of a factory -built house on site and the process of
affixing the structure to land, a foundation, or footings.
NON-RESIDENT FABRICATOR: shall mean a fabricator fabricating outside the City limits of
the City of Blair, Nebraska.
CABIN TRAILER: shall mean every vehicle without motive power, designed for living quarters
and basically designed to be towed as a transportable unit on an undercarriage or chassis which is
a permanent or an integral structural part of the floor or body of the trailer, and shall include any
transportable or relocatable device of any description designed for living quarters which is less
than twelve (12') feet wide or only one (1) story in height when in place for using as a living
quarter. MOBILE HOME shall mean every transportable or relocatable structure of one (1) or

more section, and basically designed to be towed as a transportable unit on an undercarriage or
chassis which is a permanent or an integral structural part of the floor or body of the unit, which
is twelve (12') or more feet wide, or which is one (1) or more stories in height when in place for
use as living quarters.
PREFABRICATED: The term "prefabricated" as used in this Article shall mean floors, pathway,
interior partitions, ceilings, roofs, or any parts or portion of any such, which are built up,
assembled, or put together before being incorporated into the structure.
SECTION 5. Chapter 9, Article 2, Sections 9-201, 9-202, 9-203 shall be amended and 9-
204 shall be added:
Sec. 9-201 INTERNATIONAL BUILDING CODE: ADOPTED BY REFERENCE. To
provide certain minimum standards, provisions and requirements for safe and stable design,
methods of construction, and uses of materials in buildings hereafter erected, constructed,
enlarged, altered, repaired, relocated, and converted, the International Building Code, 2018
edition, including all appendices, as recommended and published by the International Code
Council, Inc. in book or pamphlet form, is hereby incorporated by reference, insofar as said
International Building Code and any amendments or revised editions do not conflict with the
statutes of the State of Nebraska. Such International Building Code shall also include all
amendments, deletions, or additions which the City Council and Mayor may make from time to
time. Copies of the International Building Code, as amended, are on file at the office of the
Municipal Clerk pursuant to state statutes and are available for public inspection during the regular
hours the Municipal offices are open. The provisions of the International Building Code shall be
controlling throughout the Municipality and throughout its zoning jurisdiction. (Neb. Rev. Stat.

The International Building Code, 2018 Edition, is amended with the following changes:
Appendix C: Group U — Agricultural Buildings: The entire appendix is adopted.
Sec. 9-202 INTERNATIONAL EXISTING BUILDING CODE; ADOPTED BY
REFERENCE. To provide flexibility to permit the use of alternative approaches to achieve
compliance with minimum requirements to safeguard the public health, safety and welfare insofar
as they are affected by the repair, alteration, change of occupancy, addition and relocation of
existing buildings, the International Existing Building Code, 2018 edition, including all
appendices, as recommended and published by the International Code Council, Inc. in book or
pamphlet form, is hereby incorporated by reference, insofar as said International Existing Building
Code and any amendments or revised editions do not conflict with the statutes of the State of
Nebraska. Such International Existing Building Code shall also include all amendments, deletions,
or additions which the City Council and Mayor may make from time to time. Copies of the
International Existing Building Code, as amended, are on file at the office of the Municipal Clerk
pursuant to state statutes and are available for public inspection during the regular hours the
Municipal offices are open. The provisions of the International Existing Building Code shall be

controlling throughout the Municipality and throughout its zoning jurisdiction. (Neb. Rev. Stat.

Sec. 9-203 INTERNATIONAL PROPERTY MAINTENANCE CODE: ADOPTED BY
REFERENCE. That the above -described Code, a copy of which is kept on file in the office of
the City Clerk of the City of Blair, Nebraska, being marked and designated as the International
Property Maintenance Code, 2018 edition, as published by the International Code Council, be and
is hereby adopted as the Property Maintenance Code for the City of Blair, Nebraska, insofar as
said International Property Maintenance Code and any amendments or revised editions do not
conflict with the statutes of the State of Nebraska such International Property Maintenance Code
shall also include all amendments, deletions or additions which the City Council and Mayor may
make from time to time. The International Property Maintenance Code is for regulating and
governing the conditions and maintenance of all property, buildings and structures; by providing
the standards for supplied utilities and facilities and other physical things and conditions essential
to ensure that structures are safe, sanitaiy and fit for occupation and use; and the condemnation of
buildings and structures unfit for human occupancy and use, and the demolition of such existing
structures as herein provided; providing for the issuance of permits and collection of fees therefore.
Copies of the International Property Maintenance Code, as amended, are on file at the office of the
Municipal Cleric pursuant to state statutes and are available for public inspection during the regular
hours the Municipal offices are open. The provisions of the International Property Maintenance
Code shall be controlling throughout the Municipality and throughout its zoning jurisdiction.

