1958The Mayor. and Council of the City of Blair, Washington County, Nebraska met in regular session in the Council Chambers at 7 :30 o'clock P. M. Mayor Raymond C. Hansen presided, City Clerk L. W. Svendgaard recorded the pro- ceedings of the meeting. The Mayor instructed. the Clerk to call the roll. The Clerk called the roll and the following Councilmen were present: Farnberg, J. D. Johnson, W. B. Johnson, M. O. Kuhr, H. C. Kuhr, Rabbass, Sorensen, and,Wheeler, ORDER OF BUSINESS Whereupon the Mayor announced that the introduction of Ordinances was now in order. Whereupon it, was • moved by Councilman Sorensen and seconded by Councilman J. D. Johnson that the minutes of the proceedings of the Mayor and Council in the matter of the passage and approval of Ordinance No. 693 be preserved and kept in a separate and distinct volume known as the Ordinance Record of the City of Blair, Nebraska and that said separate and distinct volume be incorporated in and made a part of these proceedings the same as though spread at large herein. ORDINANCE NO. 693 Introduction of Ordinance No. 693 of the City of Blair, Nebraska and the matter now coming before the Mayor and Council was the passage and approval of Ordinance No. 693 of the City of Blair, Nebraska. This Ordinance was introduced by Councilman Rabbass and is in words and figures as follows: ORDINANCE NO. 693 AN ORDINANCE TO REPEAL ORDINANCE NO, 662 OF THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA, PASSED AND APPROVED MAY 5, 1953. Section:.1, Be it ordained by the Mayor and Council of the City of Blair, Washington County, Nebraska, that Ordinance No. 662.of said City passed and approved May 5, 1953, and entitled, An Ordinance Levying an Occupation Tax Upon a11;Ftorsons Distributing Natural Gas for ,Sale Within the City of Blair, Nebraska, and Providing for the Collection of such Occupation Tax", be and the same hereby is repealed in its entirety, said Ordinance No. 662 having been superseded by Ordinance No. 685 of this City passed and approved June 4, 1957. Section 2. Be it further ordained that this Ordinance shall be in full force and effect from and after its passage, approval and - publication, as required by law. ORDINANCE NO. 694 Blair, Nebraska May 20, 1958 1137 Introduction of Ordinance No. 694 of the City of Blair, Nebraska and the matter now coming before the Mayor and Council was the passage and approval of Ordinance No. 694 of the City of Blair, Nebraska, This Ordinance was introduced by Councilman Rabbass and is in words and figures as follows: ORDINANCE NO. 694 An Ordinance Establishing Street Improvement District No. 32 in the City of Blair, Nebraska, Designating the Purpose of said District, Defining the Limits and Boundaries of said District and Providing for the Manner of Payment of the Street Improvement therein. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1. A petition signed by more than 60% of the resident owners owning property directly abutting upon the streets to be improved, as hereinafter set forth, petitioning for the improvement of Park Street from its intersection with First Street east to its intersection with Second Street, and Second Street from its intersection with Park Street south to its intersection with Nebraska Street_by paving the same having been. presented and filed with the City Clerk, there is hereby created Street Improvement District No. 32 of the City of Blair, Nebraska. SECTION 2. The streets to be improved in said Street Improvement District No. 32 are Park Street from its intersection with First Street east to its intersection with Second Street, and Second Street from its 'intersection with Park Street south to its intersection with Nebraska Street in the City of Blair. ' SECTION 3. The property included in said Street Improvement District No. 32 and subject to special assessment to pay for the cost and expenses of said street improvementis all of'the provately• owned lots, parts of lots and tracts of land and the lots, parts of or tracts of land owned by any municipal or public corporation and abutting upon or adjacent to said streets so to be improved, to -wit: Lots 3 and 4 in Block 14 in Dexter's Second Addition, Lot 1 in Block 14 in Dexter's First Addition, 1138 Lots 1,.,2, 3, 4, 5, and - 10 in Block 11 in Dexter's First Addition, Lots and West feet of Lot 3 in Block 12 in Dexter's First Addition, and Lot 4 in Block 12 in Dexter's Second Addition, all in the City of Blair, Washington County, Nebraska. SECTION 4, The street improvement to be made on said streets shall be to pave the same 25 feet in width and curb the same, the grade to conform to the existing grades in said City of Blair and said' improvement to be made according to plans, specifications and estimates of cost to be prepared by the special engineer and filed with the City Clerk and to be approved by the Mayor and Council of