2000-08-24BOARD OF ADJUSTMENT
Meeting of August 24, 2000
Chairman Doug Cook called the Blair Board of Adjustment to order at 12:14 p.m.
Members present were Doug Cook, Dave Bohling, Bernie Kros and Randy Lock. Members
absent: Paul Buckingham and Jeff Bryan. Others present were City Attorney Samson, City
Administrator Storm and Assistant Administrator Hiller.
Motion by Kros, second by Bohling to approve the minutes of the June 22, 2000,
meeting as presented to members. All members present voted Aye. Chairman Cook
declared the motion carried.
City Attorney Samson explained to the applicants that with only (4) members of the
Board of Adjustment present, they could take action on their requests as (4) members make
a legal quorum. He noted however, that (1) negative vote would cause their request to fail.
He stated it was the applicant's decision to proceed or table their request until a full board
was present. Discussion was also held regarding the matter of requesting the Planning
Commission and City Council to reconsider the side yard setback of 50' in the AGG district
as several requests have appeared before the Board for this reason. Discussion was held
with the applicants regarding their options prior to the Board taking any action.
Motion by Kros, second by Lock to request the Planning Commission and City
Council, at their October meetings, reconsider the 50' setback in the AGG District. All
Board members present voted Aye. Chairman Cook declared the motion carried.
Motion by Bohling, second by Lock that the application submitted by Richard and
Laura Ronning, 10748 Co. Rd. 29, Blair, for a variance to reduce the side yard setback
from 50 feet to 33 feet to legitimize an existing above ground pool and deck on Tax Lot 21
in Section 15, Township 18, Range 11, Washington County, Nebraska and the application
submitted by Michael and Jackie Clegg, 13770 Co. Rd. 22, Blair, for a variance to reduce
the side yard setback from 50 feet to 30 feet for construction of a 26' x 24' detached garage
on Tax Lot 43 in Section 15, Township 18, Range 11', Washington County, Nebraska be
tabled until October 19, 2000 to allow for the Planning Commission and City Council to
consider the 50' side yard setback in the AGG District.
There were no communications from the floor.