The International Property Maintenance Code, 2018 Edition is amended with the following
changes:
Section 111.1 Application for Appeal: Board of Appeals shall be the same as the City of
Blair Housing Appeal Board.
Section 111.2.1 Alternate Members: Shall be eliminated
Section 111.2.5 Compensation of Members: Shall be amended to state that all Board
Members shall serve without compensation.
Section 302.4 Weeds: Refer to Municipal Ordinance 4-506.

The International Pool and Spa Code, 2018 Edition, is amended with the following changes:
Chapter 2, Section 202, Definition of a Residential Swimming Pool is amended to add
the condition that it can contain 24 inches or more of water.
Chapter 4: Public Swimming Pools The entire chapter is eliminated.
Chapter 5: Public Spas and Public Exercise Spas The entire chapter is eliminated.
Chapter 6: Aquatic Recreation Facilities The entire chapter is eliminated.
SECTION 6. Chapter 9, Article 3, Sections 9-301 shall be amended as follows:
Sec. 9-301 INTERNATIONAL RESIDENTIAL CODE: ADOPTED BY REFERENCE. To
provide certain minimum standards, provisions and requirements for safe and stable design,
methods of construction, and uses of materials in houses hereafter erected, constructed, enlarged,
altered, repaired, relocated, and converted, the International Residential Code, 2018 edition, as
recommended and published by the International Code Council, Inc., in book or pamphlet form,
is hereby incorporated by reference, insofar as said International Residential Code and any
amendments or revised editions do not conflict with the statutes of the State of Nebraska. Such
International Residential Code shall also include all amendments, deletions, or additions which the
City Council and Mayor may make from time to time. Copies of the International Residential
Code, as amended, are on file at the office of the Municipal Clerk pursuant to state statutes and are
available for public inspection during the regular hours the Municipal offices are open. The
provisions of the International Residential Code shall be controlling throughout the Municipality
and throughout its zoning jurisdiction.
The International Residential Code, 2018 Edition, is amended with the following changes.
Section R105.2 Work exempt from permit. Exemption from permit requirements from this code
shall not be deemed to grant authorization for any work to be done in any manner in violation of
the provisions of this code or any other laws or ordinances of the City of Blair or the State of
Nebraska. Permits shall not be required for the following:
One-story detached accessory structures which:
Have a floor area of 120 square feet or less.
Are not required to be permanently attached to the ground or a concrete pad; or
Have permanent electrical service, either as a new service or from the primary residence.

Decks that are not more than 30 inches above grade at any point, have a floor area of 120 square
feet or less, are not attached to a dwelling, do not extend into the city's right of way and do not
serve an exit door required by Section R311.5.
Section R313 Automatic Fire Sprinkler System.
The entire section, including all subsections, is eliminated.
Section R314 Smoke Alarms — Alterations, repairs, and additions.
The following Exceptions are added:
Permits limited to the, alteration or repairs of electrical systems of less than 50% of a dwelling
or structure are exempt from the requirements of this section.
Permits not involving the addition or remodeling of one or more sleeping rooms.
Section R315 Carbon Monoxide Alarms — Where required in existing dwellings.
The following Exceptions are added:
Work involving the exterior surfaces of dwellings, or the addition or replacement of
windows and doors, or the addition of a porch or deck, are exempt from the requirements
of this section.
Permits limited to the installation, alteration, or repairs of plumbing, mechanical or
electrical systems of less than 50% of a dwelling or structure are exempt from the
requirements of this section.
Permits not involving the addition or remodeling of one or more sleeping rooms are exempt
from the requirements of this section.
Appendix F Radon Control Methods.
The entire appendix is eliminated. The following requirements are added:
Radon Mitigation Passive System Requirements:
Minimum 10 feet of 4-inch perforated drain the under basement floor of new residential
construction.
Drain tile shall extend through the footing, common with an attached garage, be attached
to a 90-degree elbow fitting and extend vertically through the garage floor, ceiling, and
roof.
For residences with no attached garage, piping may be installed on the outside of an exterior
wall and vented no closer than 3 feet from an opening or 18 inches above the roofline; or,
Vertically through the interior of the dwelling through the ceiling and roof.
Vent Fan Location: The vent fan shall be located within three feet of the attic access
opening.
Exception: An elevated walkway above insulation is provided from attic access to vent
piping. The walkway shall be elevated a minimum of 30 inches above bottom of the

ceiling joists and a minimum of 30 inches below bottom of rafters. The walkway shall
be a minimum of 24 inches wide.
Exception: Attic access and radon vent are both located within the garage footprint.
Radon vent shall be exposed within the garage and within 6 feet of an electrical outlet.

