1955OPENING The Mayor and Council of the City ©f Blair, Washington County, Nebraska met in regular session in the Council Chambers at 4 o'clock P. M. Mayor Raymond C. Hansen presided. City Clerk L. W. Svendgaard recorded the pro- ceedings of the meeting. ROLL CALL The Mayor instructed the Clerk to call the roll. The Clerk called the roll and the following Councilmen were present: H. C. Kuhr, M. 0. Kuhr, Rabbass, • Reeh, Sorensen and Wheeler, Councilmen Johnson and Simpson were absent. ORDER OF BUSINESS Whereupon the Mayor announced that the introduction of Ordinances was now in order. Whereupon it was moved by Councilman Sorensen and seconded by Councilman Wheeler that the minutes of the proceedings of the Mayor and Council in the matter of the passage and approval of Ordinance No. 674 be preserved and kept in.s..separate and distinct volume known as the Ordinance Record of the City of Blair, Nebraska and that said separate and distinct volume be incorporated in and made a part of these proceedings the same as though spread at large herein. Whereupon Councilman Sorensen moved that said Ordinance No. 674 be approved on its first reading and its title agreed to, Councilman Wheeler seconded this motion. Councilman H. C. Kuhr called for the question. The Mayor put the question and instructed the Clerk to call the roll for the vote thereon. The . Clerk called the roll and the following was the vote on this motion. Whereupon the Mayor declared said Ordinance No. 674 approved on its first reading and its title agreed to. Whereupon it was moved by Counoilman.Sorensen and seconded by Councilman Wheeler that the statutory rules in regard to the passage and adoption of ordinances be . suspended. so that said Ordinance might be introduced, read, approved and passed at the same meeting. This Ordinance was introduced by Councilman Simpson and is in words and figures as follows, An Ordinance. to be termed the "Annual Appropriation`Bill" appropriating such ,sum or'sums'of money necessary to defray all necessary expenses and liabilities of the City of Blair, Nebraska,`for the fiscal year commencing on the first .Tuesday in May, 19S5, and specifying the object and purpose of each appropriation and the amount for each object and purpose. ORDINANCE NO. 675 BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLA.IR, NEBRASKA: SECTION 1. That there be, and hereby is, appropriated out of the money derived from the taxes levied for general revenue purposes for the present fiscal year, commencing on the first Tuesday in May, 1955, and out of all other available money and funds therefor belonging to.said. SECTION 5, That there be, and hereby is, appropriated out of the money derived from taxes for parks and park purposes fgr.said fiscal year and out of all other funds and moneys available therefore, the amounts for each object and purpose as follows: $ 8,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the.parks and park purposes fund. SECTION-6. That there be, and hereby is, appropriated oat. of the moneys derived from the operation of the municipal electric light system and the sale of electrical current and supplies and all other funds and moneys available therefor, the amounts for each object and purpose as follows: For salaries of light commissioner and wages of department employees, operation and maintenance of municipal power distribution system $175,000,00 For extention and improvements of municipal light power system generator and plant improvement and line extention $75,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred' to the Electric Light System Fund. SECTION 7, That there be, and hereby is, appropriated out of the money derived from taxes for sewer maintenance for said fiscal year and out of all other funds and moneys avaiable therefor, the amounts for each object and purpose as follows: For salaries of employees, operation and maintenance of sewer system $ 3,000,00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the. Sewer Maintenance Fund. .SECTION 8. That there be, and hereby is, appropriated out of.the money derived from the levy of taxes for the operation, maintenance and care of the Blair Cemetery, $ 4,000.00 Any balance of said fund remaining over and unexpended at -the end of the fiscal year shall be transferred to the Blair Ceketry Fund. 1015 , SECTION 9. That there be, and hereby is appropriated out of the moneyi derived from the levy of taxes for the payment of refunding bonds and interest thereon and the,sinking fund for said fiscal year and out of the money derived from taxes levied for payment of intersection and for district paving bonds and interest and out of any and all other funds and money available therefor, the amounts for each object and purpose as followst For payment of principal and interest on bonds in debtedness due or to become due and for sinking funds $ 25,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Sinking', Fund for the payment of refunding bonds. SECTION 10. That there be, and hereby is, appropriated out of the money derived from the operation of the municipal ice plant and the sale of products therefrom and out of all other funds available therefor, the amounts for each object and purpose as follows :' For salaries and wages of employees, operation, maintenance, repair and extension of said Ice Plant $ 12,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Ice Plant Fund. SECTION 11. That there be, and hereby is, appropriated out of the money derived from the levy taxes for the maintenance and operation of the fire department for the present fiscal year and out of all other money and funds available therefor, belonging to said City, the, amounts for each object and purpose as follows: For maintenance and operation of the Oity Fire Department $ 41,500.00 . Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the fund for the maintenance and operation of City Fire Department. SECTION•12. That there be, and hereby is appropriated out of the money derived from the levy of taxes for the.purnose of purchase of Fire Department apparatus for the present fiscal year and out of all other money and funds available therefor belonging to said City the amounts for each.object and purpose as follows: For purchase of Fire Department Apparatus $15,000.00 Any balance of said fund remaining over and unexpended at the end of the - fiscal year shall be transferred to the Fire Department Apparatus Fund. SECTION 13. That there be, and hereby is appropriated out of the Music and Public Amusement Fund and' out of all other funds .money' available therefor the amounts for each object and purpose as follows: For music and public amusement 4 3,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Music and Public Amusement Fund. SECTION 14. That there'be and hereby is appropriated out of the money now on hand for, the Special Gasoline Road Fund, and from the moneys derived from special gaspline tax and motor registration fee, the amounts for each .object and purpose as follows: For constructing street improvements $35,000.00 Any balance in said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Special Gasoline Tax Fund. SECTION 15. That there be and hereby is .appropriated out of the money derived from the levy of taxes, for the purpose of paying the City's share of the employees and officers' federal social security tax for the present fiscal year and out of all other money and funds available therefor belonging to the said City, the amount for each Object and purpose as follows: For City's share of Employees' and Officers! Federal Social Security Tax $ 3,000.00 Any balance ins aid fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Social Security.Tax Fund. 9 1016 SECTION 16. That there be, and hereby is, levied and assessed upon all the taxable property within the corporate limits of the City of Blair, Nebraska, for the fiscal year commencing on the first Tuesday in May, 1955, and ending on the first Tuesday in May, 1956, the following sums, taxes and number of mills on the dollar of tax, to -wit: An Ordinance to provide for the levy of taxes and levying the same upon all the taxable property in the City of Blair, Nebraska, for all purposes necessary to maintain the City Government for the City of Blair, Nebraska, for the fiscal year commencing on. the first Tuesday in May, 1955, and also levying a poll tax on certain inhabitants of said City for the fiscal year. This Ordinance was introduce by Councilman Wheeler and is in words and figures as follows, AN ORDINANCE OF THE CITY OF BLAIR, NEBRASKA TO PROVIDE FOR EFFECT OF BICYCLE REGULATIONS, ACQUIRING LICENSE, INSPECTION OF BICYCLES, RESPONSIBILITY OF RENTAL AGENCIES ANA BICYCLE DEALERS, TRANSFER OF LICENSE, APPLICATION OF TRAFFIC LAWS, OBEDIENCE TO TRAFFIC CONTROL DEVICES, NUMBER RIDING THEREON, PLACE OF DRIVING ON ROADS, SPEED AND GENERALLY THE USE OF BICUCLES UPON THE STREETS, SIDEWALKS AND PUBLIC PLACES IN THE CITY OF BLAIR, EQUIPMENT THEREFOR: AND PENALTIES FOR VIOLATION BY CHILD: OR PARENT, AND FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINTED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, AS FOLLOWS: The owner, driver, operator or person in charge of any bicycle shall conform 'to and comply with the following rules and regulations. . A. It is a misdemeanor for any person to do any act forbidden or fail to perform any act required in this ordinance. B. The parint of Pry child the guardian of any ward shall not authorize or'knowlingly permit any such child or ward to violate any of the provisions of this ordinance. 0. These regulations applicable to bicycles shall apply whenever a bicycle is operated upon any street or upon any public path set aside for the ex- clusive use of bicycles, subject to those exceptions stated herein. No person, who resided within this City, shall ride or propel a bicycle on any street or upon any public path posted, unless usch bicycle has been licensed and a'.1icense plate is attached therto as provided herein. SECTION 3. LICENSE APPLICATION. Application for a bicycle license and license. plate shall be made upon a form provided by the City and shall be amde to the Chief of Police. An annual fee of 2,5 cents shall be paid to the City before each license or 'renewal,thereof ' is granted. - SECTION 4. ISSUANCE OF LICENSES. A. The Chief of Police upon 'receiving proper application therefor is authorized to issue a bicycle license which shall be effective until the lst of May. . B.. The Chief. of Police shall not issue a license for any bicycle when he' knows or has resonable grounds to .believe that the applicant is not the owner of or entitled to the possession of such bicycle. 