District, Motor, Contract ,or Common Carriers, No Night Parking in Residence
District; Oil Tankers, Gasoline Transports, Tank Trucks, Parking Prohibitions
and Limitàtions," be and the same is amended to read as follows:
, It shall be unlawful for ,the operator of any,truck, truck-tractor or
semi-trailer, having a Capacity of,ov~r 3/4 of a ton to stop or park such
vehicle on Washington Street from the east line of Fourth Street to the west
line of Sixth Street, on Fifth Street from the, north line of Lincoln Street'
to the so~th line of Front Street, and on Walker Avenue from the north line
of Lincoln Street to the south line of Front Street, from 8:00 O'C~Oék A. M.,
to 6: 00 P. ~., on week days excluding holia,ays. No operator of any truck,
truck-tractor or semi-trailer,having a capacity of over 3/4 of a ton shall
stop or parkin any Street or Alley within the "Residence Dil;\tr1:ct" between the
hours of 7:00 o'clock P. M., and 9:00 o'clock A. M., of the suceeding day,
and no such driver shail use or employ any portion of the'p'arking space in
said "Residence District for any commercial purpose. No oil tanker, gasoline

AN ORDINAlîfCE LEVYING AN OCCUPATION TAX UPON ALL PERSONS DISTRIBUTING NATURAL
GAS FOR SALE WITHIN THE 'CITY OF BLAIR, NEBRASKA .AND PROVIDING FOR THE COLLECTION
OF SUCH OCCUPATION TAX. . . .'
BE IT ORDAINED by the Mayor and Council of: the City of Blair, Nebraska:
Section 1. ASSESSMENT. There is hereby assessed an occupation tax
against all persons distributing natural gas for sale in an amount equal to
two percent of the gross rece:i,.pts derived from the business of distributing
and selling natural gas within theèity Df Blair, Nebraska, exclusive of such
salss ~o governm~ntal agencies, departments or other bodies whether_thèy be
Federal, State, or Local. The term "personit shall .include any individual.
company, partnership, corpor~tion or ~ther association.
Section 2. PAYMENT OF TAX. . Payment~hal1 be made to the City
Treasurer semi-annually. The first payment shall be made on or before
May 31 of each year for the preceding six month period 'ending April 30. The
second payment shall be ma.de 'onor before l\!ovember 30 of each year for the
preceding six month period ending October 31. '
Sect ion 3. INTEREST ON TAX IN DEFAULT. If such tax is not paid when
due, one Rercent interest on the amount in default shall be added to said tax
each month~
Sectión 4. REPORT. Any person subject to the tax imposed' by this
ordinance shall file. with the City Clerk a vårified statement covering each
tax period. . S,aid statement shall show' the gross receipts derived from the
d1stribu~ion and sale of natural gas within the city of Blair, Nebraska,
exclus.ive of such governmental agencies, departments or at,her bodies.

filed with.the City Clerk.

Section 6. REPEALER. All ordinances or parts or ordinances conflicting

Section 1. The Mayor and Council of the City of Blair, Nebraska, hereby
find and determine: The City owns, maintains and operates its water works
plant and water system .and to adeqUately serve the City and its inhabitants
it is necessary that the waterworks plant t;md water system be maintained,
extended and enlarged; the cost of such maintenance, EBxtens ion and enlargeme~t
is in excess of $35.000 and it is necessary for the City' to obtain an additional
$35,000 over and above the funds available to maintain, extend and ~n:large its
said water works plant and water sJ8tem; all conditions. acts and things re-
quiredby law to exist or to be done precedent to' and in the issuance of
revenue bonds do exist and have been done in due form and time as provided by law.
Section 2. For the purpose of maintain~ng. extending and enlarging the
water works plant and water system owned by the City of Blair there shall be
and there are hereby ordered issued negot iab:1.e coupon bonds of the City of .
:Blair, Nebraska, to be known as ItWater Revenue Bonds" of the aggregate p~incipal
amount of Thirty-five Thousand Dollars ($35.000) consisting of 35 bonds of
$1,000 each, numbered from 1 to 35 inc.lus:i.ve, dated June 1. 1953 bonds numbered
1 to 24 inc~usive bearing inte~est at the rate of two and one half per centum
(21J.~) per annum and bond.s numbered 25 to 35 both inclusive bearing interest
at the rate of two arid three quarters per centum (2 3/4~) per annum, payable
semi-annually on the first day of Decembe1" and June of each year and the
principal of said bonds shall become due and payable as follows: $3,000 on
the first day of June of each year beginning in 1955 and ending in 1965 and

