Whereas: City of Blair and Felsburg Holt & Ullevig, have previously executed a Preliminary
Design Engineering Services Agreement (BK 1523) for the Blair South Bypass Project for which
the Local Public Agency (LPA) would like to obtain Federal Funds;
Whereas: City of Blair understands that it must continue to strictly follow all Federal, State and
local laws, rules, regulations, policies and guidelines applicable to the funding of this Federal -aid
project; and
Whereas: City of Blair and Felsburg Holt & Ullevig, wish to enter into a Preliminary engineering
services supplemental agreement setting out modifications and/or additional duties and/or services
funding responsibilities for the Federal -aid project.
Be It Resolved: by the City Council of the City of Blair, Nebraska that:
James Realph, Mayor of the City of Blair, Nebraska is hereby authorized to sign the attached
Preliminary Design Engineering Services Supplemental Agreement Number 1 between the City
of Blair and Felsburg Holt & Ullevig.
City of Blair is committed to providing local funds for the project as required by the Project
Program Agreement and any Supplemental Project Program Agreements.

THIS SUPPLEMENTAL AGREEMENT is between the City of Blair ("LPA") and Felsburg
Holt & Ullevig ("Consultant"), collectively referred to as the "Parties".
WHEREAS, Consultant and LPA entered into an agreement ("Original Agreement")
BK1523 for Consultant to provide Preliminary Design and NEPA for LPA's Federal Aid project,
and
WHEREAS, it is necessary that additional engineering and environmental services be
added under this Supplemental Agreement, and
WHEREAS, it is necessary to increase Consultant's compensation by this Supplemental
Agreement for the additional work necessary to complete the project.
WHEREAS, it is the desire of LPA that the project be constructed under the designation
of Project No. STP -DPS -3854(1), as evidenced by the Resolution of LPA, attached as EXHIBIT
"A" and incorporated herein by this reference, and
NOW THEREFORE, in consideration of these facts and mutual promises, the Parties
agree as follows:
SECTION 1. SCOPE OF SERVICES
Consultant will perform the additional work as set out in in Exhibit "B" Consultant Work
Order 1, attached and incorporated herein by this reference.
SECTION 2. NOTICE TO PROCEED AND COMPLETION SCHEDULE
The LPA issued Consultant a written Notice -to -Proceed on December 12, 2016. Any
work or services performed by Consultant on the project prior to the date specified in the written
Notice -to -Proceed is not eligible for reimbursement.
Consultant will complete all work stipulated in the Original Agreement and this
Supplemental Agreement by June 30, 2018.
SECTION 3. FEES AND PAYMENTS
For the work required, SECTION 9 FEES AND PAYMENTS of the Original Agreement is
hereby amended in accordance with Exhibit "B" so that the fixed -fee -for-profit is increased from
$46,378.72 to $52,399.02, an increase of $6,020.30. Actual costs are increased from
$420,121.28 to $467,300.98, an increase of $47,179.70. The total agreement amount is
increased from $466,500.00 to $519,700.00, an increase of $53,200.00 which Consultant must
not exceed without the prior written approval of LPA.

SECTION 4. ENTIRE AGREEMENT
The Original Agreement, any and all other previous supplements thereto, and this
Supplemental Agreement, constitute the entire agreement ("The Agreement') between the
Parties. The Agreement supersedes any and all other previous communications,
representations, or other understandings, either oral or written; all terms and conditions of the
Original Agreement and all previous supplements thereto, to the extent not superseded, remain
in full force and effect, and are incorporated herein as if set forth in their entirety.
SECTION 5. CONSULTANT CERTIFICATION AND REAFFIRMATION
The undersigned duly authorized representative of Consultant, by signing this
Supplemental Agreement, hereby reaffirms, under penalty of law, the truth of the certifications
set out in the Original Agreement and all Supplements thereto, including this Supplement.
Further, Consultant has a duty to inform LPA of any material changes in the accuracy of all
assertions set out in the Original Agreement and all Supplements thereto.
SECTION 6. CERTIFICATION OF LPA
By signing this Supplemental Agreement, I do hereby certify that, to the best of my
knowledge, Consultant or its representative has not been required, directly or indirectly as an
express or implied condition in connection with obtaining or carrying out this agreement to:
(a) employ or retain, or agree to employ or retain, any firm or person, or
(b) pay or agree to pay to any firm, person, or organization, any fee, contribution,
donation, or consideration of any kind.
1 acknowledge that this certification is to be furnished to the FHWA, upon their request,
in connection with this agreement involving participation of Federal -Aid highway funds and is
subject to applicable LPA and federal laws, both criminal and civil.