said City. SECTION 5. The cost of said street improvement in said " improvement district shall be paid out of a fund created by the levy of assessments on the lots and parcels of land in said Street improvement district benefited thereby in proportion to such benefits and by said City out of public funds for the payment of the cost of said street improvement of the street or alley intersections, all as by statutes of the State of Nebraska in such cases made and provided. This Ordinance was introduced by Councilman Farnberg and is in words and figures as follows: ORDINANCE 695 An ordinance relating to the extension of existing ordinances, property use ordinances, building ordinances, electrical ordinances, and plumbing ordinances to an area one -half mile beyond and adjacent to the corporate limits of the City of Blair, Nebraska; to provide that owners of real property located within one-half mile of said city shall not sub - divide, plat, or lay out any real property in such area in building lots and streets 'ithout first having obtained the approval thereof by the'City Council of said city; to repeal all ordinances.and parts of ordinances inconflict therewith and to prescribe the time when this ordinance shall be in full force and take effect, SECTION 1 (1) ZONING -- EXTENDING OF AREA BEYOND CITY LIMITS 1143 Blair, Nebraska May 20, 1958 That the. City of Blair, Nebraska hereby extends all existing or hereinafter enacted zoning ordinances, property use regulation ordinances, building ordinances, electrical ordinances and plumbing ordinances, to an area within one -half mile of the corporate limits of the City of Blair, Nebraska, with the same force and effect as if such area were within the city limits of said city. This Ordinance was introduced by Councilman Rabbass and is in words and figures as follows: ORDINANCE NO. 696 An Ordinance to be termed the "Annual Appropriation Billt appropriating such sum or sums of money necessary to defray all necessary expenses and liabilities of the City of Blair, Nebraska, for the fiscal year commencing oh the first Tuesday in May, 1958, and specifying the object and purpose of each appropriation and the amount for each object and purpose. BE IT ORDAINED BY TEE MAYOR AND.COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION,1. That there be, and hereby is, appropriated out of the money derived from the taxes levied for general revenue purposes for the present fiscal year, commencing on the first Tuesday in May, 1958, and out of all other available money and funds therefor belonging to said city, the amounts for each object and purpose as follows: For salaries of City officials $ 35,000.00 For streets, culverts, alleys, and bridges and purchase of maintenance equipment 50,000.00 For printing and publication 6,000.00 For miscellaneous and incidental expenditures 5,000.00 For expense of criminal and civil suits 4,000.00 For purchase price and future taxes on property purchased 2,000.00 For improvement, operation and maintenance of airport 15,000.00 Any balance of said funds remaining over and unexpended at the end of the fiscal year shall be transferred to the General Fund. That there be, and hereby is, appropriated out of the money derived from the levy of taxes for Public Library purposes for the present fiscal year and out of all other money and funds available there for, the amount of all other money and purposes as follows: For salaries of employees, maintenance and operation of public library $ 8,000.00 Any balance of said,fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Public LibrarrFand, SECTION 3, There there be, and hereby is appropriated out of the money derived from the'levy.of taxes for street lighting purposes for said fiscal year and out of all other money and funds available therefor, the amounts for each object and purpose as follows: For street lighting purposes For improvement, extention, operation and maintenance of works system and salary of employees and hydrant rentals $ For extension distribution system, improvement of water department, hydrant rentals and service $ $ 9,000.00 Any balance of said fund remaining over and unexpended at the end .of the fiscal year shall be transferred to the Street Lighting Fund. SECTION 4. That there be, and hereby is, appropriated out of the money derived from the water works system and out of the water fund and all other money and funds ailable therefor, the amount for each object and purpose as follows: water 40,000,00 200,000,00 Any balance of said fund reamining over and unexpended at the end of the fiscal year shall be transferred to the Water Fund. SECTION 5. That there be, and hereby is appropriated out of the money derived from taxes for parks and park purposes for said fiscal year and out of all other funds and moneys available therefor, the amounts for each object and purpose as follows: For