The Clerk called the roll and the following Councilmen were present: Farnberg, J. D. Johnson, W. B. Johnson, H. C. Kuhr, Rabbass, Sorensen, Trisdale and Wheeler, - ORDER OF BUSINESS Whereupon the Mayor announced that the introduction of ordinances was now in order. It was moved by Sorensen .and.,seconded..:by...J.,D.; Johnson that-the minutes of the proceedings of the mayor and Council in. the matter of the passage and approval of Ordinance No. 702 be, preserved and kept in a separate and distinct,volume known as the Ordinance Record of the City of Blair, Nebraska and said separate and distinct volume - be ,incorporated in and made a part of these proceedings the same as though spread at large herein. ORDINANCE NO. 702 Introduction of Ordinance No. 702 of the City of Blair, Nebraska and the matter now coming before the Mayor and Council was the passage and approval of Ordinance No. 702 of the City of Blair, Nebraska. This Ordinance was ihtroduced by Councilman W. B. Johnson and is in words and figures as follows: ORDINANCE N0. 702 AN ORDINANCE PROVIDING FOP THE DETERMINATION OF THE OWNERSHIP OF ALL DOGS WITHIN THE CORPORATE LIMITS OF THE CITY OF BLAIR: PROHIBITING THE RUNNING AT LARGE OF DOGS: PROVIDING FOR THE INOCULATION OF ALL DOGS FOR RABIES AND FOR THE PAYMENT OF A DOG TAX BY THE OWNERS OR HARBORERS OF DOGS AND FOR THE SECURING OF A LICENSE AND DOG TAG THEREFOR FROM THE CITY CLEM PROVIDING FOR THE BILLING OF DOGS FOUND RUNNING AT LARGE: PROVIDING WHEN THE DOG TAX SHALL PE DUB AND WHEN IT SHALL BE DELINQUENT: PROVIDING PENALTIES ECG/ THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE: AND REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH. Section 1. DoR ,defined. The term "dog" as used herein shall be held to apply to both made and female dogs of all ages. Section 2. Who deemed owner. Any owner. -Any person who shall harbor any dog or permit the same to be in or about his or her home or premises for a period of ten days or more shall be deemed the owner and possessor of such dog and shall be liable to the penalties prescribed for the violation of the provisions of this ordinance. Section 3, Dogs running at large. It shall be unlawful-for the owner or possessor of any dog to permit the same to run at large. A. dog shall be considered as running at large when he is away from the premises of his master, roaming at his will, and out from under the control of his owner or possessor. 1185 Section 4. Plates, tags, It shall be unlawful to harbor any dog within the corporate limits of this City, unless such dog shall have a collar with a metallic number plate or tag fastened uponAt issued by the City for the current year Section.5. Tax;, when due. when delinquent,; Every possessor of a female dog in this 'City shall pay to.the City Clerk, as-a dog tx, the sum of $2.00 per annum, and of a male dog or a spayed female dog the sum of $1,00 per annum, the same to be payable on or before May 1 in each year. Each person so paying shall be issued a metallic numbered tag to be attached to the collar of the dog for which the tar is paid. The possessor of any dog brought into or harbored within the corporate limits of the City subsequent to May 1 in each year shall be liable f or.the tax levied herein; The dog tax shall be come delinquent May 10 of each year,, No tax shall be accepted by the City. Clerk and no tag issued for any dog unless there is presented to the City Clerk at the time of payment of the tax a certificate from the veterinarian that such dog has been inoculated for rabies and that the inoculation should be effective for the license year. Section 6. Tax credited to General Fund. All dog taxes collected hereunder shall be credited to the General Fund of the:.City. It shall be the. duly of the City Clerk .to ,keep 'a. book:. in .which shall be recorded the name of the owner; the name, sex and eescription of ea Ch dog upon which the tax has been paid, and the number thereof. 