Mitigation PlanMemorandum October 20, 2011 To: Mayor & City Council Members From: Al Schoemaker RE: Engineering Agreement for Disasters 4013 & 1924 Attached is a proposed agreement with HDR Engineering to provide engineering services as needed to assist the city of Blair in their recovery and restoration of damages sustained from Disasters 4013 & 1924. Disaster 4013 is the 2011 Flooding and Disaster 1924 is the 20101 Flooding. There will be multiple tasks that this agreement will cover including the cleanup of the temporary flood prevention devices from this past year, repairs of the culverts from 2010 flooding, the replacement of Fairview Drive, the repairs to Optimists Park and Boat Ramp and permanent work such as putting in permanent levees to protect the water and wastewater treatment plants and possibly elevate Fairview Drive. Each task will need to have a scope and fee negotiated and then once approved by the city the work will begin. All work will be coordinated with the Federal Emergency Management Agency, Nebraska Emergency Management Agency, Nebraska Department of Environmental Quality, Corp of Engineers and the Nebraska Health and Human Services. One suggestion the staff has is to allow the mayor to approve of the tasks as they are negotiated and allow the engineers and city staff to move forward as quickly as possible to get the necessary approvals from state and federal officials to get the work moving forward as quickly as possible. This would mean the individual tasks would not be brought back to the city council for their approvals but rather have the mayor signoff on them if he was satisfied with the costs. Chris Koenig, HDR, Agenda Item #12 — City Administrator Storm reported on the water main project, Dana Trail, flood projects Staff is working with FEMA to complete cost summaries, Street Crews working on tarring and crack sealing, and Police Committee is reviewing problems with trash at the Youth Sports Complex from youth that congregate there and will have a recommendation to the City Council at a later date and noted the County has placed approximately $10 million in valuation on the Dana Campus which will affect the city if the property is purchased by a non -taxed entity. The actual document is about 2 inches thick. With the flooding of 2011 and subsequent federal disaster and claims submitted makes our city eligible for mitigation funding to provide permanent improvements to protect our facilitates from future damages from flooding. This application makes a request for four items. First to construct a permanent flood protection berm around the entire water and waste water treatment plants. Second to construct a new pump station to allow for the pumping of storm water and effluent from both treatment plants in the time of flooding when the gravity flow will not work. This would eliminate the need for all of the pumps we had on site last summer. Third elevate Fairview Drive from Marina Drive intersection to the west property line of the water treatment plant and the reconstruction of Fairview Drive to current standards for a local road in an industrial area. Fourth; to provide backup power generation for the water treatment plant, waste water treatment plant, the new pump station and the intake structure. There will be three generators to fulfill this accomplishment. The waste water treatment plant currently has a backup generator but it was installed at the time the plant was constructed some thirty plus years ago and it does not have capacity to run all of the components on site. The cost estimate for all of this work is just under $6.7 million. Through the application we are requesting 75% (maximum) funding from FEMA leaving the remaining 25% for local match or roughly $1.7 million. I have already submitted a letter to the Papio Missouri River Natural Resources District requesting help with the local matching funds which they are currently reviewing. I would anticipate some kind of an answer from the PMRNRD this fall on this request. I would not expect to have them contribute on all of the different items we currently have outlined in our application such as Fairview Drive and the backup power but I would anticipate they will provide some kind of assistance on the flood control devices and the pump station. Further I have notified Cargill verbally the city would want to look to them to provide some assistance for the local matching funds for the backup generators. At this time they have taken it under advisement but again I have not sent them anything formally making a request for funding assistance but plan to in the near future. The applications are due by August 1st and we would hopefully have a response from FEMA on our application either this fall or next winter. The proposed project includes the elevation of Fairview Drive, the construction of a permanent earthen berm around the WTP and WWTP, the construction of a pump system to remove any water inside the berm, and the installation of a generator to provide back-up power for both facilities. Federal funds will be released to the State in the amount of $264,960 for the development of preliminary engineering and design to determine project eligibility. The non- federal match requirement of $88,320 will be provided through local funding. No construction is approved at this time. This project impacts Waters of the United States (WOUS) and may require an individual permit under Section 404 of the Clean Water Act (CWA). Prior to Phase II, the subgrantee should either submit a USACE Section 404 CWA Permit, or provide a strategy for CWA compliance. In addition, this project appears to meet the FEMA definition of "Critical Action" as defined in 44 CFR § 9.4. If so, the current level of protection (100 -year flood protection) is insufficient for FEMA to meet Executive Order 11988, Floodplain Management obligations. For "Critical Action" projects to be eligible, the level of protection should be designed to meet 500 -year level of protection. The Phase I Design needs to address this deficiency. The activity completion timeframe for Phase I of this project is seven months from the date of this letter. Upon submission of the Phase I deliverables, FEMA will determine whether the proposed project is technically feasible, cost effective, and compliant with Environmental and Historic Preservation requirements. FEMA will render a Phase II determination upon completion of this review. If, however, the project is not approvable by FEMA, the project will end at that point and Grantee/Sub-grantee will be awarded its share of incurred costs. Any costs incurred prior to the date of this approval will be disallowed. A change to the approved scope of work (SOW) requires prior approval from FEMA. The National Environmental Policy Act (NEPA) stipulates that additions or amendments to a HMGP sub -grantee SOW shall be reviewed by all state and federal agencies participating in the NEPA process. NEPA approval for all SOW additions or amendments is essential before the revised SOW can be approved by FEMA or implemented by the HMGP sub -grantee.