0. The Chief of Police shall keep a record of the number of each license, dhe date issued, the name and address of the person to wham issued and the number on the frame of the bicycle for which issued., and a record of all bicycle license fees collected by him, SECTION 5. ATTACHMENT OF LICENSE PLATE. A. The Chief of Police upon issuing a bicycle license shall also issue a license plate bearing the license number assigned to the bicycle, the name 'of the City and the calendar year for which issued. B.. The Chief of Police shall.,cause such license plate to be firmly attached to the rear mudgard or frame of the bicycle for which issued in such position as-to be plainly visible from the- rear, C. No person shall remove a license plate from a bicycle during the period for whioh.issued except upon a transfer of owner ship or in the event the bicycle is dismantled and no longer operated upon any street in this City. SECTION 6. INSPECTION OF BICYCLES. The Chief of Police or an officer assigned such responsibility shall inspect each bicycle before licensing the same and shall refuse a license for any bicycle which he determined is in unsafe mechanical condition. • SECTION 7. RENEWAL, OF LICENSE... Each bicycle must be licensed annually and must be obtained on or before the 1st of September of each year and the license year shall be the calendar year. Upon the expiration of any bicycle license the same may be renewed upon application and. payment of the same fee as upon an original application, SECTION 8. TRANSFER OF OWNERSHIP, Upon the sale or other transfer of a licensed bicycle the licensee shall remove the license plate and shall either surrender the same to the Chief of Polce or may upon proper application but without payment of additional fee have said plate assigned to another bicycle owned by the applicant. SECTION 9. RENTAL AGENCIES, A Rental agency shall not rent or offer any bicycle for rent unless the bicycle` is licensed and a license plate is attached thereto as provided herein and such bicycle•.is equipped,with lamps and other equipment requred in this ordinance. . SECTION 1.0 BICYCLE DEALERS. 1026 Every person engaged in the business of buying or selling new or,second- hand bicycles shall make a report to the Chief of Police of every bicycle purchased or sold by such dealer giving the name and address of the person from whom purchased of to whom sold, a description of such bicycle by name or make, the frame number thereof, and the number of license plate, if any, found thereon. SECTION 11. TRAFFIC LAWS APPLY TO PERSONS RIDING BICYCLES. very person riding a bicycle upon a roadway shall be granted all the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this State declaring rules of the road applicable to vehicles or by the traffic ordinances of.this city applicable to the driver of a. vehicle,` except as to special regulations in this article and except as to those provisions of laws and ordinal ces which by their nature can have no application. SECTION 12. OB A . Any person operating a bicycle shall obey the instructions of offical traffic-control signals, signs and other control devices applicable to vehicles, unless other wise directed by a police officer. B. Whenever authorized signs are erected indicating that no right or left or U turn is permitted, no persons operating a bicycle shall disobey the direction of any such sign, except when such person dismounts from the bicycle to mace any such turn in which event such person shall then obey the regulations applicable to pedestrians. SECTION 13. RIDING ON BICYCLES. A. A person propelling a bicycle shall not ride other than astride a permanent and regular seat attached thereto. P. • No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped, unless such carrying is done in a reasonable and safe manner. SECTION 14. `RIDING ON ROADWAYS AND BICYCLE PATHS. A, Every person operating a bicycle upon a roadway shall ride as near to the right --band side of the roadway as procticable, exercising due care when passing a standing vehicle or one proceeding in the same direction. B. When ever a usuable path for bicycles has beeh provided adjacent to a roadway bicycle riders shall use such path and shall not use the roadway. SECTION 15. SPEED IENOE TO TRAFFIC CONTROL DEVICES. 102 NO person shall operate a bicycle at a spedd greater than is reasonable and prudent under the conditions then existing, and in noevent when riding on a sidewalk in the residential district shall exceed the spedd of 5 miles per hour. SECTION 16. EMERGING FROM ALLEY OR DRIVEWAY, The operator of a bicycle emerging from an alley, driveway or building shall upon approaching a sidewalk or the sidewalk area extending across any alleyway, yield the right of way to all pedestrians approaching on said side- walk or sidewalk area, and upon entering the roadway shall yield the right of way to all vehicles approaching on said. roadway. SECTION 17. CLINGING TO VEHICLES. No person riding upon any bicycle shall attach the same or himself to any vehicle upon a roadway. SECTION 18. CARRYING ARTICLES. No person operating a bicycle shall carry any package, bundle or article which prevents the rider from keeping at least one hand upon the handle bars. SECTION 19. PARKING. No person shall park a bicycle upon a street or other than upon the roadway against the curb or upon the sidewalk in a rack to support the bicycle or against a building or at the curb, in such a manner as to afford the least obstruction to pedestrian traffic, The Chief of Police is hereby authorized to erect s4,gns on any sidewalk or roadway porhibiting the parking of bicycle at any designated place so stated on the sign, and when such signs are in place no person shall disci the came. In any proceeding for the violation of parking provisions of this ordinance, the license plate displayed on the bicycle shall constitute. in a prima facie evidence that the owAer of such bicycle was the person who parked or placed such bicycl a t 'w tomittowhibrt ipluclOilblaablid. 