park and park purposes., salaries of employees, maintenance, improvement and operation of swimming pool $ 12,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the parks and park purpose fund.. SECTION 6. That there be, and hereby is appropriated aut of the moneys derived from the operation of the municipal electric light system and the sale of electrical current and supplies and all other funds and moneys available therefor, the amounts for each object and purpose as follows: For salaries of light, commissioner and wages of department employees, operation and maintenance of municipal power distribution system $ 125,000,00 For extension and improvements of municipal light power system generator and plant improvement and line extention $ 200,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Electric Light System Fund. SECTION 7, . That there be, and hereby is appropriated out of the money derived from taxes for sewer maintenance for said fiscal year and out.of all other funds and moneys available therefor, the amounts for each object and purpose as follows: 114 For salaries of employees, operation and maintenance of sewer system $ 10,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Sewer Maintenance Fund. SECTION 8. That there be, and hereby is, appropriated out of the money derived• from the levy of taxes for the operation, maintenance and care of the Blair Cemetery $ 4,000.00 Any balance of said fund remaining over'and unexpended at the end of the fiscal year shall be transferred to.the Cemetery Fund. SECTION 9. That there be, and hereby is, appropriated out of the money derived from the levy of taxes for the payment of refunding bonds and interest thereon and the sinking fund f or,said fiscal year and out of the money derived from taxes levied for payment of intersection and for district paving bonds and interest and out of any and all other funds and money available therefor, the amounts for each object and purpose as follows: 1150 For payment of principal and interest on bonds indebtedness due or to become due and for sinking funds $ 105,000,00 Any balance in said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Sinking Fund for the payment of refunding, bonds. SECTION 10. That there be, and hereby is, appropriated out of the money derived from the operation of the municipal ice plant and the sale of products therefrom and out of all other funds available th.erefori the amounts for each object and purpose as follows: For salaries and wages of employees, operation, maintenance repair and extension of said Ice Plant $ 12,000.00 Any balance of said fund. remaining over and unexpended at the end of the fiscal year shall be transferred to the Ice Plant Fund, SECTION 11. That there be, and hereby is, appropriated out of the money derived from the levy of taxes for the maintenance and operation of the fire department for the present fiscal year and out of all other money and funds available therefor, belonging to said City the amounts for each object and purpose as follows: For maintenance and operation of the City Fire Department $ 6,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the fund for the maintenance and operation of the City Fire Department. SECTION 12. That there be, and hereby is appropriated out of the money derived from the levy of taxes for the purpose of purchase of Fire Department apparatus for the present fiscal year and out of all other money and funds available therefor belonging to said City the amounts for each object and purpose as follows: For purchase of Fire Department apparatus $ 15,000,00 Any balance of said fund remaining over and unexpended at.the end of the fiscal year shall be transferred to the Fire Department Apparatus Fund, SECTION 13, That there be, and hereby is, appropriated out of the Music and Public Amusement Fund and out of all other funds and money available therefor, the amounts for each object and purpose as follows: For music and public amusement $ 5,000.00 Any balance in said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Music and Public Amusement Fund. SECTION 14, That there be, and hereby is, appropriated out of the money now on hand for the Special Gasoline Road Fund and from the moneys derived from special gasoline tax and motor registration fee, the amounts for each object and purpose as follows; For constructing street improvements $ 50,000,00 Any balance in said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Special Gasoline Tax Fund. SECTION 15. That there be and hereby is, appropriated out of the money derived from the levy of taxes for the purpose of paying the City's share of the employees and officers' federal social security tax for the present fiscal year and out of all other money and funds available therefor belonging to the said City, the amount for each object and purpose as follows: For City's share of Employees