1954OPENING The Mayor and Council of the City of Blair, Washington County, Nebraska met in regular session in the Council Chambers at 7 :30 o'clock P. M. Mayor Raymond C. Hansen presided. City Clerk L. W. Svendgaard recorded the proceedings of the meeting. ROLL CALL The Mayor instructed the Clerk to call the roll. The Clerk called the roll and the following Councilmen were present: Johnson, Kuhr, Rabbass, Reeh, Rounds, Simpson, Sorensen and_Wheeler. ORDLR OF BUSINESS Whereupon the Mayor announced that the introduction of Ordinances was now in order. ORDINANCE NO. 670 ORDINANCE NO. 670 983 Blair, Nebraska February 16, 1954 Whereupon it was moved by Councilman Sorensen and seconded by Councilman Johnson that the minutes of the proceedings of the Mayor and Council in the matter of the passage and approval of Ordinance'No. 670 be preserved and kept in a separate and distinct known as the Ordinance Record of the City of Blair, Nebraska, and that said separate and distinct volume be incorporated in and made a part of these prbce'edings the same as though spread at large herein. Inter eduction of Ordinance No. 670 of the City of Blair, Nebraska., and the matter now coming before the Mayor and Council was the passage and approval of Ordinance No. 670 of the City of Nebraska. This Ordinance was introduced by Councilman Wheeler and is in words and figures as follows, AN ORDINANCE AUTHORIZING TIE ISSUANCE OF BONDS OF THE CITY OF BLAIR, NEBRASKA, IN THE PRINCIPAL SUM OF $7,000.00, SAID BONDS BEING SEVEN. That there be hereby authorized, and it is hereby directed, that the negotiable bonds of said City of Blair, Nebraska, be issued in the principal amount. of $7,000.00, said bonds to be of the denomination of $1,000.00 each to be numbered from One to Seven consecutively, and to be known and designated as, "District Paving Bonds, Street Improvement District No 30, City of Blair, Nebraska ", said bonds to be payable to bearer, to bear interest at the rate of 3 percentum per annum, said interest to be payable semiannually on the first days of September and March of each year until said bonds are paid, said bonds to be dated March 1, 1954, and to become due and payable March 1, 1964, but reserving the right to said City at its option to call for payment and pay not more than two of said bonds three years from date of issue, two of said bonds four years from date of issuance, all. of said bonds to be callable and payable at the option of'said City on or after five years from their issuance date; interest payments on said bonds to be represented by interest coupons attached thereto; and said bonds interest coupons to be payable at the office of the County Treasurer of Washington County,. KNOW ALL MEN BY THESE PRESENTS: That the City of Blair, Nebraska, a City of the Secondr Class in Washington County, State of Nebraska, hereby promises to pay to bearer; the sum of One Thousand Dollars in. lawful money of the United Statesv on or be- fore Mar. together with interest thereon from the first day of March, 1914, until paid, 1, 1964, at the rate of 3 percentum per annum payable semi - annually, on the first day of September and the first day of March of each year on presentation and surrender of.the interest coupons hereto attached as they severally become due. Both principal and interest on this bond are payable at the office of the County Treasurer'of.Washington County, Nebraska, in Blair, Nebraska. .This bond is one of e. series of seven bonds each in the principal sum of $1,000.00, said series aggregating the principal sum of Seven Thousand D6111ars, duly issued by virtue of the acts and proceedings of the Mayor and Council of • the City of Blair, heretofore had'and done pertaining thereto, for the purpose of paying the cyst of improvement of said streets in said City by paving. the .'same in Street Improvement District No. 30, of said City. The Clerk thereupon read the aforesaid Ordinance No. 670 by title upon its first reading. Whereupon Councilman Sorensen moved that. said Ordinance No. 670 be approved on its first reading and its title agreed to. Councilman'Johnson seconded this motion. ' Councilman Rabbass called for ,the question. The Mayor put the question and instructed the Clerk to call the roll for the vote thereon. Whereupon the Mayor declared said Ordinance No. 670 approved on its first reading and its title agreed to. This Ordinance was introduced by Councilman Reeh and: is in words and figures as follows, ORDINANCE NO. 671 . An ordinance to be termed the "Annual Appropriation Bill” appropriating such sum or sums of money necessary to defray all necessary expenses and liabilities of the City :of Blair, Nebraska, for . the fiscal year commencing on the first Tuesday in May, 1954,. and specifying the object and purpose of eaeh.appropriation and the amount for each object and purpose, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF T sE1 CITY OF BLAIR, NEBRASKA: SECTION 1. SECTION 4. That there be, and_ hereby. is, appropriated out of the money derived from the .water works.system and out of the water fund and all other money and funds abailable therefor, the amount for each object and purpose as follows: For improvement, extention, operation and maintenance of water works system and salary of employees and hydrant rentals $ 24,000.00 For