SUPPLEMENT NO. 1
INTRODUCTION
This Supplemental Scope of Services consists of providing additional engineering and
environmental services related to the completion of the preliminary design and
compliance with the National Environmental Policy Act (NEPA) for the Blair South
Bypass project. This Supplemental Scope of Services includes additional work required
that was not previously scoped. At the scoping meeting with FHWA and NDOR, several
tasks were identified that would need to be included or expanded upon in the Scope of
Services. The original scope identified some data and information from previous
studies that could be used for this project. However, upon review, the Consultant has
found that several previously prepared studies were either out of date or no longer valid
and require additional work to update and/or validated. A more detailed description of
anticipated tasks is provided in the following sections. The task numbers identified are
consistent with the tasks identified in the original agreement for more convenient
reference.
DESCRIPTION OF TASKS
1. Project Management and Coordination
This task includes activities to initiate and monitor project schedules, workload
assignments and internal cost controls throughout this phase of the project. Because
the project schedule is extended 19 months beyond the original completion date
submitted in the original contract, included are efforts to prepare and process 19
additional invoices and prepare 19 additional monthly progress reports required by
NDOR to accompany all invoices; prepare project correspondence for an additional
period of 19 months with the City of Blair; and maintain project records.
3. Meetings
3.2 Progress Meetings
The number of meetings will be increased from 6 meetings identified in the
Original Scope to 19 meetings to allow the Consultant to attend monthly
meetings with the City of Blair, NDOR and FHWA. These meetings will be held
in Omaha and will be during the normal MAPA Projects monthly meetings. This
includes preparation of agendas, meeting materials and meeting minutes
distributed to attendees.
6. Public Involvement
Section 6.6 was stricken out of the original Scope of Services. This has been requested
to be added back in.
6.6 Investigation and Respond to Public Comments
Investigation and responses to the assembled public comments received at the
public meetings will be completed by the Consultant and provided to the City for
distribution. Thirty (30) comments requiring written responses are anticipated for
each public meeting, of which five (5) will require significant response effort.
Responses will be submitted to NDOR Environmental and Communications for
review and revisions made, if necessary, prior to distribution. If additional
responses are needed, they will be addressed with a supplemental agreement.
8. Preliminary Design/Alternatives Refinement and Evaluation
Additional analysis and documentation was requested to support the Alternatives
Analysis. The Original Scope of Services was based on an existing, generally

