2000-04-26Meeting of April 26, 2000 The Blair Board of Adjustment was called to order at 12:00 Noon by Chairman Doug Cook. Members present were Doug Cook, Dave Bohling, Jeff Bryan, Bernie Kros, Paul Buckingham and Randy Lock. Others present were City Attorney Samson, City Administrator Storm and Assistant Administrator Hiller. City Administrator Storm reviewed the board's responsibility when reviewing a variance request. He also reviewed the voting procedure, the responsibility of the alternate member and noted it would take four (4) votes to pass the variance. Storm introduced Assistant Administrator Sue Hiller and the two newly appointed Board Members, Jeff Bryan and Bernie Kros. Motion by Bohling, second by Buckingham to approve the minutes of the July 15, 2000, meeting as presented to members. All members present voted Aye. Chairman Cook declared the motion carried. Roger and Donna Andreasen addressed the Board with information regarding the reasons for their request. Mr. Andreasen reviewed the history of the property; the timeframe of permits pertaining to construction of buildings and homes on the property and ownership of the property through the years. He indicated the reason for the variance was to decrease the rear yard and side yard setbacks so that he would be able to apply for an Administrative Lot Line Adjustment which would attach this building site area to the lot his home currently exists on. He planned to deed the remaining property to his son. This building site was used to operate his seed business and did not want to lose this area should something happen to his son's property. Discussion was held regarding current setback requirements, zoning requirements for lot splits, requirements for Administrator Lot Line Adjustment, definition of a hardship, and other legal options Mr. Andreasen had available to resolve this problem. Attorney Samson reviewed the definition of a hardship and requirements outlined by State Statue in granting a variance. Attorney Samson also outlined several options Mr. Andreasen could obtain that would not require the Board of Adjustment to grant the variances. Motion by Bohling, second by Cook to deny the variance request as submitted by Roger H. Andreasen, 9923 Co. Rd. P35, Blair for a 46'5" variance to the rear yard setback and a 12' variance to the side yard to allow for an Administrative Lot Line Adjustment between Tax Lot 30 and Tax Lot 21 in Section 24, Township 18, Range 11, Washington County, Nebraska. Board members present voting Aye: Bohling, Cook and Buckingham. Board members voting Nay: Bryan and Lock. Chairman Cook declared the motion carried. There were no communications from the floor.
