PUD for Transformation HillORDINANCE NO. 2350 COUNCIL MEMBER STEWART INTRODUCED THE FOLLOWING ORDINANCE: AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP FOR THE CITY OF-BLAIR BY ESTABLISHING AN OVERLAY DISTRICT UNDER SECTION 1003 PUD PLANNED -- UNIT DEVELOPMENT DISTRICT OF THE CITY OF-BLAIR ZONING ORDINANCE TO CREATE PUD -1 INTENDED TO ESTABLISH THE LAND USES THAT WILL BE PERMITTED IN PUD AREA #1 ON THE FORMER DANA COLLEGE CAMPUS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, PROVIDING WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT AND PUBLISHING IN PAMPHLET FORM. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF BLAIR, NEBRASKA: SECTION 1. That the Zoning Regulations of the City of Blair were amended by Ordinance 2349 on March 13, 2018 amending Section 1003 PUD Planned Unit Development District allowing for an overlay district to be added to the official zoning map for the City of Blair by a rezoning application for a PUD -1 (General PUD) district to create PUD -1 intended to establish the land uses that will be permitted in PUD Area #1 on the former Dana College Campus. This PUD district, used in combination with the base RM — Residential Medium Density is intended to permit flexibility in the regulation of land development and to encourage innovation in land use and variety in design, layout, and type of structures constructed. A PUD district also requires approved land uses or activities be compatible with adjacent land uses and in accordance with the current Comprehensive Plan. SECTION 2. That Exhibit "A" attached hereto and duly included herein by reference adopts Zoning Map PUD -201801, establishing PUD Area #1 overlay district on the former Dana College Campus. SECTION 3. Be it further ordained by the Mayor and City Council of the City of Blair that the official zoning map of the City of Blair should be changed to reflect the PUD overlay district used in combination with the base RM — Residential Medium Density District as established hereby. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. As a city -initiated application, a detailed development plan is not required. All future projects following this city -initiated PUD -1 (General PUD) will require subsequent approval of specific projects through the normal PUD -1 or PUD -2 submission and approval procedures. Site History: This generalized development plan includes the entire area shown in Exhibit A — Area Map for PUD -1 (General PUD) Planned Unit Development Overlay District. The area is approximately 103.4 acres and is located on the former Dana College campus, north of the UPRR line and west of 27th Street. The Site is currently zoned RM — Residential Medium Density District. Following the closure of Dana College in 2010, numerous potential development concepts have been examined by subsequent owners of the property. For more than seven years, none of these development concepts have proceeded beyond the conceptual stage. In December 2017, the Dana Campus property was donated to Angels Share, Inc. The current owner desires to use the existing structures in a "mixed use" manner similar to how the property has been used previously. Proposed Land Uses: A PUD Overlay District is intended to permit flexibility in the regulation of land development and to encourage innovation in land use and variety in design, layout, and type of structures constructed. A PUD District also requires approved land uses or activities be compatible with adjacent land uses and in accordance with the current Comprehensive Plan. In addition to the Permitted Principal Uses already allowed in the base (parent) zoning district, the following compatible uses shall be permitted as uses by (1) Attached single family dwellings. (2) Two family dwellings. (3) Residential condominiums pursuant to Section 1116 of the City of Blair Zoning Regulations. (4) Multiple family dwellings with forty-eight (48) or fewer living units. (5) Dormitory, Fraternity or Sorority. GENERALIZED DEVELOPMENT PLAN DANA CAMPUS AREA #1 PAGE 2 of 5 (6) Family day care home, not operated within a private dwelling, group day care home, or day care center; (7) Public and quasi -public uses of an educational, recreational or religious type including public and parochial elementary schools, junior high schools; high schools and colleges; churches, nursery schools; private nonprofit schools and colleges; parsonages, and other religious institutions, public parks, public playgrounds; (8) Public uses of an administrative, public service or cultural type including city, county, state or federal administrative centers and courts, libraries, museums, art galleries, police and fire stations and other public buildings, structures, and facilities; (9) Public and private charitable institutions; (10) Private clubs and lodges. (11) Athletic complexes and health centers. (13) Movie production facilities and/or studios; (14) Theaters and concert venues. (15) Professional offices; In addition to the Excepted Uses already allowed in the base (parent) zoning district, the City Council mU permit the following conditional uses as exceptions in accordance with Article 14 of the City of Blair Zoning Regulations: (1) Multiple family dwellings with greater than forty-eight (48) living units; (2) Restaurants, not including drive-in restaurants. (3) Parking lots. (4) Any Principal Permitted Use in the CCB - Central Business District (as specified in Section 802.02), or any Principal Permitted Use in the A/CH — Agricultural/Commercial Highway District (as specified in Section 801.02), when limited to: a) the overall total floor space allotted to all such uses in the structure or building is less than 50% of the entire floor space of the structure or building, and b) the total floor space allotted to any such individual use is not greater than 2,500 square feet. GENERALIZED DEVELOPMENT PLAN DANA CAMPUS AREA #1 PAGE 3 of 5 Other Reasonable Modifications of Existing Zoning Regulations: Subsequent approvals of specific projects through the normal PUD -1 or PUD -2 submission and approval procedures may establish reasonable modifications to minimum yard requirements, maximum lot coverages, maximum heights, and sign regulations. Proposed Transportation Plan: The former Dana College campus currently has three internal sections of private drives, connecting with Hansen Drive, 30th Street, and College Drive. The lack of public road layout and connectivity with adjacent streets isolates the area and presents difficulty for efficient vehicular movement and emergency access. The campus area currently consists of numerous tax lots, and is expected to be platted into subdivision lots for more efficient land use. Newly created lots must front onto public rights of way. The dedication of public right of way along the existing private drives must be part of any platting that occurs. The City of Blair Trails System runs along part of this area. When public streets are extended through this area, or when subdivisions are created, the City should consider extending the Trail System through the area. Proposed Utilities/Infrastructure: Water mains, gas, electric, communication, sanitary sewer mains and storm sewer mains are available adjacent to or near the northern half of the area, with some public mains running through the area already. The southern area of the campus does not have a sanitary sewer line adjacent to that area. In order for public streets and subdivisions to be constructed in the southern half of this area, a sanitary sewer main must be extended to area. The southern area of the campus is bisected by gas mains owned by Northern Natural Gas and Black Hills Energy. The City and utility companies should consider rerouting these gas mains to the safest locations when the area is platted and public streets are constructed.
