PERMANENT EASEMENT
This easement MADE ON 12/! 91l '� between Eriksen Construction., hereinafter
referred to as "GRANTOR", and the CITY OF BLAIR, NEBRASKA, hereinafter referred to as
"CITY".
WHEREAS, Grantor owns fee simple title to the real estate described on the attached
Exhibit "A" and as follows:
A parcel of land located in Lots 12 - 16, Transformation Hill Subdivision to the City of
Blair, Washington County, Nebraska, being more particularly described as follows:
The north 15 feet of Lots 12 — 16, Transformation Hill Subdivision to the City of Blair,
Washington County, Nebraska.
WHEREAS, City desires to obtain a permanent easement from Grantor for locating,
establishing and maintaining an underground storm sewer line on the strip of land set forth on
Exhibit "A" attached hereto.
FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, Grantor and
City agree as follows:
1. Grant of Permanent Easement: Grantor does hereby grant, barging, sell and convey
unto City, its successors and assigns, a permanent easement over, under and across
that parcel of real estate described on Exhibit "A", attached hereto and incorporated
by this reference herein.
This easement shall be perpetual in nature and shall run with the land.
City may locate, establish, construct, maintain and keep in repair underground sanitary
sewer pipe, together with such rights of entry upon, passage over, deposit over, deposit of
excavated earth as may be necessary for the construction, maintenance, and repair of such
sanitary sewer line; furthermore, Grantor agrees not to construct or place any improvements, trees
or other vegetation which may impair or interfere with the use, operation or maintenance of the
sanitary sewer pipe.
2. Binding Effect: This easement shall be binding upon and insure to the benefit of the
parties hereto, their heirs, successors and assigns.