$2,000 June I, 1966; provided, however, the City resel'ves,the right to redeem
any or all of said bonds in the inverse order of their serial nu~bers at any
time on or after five years from date of issuance thereof. Said bonds are
not general obligations of the City, but shall be payable solely frómthe
rev~nUes and "earnings derived and, to be derived from the operation of the water
works 'plant and water slstem of .the Oity including 'all extensions and impr6ve-
ments thereof' as provided ,in this ordinance.
Section 3. Said bonds shall be executed on be1la1f of the Oity by being
signed by the Mayor and City Clerk and shall bave the Oity seal improssed on
each bond. The interest.coupons shall be executed onbehâlfof the City by
being signed by the Mayor. and Clerk either by affixing their own proper
signatures to each coupon or causing their facsimiles'ignat1ires to be affixed
thereto and by executing each bond the Mayor and Clerk shall be deemed to have
adopted as their own proper signature their facimile signatures affixed to
the couþons pertaining to said bonds.
Section 4. The said bonds and coupons shall be substantially in the

shall be ciesignated as the "Blair Water System Fund.n' The city shall set
up and maintain as long as any bonds ;are' outstanding the fpllowing accounts

I. OPERATION AND MAINTENANCE AOCOUNT - The City shall set aside in
thia account each month an amount sufficient for the proper maintenance anci
operation of said plant and system and the expense of maintenance and opèration
shall be paid out of this account.
II. BOND ACCOUNT - Beg:inning Julyl. 1953. the City will on the first
day of each'monthv-p'.to and incl'Ùding November 1.1953. transfer to the
Bond Account money !Squal to one-fifth (1/5th) of all interest which will be-
come due on all bonds on the next interest payment date and on the first day
of December. 1953. and each month thereafter, a sum e'l'1al to one-si.th (l/6th)
of all interest which will become due on all bonds on the next interest
payment date and will also transfer to the Bond Âccòunt such additional
amounts that the total in the Bond Account on Junel, 1955, will be equal to
all interest and principal due on that date plus the amount of interest
and principal which will become due on June 1, 1956; in addition to the
foregoing amounts the City will pay into 'the Bond Account monthly, beginning ,
with June 1,1955, an amount equal to one-twelfth(1!12th)of the principal
which will become due on the bonds during the next twelve months period.
It' is the intention that beginning June 1, .1955, there will always be in
the Bond Accòunt a reserve equal to one year's interest plus an amount
equal to the amount required to pay the principal on bonds maturing in one
year.
III. SURPLUS ACOOUNT - After providing tor the Operation and
Maintenance Account and the Bond account as above provided the surplus funds
shall be set aside in a Surplus Acéount to be used for the extension or
enlargement of the water works plant and water system or prepayment of the
bonds issued under this ordinance.
Section 8. Alleast fifteen days before such payment of principal
or interest become due on any of the said bonds, the City will deposit with
the county Treasurer of Washington County, Nebraska, an amount of money
sufficient to pay the interest and principal of the bonds which will become
due on such payment date, such payments to be made ,out of the Bond Account.
Section 9. The City will maintain the water works plant and water
system,' including extensions and improvements, in good condition and RPerate
the same in an efficient manner and at a reasonable cost. The City agrees
with the holders, from time to time, of the bonds of this issue that the City,':;'
will continue to won, free from all liens andencumb~ance, and will adequately
maintain andéffieiently operate a water works plant and system and the City
will not create or suffer to be créated any lien or charge on the revenues of
, said plant which shall be superior to or on a parity with the lien, charge
and pledge in favor of the bonds of this issue; provided, however, the City
reserves the right to issue and sell additional bonds paYable solely from,
the net revenues of said water works plant 9~d water system of equal priority
as to len and earnings of said plant and system with the bonds issued under
this ordinance for the purpose of extending and enlarging the^wate~ works
plant and water system if the earnings available from the water works plant
and water system during the preceding twelve months for debt service on any
bonds of this series then outstanding and the proposed additional bonds are
equivalent to not less than one and one '4alf times the amount required fo~
said debt service.
Section 10. The City will maintain as long as any of said bonds
are outstanding with reputable insurance companies insurance on said water,'
works plant and. water system of the kind and in the amount as would commonly
he carried by private utilitiês engaged in and opeaating the same or similar
utility. Such insurance shall include, but not necessarily belimited to.
workmen's compensation, public liability, fire, windstorm and comprehensive
coverage. In event of any loss or damage to the water owrks plant or water
system the proceeds which may be collected or paid on any policy or policies
coverning the same shall be used by the City to retire the bonds issued under
this ordinance then outstanding or to'rehabilitate said water works plant'
and water system.'
Section 11. The water service furnished to any city department not
supported by direct taxation during the time any bonds issued under this