approved, Purpose and Need (P&N). When that P&N could not be found, tasks that
were omitted from the initial Scope to Develop the P&N, need to be added back in,
including new mapping and figures, submittal of drafts, revisions, resubmittals, meetings
and consultations. NDOR provided old FHWA comments on the P&N section of the
previous DEIS to the Consultant in March 2016, which previously could not be located.
In addition, the previous Alternatives Analysis was evaluated and determined by NDOR
and the Consultant to be out of date and any information used from it would need to be
reviewed and either updated or validated. New traffic analysis along Washington Street
would be required to verify the results.
For the Alternatives Refinement described in the original scope Tasks 8.1 through 8.4,
the Consultant was to evaluate 3 alternative concepts for horizontal alignment, typical
section, and initial screening. Once these concepts were screened and a "preferred
alternative" was selected, 17 additional tasks (8.5 through 8.21) were to be completed.
Included in these were Task 8.19 traffic data collection and task 8.20 traffic analysis.
Historic daily traffic volume data and growth rates as reported in the Traffic Data Update
dated March 2014 prepared by previous consultant preparing the DEIS, daily and peak
hour traffic counts as provided by NDOR and the City of Blair were to be used. Upon
investigation, the Consultant determined that growth projections from the previous study
outpaced historic growth in Blair. Also a new City of Blair Comprehensive Plan (as
adopted October 13, 2015) will be utilized to develop future traffic volumes on the study
area roadways.
In order to accomplish the review of alternatives required by the NEPA process, the
traffic data needs to be evaluated using the appropriate growth projections, the tasks
identified below are in addition to the original scope.
8.19 Traffic Volume Data Collection
The initial Scope of Services included compiling traffic data at three intersections,
US -75 & proposed bypass, US -30 & proposed bypass, and the proposed bypass
with County Road P35. FHU will need to request and compile additional traffic
data (including crash data) at additional intersections to prepare traffic analysis
for the Environmental Documentation. The additional intersections are as
follows:
• US Highway 30 with Washington Street
• 161h Street with Washington Street
• US 75 Highway with Washington Street
• US Highway 30 with Nebraska Highway 133
No new traffic counts are needed as part of this supplement. The Consultant will
utilize historic traffic volume data and growth rates as reported in the Traffic Data
Update dated March 2014 prepared by Benesch (consultant the prepared the
DEIS), daily and peak hour traffic counts as provided by NDOR and the City of
Blair, and growth projections from the City of Blair Comprehensive Plan (as
adopted October 13, 2015) to develop new growth rates to determine future
traffic volumes on the study area roadways. The Benesch report focused
specifically on truck traffic diversion for daily traffic volumes. Daily total traffic
diversion and peak hour level of service at intersections was not analyzed by
Benesch. The report discussed the capacity analysis by roadway segment, but
did not provide enough detail regarding the capacity analysis of key intersections.
A spreadsheet model will be used to develop future traffic volumes using
methodologies outlined in NCHRP 255.
8.20 Traffic Analysis
The Consultant will complete the traffic analysis for the additional intersections
discussed in the P&N that were not included in the original Scope. The
Consultant will prepare and conduct the following additional items necessary to
complete the Environmental Documentation.

Upon completion of traffic volume development, a meeting will be held with
NDOR Traffic and the City of Blair. The minutes of the traffic volume
development meeting and any traffic projection iterations will be documented and
included in the traffic study. FHU will not proceed with Level of Service analysis
until NDOR and City of Blair agree upon the 2016 and 2040 traffic volumes, the
measures of effectiveness and performance criteria for traffic analysis (Stop
Milestone).
Develop base year 2016 and design year 2040 traffic volumes for bypass
alignments on roadway segments, up to three (3) total alternatives.
Develop base year 2016 and design year 2040 peak hour traffic volumes
for the following additional intersections:
o US Highway 30 with Washington Street
0 16th Street with Washington Street
o US 75 Highway with Washington Street
o US Highway 30 with Nebraska Highway 133
Peak hour LOS analysis will be conducted at 7 intersections, including 4
additional intersections (compared to the original scope). An emphasis on truck
traffic will be included in this updated analysis, particularly its impacts on capacity
through downtown Blair on Washington Street. As stated above in Section 8.19,
previous traffic studies only evaluated roadway segment LOS analyses and did
not evaluate any peak hour operations at intersections. The LOS analysis will be
conducted for both base year 2016 and design year 2040 conditions.