and Officers' Federal Social Security Tax $ 3,000.00 Any balance in said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Social Security Tax Fund. .SECTION 16, That there be, and hereby is, appropriated out of the money derived from the operation of the Blair Apartments and all other money and funds available therefor, the amount for each object and purpose as follows: FIRST READINQG Mayor 1151 For salaries of employees, operation and maintenance of Blair Apartments. $ 25,000.00 Any balance of said fund remaining over and unexpended at the end of the f is'cal year shall be transferred to the Blair Apartstnent Fund. SEOTION•17, That there be, and hereby is, appropriated out of the money derived from taxes for payment of principal and interest on sewage treatment plant bonds for said fiscal year and out of all other funds available therefor, the amount for each object and purposes as follows: For payment of principal and interest on Sewage Treatment Plant bonds $ 11,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Sewage Treatment Plant Bonds Fund, SECTION 18. STREETS, AVENUES, BOULEVARDS, ROADS AND DRIVES, RESIDENCES, BUILDINGS: Name and number changed; rules controlling same. The Streets, Avenues, Boulevards, Drives and Roads in the City of Blair, Nebraska, shall be.changed and designated according to the following rules. A. The rules are set forth as a control for the new street numbering plan and are to be used in the naming and numbering of future streets. 1. All present streets of an east -west or a north -south direction and which conform in alignment with the existing streets in the eefitral part of Blair are to be given the designation "Streets ". 2. All north south and'east -west streets which are misaligned with the existing plan by more than one and one -half times the legal width of the street are to be "Avenues ". 3. Those future Avenues which are north -south in direction will be given she number of the nearest adjacent street. 4. A11 streets which are diagonal in direction to the central portion of Blair are to be named as Boulevards, Drives, or Roads. B. The following rules are to control the new house numbering plan. 1. All house numbers on east -west streets will conform to the numbering of the north -south streets. 2. For north -south addresses the dividing line will be Washington Street. 3. House numbers are to be assigned on east -west streets one number per 10 feet of distance from the nearest lowest numbered street eastward, using the east lot line of the block as the starting point. 4. North -south addresses will be on the same 10 feet basis but the hundredths block will be determined by the number of blocks north or south from Washington Street. For north addresses the starting point shall be the south lot line of the block. For south'addresses the starting point shall be the north lot line of the block. On diagonal streets the numbering shall conform as if the rectangular streets were cut through so as to intersect the diagonal street. Diagonal streets which have a direction more easterly or westerly will be given numbered addresses in relation to the numbered streets. Diagonal streets which are more northerly or southerly will be given north-south addressee in relation to their distance from Weashington Street. Section 2. Firm gas service shall be made available to all domestic and commercial customers whose maximum requirements are less than 1,000 cubic fear per hour. 2. Interruptible Gas.Service Interruptible gas service is defined as gas service that is supplied on an interruptible basis. It shall be subject to curtailment or interruption on demand of the gas service company whenever necessary to protect the service of its firm gas customers. SECTION II — Maximum Rates That no person, firm or corporation supplying nautral gas to the City of Blair, Nebraska, and the inhabitants thereof, shall, effective with meter reading,periods beginning on and after November 27, 1958, charge more for such natural gas service than the following maximum rates: 1. Firm Gas Service Rate Availability — This rate is available only to domestic and commercial customers whose maxim gm requirements for natural gas are less than 1,000 cubic feet per hour. The gas service company shall not be required to serve any customer at the following rate whose requirements amount to 1,000 cubic feet or more per hour. Rate First 600 Cu. Interruptible Gas Service Rate Availability - This rate is available only on a contract basis to commercial or industrial customers whose reuirements for natural gas amount to 1,000 cubic feet or more per hour, and who install and maintain sufficient Stand- by equipment and standby fuel to take care of customer's entire requirement during periods of curtailment of the use of nattral gas by the gas service company in order to protect the service of its firm gas users. Rate