ordinance are outstanding shall.b$ paid for by the City at the established
rates. Payment for such water services shall be made quarterlyfrom the
corporate funds into the Blair Water System Fund created by this ordinance
as revenue derived from the operation of the water works plant and s~stem
in the same manner as the other revenue is required to be deposited.
Section 12. While any bonds issued hereunder are outstanding, t~e
City will render bills to all customers for water service. If said bills
are not paid within ten (10) days after due water service will be discontinued.
Section 1:3. The City wil} keep proper books, records and accounts
separate from all other records and accounts in which complete and correct
entries will be made of all transactionsIelating to said water works plant
and water system. Said books ofacéount ~hall be kept in accordance with
the lawa of the State of Nebraska, and not more than thirtY(:30) days after
the close of each three months fiscal period the City shall furnish Kirkpatrick
Pettis Company, Omaha, Nebraska, a complete separate income statement of such
water owrks plant and water system in reasonable detail covering such three
months period and not more than sixty (60) days after the close of each fiscal
year the City shall furnish KirÍtpâtrick-PetUs Company, Omaha, Nebraska, a
complete financial statement of the water works plant and water system in
reasonable detail prepared by a certified public accountant covering the
operation of said property for such fiscal year. A copy of such year's
financial statement and a'll:dit shall be filed with. the City Clerk and shall
be a public documentupen to inspection.
Section '14. The holder or holders of ten per centum or more, of
said bonds or of the coupons representing interest thereon may either at
law or in equity by appropriate proceedings in any court of competent
jurisdiction enforce any right created or granted by this ordinance or by
the bonds issued hereunder, and if the court finds that the appointment of
a receiver is necessary to protect the rights of the bondholders, ,the court
may appoint such a receiver_to take oyer and operate the property and may
fix the terms and conditions on which the same shall be operated until the
default is made good.