8.21 Crash Analysis
The Crash Analysis is revised to include the intersection added above in Task
8.19 and 8.20.
9. Environmental Assessment / NEPA Compliance
When preparing the Original Scope of Services, the Consultant was instructed to use as
much as possible of the original Blair Bypass Draft EIS for this project. Therefore, the
hours identified in the Original Scope of Services included performing minor edits to an
existing P&N, assumed to have been written specifically for the South Close segment,
and addressing comments. The Consultant requested a copy of this generally
approved P&N at the kick off meeting, 11 August 2015. That P&N and Alternatives
Analysis however, was not reasonably ascertainable after multiple searches. Therefore
tasks that were omitted from the initial Scope to Develop the P&N, needed to be
completed; including new mapping and figures. During this process of writing a P&N
specific to the south segment the Consultant reviewed existing documentation from the
Draft EIS for use and additional needs for evaluation were identified, particularly with
the traffic data analyses that is needed to support the P&N. Certain previous studies
completed for the Draft EIS were determined to be either out of date or no longer valid.
Therefore, additional submittal of drafts, revisions, resubmittals, meetings and
consultations became necessary.
9.3 Purpose and Need
This Supplement includes hours for the Consultant to recreate a P&N based on
all available materials, including previous versions of the P&N from the DEIS,
minutes from past meetings, email chains, agency review comments, and other
materials from the DEIS (following determination of accuracy or updating). The
first draft P&N was submitted on 29 January 2016. Hours are also included to
revise the document per two rounds of agency comments. Comments received
on 29 February 2016 were incorporated into the document, and the second draft

of the P&N was resubmitted on 22 March. Additional comments received on 31
March were incorporated, and the revised P&N was resubmitted on 6 May 2016.
9.4 Discussion of Alternatives Considered
As mentioned in Task 8 above, additional analysis and documentation was
requested to support the Alternatives Analysis. Again, when preparing the
Original Scope of Services, the Consultant was led to believe that the information
from the original DEIS could be used with minor edits. However, following
review, certain portions of the previous Alternatives Analysis were determined to
be out of date and would need to be reevaluated. While Task 8 above,
addresses the traffic modeling and engineering studies, findings from these
technical evaluations need to be incorporated into the NEPA document in
concise and reader friendly language, that tells a convincing story, and builds a
case for selection of the preferred alternative. This section will require additional
work to include a discussion of the development of alternatives as well as
additional screening of the alternatives to determine how well they meet project
purpose and need. The additional traffic analysis identified in Task 8.20 & 8.21
will be used to prepare these sections of the NEPA document.
9.23 Decision Memo
The Original Scope of Service identified the Consultant preparing the Decision
Memo. This will be done by FHWA. This task will negate the hours identified in
the Original Agreement.

PRELIMINARY ENGINEERING SERVICES AGREEMENT SUPPLEMENTAL
AGREEMENT NUMBER 1— BK1523
COUNCIL MEMBER STEWART INTRODUCED THE FOLLOWING RESOLUTION:
Whereas: City of Blair and Felsburg Holt & Ullevig, have previously executed a Preliminary
Design Engineering Services Agreement (BK 1523) for the Blair South Bypass Project for which
the Local Public Agency (LPA) would like to obtain Federal Funds;
Whereas: City of Blair understands that it must continue to strictly follow all Federal, State and
local laws, rules, regulations, policies and guidelines applicable to the funding of this Federal -aid
project; and
Whereas: City of Blair and Felsburg Holt & Ullevig, wish to enter into a Preliminary engineering
services supplemental agreement setting out modifications and/or additional duties and/or services
funding responsibilities for the Federal -aid project.
Be It Resolved: by the City Council of the City of Blair, Nebraska that:
James Realph, Mayor of the City of Blair, Nebraska is hereby authorized to sign the attached
Preliminary Design Engineering Services Supplemental Agreement Number 1 between the City
of Blair and Felsburg Holt & Ullevig.
City of Blair is committed to providing local funds for the project as required by the Project
Program Agreement and any Supplemental Project Program Agreements.