'r Section 7. Violation. penalty. The owner /of possessor of any dog who permits such tp run at large or refuses or neglects to procure a plate or tag for same as herein provided shall be deemed guilty of a misdemeanor and on conviction thereof.shall be fined in any sum'not exceeding $20.00. The City Police or ofther officer designated by the Mayor and city Council is authorized to kill any dog found running at large or any dog found without the plate or tag provided for herein. Section 8. Repeal of prior ordinance in conflict. All prior ordinances in conflict herewith are hereby repealed. This ordinance shall be in full'force and take effect from and after its passage, approval and publication • according to law. Passed and, approved this 3rd day of March, 1959. ' FIRe. AND PAVING THEREIN. BE IT ORDLIN.D BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1.. That htere is hereby created: within said city, a paving district, to be known as "Street Improvement District No. 34," consisting of the following described property, to -wit: State Street from its intersection with Sixteenth Street to its intersection with Tenth Street.' SECTION g. That the paving in said district shall be width between the present curb and gutters; that the grading, curbing, guttering and paving shall be in accordance with plans, specifications and estimates to be hereafter adopted. SECTION 3. The Mayor and City Council of Blair, Nebraska, hereby declare and deem it necessary to improve State Street of said City by paving same from its intersection with Sixgeenth Street east to its intersection with Tenth Street, and for said purpose there is hereby created Street Improvement Distrust No. 34 of the City of Blair, Nebraska. SECTION 2, The street improvement•to be made on the street in said District shall be to pave the same with concrete paving between the existing concrete curbs thereon, the grade ibf said street to confrom to the existing grades of said City of Blair, and said improvement to be made according to plans and specifications and estimate of cost to be prepared'by the special engineer for said District, and to be filed with the City Clerk and to be approved by the Mayor and Council of said City. Firm Gas Service Firm gas service is def hied as gas service that is supplied on a noninterruptible basis, 'Firm'gas service shall be made available to all domestic and commercial'customers whose maximum requirements are less than 1,000 cubic feet per'hour, 2, Interruptible Gas:'$ervice Interruptible gas service is defined as gas service that is supplied on an interruptible basis. Rate - The rate for interruptible gas service shall be such rate as may be mutually agreed upon between the customer and, the gas service company, but shall not be higher than the firm gas service rate set out above, SECTION III - UAS COST ADJUSTMENT 1, N©rthernes Docket,G- 12153.(Rate Case # 6), As,,the 'result of an application-filed and now, pending with the Federal Power Commission (Commission), Docket G -12153 (Rate Case # 6), Northern Natural Gas Company(Northern), wholesale supplier of natural gas, was permitted to increase its wholesale, gas price to Central Electric & Gas Company(Central), the distributor of natural gas, on August 27, 1957. Such increased price is being collected by Northern under refunding bond pending final determination by the Commission of the reasonableness of- such .increase. If :the Commission orders Northern to refund to Central any monies collected under such refunding bond as a result of Docket G- 121253 (Rate Case # 5), Central agrees to make a @cost of $asp credit refund to;;its firm gas customer. The`amount of such refund to each firm gas customer shall be computed by (1) dividing the, total refund received from Northern allocable to firm gas purchased from Northern for resale in Blair between August 27, -1959 and:the effective date of the final wholesale price resulting from Docket G- 121253 (Rate Case# 6) by the total. number of.MGi' of firm gas.billed by Central. in Blair between August 27, 1957 and the effective date of the final:whoesale price resulting from said Docket G- -12153 (Rate Case # 6), and (2) multiplying the resulting figure (cents per Mai') by the number of MCF of firm gas billed each firm gas customer from meter reading periods beginning on and 'after August 27 +1957, the date on which rates as provided in Paragraph I of Section II of Ordinance 688 were first charged, to the: effective date of the final price resulting from said Docket G -12153 - (Rate . Case # 6 )... Such refund shall be made to such firm gas customers within a reasonable time after receipt of Northern's refund. 2. That all ordinances and parts of-ordinances in conflict with the provisions of this ordinance are hereby repealed. This ordinance shall be effective from and after its passage and publication as required by law.
