',ORDINANOE NO. 9.62 AN ORDINAlîfCE LEVYING AN OCCUPATION TAX UPON ALL PERSONS DISTRIBUTING NATURAL GAS FOR SALE WITHIN THE 'CITY OF BLAIR, NEBRASKA .AND PROVIDING FOR THE COLLECTION OF SUCH OCCUPATION TAX. . . .' BE IT ORDAINED by the Mayor and Council of: the City of Blair, Nebraska: Section 1. ASSESSMENT. There is hereby assessed an occupation tax against all persons distributing natural gas for sale in an amount equal to two percent of the gross rece:i,.pts derived from the business of distributing and selling natural gas within theèity Df Blair, Nebraska, exclusive of such salss ~o governm~ntal agencies, departments or other bodies whether_thèy be Federal, State, or Local. SURPLUS ACOOUNT - After providing tor the Operation and Maintenance Account and the Bond account as above provided the surplus funds shall be set aside in a Surplus Acéount to be used for the extension or enlargement of the water works plant and water system or prepayment of the bonds issued under this ordinance. Alleast fifteen days before such payment of principal or interest become due on any of the said bonds, the City will deposit with the county Treasurer of Washington County, Nebraska, an amount of money sufficient to pay the interest and principal of the bonds which will become due on such payment date, such payments to be made ,out of the Bond Account. The City will maintain the water works plant and water system,' including extensions and improvements, in good condition and RPerate the same in an efficient manner and at a reasonable cost. Such insurance shall include, but not necessarily belimited to. workmen's compensation, public liability, fire, windstorm and comprehensive coverage. In event of any loss or damage to the water owrks plant or water system the proceeds which may be collected or paid on any policy or policies coverning the same shall be used by the City to retire the bonds issued under this ordinance then outstanding or to'rehabilitate said water works plant' and water system.' Section 12. While any bonds issued hereunder are outstanding, t~e City will render bills to all customers for water service. If said bills are not paid within ten (10) days after due water service will be discontinued. Section 1:3. The City wil} keep proper books, records and accounts separate from all other records and accounts in which complete and correct entries will be made of all transactionsIelating to said water works plant and water system. Said books ofacéount ~hall be kept in accordance with the lawa of the State of Nebraska, and not more than thirtY(:30) days after the close of each three months fiscal period the City shall furnish Kirkpatrick Pettis Company, Omaha, Nebraska, a complete separate income statement of such water owrks plant and water system in reasonable detail covering such three months period and not more than sixty (60) days after the close of each fiscal year the City shall furnish KirÍtpâtrick-PetUs Company, Omaha, Nebraska, a complete financial statement of the water works plant and water system in reasonable detail prepared by a certified public accountant covering the operation of said property for such fiscal year. A copy of such year's financial statement and a'll:dit shall be filed with. the City Clerk and shall be a public documentupen to inspection. Section '14. The holder or holders of ten per centum or more, of said bonds or of the coupons representing interest thereon may either at law or in equity by appropriate proceedings in any court of competent jurisdiction enforce any right created or granted by this ordinance or by the bonds issued hereunder, and if the court finds that the appointment of a receiver is necessary to protect the rights of the bondholders, ,the court may appoint such a receiver_to take oyer and operate the property and may fix the terms and conditions on which the same shall be operated until the default is made good. , ' Section 15. The provisions of this ordinance shall constitute an irrevocable contract between the City of Blair and the holders of the bonds issued hereiUlder and after the issuance of said bonds no change or alteration of any kind in the proviaions of this ordinance shall be made without the ,written consent of the holders of seventy-five per centum(75~) in principal amount of the bonds then outstanding. Section 16. The City Treasurer and the City Clerk shall be bonded, in addition to their official bonds, by an insurance company licensed to do business in Nebraska in amounts' sUffiCient to cover at all times all the revenues and earnings of said water works plant and water system in théir hands. Any other person employed by t~ City in the collection or handling of mQneys derived from the operation ,of said property shall also be bonded in an amount sufficient to cover all moneys which may at any. ti,me be placed in his hands. The amount of such bonds shall be fixed by the Council, and the cost thereof shall be "paid from the earnings of said water works plant and water system, an~ theyst~ll secure the faithful.accounting for all mon~ys. Section 17. The 'City Clerk shall make and certify in duplicate a complete transcript of the proceedings had and ~done by saidOityprecedent to the issuance of said bonds, onEl of which transcripts .shall be filed with the Auditor of Public Accounts of the State of Nebraska, and the other shall be delivered to t1}.e purchaser of the bonds. After being executed by the Mayor and Clerk said bonds shall be deliyeredto the City Treasurer who shall be responsible under his official bond and the Treasurer shall cause said bonds to be transmitted with a certified transcript aforesaid to the Auditor of Public Accounts of the $tate of Nebraska to be registered in said Auditor's office arid ~hall then cause the same to be registered in the office of the Clerk of Washington County, Nebraska. Interruptible Gas Servic~ Interruptible gas service'is defined as gas service that is supplied on an interruptible basis. It shall be subject to c-urtailment or 'interruption on demand of the gas service company whenever necessary to proteqt the service of its firm gas customers.