4d. SECTION 20. RIDING ON SIDEWALKS. A. No person shall ride a.bicycl.e upon a sidewalk. within a business district. B. The Chief of Police is authorized to erect signs on any sidewalk or roadway prohibiting the riding of bicycles thereon by any person and when such signs are in place no person shall disobey same. C. Pedestrians are hereby given the right —of —way on the sidewalks and along the crossings of the city and any rider of a bicycle or wheel of any description when wishing to pass a person on foot must dismount at least f ifteeen (15) feet from said person and pass dismounted. SECTION 21. ' LAMPS AND OTHER. EQUIPMENT ON BICYCLES, A. Every bicycle when in use at nightime shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least • 500'feet to the front and a red reflector on the rear of a type which shall be visible from all distances from 50, feet to 300 feet to the rear when directly in front of lawful upper beams of headlamps on a motor vehivle. A lamp omitting a red light visible from a distance of 500 feet to the rear maybe used in addition to the read reflector. ..C. Every bicycle shall be:•.equipped with a brake which will enable the operator to make the braked wheel skid on dry, level, clean pavement. SECTION 22. REPEAL. All ordinances or parts, of ordinances in conflict with the provisions of this ordinance are hereby ,ropealed. SECTION 23, PENALTIES. Any person violating any provision of Section 1 to 21 inclusive, set forth above, on conviction thereof shall be fined in any sum not less'than $1,00 nor more than $25.00 and stand committed until such fine and costs are paid, or any person convicted of any violation of any provision of this ordinance shall be punished by removal and detention of the license plates from such person's bicycle for a period ,of not to exceed 90 days or by impounding of such person's bicycle for a period not to exceed 90 days or by any combination thereof. That further it shall be unlawful for any parent of guardian to permit his child or ward to use and drive-upon the streets and sidewalks of the City of Blair a bicycle not equipped as set forth in this'ordinance and any parent or guardian so permitting his child or ward to operate and use an unlawfully equipped bicycle shall be fined in any sum not less than $1.00 and not more than $25.00 and stand committed until such fine and costs are paid. This Ordinance was introduced by Councilman Wheeler and is in woids and figures as follows; ORDINANCE NO. 678 An Ordinance of the City of Blair, Nebraska; providing for the making, adoption , amendment, extension and carrying out of a municipal plan; a City Planning Commission; providing the number, qualifications and manner of appointment of members of such commission, the manner of removal of such members, the filling of vancancies on such commission and the compensation and terms of office of its members; authorizing such commission to organize, elect officers, adopt rules for the transaction of business and keep records; specifying the duties and powers of such commission, the number of its regular meetings and the limit of its expenditures; repealing all Ordinances and parts of Ordinances in conflict here- with and providing when this Ordinance shall be in force. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA: Section 1. The City of Blair shall be authorized to make, adopt, amend, extend and carry out a municipal plan as authorized by law. Section 2. A commission to be known as "City Planninn. Commission" is hereby created which shall consist of nine members who shall represent insofar as is possible different professions or occupations in the City and who shall be appointed by the Mayor by and with the approval of a three - fourths vote of the Council. Section 3. All members of the City Planning Commission shall serve as such without compensation and shall hold no other municipal office. Section 4. The term of each member of the City Planning Commission shall be three years, except that three members of the first Commission shall be appointed to serve. for the term of one year,' three to serve for the term of two years, and three to serve for the term of three years. All members shall hold office until their successors are appointed. A'1I' members may, after a public hearing before the 1034 City Council, be removed by the Mayor, by and with the consent of a three - fourths vote of the Council, for inefficiency, neglect of duty, or malfeasance in office or other good arid sufficient cause. Vacancies on the commission occurring other than through the expiration of term shall be filled for the unexpired term by the Mayor. Section 5;. The City Planning Commission shall elect its chairman from its members and create and fill such other of its offices as it may determine. The term of the chairman shall be one year and he shall be eligible for re— election. The Commission shall hold at least one regular meeting in each month. It shall adopt rules for the transaction of business and shall keep a record of its resolutions, , transactions, findings and determinations, which record shall be a public record. Section 6. The Council.may provide the funds, equipment and accommodations necessary for the work of the Commission, but the expenditures of the Commission,' exclusive.of gifts, shall be within the amounts appropriated for that purpose by the Council and no expenditures, nor agreements for expenditures, shall be valid in excess of such amount. Section 7. It shall be the function and duty of the Commission to make and adept plans for the physical development of the municipality, including any areas outside its boundaries which, in the Commission's judgment, bear relation to the planning of the municipality. Section 8. The C©mmission shall, from time to time, .recommend to the appropriate public officials programs for public structures and improvements and for the financing thereof. It shall be part of its duties to.consult and advise with public officials and agencies, public utility companies, civic, educational, professional and other otganizations and with citizens with relation to the protecting or carrying out of the plan. Section 9. All ordinances and parts of ordinances in conflict therewith are hereby repealed.
