SEOTION I. That the Police Magistrate of the City of, Blalr" Nebraska,
shall receive an annual salary of $100.00 per year, and tbat the same shan
be payable in equal quarterly installments as other olaims aga.1œt s6.id City
from ita general fund and tbat ea1d salary shall be full compensation for all
services rendered by suoh Police Mavzistra.te.

BE IT ORDAINED BY TEE MAYOR AND CITY OOU~TCIL OF THE CITY OF BLAIR" NEBRASKA:
SECTION 1. Unless the context otherwise requires; the words and phrases
her,sin defined are used in this ordinance 1n the s ansa gi van them in the f allow-
ing definitions: (1) The word IlfAlcoholß means t.he product of distillation of any
ferm6ntl~d liquid" wh~th\9r rectified or diluted" whatever mr...y be thfi origin
thereof;J and includes synthetic ethyl alcohol. It does not inol'llde denatured
alcohol or we or). alcohol. (2) The ~ord "Spirit" weans any beverage which (3 ontains
alcohol obtained by distillation" mixed with water or other substance in
solution" and includes brandYJ rum, whiskey gin~ or other spirituous li~ors
and such lif:pOrs when reotified" blended or otherwise mixed wi th alooho1 or other
substances. (3) The word "Wine" In,sane any alocholic beverage obts,ine d by the
fermentation of the natural contents of fruit or vegetables, containing sugar"
including such beverages when fortified by the addition of alcoholic spirits"
as above defined. (4) The ',vord "Beer" meanSEi, beverage obte.:1.ned by alcoholic
fermentation of an infusion or concoction ofbarleY,por other grain" malt and
hopS in water" and inoludes.:ranlong other things, beer" ale, stout;1ager beer,
near beer" porter and the like. (5) The phrase "alcoholic liq~orn inpludes the
four varieties of liqaor above defined" "alcohol" "spirits" "wine" and "beer""
and every li~id or solid" patented,) or not" containing aloohol" spirit" \1W.1ns
or beer" and ca.peble of being consumed as ~ beverage by So h'Ur!!an being. The
provisions of this ordinance shall not apply to alcohol ueed in the manufacture
of denatured alcohol produced in accordance with acts of Congress aLd reg~~tions
promulgated thereunder. Nor shall the provisions of this ordinance apply to
flavoring'extraots" syrups; or medioinal" meohanioal soientifio culinary or
toilet prepar~tionsJ or food products unfit fir beverage purposes" but the
provisions of this ordinance shall not be construed to exclude alcoholic l1q.lor
used in the memufa,oture" preparation or oOï!1pounding of such products. None of
the provisions of this ordinmos shall apply to e,lcoholio liquor used in the
manufaotu1's,¡¡ preparation or compounding of such products. None of the provisions
of this ordinance shall apply to wine intended. for use and used by any ohmch or
religious organization for s aoramenta.1 purl)OSes. (6) The phrase "original
f,ackage"meane any bottle" flask; j1J.g" can, oask; barrel" keg" hogshead or other
reoept&ole or container" whatsoever, used" corked or capped" sealed and labeled
by the manufacturer of alooholio liquor" to contain and to convey any alcoholic
liq:.¡or. (7) The word ßma.nufaoturer n meane every brewer, f erroent er, distiller,
reotifier" wine maker" blender, processor, bottler or person who fills or refills
an original package and others engaged in brewing" fermenting" distilling,
rectifying or bottling alcoholic li~ors as above defined. (g) The words "non-
beverage user If means every manufacturer of any of the pr 0 d'\.'l ot S set forth and
desc~1bed in sub-aeotion (ã) of Section 50 of The Nebraska Liquor Cont~ol Act,
when the same contains aloohol" and all laborat ores and hespi tale and sanatoria
using alcohol tor non-beverage purposes. (9) The word. Dma.nufaoturaD means to
distill.ll rectify~ ferment" b~ew" maks" mix" conooot" prooess" blend" bottle or
fill an original package wi th any alcoholic liqy.or" and includes blending but
does not include the mi:<ingor other preparation of dri,nks for serving by those
persons authoriZed and permitted in this ordinance to serve drinks for consumption
on the premises . where sold. (10) The word "distribut.or" means the pe"rson" es
hereinafter defined; importing or causing to be imported into the state" or
purchasing or causing to be purchased wi thin the state" alcoholic liquors for
sale or resale to retailers licensed under Nebraska Liq¡or Control Act. (11) The
word "person" includes any natural person" oorporation" partnership or
association. (12) The word. "retailer" means a person who sells I or offers for
sale,p alcoholic liquors for use and consumption and not f or resale in any form.
(13) DSell at retail" and "sale at retail" refer to and mean sales foruae or
consumption and not for resale in any form. (14-) The word DooIDmisai on" means
the Nebraska. Liquor Control Commission. (15) The word "sale" means any transfer"
exchange or barter in any manner or by means whatsoever fora co:nsideration~
and. includes and means all e ales me.de by any person~ whether principal"
proprietor" agent" servant or employee. (16) The word "to sell" includes to
solicit or receive an order for" to keep or expose for sale -and to keep with
intent to aell. (17) The word "reataurantB means any public place kept.. used"
llls.intained" advertised and held out to the public as a place where meals are
served;¡ and where meals are actually and regularly served~ without sleeping
accomodations" such space being provided wi thadeçp.ate and sanitary ki tohen and
dining room equipment and capacity and having employed therein a sufficient
number and kind of employees to prepare" cook and serve suitable food for its
guests..
SECTION 2. It shall be unlawful for any :r;erson to manufacture for sale"
aell.. keep f or sale or to barter" - or exchange" under any pretext" any alcoholic
liquor within said city unless said person shall have in full force and effect a.
license therefore as provldèd by the Nebraska Li~1.or Control Act.
SECTION 3. (a) No pèrson shall; within such c1 ty" sell or give anyaloohõlic
liquors - to". or procure anysuoh liquor for, or permi t the sale or gift of any
such liquor to~ or the procuring of any such li~or for" any minor or any person
who is mentally incompetent o~ any person who is physically or mentally
incapacitated due to the consumption of such llepors. (b) No minor shall within
such city represènt that he is of age for the purpose of asking for" purchasing
or receiving any alooholio liquors from any person. Any person violating any

