PERMANENT EASEMENT
This easement MADE on October 9,
hereinafter referred to as "GRANTOR",
HEREINAFTER REFERRED TO AS "CITY".
2019 between Melvin Sudbeck Homes, Inc.,
and the CITY OF BLAIR, NEBRASKA,
WHEREAS, Grantor owns fee simple title to the real estate described on the attached
Exhibit "A" and as follows:
A parcel of land located in Lots 22 through 24, Northern View Addition to the City of
Blair, a subdivision in Washington County, Nebraska, described as follows:
That part of Lots 22, 23 and 24, Northern View Addition to the City of Blair, a subdivision
in Washington County, Nebraska described as follows: Starting at the commencing point, which
is the NW corner of said Lot 22; Thence S89°46'09" E (assumed bearing) 37.01 feet on the north
line of said Lot 22 to the point of beginning; Thence continuing S89°46'09" E 267.29 feet on the
north lines of said Lots 22, 23, and 24 to the NE corner of said Lot 24; Thence southerly on a
225.00 foot radius curve to the left, chord bearing S02°26'23" E, chord distance 20.02 feet, an arch
distance of 20.03 feet; Thence N89°46'09" E 268.23 feet on a line 20.00 feet south of and parallel
with the north line of said Lots 22, 23 and 24; Thence N00°13'51" E 20.00 feet to the point of
beginning.
WHEREAS, City desires to obtain a permanent easement from Grantor for locating,
establishing and maintaining an underground storm sewer line on the strip of land set forth on
Exhibit "A" attached hereto.
FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, Grantor and
City agree as follows;
1. Grant of Permanent Easement: Grantor does hereby grant, barging, sell and convey
unto City, its successors and assigns, a permanent easement over, under and across that
parcel of real estate described on Exhibit "A", attached hereto and incorporated by this
reference herein.

This easement shall be perpetual in nature and shall run with the land.
City may locate, establish, construct, maintain and keep in repair underground sanitary
sewer line, together with such rights of entry upon, passage over, deposit over, deposit of
excavated earth as may be necessary for the construction, maintenance, and repair of such
sanitary sewer line; furthermore, Grantor agrees not to construct or place any improvements, trees
or other vegetation which may impair or interfere with the. use, operation or maintenance of the
storm sewer pipe.
2. Binding Effect: This easement shall be binding upon and insure to the benefit of the
parties hereto, their heirs, successors and assigns.