extention of distribution system, improvement of water department, hydrant rentals and services $ 90,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Water Fund. SECTION 5. That there be, and hereby is, appropriated out of the money derived from ,taxes for parks and park purposes for said fiscal year and out of all other funds and moneys available therefore, the amounts for each object and purpose as follows: For park and park purposes, salaries of employees maintenance, improvement and operation of swimming pool $ 8,000.00 Any balance of said fund remaining over and unexpended at,the end of the fiscal year shall be transferred to the parks and park purposes fund. SECTION 6, That there be, and hereby is, appropriated out of the moneys derived from the operation of the municipal electric light system and the sale of electrical current and supplies and all other funds find moneys available therefor, the amounts for each object and purpose as follows: For salary of light commissioner and wages of department employees, operation • and maintenance of municipal power distribution system $102,000.00 For extention and improvements of municipal light power system generator and plant improvement and line extention $100,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Electric Light System Fund. SECTION 7. That there be, and hereby is, appropriated out of the money derived from taxes for -sewer maintenance for said fiscal year and out of all other funds and moneys abailable therefor, tho amounts for each object and purpose as follows: For salaries of employees, operation and maintenance of sewer system $ 3,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Sewer Maintenance Fund. SECTION 8. That there be, and hereby is, appropriated out of the money derived from the levy of taxes for the operation, maintenance and care of the Blair Cemetery $ 4,000.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Blair Cemetery Fund, SECTION 9. That there be, and hereby is appropriated out 0f the money derived from the levy of taxes for the payment of refunding bonds and interest thereon and the sinking fund for said fiscal year and out of the money derived from taxes levied for payment of intersection and for district paving bonds and interest and out of any and all other funds and money available therefor, the amounts for each object and purpose as ,follows: For payment of principal and interest on bonds indebtedness due or to become due and for sinking funds $ 25,000.00 Any balance of said fund remaining over and unexpended at the end of the . fiscal year shall be transferred to the Sinking Fund for the payment of refunding bonds. SECTION 10. That there be, and hereby is, appropriated out of the money derived from the operation of the municipal ice plant and the sale of products therefrom and out of all other funds available therefor, the amounts for each object and purpose as follows; For salaries and wages of employees, operation, maintenance, repair and extension of said Ice Plant $ 12,000.00 Any balance of said fund retraining over and unexpended at the end of the fiscal year shall be transferred to the Ice Plant Fund. SECTION 11. That there be, and hereby is. appropriated out of the money derived from the levy of taxes for the maintenance and operation of the fire department for the present fiscal year and out of all other money, and funds available therefor, belonging to said City,'the amounts for.each object and purpose as follows: For maintenance and operation of the City Fire Department $ 4,500.00 Any balance of said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the fund for the maintenance and operation of the City Fire Department. SECTION 12. That there be, and hereby is appropriated out of the money derived from the levy of taxes for the purpose of purchase of Fire Department apparatus for the present.fiscal year and out of all other money and funds available therefor belonging to said City the amounts for each object and purpose as follows: For purchase of Fire Department apparatus $ 15,000.00 Any balance of said fund remaining over and unexpended at, the end of the .fiscal year shall be transferred to the Fire Department Apparatus. That there be, and hereby is appropriated out the Music and Public Amusement Fluid and out of all other funds and money available .therefor, the amounts for each object and purose as follows: For music and public amusement $ 2,000.00 Any balance of fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Music and Public Amusement Fund. SECTION 14. That there be and hereby is appropriated out of the money now on hand for the Special Gasoline Road Fund and from the moneys derived from specialgasoline tax and motor registration fee, the amounts for each object and purpose as follows: For constructing street improvements. $ 35,000.00 Any balance in said fund remaining over and unexpended at the end of the fiscal year shall be transferred to the Special Gasoline Tax Fund. SECTION 15. That there be and hereby is, appropriated out of the money derived from the levy taxes. for the purpose of paying the City's share of the employees and officers'.federal social.security for the present fiscal year and out of all other money and funds abailable therefor belonging to the said City, the amount for each object and