COUNCIL MEMBER HALL INTRODUCED THE FOLLOWING ORDINANCE:
AN ORDINANCE CREATING PAVING DISTRICT NO. 202 - 10TH STREET EXTENSION IN
THE CITY OF BLAIR, WASHINGTON COUNTY, NEBRASKA, DESCRIBING SAID
STREET IMPROVEMENT DISTRICT AND IMPROVEMENTS TO BE CONSTRUCTED
THEREIN, AND PROVIDING THAT SPECIAL ASSESSMENTS MAY BE LEVIED IN
PROPORTION TO BENEFITS TO THE PROPERTY IN SAID DISTRICT; AND PROVIDING
FOR PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BLAIR, NEBRASKA:
SECTION 1. Pursuant to Sections 16-617, 16-617.01, 16-618, 16-619 and 16-620, R.R.S.
Neb. 1997, Paving District No. 202 be and the same is hereby created within the City of Blair,
Nebraska, the outer boundaries of which District shall encompass the following -described
properties together with the street described below upon which said properties abut, TO -WIT:
A PARCEL OF LAND LOCATED IN THE NORTHEAST QUARTER AND THE
NORTHWEST QUARTER OF SECTION 13, TOWNSHIP 18 NORTH, RANGE 11 EAST OF
THE SIXTH P.M., WASHINGTON COUNTY,NEBRASKA, BEING DESCRIBED AS
FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF THE SOUTHWEST
QUARTER OF THE NORTHEAST QUARTER OF SAID SECTION 13; THENCE S89°41'46"E
(ASSUMED BEARING) ON THE SOUTH LINE OF SAID SOUTHWEST QUARTER, A
DISTANCE OF 262.12 FEET TO THE POINT OF BEGINNING; THENCE CONTINUING
S89°41'46"E, A DISTANCE OF 63.76 FEET TO A POINT OF CURVATURE; THENCE
NORTHERLY ON A 405.00 FOOT RADIUS CURVE TO THE LEFT, AN ARC DISTANCE
OF 88.70 FEET TO A POINT OF TANGENCY, THE CHORD OF SAID CURVE BEARS
N24°09'51"W, A DISTANCE OF 88.52 FEET; THENCE N30°26'19"W, A DISTANCE OF
413.31 FEET TO A POINT OF CURVATURE; THENCE NORTHERLY ON A 320.00 FOOT
RADIUS CURVE TO THE RIGHT, AN ARC DISTANCE OF 171.68 FEET TO A POINT OF
TANGENCY, THE CHORD OF SAID CURVE BEARS N15°04'07"W, A DISTANCE OF
169.63 FEET; THENCE N00°18'04"E, A DISTANCE OF 690.85 FEET TO A POINT OF
INTERSECTION OF THE SOUTH RIGHT OF WAY LINE OF WILBUR STREET WITH THE
EAST RIGHT OF WAY LINE OF SOUTH TENTH STREET; THENCE N89°48'58"W ON SAID
SOUTH RIGHT OF WAY, A DISTAINCE OF 33.00 FEET TO THE WEST LINE OF SAID
SOUTHWEST QUARTER; THENCE N89°46'58"W ON SAID SOUTH RIGHT OF WAY LINE,
A DISTANCE OF 27.00 FEET; THENCE S00°18'04"W, 690.74 FEET TO A PONT OF
CURVATURE; THENCE SOUTHERLY ON A 380.00 FOOT RADIUS CURVE TO THE LEFT,
AN ARC DISTANCE OF 203.87 FEET TO A POINT OF TANGENCY, THE CHORD OF SAID
CURVE BEARS S15004'07"E, A DISTAINCE OF 201.44 FEET; THENCE S30°26'19"E, A
DISTANCE OF 413.31 FEET TO A POINT OF CURVATURE; THENCE SOUTHERLY ON A
345.00 FOOT RADIUS CURVE TO THE RIGHT, AN ARC DISTANCE OF 55.69 FEET, THE
CHORD OF SAID CURVE BEARS S25048'52"E, A DISTANCE OF 55.63 FEET TO THE
POINT OF BEGINNING, CONTAINING 1.88 ACRES, MORE OR LESS.
Within said District, the street to be improved and improvements to be included are:
10th Street from the current intersection of 10th Street and Wilbur Street Blair, Washington
County, Nebraska.
SECTION 2. The improvements to be constructed in Paving District Number 202 shall
include grading, paving, curbing, guttering, storm sewer and other necessary or incidental
appurtenances to the improvements. Paving will consist of 31 feet wide by 12 inches thick
Portland Cement Concrete.
SECTION 3. All said improvements shall be constructed to the established grades as fixed
by ordinance of said City and shall be constructed in accordance with plans and specifications to
be approved by the City Council. Said improvements in Paving District Number 202 shall be
made at public cost, and the cost of such improvements, excepting street intersections, will be
assessed against the property within said District specially benefited thereby, in proportion to such
benefits.
SECTION 4. That this ordinance shall be known as Ordinance No. 2428 and shall be in
effect from and after its passage, approval, and publication according to law.