misdemeanor and upon conviction thereof shall be punished by fine of not more
than $50.00. .
.SECTION 4-. No person shall within such city sell at retail any alcoholic

election" includi.ng priraary eleotionJ during the hours the polls are o:pen 1n said
city. - No person shall within such city sell at ret.ail any alcoholic liquors,
except beer on the first day of the week commonly called Sunday. It shall be
unlawful for any person to sell aloohO110 liquors" except beer" within such city
on secular days between the hours of nine o'clock P. M.and six o'olook A. M.
SECTIOI~ 5. It shall be unlawful for any person or persons holding a license
or licenses for the sale at retail of beer and of alcoholic liquors other than

premises shall be deemed separate and die inot only when located 'in buildings
which are not adjacent, or when so separa ad by walls or partitions that access

SECTION 6. No person holding a licem!e for the sale at retail of alcoholic
liquors including beer; shall s,ell wi thi~ such oi ty, any such liquors or conduct

p!'ovided with a public entrance at the f1' nt thereof, opening upon a public ,
street and no person holding such lioens shall permit the use of any entrance
other than such front entrance for any pu*poees other than the use thereof by the
licensee, his family or employees, or f oí ingress and egress. bY. other persons

SECTION 7. In pren1i ses wi thin such oJ ty 'l.1.pOn which the sale of any alcoholic
liquor (for consumption on the premises) is licensed (other than restaurants
hotels or clubs) no soreen" blind, ourtai*" partition" article or thing shall be
permi tted in the windoillls or upon the door~ of such premises, and no booth,) screen,
we.ll, partition, or other obstruotion no~ any arrangement of lig1¡ts shall be
permi tted in or about the int erior of suoli licensed preüJises which shall prevent
a full and olear view of the entire interior of such premises from the streets"
road or sidewalks adjacent thereto, anda~l roOms where alcoholic li~uors are sold
shall be continuously well lighted during busi:œss hours by natural or artificial
light. t
SECIJION 8. It shall be unlawful for y person to consume alcoholic liquors
within such oi ty in the public streets; a leys, roads or highways or upon property
owned by the state or any governmental su1)divlsi On thereof" or inside vehicles
while upon the public streets" alleys:> roads or highways" in theaters, dance

retail; provided that nothing herein oont~ned shall be construed to prohibit
persons purchasing beer upon premises witHin which beer is lawfully sold for
consumption on the premises from drinking lauch beer on such premises.
SECTION 9. It shall be unlawful for ~ny person to have in his possession
wi thin such city f or sale at retail any a~ooholio liquors contained in bottles"
casks or other containers except the orig~nal package.