Section 15. The provisions of this ordinance shall constitute an
irrevocable contract between the City of Blair and the holders of the bonds
issued hereiUlder and after the issuance of said bonds no change or alteration
of any kind in the proviaions of this ordinance shall be made without the
,written consent of the holders of seventy-five per centum(75~) in principal
amount of the bonds then outstanding.
Section 16. The City Treasurer and the City Clerk shall be bonded,
in addition to their official bonds, by an insurance company licensed to do
business in Nebraska in amounts' sUffiCient to cover at all times all the
revenues and earnings of said water works plant and water system in théir
hands. Any other person employed by t~ City in the collection or handling
of mQneys derived from the operation ,of said property shall also be bonded
in an amount sufficient to cover all moneys which may at any. ti,me be placed
in his hands. The amount of such bonds shall be fixed by the Council, and
the cost thereof shall be "paid from the earnings of said water works plant
and water system, an~ theyst~ll secure the faithful.accounting for all
mon~ys.
Section 17. The 'City Clerk shall make and certify in duplicate a
complete transcript of the proceedings had and ~done by saidOityprecedent
to the issuance of said bonds, onEl of which transcripts .shall be filed with
the Auditor of Public Accounts of the State of Nebraska, and the other shall
be delivered to t1}.e purchaser of the bonds. After being executed by the
Mayor and Clerk said bonds shall be deliyeredto the City Treasurer who shall
be responsible under his official bond and the Treasurer shall cause said
bonds to be transmitted with a certified transcript aforesaid to the Auditor
of Public Accounts of the $tate of Nebraska to be registered in said Auditor's
office arid ~hall then cause the same to be registered in the office of the
Clerk of Washington County, Nebraska. The Oity Treasurer is authorized and
directed to deliver said bond,s to the purchaser upon receipt of payment of
the purchase price in accordance with the contract of the City with said
purchaser.
Section 18. If any section, paragraph, clause or provision of this
ordinance shall be ,held invalid, th9 invalidity of such section, paragraph,
clause or provision shall not affect any of the other provisions of this
ordinance.
Section 19. All'ordinances, resolutions or orders, or parts thereof,
in conflict with the provisions of this ordinance are to the extent of such
conflict hereby repealed.

and after its passage as provided by law.

BE IT ORDAINED by the Mayor and Council of the City of Blair, Nebraska:
SECTION 1. That Section 22 and Ordinance No. 657, entitled "Salaries of statutory
officers, elective, appointive; compensation of employøes; when paid" of the
Municipal Code of :Blàir, Nebraska, be and the same is amended by fixing the salaries
of said officers as follows:
Mayor - Five Hundred Dollars ($SOO.OO) per year
Councilmen each - Two Hundred Fifty Dollars($250.00) per year
Treasurer - Six Hundred Dollars($600.oo) per year
Clerk,- Seven Hundred Fifty ($750.00) per ye~
Police Magistrate - Six Hundred Dollars($600.00) per year
City Attorney - One Thousand Two 'Hundred.
Fifty( $1 ,2S0. 00)
per year
SECTION 2. This ordinance shall take effect and be in force from and
after its passage" approval and publication as provided by law.

met in regular session in the Co-pncil Chambers at 7:30 o'clock P. M. P.r~sident
of 'the Council Lester Wheeler presided. City Clerk L. W. Svendgaard recorded
the proceedings of the meeting. .

. The Pr!,7sident of the CoUncil instructed the Clerk to call the roll. The
Clerk called the roll and the following Councilmen were present: Johnson.
Kuhr,. Rabbass. Reeh, Rounds, Sorensen ând Wheeler. Councilman Simpson was
absent. '

Whereupon the President of the Council annoU11ced that the introduction
of Ordinances was now in order.
Whereupon it was mov~d by Counc~lma.n Raeh and, seconded by Sorensen that
the minutes of the proceedings of the Mayor and Council in the'matter of the
passage and approval of Ordinance No. 669 be presèrved and kept in a separate
and distinct'volume known as'the Ordinance Record of the City of Blair.
Nebraska. and that said separate and distinct volume be incorporated in ànd
made a part of these proceedings the same as though spread at large herein.
The President of the Council instructed the Clerk to' call the roll.

Section I - Classification
That all persons, firms or corporations supplying natural gas service
to the City of Blair, Nebraska, and the inhabitants thereof, shall provide
two classes of service tò its customers as hereinafter specified and defined:'
1. ' Firm Gas Service

~irm gas service is'defined as gas service that is supplied on a non-
interl~ptible basis. F~rm ga~ service shall be made available to .all
domestic and commercial customers whose ma~imu.m requirements are less
thån 1.000 cubic f~et per hour.
'2. Interruptible Gas Servic~
Interruptible gas service'is defined as gas service that is supplied
on an interruptible basis. It shall be subject to c-urtailment or
'interruption on demand of the gas service company whenever necessary
to proteqt the service of its firm gas customers.
Section II -Maximum Rates
That no person,firm or corporation supplying natural 'gas to the City of
Blair, Nebraska, and the inhabitants thereof, shall, after the effective date
of this ordinance. charge more for such natural gas service than the following
maximum rates: ' ,
