miscellaneous storage
Dear Mr. Pearson,
As you will remember, the City Council granted you the above permit at their regular meeting of
December 12, 2006 with the following stipulations: 1) required off street parking area will be paved, 2) a unisex
bathroom be installed to meet ADA standards, and 3) a contractor's office be constructed all prior to July 1,
2007 or prior to the facility being open to the public (See attached minutes).
To date, the off street parking area has not been paved and no record of a building permit for
construction of an ADA bathroom and contractor's office has been obtained from City Hall. Therefore, you are
required to discontinue use of this facility to the public until you comply with the conditions stated above.
Please apply for a building permit no later than Friday, July 13, 2007 to complete the above
requirements which will need to be completed within 60 days or this issue will be referred to the Planning
Commission for possible revocation of your Conditional Use Permit at their October 2, 2007 meeting.

use permit to operate the salon since 1986 and has renewed the permit eight times. The City has received no
complaints from surrounding property owners. The property is currently zoned RM (Residential Medium Density)
and is well maintained with limited foot traffic. There is also ample off street parking. Staff recommends a (10)
year permit for reasonable oversight. Julie Flynn was present regarding her permit. The Planning Commission
recommended to approve for (10) years). There were no comments from the floor or in writing. Mayor Realph
closed the public hearing. Council member Scheve stated that due to the applicants proven track record for this
type of request, he would like to grant Mrs. Flynn the (20) year permit as she requested. Motion by Scheve, second
by Wolff to approve the Conditional Use Permit renewal application submitted by Julie Flynn, 1256 Adams Street,
Blair, Nebraska to continue operation of a hairstyling salon on Tax Lot 19 in Section 1, Township 18 North, Range
11 East of the 6th P.M. (1256 Adams Street) Washington County, Blair, Nebraska for twenty (20) years. Council
member Biffar stated he was not comfortable with a twenty year permit due to the fact the permit goes with the
land and not the applicant. Discussion was held regarding the affects of a twenty year permit should a change in
ownership occur since the permit does not go with the applicant but the property. City Administrator Storm stated
this permit does not have particular conditions that would allow the City to revoke the permit based solely on a
neighbor complaint. Motion by Abbott, second by Biffar to amend the motion to approve the permit for (10) years.
Council members present voting Aye: Stewart, Shotwell, Scheve, Christiansen, Abbott and Biffar. Council
members present voting Nay: Fanoele and Wolff. Mayor Realph declared the motion amended. Council members

Agenda Item #14 - Assistant Administrator Green reviewed the request by Robe for a conditional
use permit for a contractor's office and miscellaneous storage at 634 S. 19th Street. The property is zoned A/CH
(Highway Commercial). He reviewed pictures of the area indicating Mr. Pearson has already begun to make
improvements at the property by installing new doors. Green stated staff would recommend approval for five (5)
years to allow for appropriate review. Council member Abbott questioned if the Planning Commission had placed
any conditions on the permit. Assistant Administrator Green stated no conditions were placed on the permit by the
Planning Commission. They had approved the permit for (5) years; however, Mr.. Pearson did indicate that he
planned to pave the off street parking area, install a unisex bathroom to ADA standards and construct a contractor's
office prior to July 1, 2007. Green stated that a condition could be placed on the permit that these items would
need to be completed prior to Mr. Pearson opening the facility as a public office. Until these items were complete,
he would be able to use the facility for storage as grandfathered by the previous owner. There were no comments
from the floor or in writing. Mayor Realph closed the public hearing. Motion by Abbott, second by Wolff to
approve a Conditional Use Permit application submitted by Robert W. Pearson, 2113 Washington Street, Blair,
Nebraska for contractors office and miscellaneous storage on Tax Lot 657 formerly known as Tax Lot 354 lying in
the SW t/4 of SE t/4 of Section 11, Township 18 North, Range I1 East of the 61h P.M., (634 N. 19th Street),
Washington County, Blair, Nebraska for five (5) years with the stipulation that the off street parking area be paved,
a unisex bathroom be installed to ADA standards and a contractor's office be constructed by July 1, 2007 or prior
to the facility being opened to the public. All Council members present voted Aye. Mayor Realph declared the
motion carried.
Agenda Item #15 - Robert Johnson, RJ Development, 407 S. 16th Street, appeared before the Planning
Commission to discuss enabling historical designation development in the city's redevelopment district. Mr.
Johnson stated he purchase the abandoned Central School in 1989 and renovated the facility into 34 one, two
and three bedroom apartments. He did not purchase the Vo -Ag Building which abutted the Central School
property in 1989 as the school maintained ownership for use by the school. Since that time, he has purchased
that property and would now like to convert that building into four three bedroom apartments. The building is
currently being used for storage and a parking garage for (6) tenants. Due to losing this space for garage