The rate for interruptible gas service shall be such rate as may be mutually agreed upon between the customer and the gas service company, but shall not be higher than the firm gas service rate set out above. SECTION III - Gas Cost Adjustment 1. Northern's Docket G- 1215'3 (Rate Case No. 6) As the result of an application filed and now pending with the Federal Power Commission(Commission), Docket C -12153 (Rate Case No. 6), Northern Natural Gas Company (Northern) wholesale supplier of natural gas, was • permitted to increase its wholesale gas price to Central Electric and Gas Company (Central), the distributor of natural gas, on August 27, 1957, Such increased price is being collected by Northern under refunding bond pending final determination by_the Commission of the reasonableness of such increase. If the Commission orders Northern to refund to Central any monies collected under such refunding bond as'a result of Docket G- 12153(Rate Case No. 6) Central agrees to make a'6 cost of gas" credit refund to its firm gas customers. The amount of such refund to each firm gas customer shall be computed by (1) dividing the total refund received from Northern allocable to firm gas purchased from Northern for resale in Blair between August 27, 1957, and the effective date of the final wholesale price resulting from Docket G -22153 (Rate Case No. 6) by the total number of MCP of firm gas billed by Central in Blair between August 27, 1957 and the effective date of the final wholesale price resulting from said Docket G- 12153(Rate Case No. 6), and (2) multiplying the resulting figure(cents'per MCF) by the number of MCF of firm gas billed each firm gas customer from meter reading periods beginning on and after August 27, 1957, the date ...on which rates -as provided in Paragraph 1 of Section II of Ordinance No. 688 were first charged, to the effective date of the final price resulting from said Docket G -12153 (Rate Case No. 6). Such refund shall be made to such firm gas customers within a reasonable time after receipt of Northern's refund. 2. Northern's Docket G- 15175 (Rate Case No. 7) As the result of a further application filed and now pending with the Federal Power Commission(Commission), Docket 0-15335 (Rate Case No. 7), Northern Natural Gas Company(Northern), wholesale supplier of Natural gas, will again be permitted to increase its wholesale gas price to Central Electric and Gas Company(Central), the distributor of natural gas, on November 27, 1958. Such increased price will be collected by Northern under refunding bond pending final•determination by the Commission of the reasonableness of such increase. A petition signed by more than 600 of the resident owners owning property directly abutting upon the streets to be improved., as hereinafter set forth, petitioning for the improvement of Park Street from its intersection with Ninth Street to its intersection with Eleventh Street by paving the same having been presented and filed with the City Clerk, there is hereby created Street Improvement District No. 33 of the City of Blair, Nebraska. The property included in said Street Improvement District No. 33 and subjec to special assessment to pay for the cost and expenses of said street improvement is all of the privately owned lots, parts of lots and tracts of land and, the lots, parts of or tracts of land owned by any municipal or public corporation and abutting upon or adjacent to said streets so to be improved, to -wit: Lots 7 to 12 in Block 90, Lots 1 to 6 in Block 5, Lots 7 to 12 in Block 89;. Lots 1 to 6 in Block 4, all in the Second. Addition, to the City of Blair, Washington County, Nebraska, SECTION 4. The Street improvement to be made on said streets shall be to pave the same 21 feet in width and curb the same, the grade to conform to the, existing grades in said City of Blair-and said improvement to be amde according to plans, specifications and estimates of cost to be prepared by the special engineer and filed with the City Clerk and to be approved by the Mayor and Council of said City. Whereupon Councilman W. B. Johnson moved that said Ordinance No. 701 be approved on its first reading and its title agreed to, Councilman Rabbass seconded this motion. Councilman kihr called for the question, The Mayor put the question and instructed the Clerk to call the roll for the vote on this motion. Yeas: Farnberg, J. D. Johnson, W. B. Johnson, Kuhr, Rabbass, Sorensen, Trisdale and Wheeler. Nays: None. Absent: .None. Motion: Carried. Whereupon the Mayor declared said Ordinance No. 701 approved on its first reading and its title agreed to. SUSPENSION OF RULES Whereupon it was moved by Councilman W. B. Johnson and seconded by Rabbass that the statutory rules in regard to the passage and adoption of ordinances be suspended so that said Ordinance might be introduced, read approved and passed at the,same meeting.