SECTION 7. Chapter 9, Article 4, Sections 4-401 and 4-403 shall be amended as follows:
Sec. 9-401 INTERNATIONAL PLUMBING CODE: ADOPTED BY REFERENCE. To
provide certain minimum standards, provisions and requirements for safe and stable installation,
methods of connection, and uses of materials in the installation of plumbing and heating, the
International Plumbing Code, 2018 edition, as recommended and published by the International
Code Council, Inc., in book or pamphlet form, is hereby incorporated by reference, insofar as said
International Plumbing Code and any amendments or revised editions do not conflict with the
statutes of the State of Nebraska —Such International Plumbing Code shall also include all
amendments, deletions or additions which the City Council and Mayor may make from time to
time. Copies of the International Plumbing Code, as amended, are on file at the office of the
Municipal Clerk pursuant to state statutes and are available for public inspection during the regular
hours the Municipal offices are open. The provisions of the International Plumbing Code shall be
controlling throughout the Municipality and throughout its zoning jurisdiction. (Amended by

The International Plumbing Code, 2018 Edition, is amended with the following changes:
Section 109: Means of Appeals The entire section is eliminated.
Section 607.1.1: Temperature Limiting Means This section is eliminated.
Section 607.1.2: Tempered Water Temperature Control This section is eliminated.
Section 607.2: Hot or Tempered Water Supply to Fixtures An exemption from the
permit requirements of this code may be made providing any hot or tempered line in excess
of 50 feet from the water heater to the fixture is insulated in its entirety at a rating of no
less than R3.
Chapter 13: Non -Potable Water Systems This chapter is eliminated.
Sec. 9-403 MECHANICAL AND FUEL GAS CODES: ADOPTED BY REFERENCE. To provide
certain minimum standards, provisions and requirements for safe and stable design, construction, quality
of materials, erection, installation, alteration, relocation, replacement, use or maintenance of mechanical
systems, the International Mechanical Code, 2018 edition, and the International Fuel Gas Code, 2018
edition, as recommended and published by the International Code Council, Inc., in book or pamphlet form,
are hereby incorporated by reference, insofar as said International Mechanical Code, and International Fuel
Gas Code, and any amendments or revised editions do not conflict with the statutes of the State of Nebraska.
Such International Mechanical Code and International Fuel Gas Code shall also include all amendments,
deletions, or additions which the City Council and Mayor may make from time to time. Copies of the

International Mechanical Code and the International Fuel Gas Code, as amended, are on file at the office
of the Municipal Clerk pursuant to state statutes and are available for public inspection during the regular
hours the Municipal offices are open. The provisions of the International Mechanical Code and the
International Fuel Gas Code shall be controlling throughout the Municipality and throughout its zoning

SECTION 8. Chapter 9, Article 5, Sections 9-501 and 9-502 shall be amended as follows:
Sec. 9-501 NATIONAL ELECTRICAL CODE: ADOPTED BY REFERENCE. To provide
certain minimum standards, provisions and requirements for safe and fire proof installation,
methods of connection, and uses of materials in the installation of electrical wiring and appliances,
the National Electrical Code, 2017 edition, as recommended and published by the National Fire
Protection Association, and printed in book or pamphlet form, is hereby incorporated by reference,
insofar as said National Electrical Code and any amendments or revised editions do not conflict
with the statutes of the State of Nebraska. Such National Electrical Code shall also include all
amendments, deletions, or additions which the City Council and Mayor may make from time to
time. Copies of the National Electrical Code are on file at the office of the Municipal Clerk
pursuant to state statutes and are available for public inspection during the regular hours the
municipal offices are open. The provisions of the National Electrical Code shall be controlling
throughout the Municipality and throughout its zoning jurisdiction. (Amended by Ordinance 1833

Sec. 9-502 INTERNATIONAL FIRE CODE: ADOPTED BY REFERENCE. To provide
certain minimum standards, provisions, and requirements for safe and fire proof installations and
other matters affecting or relating to structures, processes, and premises from the hazard of fire
and explosion, the International Fire Code, 2018 edition, as recommended and published by the
International Code Council, Inc., and printed in book or pamphlet form is hereby incorporated by
reference, insofar as said International Fire Code and any amendments or revised editions do not
conflict with the statutes of the State of Nebraska. Such International Fire Code shall also include
all amendments, deletions or additions which the City Council and Mayor may make from time to
time. Copies of the International Fire Code, as amended, are on file at the office of the Municipal
Cleric pursuant to state statutes and are available for public inspection during the regular hours the
Municipal offices are open. The provisions of the International Fire Code shall be controlling
throughout the Municipality and throughout its zoning jurisdiction. (Amended by Ordinance 1904

The International Fire Code, 2018 Edition, is amended with the following changes:
Section 109: Board of Appeals The entire section is eliminated.
Section 307: Open Burn, Recreational Fires and Portable Outdoor Fireplaces The entire
section is eliminated.
Section 5601.2.4 Financial Responsibility The entire section is eliminated.