SECTION 10. Every licensee under the ¡Nebraska Liquor Control Act within such
oityshall cause his license or licenses 'tIo be framed and hung in plain public
view in a conspicuous place on the licens1d premises.
SECTION 11. No non-beverage user shaJJ1 wi thin such city s ell give away or
otherwise dispose of any alcohol purohas~d under a lioenseas such non-beverage
user; in any form fit for beverage purposds.
SECTIO1J 12" It sha.ll' be unlawful for lany person to dxive ~ any motor vehicle,
on the streets of such oi ty while under t~e inf'1u~noe of alcoholic liq,uor. Any
person found guilty of such offense; in a dition to the general. penalty provided
hereaft'81" for the violation (¡If the provie ons hereof, shal~ be adjudged and
ordered by the court not to drive a motor ¡VehiCle wi thin the s tate of Nebraska

SECTION 19. That all police officers of the City of Blair are hereby ~uthorized
to enter at any time upon any !Æ6miees of any licensee under the Nebraska. Liquœ
Control Act within seJ.d 'city to determine w'hether any of the provisions of such
Act or of this ordinance, or any rules or regulations adopted by such 01 ty or by
~!ebr~ska. Li~or Cont;rol Comwiesion have been or, ä.r'e being violated and at such
tiws to examine sufficiently sw.d premises of said lic6nese in connection therewith.
SECTION 20. OCCUPATION TAX. F9r the ,pvxþose of raising revenue within said
cit~r there is hereby levied upon the following described business conducted in said

SECTION 1. All persons not having v1sibls,means of
support and maintenance and who live without employment" and SolI persons
wandering abroad emd living in sheds, barns or in open air, and not giving
good aCcount of themselves, and all parsons wandering abo~t and begging, or
who go from door to door" or f::Onl place to place, or occupy public places for the
purpose of beggj.ng and rece1vingalms" shall be deems d and are hereby declared
to be vagTants, and the act of being ~ vagrant as herein defined shall be
deemed and is hereby declared to be vagrancy.
SECTION 2. Any person guilty of vagrancy s~all be deemed
guilty of a misdes.meanor and upon conviction thereof shall be fined in 6.ny sum
not exceeding fifty'dollars or imprisoned in the City Jail not exceeding three
months, and be subject to hard labor in said jailor elsewhere in the City
as the court may order" and shall stand committed to said jail until such fine
and the CO3ts of prosecution are paid, provided, any person so convicte.d who.
shall be disqualified for manual labor by physical disability, and shall be a
proper object f or relief" shall be sent to 'the a.lmshouse of the proper oi ty or
county, or otherwise oared for, according to law.

AN ORDINANCE, Amending and Repealing Section 4 of Ordinance No. 518 of the City
of Blair. Nebraska, Providing Rules and Regt1Jt:Ltions for the Sale
of Alcoholic Liquors and Providing When same may be Sold in said
Oi ty, and Prescribing when this Ordinance shall be in full Force
and Effect. . '
ORDINANCE NO. 522.
BE IT ORDAINED, BY THE MAYOR Am> CITY COUNOIL OF mE CITY OF BLArR, NEBRASKA:
SECTION 1. That Section 4 of Ordinance No. '518 of-the City of
Blair, Nebraska, be and the same is amended to read as follows:
SEOTION 4. No person shall within such City sEŒl&t retail any
alcoholic liquor, including beer, on the day of any national, state, county,
or municipal election, including primaryelectioDS, duri~ the hours the
polls are open in said City. No person shall within such City sell at
retail any alcoholic liquor, excep~ beer, on the first day of the week,
commonly called Sunday. It shall be unlawful for any perEO'n to sell any
alcoholic liquor, except beer, within such City on secular days between the
hours of twelve o'clock, midnight and six o!clock, a. m. /
SECTION 2. That said original Section 4 of Ordinan'ce No. 518 be
and the s~me is hereby repealed.
SEOTION 3. That this ordinance shall be in force and take effect
from and after its passage, approval and publication, as pro~ded by law.
