and that I need the status check for his garage.

Paul Anderson came into Blair City Hall Office on the afternoon of Friday March 3,
2006, and he had a discussion with Brenda Wheeler, City Clerk. The discussion was
about the accessory building (garage) that Paul is building at 1121 Nebraska Street. It is
larger than the existing house on this property, therefore in violation of City code. Paul
did tell Brenda that he would be demolishing this house at 1121 Nebraska Street in the
next year or two. He also told Brenda that he is aware that in order to have the accessory
building (garage), he needs to demolish the existing house at this property and build a
new house to meet city code.

As you are aware, the construction of the accessory building (Building Permit #11587) on the above
property will require you to demolish the existing residential structure and rebuild a new residential
structure with a height of (20) feet or more. According to current Zoning Regulations, the maximum
allowable building height of an accessory building, at its highest point, shall not exceed the height of
the peak of the roof of the primary building or the height of twenty (20) feet, whichever is less.
Therefore, within the year 2007, you agree to replace the residential primary structure that currently
exists on BC Lots 5 & 6, Block20 and apply for a building permit to construct a new residential
primary structure of twenty (20) feet or more in height.
If your understanding is as set forth in this letter and you are in agreement with these conditions,

September, 2004 to demolish the eXIsting residential structure and rebuild a residential
structure at that location with a height of 20 feet because the garage you constructed at
the above address is in violation of the Zoning Ordinance Section 1103 - Accessory
Buildings and Uses (See enclosed Section).
Prior to obtaining a fmal inspection of this accessory building and occupancy
being granted, you will need to sign the enclosed agreement stating you agree to apply for
a building permit to construct a residential structure on this lot within six months from
the expiration of the accessory building permit (which will expire on September 30,
2006) or six months from a fmal inspection when occupancy is granted. You will then
have two years to complete the construction of a new residential structure under the terms
of a building permit.

FYI - I searched all of Scott's old documents on the 0: drive for anything with "Anderson" and found nothing
dealing with this property. So, evidently nothing exists in writing.
I would stick with what we discussed yesterday, which is to prepare a letter for him to sign prior to receiving a final
inspection on the garage, agreeing to tear down the current house and rebuild a new house of "x" size (based on the
size of the garage) all within two years of the letter.
Please send an e-mail to Geoff regarding the situation and the letter and see what wording may need to be added that
would give us the legal right to condemn his house in two years ifhe doesn't do what the letter states.

Scot Bovick agreed to allow the accessary building with the stipulation that the existing house
is demoshlished and a new house rebiult at that location with a height of 20 feet or more
within 2 years..
Brenda is looking into. No written agreement was made.
Not Complete. 90 days. Changed completion date to 5-31-2006. Brenda and Phil are still
looking into.
Brenda sent Paul a letter on March 22, 2006 about Paul needing to pull a permit for a new
residential on this property 6 months after Dale finals this permit.
Called and left message for Paul to call back and either extend completion date or final.
Called and left a message for Paul, and said I needed to hear from him as soon as possible,
and that I need the status check for his garage.
Changed completion date to 9/15/2006 per Paul Anderson.
Brenda has file, she will be giving it to Phil, so he can handle.

SECTION 1103 ACCESSORY BUILDINGS AND USES
1103.01 USE FOR DWELLING: Accessory buildings shall not be used for dwelling purposes
unless specifically permitted.
1103.02 SIZE LIMITATIONS
Accessory buildings are intended to remain secondary in nature to the primary building or structure
on the land or tract of land in wmch they are located. Accessory buildings in all Residential
Districts, located within the city limits of the City of Blair, Nebraska, shall meet the following
additional requirements:
1. In all Residential Zoning Districts except AGG the maximum amount of accessory
buildings shall be limited to two (2) structures.
2. The maximum combined total square footage of all accessory buildings shall not exceed
fifty (50) percent of the total square footage of the primary buildingls ground coverage
area (area calculated at the exterior of thebuilding at ground level), or eight hundred and
sixty four (864) square feet in total area, which ever is the greater.
3. The combined total square footage area of the primary and accessory buildings shall not
exceed the maximum allowable Lot Coverage Area as allowed by the zoning
classification in wmch the buildings are located.
4. The maximum allowable building height of an accessory building, at its highest point,
shall not exceed the height ofthe peak: ofthe roof of the primary building or the height of
twenty (20) feet, whichever is less. For purposes of this provision, height shall mean
vertical distance measured from the average elevation of the finished grade of the
building to the highest point of the building.
5. No accessory structure shall be constructed without a primary building or structure. No
accessory building shall remain if the primary structure is removed or demolished.
1103.03 VEHICLE ACCESS: Unless otherwise specifically permitted, any accessory building
requiring vehicle access from an alley way shall be located a minimum of fifteen (15) feet from the
rear property line.
1103.04 ATTACHEDACCESSORYUSE: Any accessory attached to the principle building shall
be considered as a part of the principle building and shall meet the same requirements as specified
for the principle building in said district.
1103.05 FIRE HAZARDOUS ACCESSORY USES: No accessory use shall be located within ten
(10) feet of a residential dwelling that creates a fire hazard or would subj ect the residential structure
to a potential fire, such as a detached fireplace, barbecue ovens, flammable liquid storage, etc.
1103.06 CAR PORTS: Car ports are not considered structures. Carports can not be use for storing
