NH -75-3(1029) CONTROL NO. 22604 CITY OF BLAIR STATE OF NEBRASKA, DEPARTMENT OF ROADS MUNICIPAL RESURFACING AND REPAIR PROJECT SELECTED HIGHWAYS THIS AGREEMENT is between the City of Blair ("City") and the State of Nebraska, Department of Roads ("State"), collectively referred to as the "Parties." WITNESSETH: WHEREAS, it is the desire of the City and the State to maintain the urban extensions of State Highways in a favorable condition for the general public. Because of increased traffic and general deterioration of the roadway, some of the streets require resurfacing and repair work. It is hereby agreed that the City and State join in resurfacing and repair work on Selected Highways, and WHEREAS, the State for its Fiscal Year 2017 construction program is providing an estimated $2,200,000.00 with the States' responsibility estimated at $1,050,000.00. The State is only responsible for the concrete repair, asphalt overlay, joint and crack repair, and adjustment of utility boxes and manholes for the center 2 lanes of the entire project for various State highways in Blair, and WHEREAS, traffic control, lane striping and pavement marking will be split funded with the City and State's share each being 50%, and WHEREAS, City is responsible for 100% of the cost of any sidewalk repair and ADA requirements and will perform this work with the project or prior to the project, and WHEREAS, the City will pay 100% of all preliminary engineering and construction engineering costs for the entire project and 100% of the construction costs on the two outside lanes, turn lanes, and parking areas, and WHEREAS, the City agrees with the Fiscal Year 2017 construction program for the resurfacing and repair of various State highways in Blair under the designation of Project No. NH -75-3(1029), and that the City Council authorizes the Mayor to sign this agreement, as evidenced by the Resolution of the City Council as shown on Exhibit "A". Project No. NH -75-3(1029) Page 1 of 4 Control No. 22604 City of Blair NOW THEREFORE, in consideration of these facts, the parties hereto agree as follows: SECTION 1. The City agrees to prepare specifications, take bids, award contracts, provide the necessary inspection to insure the performance is within specification requirements and maintain sufficient records to fully document locations and actual costs of work performed. The City further agrees that final inspection of the work shall be by the State and only that work which is deemed satisfactory shall be eligible for payment by the State. The City also agrees that the State's share of the cost of the work shall be limited only to the actual construction cost of accepted work based on the lane responsibilities of the City and the State at the locations described in Section 7 herein. SECTION 2. The State agrees to participate in resurfacing and repair as follows: • US -75 South City Limit to Lincoln Street; repair underlying concrete as needed; Mill 2" of the existing asphalt by Cold Milling, Class 3. Place 2" of Asphalt Concrete, Type SPR (FINE). • US -75 Lincoln Street to US -30 Repair concrete as needed; Joint and Crack Seal. • US-75/US-30 to Park Street; repair concrete as needed; Mill 1" of existing concrete by Concrete Surface Milling. Place 3" of Asphalt Concrete, Type SPR (FINE). • US -75 Park Street to Deerfield Blvd; repair concrete as needed; Mill 1" of existing concrete by Concrete Surface Milling. Place 3" of Asphalt Concrete, Type SPR (FINE). • US -30 - US -75/91 Junction to 18th Street; repair concrete as needed; Mill 1" of existing concrete by Concrete'Surface Milling. Place 3" of Asphalt Concrete, Type SPR (FINE). • US -30 181h Street to US -75 East Junction; repair concrete as needed; Joint and Crack Seal SECTION 3. The City is responsible for 100% of the cost for sidewalk repair and ADA requirements and agrees to perform any sidewalk repair and all of the work required to meet the federal and state standards for the American with Disability Act (ADA) standards at their cost. The City will perform this work with the project or prior to the project being constructed. SECTION 4. The City is responsible for 100% of all preliminary engineering and construction engineering costs for the entire project and 100% of the construction costs on the two outside lanes, turn lanes, and parking areas. The State is only responsible for 100% of the concrete repair, asphalt overlay, joint and crack repair, and adjustment of utility boxes and manholes for the center 2 lanes of the entire project. SECTION 6. The State and City will split 50/50 the cost of traffic control, lane striping and pavement marking. SECTION 7. The specific locations of highways for which resurfacing and repair are authorized are as follows: US -75 South City Limit to Lincoln Street R. P. 113+89 to R. P. 114.92 US -75 Lincoln Street to US -30 R. P. 114+92 to R. P. 114+97 US-75/US-30 to Park Street R. P. 115+46 to R. P. 115+75 US -75 Park Street to Deerfield Blvd R. P. 115+75 to R. P. 116+33 US -30 - US -75/91 Junction to 18th Street R.P. 448+14 to R.P. 448+22 US -30 18th Street to US -75 East Junction R.P. 448+22 to R.P. 448+57 SECTION 8. The total estimated cost for this project is $2,200,000.00 with the States' responsibility estimated at $1,050,000.00. The State is only responsible for the concrete repair, asphalt overlay, joint and crack repair, and adjustment of utility boxes and manholes for the center 2 lanes of the entire project for various State highways in Blair, and 50% of the traffic control, lane striping and pavement marking. SECTION 9. City may submit progress billings to the State no more often than weekly. Upon completion of the work described herein, the City shall provide to the State certification that the work has been performed according to Specifications and shall furnish a summary ar�d supporting pay estimates of actual costs of work performed in the specific areas. These items shall be submitted to the Department of.Roads through the District 2 Office in Omaha. Project No. NH -75-3(1029) Control No. 22604 City of Blair Page 3 of 4 Agreement No. IH1601 The State agrees to make final payment to the City for the actual eligible construction costs within thirty (30) days after inspection and approval of the work by the State's District Engineer and the subsequent receipt of the City's invoice. The final payment of the State's share will be made after the State's cost audit of City records has been made to verify actual costs. SECTION 10. The City agrees to abide by the provisions of the Nebraska Fair Employment Practices Act as provided by Neb. Rev. Stat. §48-1101 through 48-1126. SECTION 11. The City shall maintain all books, documents, papers, accounting records and other evidence pertaining to costs incurred and shall make such material available at its office at all reasonable times during the contract period and for three (3) years from the date of final payment under this agreement; such records to be available for inspection by the State, and copies thereof shall be furnished by the City if requested. SECTION 12. The Mayor is authorized by the City Council to execute this Agreement, as evidenced by the Resolution of City Council, attached as Exhibit "A" and incorporated herein by this reference.