SECTION 9. Chapter 9, Article 6, Section 9-601 shall be amended as follows:
Sec. 9-601 INTERNATIONAL ENERGY CONSERVATION CODE: ADOPTED BY
REFERENCE. To provide certain minimum standards, provisions and requirements to regulate
the design and construction of buildings for the effective use of energy, with flexibility to permit
the use of innovative approaches and techniques to achieve the effective use of energy while not
abridging safety, health or environmental requirements contained in other applicable codes or
ordinances, the International Energy Conservation Code, 2018 edition, as recommended and
published by the International Code Council, Inc., in book or pamphlet form, is hereby
incorporated by reference, insofar as said International Energy Conservation Code and any
amendments or revised editions do not conflict with the statutes of the State of Nebraska. Such
International Energy Conservation Code shall also include all amendments, deletions, or additions
which the City Council and Mayor may make from time to time. Copies of the International
Energy Conservation Code, as amended, are on file at the office of the Municipal Clerk pursuant
to state statutes and are available for public inspection during the regular hours the Municipal
offices are open. The provisions of the International Energy Conservation Code shall be
controlling throughout the Municipality and throughout its zoning jurisdiction.
Sec. 9-602 through 9-609 Repealed by Ordinance 226611/11/2014
The International Energy Conservation Code, 2018 Edition, is amended with the following
changes:
Section C109.2: This section is eliminated.
Section C109.3: This section is eliminated.
Section C402.2.2 Above Grade Walls Is amended to include:
Exterior wall cavities of conditioned spaces shall be filled to a minimum of 98% capacity
with insulation.
Chapter 4 Residential Energy Efficiency: This chapter is eliminated.
Section R402.1.2 Insulation and Fenestration Criteria. Minimum requirements:
Ceiling R Value is R-60.
Frame walls R Value is R-20 (combined R-Value of combined elements).
Exterior wall cavities of conditioned spaces shall be filled to a minimum of
98% capacity with insulation.
Slab edge (on -grade): R-10 insulation, from top of slab to 24 inches below finished
grade.
Floors (over unheated spaces): R-38 insulation.

Finished basement walls: R-18 (combined R-valued of wall elements).
Crawl spaces: R-10 insulation. Shall be a conditioned space. Floor shall be covered
with not less than 3 inches of concrete.
Windows: Minimum of double -glazed and maximum U-factor of .30.
Doors:
Sliding glass: Double -glazed and maximum U-factor of .30.
Swinging: Maximum U-value of .35.
Weatherstripping and caulking: Whatever is necessary to minimize infiltration.
HVAC Equipment.
Heat pumps — Heating mode:
COP = 2.5/1.5 (air source).
COP = 2.5 (water source).
Boilers and furnaces: Combustion efficiency = 82%.
Air conditioners/heat pumps — Cooling: SEER Minimum rating = 15.0.
Controls: Each system controlled by thermostat; heating system capable to
setback to 55' Fahrenheit; cooling system capable of setup to 85'
Fahrenheit.
All duct work shall be located within the conditioned envelope of a
dwelling. Duct work within an attic shall be considered to be in a
conditioned space when:
Immediately adjacent to a conditioned living space; and,
Remaining surfaces are covered by not less than R-60 insulation.
Joints in duct work shall be sealed to the HVAC manufacturer's
recommendations.
Insulate exterior of foundation of slab -on -grade heated structures or provide a
thermal break between floor and exterior foundation.
When proposed rehabilitation of a structure exceeds 50% of current market value,
the structure shall meet or exceed all energy code requirements adopted by the City.

A minimum R-value of R-44 shall be maintained above all exterior wall plates of
conditioned spaces.
Deviations from the above standards require approval of the Building Inspector.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR OF THE CITY
COUNCIL OF THE CITY OF BLAIR, NEBRASKA AS FOLLOWS:
Blair City Code Chapter 3, Article 1, Section 3-109— Water Service, shall be amended; Chapter 4,
Article 5, Sections 4-507 and 4-507.01 shall be repealed; Chapter 8, Article 5, Section 8-505.1
shall be added; Chapter 9, Article 1, Sections 9-101 and 9-109 shall be amended; Chapter 9, Article
2, Sections 9-201, 9-202, 9-203, and 9-204, shall be amended; Chapter 9, Article 3, Sections 9-
301 shall be amended; Chapter 9, Article 4, Sections 9-401 and 9-403 shall be amended; Chapter
9, Article 5, Sections 9-501 and 9-502 shall be amended; Chapter 9, Article 6, Section 9-601 shall
be amended and changes to the applicable Blair City Code Sections affected by the adoption of
the 2018 International Building Code.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.