purpose as follows :. . Buhr and is in words and figures as follows, ORDINANCE NO. 672 The Clerk called the Blair, Nebraska July 6, 1954 An Ordinance to provide for the levy of taxes and levying the same upon all the taxable property in the City of Blair. Nebraska, for all purposes necessary to maintain the City Government•for the City of Blair, Nebraska, for the fiscal year commencing on the first Tuesday in May, 1954, and also levying a poll tax on certain inhabitants of said City for the fiscal year. That said poll tax shall be collected as provided by law, for said fiscal year commencing on the first Tuesday of May, 1954. This Ordinance•was introduced bit Councilman Wheeler and is in words and figures as follows, ORDINANCE NO. 673 AN ORDINANCE OF THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA, ESTABLISHING RATES FOR FIRM GAS SERVICE AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT WITH THE PROVISIONS OF THIS ORDINANCE. BE IT ORDAINED, by the Mayor and City Council of the City of Blair, Nebraska: That no person, frim or corporation supplying natural gas to the City of Blair, Nebraska and the inhabitants thereof on a firm basis as defined in Ordinance No. 669, shall after the effective date of this ordinance charge more for such gas service than the rates thereinafter set forth in Section II. Paragraph (b) hereof) 642.00 per MCP O 1.10 " " O .82 ® .72 @ .66 ® .60 c� .56 Ir 11 11 11 u 11 11 7.11 n Minumum Bill - $1.00 per month per customer (b) Adjustment for Cost of Purchased Gas The charges to customers for all gas supplied in the period covered by any bill shall be increased or decreased from the foregoing schedule, as follows: SECTION III' That all ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby. repealed, SECTION IV 1003 If at., any time or from time to, time on or after ?7,,15.54,. the rate authorized to b.e charged the Company for any natural gas purchased by it on a firm supply basis for resale in Blair shall be increased or decreased so as to result in an average cost per MCF to the Company greater or less than 43.7 cents (whether or not such increase or decrease is final or is made under refunding bond) the Company's charges per MCF for gas which it supplies to firm customer in Blair, on and after the effective date of such increase or decrease may be increased or shall be decreased to such amount per .MCF as shall be above or below he scheduled rates in each bracket by the same amount by which such increased or decreased average cost per MCF to the Company shall be move or less, as the case may be, than 43.7 cents; provided that if the amount of such increase or decrease in the Company's charges per MCF shall not be a multiple of one -tenth cent, the increase or decrease shall be made to the nearest such.multiple, or if there is no nearest such multiple, to the next higher such multiple; and provided, further, that the Company's charges shall also be adjusted by such amount per MCF as shall be necessary to reflect any increase or decrease in applicable sales,,use or gross revenue taxes on account of such increase or decrease in the Compnay's charges for natural gas sold in Blair. For the purposes hereof, the average cost per MCF of purchased gas shall be computed; (1) by applying(a) the newly effective rates(increased or decreased, as the case may be) applicable to. natural gas purchased on a firm supply basis for resale in Blair to firm customers, to(b) the respective quantities of natural gas so purchased during the first 12 of the 14 calendar months immediately preceding the effective date of such increase or decrease, and (2) by dividing the total cost of such natural gas so computed by the aggregate quantity of gas so purchased during such twelve month period. In the event of the Company's receipt of any refund in respect of rates paid by it under bond and applicable to natural gas purchased on a firm supply basis on or subsequent to december 27, 1954, then unless, upon application by the Company, the City Council of Blair shall other wise determine, (a) such refund shall be translated into terms of an amount per MCF of the quantity of purchased gas with respect to which such refund is received; (b) the average cost per MCF of an equal quantity of natural gas purchased on a firm supply basis subsequent to receipt of Such refund shall be deemed decreased. by the amount per MCF computed as provided in Paragraph(a); and (c) the Company's charges'per MCF which would otherwise be effective, shall be reduced by amount equal to such decrease in the average cost per MCF of purchased natural gas, which derease shall be applicable to a quantity of natural gas thereafter sold by the Company to firm customers in Blair equal to the quantity of pur- chased gas with respect to which such refund was received, and shall not be effective with respect to further sales. The Company shall, as promptly as possible after receipt of such refund, make the necessary computations and arrangements and shall effect the decrease resulting from receipt of such refund with the first billing period after such computations and arrangements have been made. This ordinance shall be in full force and effect from and after its passage by the Mayor and City Council of the City of Blair, Nebraska, and its publication as required by law.
