2020-42RESOLUTION 2020-42 COUNCIL MEMBER SHEPARD INTRODUCED THE FOLLOWING RESOLUTION: WHEREAS the City of Blair, Nebraska has been presented with an agreement of indemnity regarding transfer of ownership of trained canine Duke to Travis Lyon; and WHEREAS, the terms and conditions of the Agreement of Indemnity are acceptable to the City of Blair, Nebraska. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA, that the Agreement of Indemnity attached hereto, marked Exhibit "A" and by this reference made a part hereof as though fully set forth herein, which has been presented to the City Council, is hereby accepted and adopted by the City of Blair, Nebraska, COUNCIL MEMBER SHEPARD MOVED THAT THE RESOLUTION BE ADOPTED AS READ, WHICH SAID MOTION WAS SECONDED BY COUNCIL MEMBER JENSEN. UPON ROLL CALL, COUNCIL MEMBERS SHEPARD, STEWART, WILLIS, WOLFF, HALL, ANDERSEN AND JENSEN VOTING "AYE", AND COUNCIL MEMBERS NONE VOTING "NAY", THE MAYOR DECLARED THE FOREGOING RESOLUTION PASSED AND APPROVED THIS 10TH DAY OF NOVEMBER 2020. BRENDA WHEELER, CITY CLERK AGREEMENT OF INDEMNITY REGARDING TRANSFER OF OWNERSHIP OF TRAINED CANINE In consideration of the transfer of ownership of canine, DUKE, hereinafter referred to as the "ANIMAL", from the City of Blair, Nebraska, to the undersigned, the undersigned hereby releases and forever discharges the City of Blair, Nebraska, the Blair Police Department, the Chief of the Blair Police Department, their agents, employees, heirs, and assigns from any and all injury, disability, loss, destruction, or mishap that may occur to be the undersigned, any persons or property in connection with the "ANIMAL". The undersigned accepts full responsibility and furthermore agrees to defend, indemnify and hold harmless the City of Blair, Nebraska, the Blair Police Department, the Chief of the Blair Police Department, and their agents, employees, heirs, and assigns for any injury or damage to any person or property that may occur or be caused by or contributed to be caused by the "ANIMAL" after the transfer of the ownership, which is effective as of the date indicated below. The undersigned is fully aware of the nature of the training the "ANIMAL" received and the nature of the work that the "ANIMAL" was trained to perform during the time of ownership by the City of Blair, Nebraska. Further, the undersigned recipient understands the need to provide the "ANIMAL" with suitable shelter and reasonable surroundings that is consistent with its training and work experience.
