1990-05-02Minutes Of The May 2, 1990 Board of Adjustment Meeting
The Blair City Board of Adjustment met at 12 noon on WEdnesday,
May 2, 1990 at the Blair City Hall.
Present for the meeting were: Jim Martin, Margaret Beck, Ken
Rhoades and Mark Kettlekamp.
Minutes of the previous meeting were accepted but not read
at the meeting.
An application for a variance permit, from John Wolsmann Jr.
was presented for a hog complex on his farm southwest of Blair.
Mr. and Mrs. Russell Larson spoke on the subject and felt
the confinement building should be on the west side of
the hill and then it would be the necessary distance from
other residences. Bob Holderness spoke and said that the
run-off is now going directly into the creek.
Mr. Wolsmann was not present to answer questions about the runoff.
City Attorney Nelson said there had to be proper control of
run-off if the application for a '300 variance could be allowed.
Kettlekamp made motion to table the application, Beck
seconded. All present voted "aye".
Next item of business considered was an application for variance
permit from Michael and Marilynne Rouse to have a 10' variance
on setback along Pinecrest Drive for the purpose of building a
new house. Mr. Rouse showed a map of the area where house is
to be constructed. He noted that hardship would be created if
the variance was not approved.,
Beck Made motion to grant the variance, Kettlekamp seconded. All
present voted "aye".
Next item of business was an application for a variance permit
by Homer Nielsen to have a 2 foot variance on the side yard set-
back to build a garage. Contractor Bill Hardy spoke on the sub
ject as did Mr.Nielsen. Foundation would be 7 foot from lot
line and rain trough would be 4'6" from line.
Rhoades made motion for approval of the variance and Beck
seconded. All present voted "aye".
Discussion wa sheld to hold a regular meeting on a designated
Thursday each month. No motion the 'sc to made.

PROTEST
The undersigned reside in the area surrounding the real
estate of John Wolsmann, Jr., on which an application for a
special use permit and an application for a variance from the
provisions of the City of Blair Zoning Regulations, is currently
pending.
The undersigned oppose the special use permit and the
application for variance for the following reasons:
1. The proposed site of the feed lot is located within
1,000 feet of existing residential structures contrary to Section
501.05(3) of the City of Blair Zoning Regulations.
2. There are no unique circumstances or conditions
affecting the property and, on the contrary, the Applicant has
other sites on his property on which to place the feed lot which
would not be within 1,000 feet of an existing residential
structure.
3. The variance is not necessary for the reasonable and
acceptable development of the property in question.
4. Granting of the variance will be detrimental to the
public welfare and injurious to adjacent property; and
furthermore the proposed site of the feed lot will be in close
proximity to a natural waterway.
5. The strict application of the Zoning Regulations
will not constitute an unnecessary hardship upon the Applicant
for the reason that alternative sites are available to him.
