2006-03-14 Fiberoptic to city buildingsContract THIS CONTRACT AND AGREEMENT made and entered into this 14th day of March, 2006 by and between the City of Blair, hereinafter referred to as "Owner", and KRW Construction, Inc., hereinafter referred to as the "Contractor" WITNESSETH: Contractor, for and in consideration of the sum of $24,847.75 payable as set forth in this contract, hereby agrees to perform, in accordance with the specifications, the various items of work awarded said contractor on the 14th day of March, 2006, as follows: As shown in bid submitted on March 6, 2006. That it is mutually understood and agreed by parties hereto that the Contractor's Bond, the proposal Project Specifications, Special Provisions and all supplemental agreements are a part of this contract. The Contractor expressly warrants that they have no third party to solicit or obtain this contract in their behalf or to cause or procure the same to be obtained upon compensation in any way contingent in whole or in part, upon such procurement, and that they has nor paid or promised or agreed to pay to any third person in consideration of such procurement or in compensation for service in connection herewith, any brokerage, commission, or percentage upon the amount to be received by them hereunder, and that they have not, in estimating the contract price determined by them, included any sum by reason of any such brokerage, commission or percentage; and that all monies payable to the Contractor hereunder are free from obligation of any other person for services rendered or supposed to have been rendered in the procurement of this contract. Contractor further agrees that any breach of this warrant shall constitute adequate cause or the annulment of this contract by the Owner, and that the said Owner may retain for its own use, from any sums due or to become due hereunder, an amount equal to any brokerage, commission or percentage so paid or agreed to be paid. All work required in carrying out this contract shall be performed under direct supervision of the Owner or its representative in compliance with the laws of the State of Nebraska. Contractor also states that they will comply with Fair Labor Standards in the performance of this contract. That the Contractor further agrees to supply and pay all just claims for materials, supplies, tools, fuels, lubricants, equipment, rental, machinery insurance premiums and services used or consumed in the construction of the work by them or any of their subcontractors in carrying out the provisions of this contract, and further agrees that the Contractor's Bond shall be held to cover all such claims. That in consideration of the foregoing, the Owner hereby agrees to pay the Contractor promptly the amounts set forth herein subject to the conditions set forth in this contract or any part thereof as herein described. It is further understood and agreed that the Contractor shall not do any work or furnish any materials not covered and authorized by this contract unless ordered in writing by the Owner, Any such work which may be done or any such materials which may be furnished by the Contractor with out such written order first being given shall be at their own risk, cost and expense; and the Contractor hereby convents and agrees that they shall make no claim for compensation for any work so done or any materials so furnished. Wheeler City Clerk President Secretary Specifications for Fiber Optic Cabling for Blair City Hall, Library, Police Department and Washington County Court House The City of Blair is requesting proposals for the purchase and installation of fiber optic cable and conduits to the city's police station, library, city hall and Washington County Court House. Please submit you proposal including materials, labor and equipment on per lineal foot basis. All right-of-way restoration shall be considered incidental to the price listed for each bid item including but not limited to concrete, seed, grading and general cleanup. • Fiber optic cable shall be Multimode 62.5 micron fiber • 12 -strand fiber optic cable with metal sheath for future locating. • Leave a service loop at each of the four locations of 25 LF • Entrance to the Blair Police Station will be on the south wall approx. 30 feet from the southeast corner of the building. Contractor will be required to place conduit on the exterior wall for approx. 3 -feet then penetrate the exterior wall with a core drilled hole. Once through the exterior wall the cable will be bent to the east to the nearest partition wall in conduit then ran inside the partition wall to above the drop ceiling then to the control room leaving a 25 Lineal Foot spool of cable on top of the drop ceiling in the southwest corner of the room. Internal cabling is approx. 43 LF with 5 LF in conduit. • Entrance to the Blair Library will be on the south wall approx. center of the west side of the building into the mechanical room. Contractor will be required to place conduit on the exterior wall for approx. 10 feet then penetrate exterior wall with a core drilled hole. Once through the wall the cable will be ran in conduit on the west wall of the mechanical room to the north wall then up the wall to above the adjacent room drop ceiling then through the block wall and over the drop ceiling to the northeast corner of the director's office leaving a 25 lineal foot spool in this location on top of the drop ceiling. Internal cabling is approx. 42 LF with 16 LF in conduit. • Entrance to the Blair City Hall will be on the west wall to the below grade room below the main room north of the main building entrance. Once through the wall the cable shall be ran along the north wall in conduit to the east wall then up the east wall to above the adjoining room's drop ceiling then through the wall and along the drop ceiling to the copier room south wall leaving a 25 lineal foot spool of cable on the drop ceiling. Internal cabling is approx. 70 LF with 30 LF in conduit. • Entrance to the Washington County Court House is on the north wall of the new annex to the mechanical room below grade then along the floor joist of the upper floor in conduit to the computer room then leave a 35 lineal foot spool of cable on top of the drop ceiling. Internal cabling is approx. 60 LF all in conduit. • All fiber optic cable will be placed in conduits bored into the ground not less than 4 feet below grade. Bidder will need to include with their bid a description on the type and size of conduit they will be using for the project. • Lengths of conduit and fiber optic cable for each run are as follows: (All distances listed are approx. and will be paid on a per lineal foot basis) o Blair Police Department to Blair City Hall: 830 LF o Blair Library to Blair City Hall: 400 LF o Washington County Court House Annex to Blair City Hall: 1020 LF Attached are maps showing the proposed routing and location of the conduits between each building listed. Winning bidder shall show proof of insurance before final contract execution. Bid price for each item shall include all materials, equipment and labor for the work described in the specifications.
